THIS EASEMENT AGREEMENT is made and entered into by and between the undersigned owner
(grantor) in fee simple of the land described herein. And is for the benefit of the Grantee.
For and in consideration of the mutual covenants, an agreement hereinafter expressed and other good and
valuable considerations, in hand paid, receipt of which is hereby acknowledged, the parties hereto agree
as follows:
1. The owner (Grantor) of the above described land does hereby define, grant and convey to the present
and future owner(s) (Grantee) of the land described as follows:
An exclusive perpetual Storm Drainage Easement over, across, along in upon and under that portion of
said Grantor's land described as follows:
A STRIP OF LAND LYING WITHIN THE WESTERN MOST 10 FEET OF THE SOUTHERN MOST
15 PEET OF THE FOLLOWING DESCRIBED PARCEL;
LOT 4, EXCEPT THE NORTH 10.50 FEET;
TOGETHER WITH ALL OF LOT 5;
AND TOGETHER WITH LOT 6, EXCEPT THE SOUTH 5.25 FEET THEREOF;
ALL IN BLOCK 4, PLAT OF ALLENTOWN ADDITION TO THE CITY OF SEATTLE;
ACCORDING TO THE PLAT THEREOF RECORDED IN VOLUME 12 OF PLATS,
PAGE 100, IN KING COUNTY, WASHINGTON. ALSO KNOWN AS LOT B, CITY OF TUKWILA,
LOT CONSOLIDATION NO. L12 -020.
2. This easement is for the sole purpose of the construction, use and maintenance of a Storm Drainage
System, together with the right of ingress and egress for said construction, use and maintenance.
3. Grantee shall install said Storm Drainage System at their sole cost and expense and shall continue to
maintain and shall continue to bear all cost of repair and maintenance or repair of said Storm Drainage
System.
4. Grantee shall hold Grantor harmless from and against any and all claims which may be made against
Grantor arising out of the installation, operation, maintenance or repair or said Storm Drainage System.
5. The herein easement and agreement may be amended only with the written agreement of the Grantee
herein.
This easement agreement shall run with the land and shall be binding on all parties having or acquiring
any right, title or interest in the land descried herein or any part thereof.
