CITIZEN COMMENTS
At each Council meeting, citizens are given the opportunity to address the Council on items that are not
included on the agenda during CITIZEN COMMENTS. Please limit your comments to 5 minutes.
SPECIAL MEETINGS /EXECUTIVE SESSIONS
Special Meetings may be called at any time with proper public notice. Procedures followed are the same as
those used in Regular Council meetings.
Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel
matters as prescribed by law. Executive Sessions are not open to the public.
PUBLIC HEARINGS
Public Hearings are required by law before the Council can take action on matters affecting the public
interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the
Tukwila Municipal Code states the following guidelines for Public Hearings:
The proponent shall speak first and is allowed 15 minutes for a presentation.
2. The opponent is then allowed 15 minutes to make a presentation.
3. Each side is then allowed 5 minutes for rebuttal.
4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second
time until everyone wishing to speak has spoken.
5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the
question, but may not engage in further debate at that time.
6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss
the issue among themselves, or defer the discussion to a future Council meeting, without further public
testimony. Council action may only be taken during Regular or Special Meetings.
COUNCIL MEETING SCHEDULE
No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given.
Regular Meetings - The Mayor, elected by the people to a four -year term, presides at all Regular Council
Meetings held on the 1st and 3rd Mondays of each month at 7:00 p.m. and Special Meetings. Official
Council action in the form of formal motions, adopting of resolutions and passing of ordinances can
only be taken at Regular or Special Council meetings.
Committee of the Whole Meetings - Councilmembers are elected for a four -year term. The Council
President is elected by the Councilmembers to preside at all Committee of the Whole meetings for a
one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m.
Issues discussed there are forwarded to Regular or Special Council meetings for official action.

the sewer in Andover Park East in preparation for the 2015/2016 CBD Sewer Rehabilitation

Approve Resolution for the emergency repair of the sanitary sewer main at the 1200 block of Andover Park East (APE).

The City has been implementing a phased rehabilitation of the sanitary sewer system in the Commercial Business
District (CBD) since 2013. The sewer lines were originally installed in the 1960's and have served their effective lifespan.
Rehabilitation or replacement is necessary to extend the service life of the sewer system. Visual inspections have
revealed that certain segments of the sewer main have deteriorated severely and multiple failures have occurred (see
attached photo). The sewer mains must be cleaned of debris before they can be slip -lined and the process of high -
pressure water cleaning can damage the sewer or even remove bedding adjacent to the sewer mains if a breach has
already occurred. Some sewer mains have not been visually inspected due to inaccessibility of the inspection camera;
therefore, some pipe conditions are unknown.
DISCUSSION
Slip- lining began in late January 2016 with initial efforts proceeding without incident. The contractor began finding issues
with gravel in the mains near Shasta Beverage and Costco. Cleaning efforts on February 17, 2016 of the sewer main in
APE, just downstream of Shasta, have exposed a broken sewer pipe that prevents the current relining process to move
forward without repairing the main by excavation and replacement. Attached is Mayor Ekberg's signed Emergency
Declaration dated February 23, 2016 for the sewer main repair at 1200 Andover Park East.
FISCAL IMPACT
Since the emergency declaration was signed, staff requested quotes from nine contractors and received three
submittals. The R.L. Alia Company submitted a cost of $114,219.46 (which includes a 20% contingency). The full extent
of the damage to the sewer main can only be determined after exposing the failing pipe. The construction will be paid for
from the 2015/2016 CBD Sanitary Sewer Rehabilitation Project funds, currently budgeted at $900,000.00 for 2016.
RECOMMENDATION
Council is being asked to approve the Resolution declaring an emergency for the repair of the sanitary sewer at 1200
Andover Park East and consider this item on the Consent Agenda at the March 21, 2016 Regular Meeting.

Business District (CBD) since 2013. The sewer lines were originally installed in the 1960's and have
served their effective |ifeapan. Rehabilitation or replacement is necessary to extend the service |iha of
the sewer system. Visual inspections have revealed that certain segments of sewer main have
deteriorated severely and multiple failures have occurred (see attached photos). The rehabilitation
process must be carefully implemented as preparing the sewer mains for relining can cause additional
damage and possible failure. The mains must be cleaned of debris before they can be relined and the
process of high-pressure water cleaning can damage the sewer or even remove bedding adjacent to
the sewer mains if a breach has already occurred. Some sewer mains have not been visually inspected
due to inaccessibility of the inspection camera; therefore some pipe conditions are unknown.
DISCUSSION
Construction began in late January 2O16 with initial relining efforts proceeding without incident. The
Contractor began finding issues with gravel in the mains near Shasta and Costco. Cleaning efforts on
February 16 of the sewer main in APE just downstream of the Shasta Corporation have exposed a
collapsed pipe that prevents the current relining process to move forward without repairing the main by
excavation and replacement. AD emergency in accordance with TK4C 2.57.O30 and F{CVV35.23.352io
requested in order to waive the standard bidding process. A Resolution will be prepared for Council
approval at the next available Utilities Committee meeting date.
FISCAL IMPACT
At this time, repair costs are unknown. The extent of the damage can only bedetermined by exposing
the failed sewer main. This work will be paid from the 2015/2016 CBD Sanitary Sewer Rehabilitation
Project funds, currently budgeted at $900,000.00 for 2016.

Mayor is being asked to declare an emergency for the Sewer Repair at 1200 Andover Park East.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, DECLARING AN EMERGENCY
IN RESPONSE TO DAMAGES TO PUBLIC PROPERTY DUE
TO A SEVERELY DAMAGED SANITARY SEWER MAIN.
WHEREAS, it has been determined that a damaged sanitary sewer main is in
danger of collapsing in the 1200 block of Andover Park East; and
WHEREAS, if the sanitary sewer main collapses, the break could pose significant
risks to existing gas lines, storm drains, and water utilities; and
WHEREAS, the repairs to the sanitary sewer main are required immediately; and
WHEREAS, RCW 39.04.280 provides for emergency declarations and competitive
bidding exemptions; and
WHEREAS, the Mayor of Tukwila declared an emergency on February 23, 2016, in
order to allow City forces to respond with appropriate resources to restore damages and
prevent further impacts to public and private property; and
WHEREAS, the City Council wishes to provide their support and endorsement of
the Mayor in his action to declare an emergency and for the City's efforts to respond to
the emergency;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
The City Council supports the Mayor in his declaration of emergency and
authorizes the execution of contracts or agreements due to damages and the need for
protective actions brought about by a failed sanitary sewer main, and hereby authorizes
City forces to respond in the most effective and expedient manner, without regard for
the procedures and formalities that would otherwise govern the assignment of duties,
procurement of materials, and contracting of services. This situation is an emergency
as defined in RCW 39.04.280(3)

becoming soft. Slip lining the pipe will reinforce the strength with little impact to roadways and minimal excavation.
JUSTIFICATION: If the pipe collapses, the street will have to be excavated and the cost of the repairs will be significant. In the
last five years we have had two major pipe failures on Andover Park West.
STATUS: A Public Works Trust Fund loan was successfully obtained in 2012 for construction.
MAINT. IMPACT: Reduced maintenance and repair costs.
COMMENT: The limits of the 2013 project is APW to APE from Minkler Blvd to S 180th St and will now include the repair
to the sewer under the railroad tracks.

A. Resolution: Declaring an Emergencv for Sanitary Sewer Repair at 1200 Andover Park East
Staff is seeking Council approval of a resolution that would declare an emergency for the repair
of the sanitary sewer at 1200 Andover Park East. A broken sewer pipe was discovered in
February that is preventing progress on the sliplining effort. The Mayor signed an emergency
declaration on February 23, 2016, and since then staff has received three quotes for the sewer
repair. The R.L. Alia Company submitted a cost of $114,219.46, including a 20% contingency,
which can be paid for from the 2015/2016 CBD Sanitary Sewer Rehabilitation Project.

B. NPDES Program 2015 Annual Report and 2016 Surface Water Management Program Plan
Staff provided an overview of the National Pollutant Discharge Elimination System (NPDES) 2015
Annual Report and 2016 Surface Water Management Program (SWMP) Plan. The Annual Report
reflects activities completed by the City in 2015. The SWMP Plan is required by the NPDES
Program to showthatthe Citycomplies with requirements outlined in the NPDES Phase II permit,
effective August 1, 2013. The SWMP Plan contains required elements including public education
and outreach, public involvement and participation, illicit discharge detection and elimination,
runoff control, and pollution prevention and operation and maintenance. Committee members
and staff discussed the importance of public education and outreach. INFORMATION ONLY.
C. Coordinated Prevention Grant for Recycling Program
Staff is seeking Council approval to accept a Coordinated Prevention Grant from the
Washington State Department of Ecology in the amount of $14,070 to fund the Recycling
Assistance Program through June 30, 2017. Grant funding from King County is used for the
$4,690 required local match. Funds will be used for annual residential drop -off events as well

ISSUE
Council approval is required to authorize Mayor Ekberg to sign an Interlocal Agreement, and
accept $18,760 ($14,070 grant + $4,690 local match) in recycling funds from the Washington
Department of Ecology.
BACKGROUND
Tukwila has been awarded a Coordinated Prevention Grant (CPG) from the Washington
Department of Ecology to fund Tukwila's Recycling Assistance program through June 30, 2017.
Tukwila regularly obtains this grant, as well as a grant from King County, to support the
recycling program. Tukwila uses the King County recycling grant to provide the 25% local
match that the CPG grant requires. Tukwila's Recycling Assistance Program is financed
entirely through outside grants rather than with City of Tukwila funds. A signed Interlocal
Agreement is required to accept the grant money.
DISCUSSION
The CPG grant funds will be used as follows:
• Residential Recycling Collections—$17, 000 total
(Two-year total combines DOE grant and 25% required local match)
Hold drop-off events for Tukwila residents in 2016 and 2017 to collect and recycle hard-to-
recycle goods (i.e. tires, furniture, bulky yard debris, sinks, appliances, Styrofoam, textiles
etc.).
• Commercial Education and Outreach materials-41,760 total
(Two-year total combines DOE grant and 25% required local match)
Provide support for Tukwila businesses and multi-family complexes to start and improve
recycling and waste prevention practices.
FINANCIAL IMPACT
The Coordinated Prevention Grant (CPG) from the Washington Department of Ecology (DOE)
totals a maximum allowable cost of $18,760. The State grant share is $14,070. Funds from a
Waste Reduction Recycling (WRR) grant from King County will provide $4,690 for the required
25% local share/match. No direct City of Tukwila funds are used.
RECOMMENDATION
The Council is being asked to forward the Interlocal Agreement to the Regular Meeting on
March 21, 2016 for approval on the consent agenda.

Project Short Description:
The City of Tukwila will use a $18,760 grant to provide Tukwila businesses with information and assistance
regarding recycling, waste prevention, and recycled - content products. Furthermore, residents will have access
to an annual event to which they may bring hard -to- recycle items for proper reuse or recycling. Over the
two -year grant period, an estimated 40 tons will be diverted via approximately 900 business and residential
participants.

Task Description:
RECIPIENT will provide Tukwila businesses, including City of Tukwila facilities and possibly some multifamily
complexes, with materials such as printed information and/or indoor containers, that support ongoing outreach and
education efforts in recycling, waste prevention, use of recycled - content products, contamination reduction, and /or how
to achieve good results.
RECIPIENT will ensure equal opportunity for all entities providing collection of one or more traditional commercial
recyclables (for example bottles, cans, paper, and, separately, organics) for recycling within its jurisdiction. For
example, all educational materials provided to commercial facility representatives will list all available collection
services and present them in a fair manner. RECIPIENT shall make contact with representatives of all the companies
providing commercial recycling services in the RECIPIENT's jurisdiction at least once a year to ensure the service and
contact information shown on outreach materials remains accurate.
RECIPIENT shall obtain ECOLOGY's approval for all grant - funded communication materials or documents related to
the fulfillment of this Agreement, per section 1$ of the General Terms and Conditions of this Agreement.
This Coordinated Prevention Grant will pay for a portion of the activities described of this task. A King County Solid
Waste Waste Reduction/Recycling (WRR) Grant will be used for the 25% match, as well as other tasks that are not
identified in this Agreement.
Task Goal Statement:
The goal of this task is to support outreach efforts to reduce waste produced by businesses, increase Tukwila recycling
rates and participation of businesses and multifamily complexes /residents, and to ensure the businesses and
multifamily residents are recycling the correct items onsite.
Task Expected Outcome:
Over the two -year grant period, an estimated 2,000 businesses will be contacted via postal mail or email. As a result of
the contact, it is expected that approximately 100 businesses will participate in Tukwila's assistance program. The
RECIPIENT will survey selected business participants via email to determine which assistance they found the most or
least helpful, and what changes, if any, they made to their practices as a result.

Task Title: Recycling Collection Event - Residential
Task Description:
RECIPIENT will offer residents the opportunity to self -haul unusual recyclable and reusable materials to a temporary
drop site, open one day for approximately six hours during spring 2016 and 2017.
Materials targeted for collection may include, but are not limited to: tires, metal, wood, sinks /toilets, polystyrene foam,
large branches (not grass or leaves), household items, appliances, and furniture. Additional materials may be included
as budget and markets allow. This task also includes development and distribution of promotional materials in a
variety of formats to encourage participation.
Participants may pay some or all of the fees associated with handling, hauling or recycling various materials. The
RECIPIENT will credit the grant for any revenue received from the collection of fees or commodity sales on items the
grant is supporting.
RECIPIENT shall obtain ECOLOGY'S approval for all grant - funded communication materials or documents related to
the fulfillment of this Agreement, per section 18 of the General Terms and Conditions of this Agreement.
RECIPIENT will ensure costs eligible under the E -Cycle Washington, LightRecycle Washington, and/or Call2Recycle
program are not charged to this grant, if items covered under those programs are collected.
This Coordinated Prevention Grant will pay for a portion of the activities described of this task. A King County Solid
Waste Waste Reduction/Recycling (WRR) Grant will be used for the 25% match, as well as other tasks that are not
identified in this Agreement.

GENERAL FEDERAL CONDITIONS
If a portion or all of the funds for this agreement are provided through federal funding sources or this
agreement is used to match a federal grant award, the following terms and conditions apply to you.
A. CERTIFICATION REGARDING SUSPENSION, DEBARMENT, INELIGIBILITY OR VOLUNTARY
EXCLUSION:
1. The RECIPIENT /CONTRACTOR, by signing this agreement, certifies that it is not suspended, debarred,
proposed for debarment, declared ineligible or otherwise excluded from contracting with the federal
government, or from receiving contracts paid for with federal funds. If the RECIPIENT /CONTRACTOR is
unable to certify to the statements contained in the certification, they must provide an explanation as to why they
cannot.
2. The RECIPIENT /CONTRACTOR shall provide immediate written notice to ECOLOGY if at any time the
RECIPIENT /CONTRACTOR learns that its certification was erroneous when submitted or had become
erroneous by reason of changed circumstances.
3. The terms covered transaction, debarred, suspended, ineligible, lower tier covered transaction, participant,
person, primary covered transaction, principal, proposal, and voluntarily excluded, as used in this clause, have
the meaning set out in the Definitions and Coverage sections of rules implementing Executive Order 12549.
You may contact ECOLOGY for assistance in obtaining a copy of those regulations.
4. The RECIPIENT /CONTRACTOR agrees it shall not knowingly enter into any lower tier covered transaction
with a person who is proposed for debarment under the applicable Code of Federal Regulations, debarred,
suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction.
5. The RECIPIENT /CONTRACTOR further agrees by signing this agreement, that it will include this clause titled
"CERTIFICATION REGARDING SUSPENSION, DEBARMENT, INELIGIBILITY OR VOLUNTARY
EXCLUSION" without modification in all lower tier covered transactions and in all solicitations for lower tier
covered transactions.
6. Pursuant to 2CFR180.330, the RECIPIENT /CONTRACTOR is responsible for ensuring that any lower tier

remedies, including suspension and debarment.
8. RECIPIENT /CONTRACTOR agrees to keep proof in its agreement file, that it, and all lower tier recipients or
contractors, are not suspended or debarred, and will make this proof available to ECOLOGY before requests for
reimbursements will be approved for payment. RECIPIENT /CONTRACTOR must run a search in

B. FEDERAL FUNDING ACCOUNTABILITY AND TRANSPARENCY ACT (FFATA) REPORTING
REQUIREMENTS:
CONTRACTOR/RECIPIENT must complete the FFATA Data Collection Form (ECY 070 -395) and return it
with the signed agreement to ECOLOGY.
Any CONTRACTOR/RECIPIENT that meets each of the criteria below must report compensation for its five
top executives using the FFATA Data Collection Form.
• Receives more than $25,000 in federal funds under this award.
• Receives more than 80 percent of its annual gross revenues from federal funds.
• Receives more than $25,000,000 in annual federal funds.
Ecology will not pay any invoices until it has received a completed and signed FFATA Data Collection Form.

1. ADMINISTRATIVE REQUIREMENTS
a) RECIPIENT shall follow the "Administrative Requirements for Recipients of Ecology Grants and Loans — EAGL

b) RECIPIENT shall complete all activities funded by this Agreement and be fully responsible for the proper
management of all funds and resources made available under this Agreement.
c) RECIPIENT agrees to take complete responsibility for all actions taken under this Agreement, including ensuring
all subgrantees and contractors comply with the terms and conditions of this Agreement. ECOLOGY reserves the right
to request proof of compliance by subgrantees and contractors.
d) R.ECIPIENT's activities under this Agreement shall be subject to the review and approval by ECOLOGY for the
extent and character of al l work and services.

2. AMENDMENTS AND MODIFICATIONS
This Agreement may be altered, amended, or waived only by a written amendment executed by both parties. No
subsequent modification(s) or amendment(s) of this Agreement will be of any force or effect unless in writing and
signed by authorized representatives of both parties. ECOLOGY and the RECIPIENT may change their respective staff
contacts and administrative information without the concurrence of either party.
3. ARCHAEOLOGICAL AND CULTURAL RESOURCES
RECIPIENT shall take reasonable action to avoid, minimize, or mitigate adverse effects to archeological or cultural
resources. Activities associated with archaeological and cultural resources are an eligible reimbursable cost subject to
approval by ECOLOGY.
RECIPIENT shall:
a) Immediately cease work and notify ECOLOGY if any archeological or cultural resources are found while
conducting work under this Agreement.
b) Immediately notify the Department of Archaeology and Historic Preservation at (360) 586 -3064, in the event
historical or cultural artifacts are discovered at a work site.
c) Comply with Governor Executive Order 05 -05, Archaeology and Cultural Resources, for any capital construction
projects prior to the start of any work.
d) Comply with RCW 27.53, Archaeological Sites and Resources, for any work performed under this Agreement, as
applicable. National Historic Preservation Act (NHPA) may require the RECIPIENT to obtain a permit pursuant to
Chapter 27.53 RCW prior to conducting on -site activity with the potential to impact cultural or historic properties.
4. ASSIGNMENT
No right or claim of the RECIPIENT arising under this Agreement shall be transferred or assigned by the RECIPIENT.
5. COMMUNICATION
RECIPIENT shall make every effort to maintain effective communications with the RECIPIENT's designees,
ECOLOGY, all affected local, state, or federal jurisdictions, and any interested individuals or groups.
6. COMPENSATION
a) Any work performed prior to effective date of this Agreement will be at the sole expense and risk of the

RECIPIENT. ECOLOGY must sign the Agreement before any payment requests can be submitted.
b) Payments will be made on a reimbursable basis for approved and completed work as specified in this Agreement.
c) RECIPIENT is responsible to determine if costs are eligible. Any questions regarding eligibility should be clarified
with ECOLOGY prior to incurring costs. Costs that are conditionally eligible may require approval by ECOLOGY
prior to purchase.
d) RECIPIENT shall not invoice more than once per month unless agreed on by ECOLOGY.
e) ECOLOGY will not process payment requests without the proper reimbursement forms, Progress Report and
supporting documentation. ECOLOGY will provide instructions for submitting payment requests.
f) ECOLOGY will pay the RECIPIENT thirty (30) days after receipt of a properly completed request for payment.
g) RECIPIENT will receive payment through Washington State Department of Enterprise Services' Statewide Payee
Desk. RECIPIENT must register as a payee by submitting a Statewide Payee Registration form and an IRS W -9 form at
the website, http: / /www. des. wa. gov / services /ContractingPurchasing/ Business /VendorPay/Pages /default.aspx. For any
questions about the vendor registration process contact the Statewide Payee Help Desk at (360) 407 -8180 or email
payeehelpdesk@des.wa.gov.
h) ECOLOGY may, at its sole discretion, withhold payments claimed by the RECIPIENT if the RECIPIENT fails to
satisfactorily comply with any term or condition of this Agreement.
i) Monies withheld by ECOLOGY may be paid to the RECIPIENT when the work described herein, or a portion
thereof, has been completed if, at ECOLOGY's sole discretion, such payment is reasonable and approved according to
this Agreement, as appropriate, or upon completion of an audit as specified herein.
j) RECIPIENT should submit final requests for compensation within thirty (30) days after the expiration date of this
Agreement. Failure to comply may result in delayed reimbursement.
7. COMPLIANCE WITH ALL LAWS
RECIPIENT agrees to comply fully with all applicable Federal, State and local laws, orders, regulations, and permits
related to this Agreement, including but not limited to:
a) RECIPIENT agrees to comply with all applicable laws, regulations, and policies of the United States and the State
of Washington which affect wages and job safety.
b) RECIPIENT agrees to be bound by all federal and state laws, regulations, and policies against discrimination.
c) RECIPIENT certifies full compliance with all applicable state industrial insurance requirements.
d) RECIPIENT agrees to secure and provide assurance to ECOLOGY that all the necessary approvals and permits
required by authorities having jurisdiction over the project are obtained. RECIPIENT must include time in their project
timeline for the permit and approval processes.
ECOLOGY shall have the right to immediately terminate for cause this Agreement as provided herein if the
RECIPIENT fails to comply with above requirements.
If any provision of this Agreement violates any statute or rule of law of the state of Washington, it is considered
modified to conform to that statute or rule of law.
8. CONFLICT OF INTEREST
RECIPIENT and ECOLOGY agree that any officer, member, agent, or employee, who exercises any function or
responsibility in the review, approval, or carrying out of this Agreement, shall not have any personal or financial
interest, direct or indirect, nor affect the interest of any corporation, partnership, or association in which he /she is a part,
in this Agreement or the proceeds thereof.
9. CONTRACTING FOR GOODS AND SERVICES
RECIPIENT may contract to buy goods or services related to its performance under this Agreement. RECIPIENT shall

award all contracts for construction, purchase of goods, equipment, services, and professional architectural and
engineering services through a competitive process, if required by State law. RECIPIENT is required to follow
procurement procedures that ensure legal, fair, and open competition.
RECIPIENT must have a standard procurement process or follow current state procurement procedures. RECIPIENT
may be required to provide written certification that they have followed their standard procurement procedures and
applicable state law in awarding contracts under this Agreement.
ECOLOGY reserves the right to inspect and request copies of all procurement documentation, and review procurement
practices related to this Agreement. Any costs incurred as a result of procurement practices not in compliance with
state procurement law or the RECIPIENT's normal procedures may be disallowed at ECOLOGY's sole discretion.
10. DISPUTES
When there is a dispute with regard to the extent and character of the work, or any other matter related to this
Agreement the determination of ECOLOGY will govern, although the RECIPIENT shall have the right to appeal
decisions as provided for below:
a) RECIPIENT notifies the funding program of an appeal request.
b) Appeal request must be in writing and state the disputed issue(s).
c) RECIPIENT has the opportunity to be heard and offer evidence in support of its appeal.
d) ECOLOGY reviews the RECIPIENT's appeal.
e) ECOLOGY sends a written answer within ten (10) business days, unless more time is needed, after concluding the
review.

The decision of ECOLOGY from an appeal will be final and conclusive, unless within thirty (30) days from the date of
such decision, the RECIPIENT furnishes to the Director of ECOLOGY a written appeal. The decision of the Director or
duly authorized representative will be final and conclusive.
The parties agree that this dispute process will precede any action in a judicial or quasi-judicial tribunal.
Appeals of the Director's decision will be brought in the Superior Court of Thurston County. Review of the Director's
decision will not be taken to Environmental and Land Use Hearings Office.
Pending final decision of a dispute, the RECIPIENT agrees to proceed diligently with the performance of this
Agreement and in accordance with the decision rendered.
Nothing in this contract will be construed to limit the parties' choice of another mutually acceptable method, in addition
to the dispute resolution procedure outlined above.
11. ENVIRONMENTAL STANDARDS
a) RECIPIENTS who collect environmental - monitoring data must provide these data to ECOLOGY using the
Environmental Information Management System (ECM). To satisfy this requirement these data must be successfully
loaded into EIM, see instructions on the EIM website at: http: / /www.ecy.wa.gov /eim.
b) RECIPIENTS are required to follow ECOLOGY's data standards when Geographic Information System (GIS) data
are collected and processed. More information and requirements are available at:
http: / /www.ecy.wa.gov/ services /gis/ data / standards /standards.htm. RECIPIENTS shall provide copies to ECOLOGY of
all final GIS data layers, imagery, related tables, raw data collection files, map products, and all metadata and project
documentation.

c) RECIPIENTS must prepare a Quality Assurance Project Plan (QAPP) when a project involves the collection of
environmental measurement data. QAPP is to ensure the consistent application of quality assurance principles to the
planning and execution of all activities involved in generating data. RECIPIENTS must follow ECOLOGY's
Guidelines for Preparing Quality Assurance Project Plans for Environmental Studies, July 2004 (Ecology Publication
No. 04 -03 -030). ECOLOGY shall review and approve the QAPP prior to start of work. The size, cost, and complexity
of the QAPP should be in proportion to the magnitude of the sampling effort.
12. GOVERNING LAW
This Agreement will be governed by the laws of the State of Washington, and the venue of any action brought
hereunder will be in the Superior Court of Thurston County.
13. INDEMNIFICATION
ECOLOGY will in no way be held responsible for payment of salaries, consultant's fees, and other costs related to the
project described herein, except as provided in the Scope of Work.
To the extent that the Constitution and laws of the State of Washington permit, each party will indemnify and hold the
other harmless from and against any liability for any or all injuries to persons or property arising from the negligent act
or omission of that party or that party's agents or employees arising out of this Agreement.
14. INDEPENDENT STATUS

The employees, volunteers, or agents of each party who are engaged in the performance of this Agreement will continue
to be employees, volunteers, or agents of that party and will not for any purpose be employees, volunteers, or agents of
the other party.
15. KICKBACKS
RECIPIENT is prohibited from inducing by any means any person employed or otherwise involved in this Agreement to
give up any part of the compensation to which he /she is otherwise entitled to or receive any fee, commission, or gift in
return for award of a subcontract hereunder.
16. MINORITY AND WOMEN'S BUSINESS ENTERPRISES (MWBE)
RECIPIENT is encouraged to solicit and recruit, to the extent passible, certified minority -owned (MBE) and
women -owned (WBE) businesses in purchases and contracts initiated under this Agreement.
Contract awards or rejections cannot be made based on MWBE participation; however, the RECIPIENT is encouraged
to take the following actions, when possible, in any procurement under this Agreement:
a) Include qualified minority and women's businesses on solicitation lists whenever they are potential sources of goods
or services.
b) Divide the total requirements, when economically feasible, into smaller tasks or quantities, to permit maximum
participation by qualified minority and women's businesses.
c) Establish delivery schedules, where work requirements permit, which will encourage participation of qualified
minority and women's businesses.
d) Use the services and assistance of the Washington State Office of Minority and Women's Business Enterprises
(OMWBE) (866- 208 -1064) and the Office of Minority Business Enterprises of the U.S. Department of Commerce, as
appropriate.
17. ORDER OF PRECEDENCE
In the event of inconsistency in this Agreement, unless otherwise provided herein, the inconsistency shall be resolved by

giving precedence in the following order: (a) applicable federal and state statutes and regulations; (b) The Agreement;
(c) Scope of Work; (d) Special Terms and Conditions; (e) Any provisions or terms incorporated herein by reference,
including the "Administrative Requirements for Recipients of Ecology Grants and Loans "; and (f) the General Terms
and Conditions.
18. PRESENTATION AND PROMOTIONAL MATERIALS
ECOLOGY reserves the right to approve RECIPIENT's communication documents and materials related to the
fulfillment of this Agreement:
a) If requested, RECIPIENT shall provide a draft copy to ECOLOGY for review and approval ten (10) business days
prior to production and distribution.
b) RECIPIENT shall include time for ECOLOGY's review and approval process in their project timeline.
c) If requested, RECIPIENT shall provide ECOLOGY two (2) final copies and an electronic copy of any tangible
products developed.
Copies include any printed materials, and all tangible products developed such as brochures, manuals, pamphlets,
videos, audio tapes, CDs, curriculum, posters, media announcements, or gadgets with a message, such as a refrigerator
magnet, and any online communications, such as web pages, blogs, and twitter campaigns. If it is not practical to
provide a copy, then the RECIPIENT shall provide a description (photographs, drawings, printouts, etc.) that best
represents the item.
Any communications intended for public distribution that uses ECOLOGY's logo shall comply with ECOLOGY's
graphic requirements and any additional requirements specified in this Agreement. Before the use of ECOLOGY's
logo contact ECOLOGY for guidelines.
RECIPIENT shall acknowledge in the communications that funding was provided by ECOLOGY.
19. PROGRESS REPORTING

a) RECIPIENT must satisfactorily demonstrate the timely use of funds by submitting payment requests and progress
reports to ECOLOGY. ECOLOGY reserves the right to amend or terminate this Agreement if the RECIPIENT does not
document timely use of funds.
b) RECIPIENT must submit a progress report with each payment request. Payment requests will not be processed
without a progress report. ECOLOGY will define the elements and frequency of progress reports.
c) RECIPIENT shall use ECOLOGY's provided progress report format.
d) Quarterly progress reports will cover the periods from January 1 through March 31, April 1 through June 30, July 1
through September 30, and October I through December 31. Reports shall be submitted within thirty (30) days after
the end of the quarter being reported.
e) RECIPIENT shall submit the Closeout Report within thirty (30) days of the expiration date of the project, unless an
extension has been approved by ECOLOGY. RECIPIENT shall use the ECOLOGY provided closeout report format.
20. PROPERTY RIGHTS
a) Copyrights and Patents. When the RECIPIENT creates any copyrightable materials or invents any patentable
property under this agreement, the RECIPIENT may copyright or patent the same but ECOLOGY retains a royalty free,
nonexclusive, and irrevocable license to reproduce, publish, recover, or otherwise use the material(s) or property, and to
authorize others to use the same for federal, state, or local government purposes.
b) Publications. When the RECIPIENT or persons employed by the RECIPIENT use or publish ECOLOGY
information; present papers, lectures, or seminars involving information supplied by ECOLOGY; or use logos, reports,
maps, or other data in printed reports, signs, brochures, pamphlets, etc., appropriate credit shall be given to ECOLOGY.
c) Presentation and Promotional Materials. ECOLOGY shall have the right to use or reproduce any printed or graphic

materials produced in fulfillment of this Agreement, in any manner ECOLOGY deems appropriate. ECOLOGY shall
acknowledge the RECIPIENT as the sole copyright owner in every use or reproduction of the materials.
d) Tangible Property Rights. ECOLOGY's current edition of "Administrative Requirements for Recipients of Ecology
Grants and Loans," shall control the use and disposition of all real and personal property purchased wholly or in part
with funds furnished by ECOLOGY in the absence of state and federal statutes, regulations, or policies to the contrary,
or upon specific instructions with respect thereto in this Agreement.
e) Personal Property Furnished by ECOLOGY. When ECOLOGY provides personal property directly to the
RECIPIENT for use in performance of the project, it shall be returned to ECOLOGY prior to final payment by
ECOLOGY. If said property is lost, stolen, or damaged while in the RECIPIENT's possession, then ECOLOGY shall
be reimbursed in cash or by setoff by the RECIPIENT for the fair market value of such property.
f) Acquisition Projects. The following provisions shall apply if the project covered by this Agreement includes funds
for the acquisition of land or facilities:
a. RECIPIENT shall establish that the cost is fair value and reasonable prior to disbursement of funds provided for in
this Agreement.
b. RECIPIENT shall provide satisfactory evidence of title or ability to acquire title for each parcel prior to
disbursement of funds provided by this Agreement. Such evidence may include title insurance policies, Torrens
certificates, or abstracts, and attorney's opinions establishing that the land is free from any impediment, lien, or claim
which would impair the uses intended by this Agreement.
g) Conversions. Regardless of the agreement expiration date, the RECIPIENT shall not at any time convert any
equipment, property, or facility acquired or developed under this Agreement to uses other than those for which
assistance was originally approved without prior written approval of ECOLOGY. Such approval may be conditioned
upon payment to ECOLOGY of that portion of the proceeds of the sale, lease, or other conversion or encumbrance
which monies granted pursuant to this Agreement bear to the total acquisition, purchase, or construction costs of such
property.
21. RECORDS, AUDITS, AND INSPECTIONS
RECIPIENT shall maintain complete program and financial records relating to this Agreement, including any
engineering documentation and field inspection reports of all construction work accomplished.
All records shall:
a) Be kept in a manner which provides an audit trail for all expenditures.
b) Be kept in a common file to facilitate audits and inspections.
c) Clearly indicate total receipts and expenditures related to this Agreement.
d) Be open for audit or inspection by ECOLOGY, or by any duly authorized audit representative of the State of
Washington, for a period of at least three (3) years after the final grant payment or loan repayment, or any dispute
resolution hereunder.
RECIPIENT shall provide clarification and make necessary adjustments if any audits or inspections identify
discrepancies in the records.
ECOLOGY reserves the right to audit, or have a designated third party audit, applicable records to ensure that the state
has been properly invoiced. Any remedies and penalties allowed by law to recover monies determined owed will be
enforced. Repetitive instances of incorrect invoicing or inadequate records may be considered cause for termination.
All work performed under this Agreement and any property and equipment purchased shall be made available to
ECOLOGY and to any authorized state, federal or local representative for inspection at any time during the course of
this Agreement and for at least three (3) years following grant or loan termination or dispute resolution hereunder.

RECIPIENT shall provide right of access to ECOLOGY, or any other authorized representative, at all reasonable times,
in order to monitor and evaluate performance, compliance, and any other conditions under this Agreement.
22. RECOVERY OF FUNDS
The right of the RECIPIENT to retain monies received as reimbursement payments is contingent upon satisfactory
performance of this Agreement and completion of the work described in the Scope of Work.
All payments to the RECIPIENT are subject to approval and audit by ECOLOGY, and any unauthorized expenditure(s)
or unallowable cost charged to this agreement shall be refunded to ECOLOGY by the RECIPIENT.
RECIPIENT shall refund to ECOLOGY the full amount of any erroneous payment or overpayment under this
Agreement.
RECIPIENT shall refund by check payable to ECOLOGY the amount of any such reduction of payments or repayments
within thirty (30) days of a written notice. Interest will accrue at the rate of twelve percent (12 %) per year from the
time ECOLOGY demands repayment of funds.
Any property acquired under this Agreement, at the option of ECOLOGY, may become ECOLOGY's property and the
RECIPIENT's liability to repay monies will be reduced by an amount reflecting the fair value of such property.
23. SEVERABILITY
If any provision of this Agreement or any provision of any document incorporated by reference shall be held invalid,
such invalidity shall not affect the other provisions of this Agreement which can be given effect without the invalid
provision, and to this end the provisions of this Agreement are declared to be severable.
24. STATE ENVIRONMENTAL POLICY ACT (SEPA)
RECIPIENT must demonstrate to ECOLOGY's satisfaction that compliance with the requirements of the State
Environmental Policy Act (Chapter 43.21C RC W and Chapter 197 -11 WAC) have been or will be met. Any
reimbursements are subject to this provision.
25. SUSPENSION
When in the best interest of ECOLOGY, ECOLOGY may at any time, and without cause, suspend this Agreement or
any portion thereof for a temporary period by written notice from ECOLOGY to the RECIPIENT. RECIPIENT shall
resume performance on the next business day following the suspension period unless another day is specified by
ECOLOGY.
26, SUSTAINABLE PRACTICES
In order to sustain Washington's natural resources and ecosystems, the RECIPIENT is fully encouraged to implement
sustainable practices and to purchase environmentally preferable products under this Agreement.
a) Sustainable practices may include such activities as: use of clean energy, use of double -sided printing, hosting low
impact meetings, and setting up recycling and composting programs.
b) Purchasing may include such items as: sustainably produced products and services, EPEAT registered computers
and imaging equipment, independently certified green cleaning products, remanufactured toner cartridges, products
with reduced packaging, office products that are refillable, rechargeable, and recyclable, and 100% post- consumer
recycled paper.

27. TERMINATION
a) For Cause
ECOLOGY may terminate for cause this Agreement with a seven (7) calendar days prior written notification to the
RECIPIENT, at the sole discretion of ECOLOGY, for failing to perform an Agreement requirement or for a material
breach of any term or condition. If this Agreement is so terminated, the parties shall be liable only for performance
rendered or costs incurred in accordance with the terms of this Agreement prior to the effective date of termination.
Failure to Commence Work. ECOLOGY reserves the right to terminate this Agreement if RECIPIENT fails to
commence work on the project funded within four (4) months after the effective date of this Agreement, or by any date
mutually agreed upon in writing for commencement of work, or the time period defined within the Scope of Work.
Non - Performance. The obligation of ECOLOGY to the RECIPIENT is contingent upon satisfactory performance by the
RECIPIENT of all of its obligations under this Agreement. In the event the RECIPIENT unjustifiably fails, in the
opinion of ECOLOGY, to perform any obligation required of it by this Agreement, ECOLOGY may refuse to pay any
further funds, terminate in whole or in part this Agreement, and exercise any other rights under this Agreement.
Despite the above, the RECIPIENT shall not be relieved of any liability to ECOLOGY for damages sustained by
ECOLOGY and the State of Washington because of any breach of this Agreement by the RECIPIENT. ECOLOGY
may withhold payments for the purpose of setoff until such time as the exact amount of damages due ECOLOGY from
the RECIPIENT is determined.
b) For Convenience
ECOLOGY may terminate for convenience this Agreement, in whole or in part, for any reason when it is the best
interest of ECOLOGY, with a thirty (30) calendar days prior written notification to the RECIPIENT. If this Agreement
is so terminated, the parties shall be liable only for performance rendered or costs incurred in accordance with the terms
of this Agreement prior to the effective date of termination.
Non- Allocation of Funds. ECOLOGY's ability to make payments is contingent on availability of funding. In the event
funding from state, federal or other sources is withdrawn, reduced, or limited in any way after the effective date and
prior to the completion or expiration date of this agreement, ECOLOGY, at its sole discretion, may elect to terminate
the agreement, in whole or part, or renegotiate the agreement, subject to new funding limitations or conditions.
ECOLOGY may also elect to suspend performance of the agreement until ECOLOGY determines the funding
insufficiency is resolved. ECOLOGY may exercise any of these options with no notification or restrictions.
If payments have been discontinued by ECOLOGY due to unavailable funds, the RECIPIENT shall not be obligated to
repay monies which had been paid to the RECIPIENT prior to such termination.
RECIPIENT's obligation to continue or complete the work described in this Agreement shall be contingent upon
availability of funds by the RECIPIENT's governing body.
e) By Mutual Agreement
ECOLOGY and the RECIPIENT may terminate this Agreement, in whole or in part, at any time, by mutual written
agreement.
d) In Event of Termination
All finished or unfinished documents, data studies, surveys, drawings, maps, models, photographs, reports or other

materials prepared by the RECIPIENT under this Agreement, at the option of ECOLOGY, will become property of
ECOLOGY and the RECIPIENT shall be entitled to receive just and equitable compensation for any satisfactory work
completed on such documents and other materials.
Nothing contained herein shall preclude ECOLOGY from demanding repayment of all funds paid to the RECIPIENT in
accordance with Recovery of Funds, identified herein.
28. THIRD PARTY BENEFICIARY
RECIPIENT shall ensure that in all subcontracts entered into by the RECIPIENT pursuant to this Agreement, the state
of Washington is named as an express third party beneficiary of such subcontracts with full rights as such.
29. WAIVER
Waiver of a default or breach of any provision of this Agreement is not a waiver of any subsequent default or breach,
and will not be construed as a modification of the terms of this Agreement unless stated as such in writing by the
authorized representative of ECOLOGY.

A. Resolution: Declaring an Emergency for Sanitary Sewer Repair at 1200 Andover Park East
Staff is seeking Council approval of a resolution that would declare an emergency for the repair
of the sanitary sewer at 1200 Andover Park East. A broken sewer pipe was discovered in
February that is preventing progress on the sliplining effort. The Mayor signed an emergency
declaration on February 23, 2016, and since then staff has received three quotes for the sewer
repair. The R.L. Alia Company submitted a cost of $114,219.46, including a 20% contingency,
which can be paid for from the 2015/2016 CBD Sanitary Sewer Rehabilitation Project.

B. NPDES Program 2015 Annual Report and 2016 Surface Water Management Program Plan
Staff provided an overview of the National Pollutant Discharge Elimination System (NPDES) 2015
Annual Report and 2016 Surface Water Management Program (SWMP) Plan. The Annual Report
reflects activities completed by the City in 2015. The SWMP Plan is required by the NPDES
Program to showthatthe Citycomplies with requirements outlined in the NPDES Phase II permit,
effective August 1, 2013. The SWMP Plan contains required elements including public education
and outreach, public involvement and participation, illicit discharge detection and elimination,
runoff control, and pollution prevention and operation and maintenance. Committee members
and staff discussed the importance of public education and outreach. INFORMATION ONLY.
C. Coordinated Prevention Grant for Recycling Program
Staff is seeking Council approval to accept a Coordinated Prevention Grant from the
Washington State Department of Ecology in the amount of $14,070 to fund the Recycling
Assistance Program through June 30, 2017. Grant funding from King County is used for the
$4,690 required local match. Funds will be used for annual residential drop -off events as well

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, UPDATING AND CLARIFYING
THE NON-REPRESENTED EMPLOYEES' COMPENSATION
AND ADOPTING THE NON-REPRESENTED SALARY
SCHEDULE AND BENEFITS SUMMARY, EFFECTIVE
JANUARY 1, 2016.
WHEREAS, the City Council has made a determination to review the non-
represented compensation for even-numbered years and provide cost-of-living
adjustments (COLAs) in odd-numbered years; and
WHEREAS, per Resolution No. 1796 a market study was conducted in 2015; the
market data revealed the position banded at F102 was below the market average by
4%; and
WHEREAS, City Administration recommends a 1.5% across the board increase to
the Non-Represented Salary Structure effective January 1, 2016 to maintain internal
equity with represented groups and to adjust the band F102 by an increase of 2.5% to
bring it into alignment with the market;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. Non-Represented Wage Plan.
A. The 2016 wage schedule for non-represented employees shall increase by
1.5% across the board, with an additional market increase of 2.5% given to band F102
as reflected in Attachment A, "Non- Represented Salary Structure 2016".
B. In addition, during the 3rd quarter of 2016, City Administration will meet with
the City Council to review and discuss City Council Resolution No. 1796, specific to
comparability related to non-represented employees' compensation and benefits.

Social Security (FICA): Social Security benefits shall be provided as contained in Section
2.52.010 of the Tukwila Municipal Code (TMC).
State-Wide Emplffee Retirement System (PERS): Retirement shall be provided as contained
in Section 2.52.020 of the TMC.
Holidays: Holidays shall be provided as contained in Section 2.52.030 of the TMC. An
additional floating holiday has been granted to each non-represented employee, for a total of 2
floating holidays. Regular part-time employees shall be entitled to benefits on a pro-rata basis.
Sick Leave: Sick leave shall be provided as contained in Section 2.52.040 of the TMC. Regular
part-time employees shall be entitled to benefits on a pro-rata basis.
Medical Insurance: The City shall pay 100% of the 2016 premium for regular full-time
employees and their dependents under the City of Tukwila self-insured medical/ dental plan.
Premium increases above 8% per year shall result in a modified plan document to cover the
additional cost above 8%, or a premium shall be implemented for the difference, at the City's
discretion. The City reserves the right to select all medical plans and providers. Regular part-
time employees shall be entitled to benefits on a pro-rata basis. Employees who choose
coverage under the Group Health Cooperative plan shall pay the difference between the City of
Tukwila plan full-family rate and the rate charged to them by Group Health.
Dental Insurance: The City shall provide 100% of the 2016 premium for the regular full-time
employees and all dependents under the City of Tukwila self-insured medical/ dental plan for
dental coverage. Regular part-time employees shall be entitled to the same benefits on a pro-
rata basis.
Life Insurance: For regular full-time employees, the City shall pay the premium for Plan C
(Multiple of annual earnings) or similar group life and accidental death and dismemberment
insurance policy. Said plan shall be at 100% of annual earnings rounded up to the next $1,000.
Regular part-time employees that work at least 20 hours per week shall be entitled to benefits
on a pro-rata basis (per insurance program requirements).
Vision/Optical: Benefits provided to all non-represented regular full-time employees and their
dependents at the rate of $200 per person, to a maximum of $400 per family unit each year.
Regular part-time employees and their dependents shall be entitled to benefits on a pro-rata
basis.
Disability Insurance: The City shall provide 100% of the premium for regular full-time
employees for a comprehensive long-term disability policy. Regular part-time employees that
work at least 20 hours per week shall be entitled to benefits on a pro-rata basis (per insurance
program requirements).
Health Reimbursement Arrangement/Voluntary Employee Benefit Association (HRA/VEBA):
VEBA benefits shall be provided as contained in Resolution No. 1445 and as amended.

Vacation: Following the sixth month of continuous employment, annual vacation leave of six
full days (each day is calculated at eight hours, regardless of schedule worked) shall be granted.
Thereafter, an additional day of annual leave shall accrue each month, up to a total of 12 days.
Three additional days of annual leave shall be granted on the employee's anniversary date after
the third, fourth and fifth years. After six years, the employee shall be granted one day per year
additional annual leave to a maximum of 24 days per year. The maximum number of accrued
hours is 384 or 48 days.

activities of the City and on issues that concern Tukwila. Please let me know if you have any questions

Intergovernmental Update
• National League of Cities Congressional City Conference: Mayor Ekberg, Councilmembers
Hougardy, Kruller, Quinn and Seal, Communications and Government Relations Manager
Rachel Bianchi and Nate Robinson, along with j.1 Tukwila Teens, attended the National League
of Cities Congressional City Conference in Washington DC and met with Senators Cantwell and
Murray.
• Washington State Municipal Clerk's Association (WMCA) Executive Board: Christy
O'Flaherty, City Clerk has been elected to the Washington State Municipal Clerk's Association
(WMCA) Executive Board as President - Elect.
• Sound Cities Association Convening of King County Cities: Mayor Ekberg, Councilmember
Kate Kruller, City Administrator David Cline, Human Services Program Manager Evie Boykan
and Commander Rick Mitchell attended a Convening of King County Cities sponsored by the
Sound Cities Association regarding the issue of homelessness.
II. Staff Updates
Project Updates
• Tukwila International Boulevard Redevelopment - Motel Demolition: The contractor has
demolished as much as they can on the Smoke Shop, Spruce Motel, Boulevard Motel and the
Great Bear Motel. The only building segments left to be demolished are still connected to
Seattle City Light (SCL) power. The construction site has been secured pending SCL's
disconnection of power. The power disconnection permit was approved on March :Lo and
demolition will proceed once SCL crews have completed the power disconnection. In the next
few months staff will seek Council direction on when to begin a developer selection process.
• Foster Library: The King County Library System has officially determined that Foster Library is
surplus property and they can accept offers. Before they list it, they are asking if the City or
School District is interested in buying it. The District is willing to purchase it and would

appreciate funding and partnering with the City. City staff will bring this issue to the Council
once we have more information on what capacity may be available for City use.
• BNSF Intermodal Facility Access: An open house has been scheduled for March 3o at the
Tukwila Community Center. An online Open House is available through March 31 at
TukBNSFAccess .publicmeeting.info. Please visit the website and share your thoughts.
• Interurban Roadway: Seven of the project driveway approaches were paved and several more
are expected to be completed after final grading. The center median landscaping installation is
expected to be completed by March io.
• 5 3rd Avenue South: Staff and KPG are preparing for an open house on March 23 to discuss
design concepts and receive residents input on roadway design options.
• South 144th Street: King County Housing Authority has agreed to the right -of -way acquisition
and paperwork is being finalized. There has been ongoing coordination with the Tukwila
Village site developer and the King County Library System, including placement of the art work
being installed at the NE corner of Tukwila International Blvd and S 144th St.
• 42nd Avenue South Phase III: An open house was held March 15. Requests for Right of Entry to
all affected property owners have been mailed out. This will allow the City's contractor to
install the future underground connections for electricity and communications as well as make
transitions from private driveways to the new street.
• TUC Pedestrian /Bicycle Bridge: The City is waiting for approval from the US Army Corps of
Engineers (USACE) of the Section 408 Levee Modification Permit, which is expected by the
end of March.
• Tukwila Village: King County Library System continues construction on the new library,
estimated to be open to the public in late 2016. Tukwila Village Development Associates
continues sitework on the property north of 144th. The City has approved building permits for
buildings A, C, and E. City is awaiting developer response to comments on the permit
application for building D. Developer will submit permit application for building B at a future
time. City and developer expect to close escrow on the land sale for the first phase in May
2016. Developer estimates first buildings will open in late 2017.
• Washington Place: Development is under construction. Expects to open in late 2017.
• Southcenter Marketing Partnership: On March 2 Economic Development held a Southcenter
Marketing Partnership Forum at Total Wine and More. The event was well attended with over
5o people from various Tukwila area businesses. The meeting allowed businesses to network
with one another and to meet City staff. Staff presented the City's day marketing initiative
which was well received by the attendees.
• Little Library at the Tukwila Community Center: Nicholas Boyle installed a free Little Library
in the lobby at the Tukwila Community Center as his Eagle Scout project. He built the shelves
and donated the books for the library. People are encouraged to look through the library and
take a book. Book donations are also being accepted.
• Cascadia Rising: The city will be participating in a Multi -State Emergency Management
Tabletop Exercise called "Cascadia Rising" on June 7 and 8. As part of our preparation for the
exercise staff will be participating in several training opportunities between now and then.
