MINUTES REGULAR MEETING CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Pro Tempore Duffie called the Regular Meeting of the Tukwila City Council to order at 7:01 p.m. Councilmember Robertson led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Dennis Robertson, Verna Seal, Joe Duffle, Kathy Hougardy, De'Sean Quinn, Kate Kruller, Thomas McLeod, CITY OFFICIALS Mayor Ekberg was not in attendance. Mike Villa, Acting City Administrator; Rache! Turpin, City Attorney; Jack Pace, Community Development Director; Rick Still, Parks and Recreation Director; Laurel Humphrey, Council Analyst; Christy O'Flaherty, City Clerk. PROCLAMATIONS a. A proclamation declaring April as "Sexual Assault Awareness Month." Councilmember Kruller read a proclamation on behalf of Mayor Ekberg declaring April as "Sexual Assault Awareness" month in the City of Tukwila, encouraging all citizens to join advocates and communities across the country in taking action to prevent sexual violence. b. A proclamation declaring April 13, 2016 as "Arbor Day." Councilmember Quinn read a proclamation on behalf of Mayor Ekberg declaring April 13, 2016 as Arbor Day in the City of Tukwila, encouraging all citizens to protect trees and woodlands. Councilmember Quinn presented the proclamation to Rick Still, Director of Parks and Recreation. c. A proclamation declaring April 10 -16, 2016 as "National Volunteer Week." Mayor Pro Tempore Duffie read a proclamation on behalf of Mayor Ekberg declaring April 10 -16, 2016 as National Volunteer Week in the City of Tukwila, encouraging all citizens to recognize the outstanding volunteer spirit that exists in our community. Mayor Pro Tempore Duffie presented the proclamation to Rick Still, Director of Parks and Recreation. Mr. Still expressed appreciation for the proclamations and relayed that on Arbor Day (April 13), there will be tree planting at the 57th Avenue Park at 12:30 p.m. Additionally, on April 14, there will be a Volunteer Appreciation event at the Tukwila Community Center at 5:00 p.m. CITIZEN COMMENTS There were no citizen comments. MOTION CARRIED 7 -0. UNFINISHED BUSINESS a. An ordinance amending various ordinances to update the criminal code as codified in Title 8 of the Tukwila Municipal Code to be consistent with state law; establishing provisions pertaining to the crime of making or possessing a retail theft tool, to be codified at Tukwila Municipal Code Section 8.40.050. MOVED BY SEAL, SECONDED BY QUINN THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Christy O'Flaherty, City Clerk, read the proposed ordinance by title only. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING VARIOUS ORDINANCES TO UPDATE THE CRIMINAL CODE AS CODIFIED IN TITLE 8 OF THE TUKWILA MUNICIPAL CODE TO BE CONSISTENT WITH STATE LAW; ESTABLISHING PROVISIONS PERTAINING TO THE CRIME OF MAKING OR POSSESSING A RETAIL THEFT TOOL, TO BE CODIFIED AT TUKWILA MUNICIPAL CODE SECTION 8.40.050; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY QUINN, SECONDED BY SEAL THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 7 -0, TO ADOPT ORDINANCE NUMBER 2497. b. A motion relating to a rezone and Comprehensive Plan map change request from Low Density Residential (LDR) to Regional Commercial Mixed -Use (RCM) at 13536 52ND Avenue South (Ango/kar Rezone). Quasi- Judicial MOVED BY QUINN, SECONDED BY KRULLER TO DENY THE REZONE AND COMPREHENSIVE PLAN MAP CHANGE FROM LOW DENSITY RESIDENTIAL (LDR) TO REGIONAL COMMERCIAL MIXED -USE (RCM) AT 13536 52ND AVENUE SOUTH BASED ON THE FINDINGS AND CONCLUSIONS CONTAINED IN THE STAFF REPORT INCLUDED IN THE COUNCIL PACKET FOR MARCH 28, 2016 (ANGOLKAR REZONE).* Mayor Pro Tempore Duffie announced that the public comment period for this quasi - judicial item has ended. Rachel Turpin, City Attorney, reiterated that the record has been closed on this matter. Councilmember McLeod stated that at the last Council meeting, he disclosed during the meeting that he had driven by the subject property. He was alone and did not speak to anyone before or after driving by the property. He answered at that meeting that he felt he could weigh in on this issue in a fair manner. He asked the City Attorney if he would be permitted to discuss and /or vote on the issue this evening. Ms. Turpin responded to Councilmember McLeod that he would be permitted to participate and would not be barred by the Appearance of Fairness Doctrine. If Mr. McLeod feels able to participate as an unbiased decision maker and did not have ex parte contact, he may discuss and vote on this issue. This has been disclosed on the record, and anyone present who would like to dispute this issue is welcome to do so. The Councilmembers all expressed support for the motion to deny the change from LDR to RCM, with the following comments: Acknowledgement of the citizens who testified in support of retaining the character of the single family neighborhood; The importance of remaining consistent and committed to the City's Comprehensive Plan; Recognition and appreciation for the applicant's effort to develop the site; The necessity of exploring other options to preserve the neighborhood, such as adequate parking. *MOTION CARRIED 7 -0, TO DENY THE REZONE AND COMPREHENSIVE PLAN MAP CHANGE. Tukwila City Council Regular Meeting Minutes April 4, 2016 Page 3 of 4 REPORTS a. Mayor Mayor Ekberg was not in attendance b. City Council Councilmember Robertson commended staff in the Department of Community Development for the thorough and well- written staff report provided for the rezone item discussed this evening. Additionally, Public Works staff will be preparing information on traffic issues that came out of the rezone discussion. This topic will come to a future Transportation Committee meeting. Councilmember Seal attended the monthly LEOFF1 (Law Enforcement Officers and Firefighters) meeting, where the members review claims for the retirees. She said that any questions regarding the first Facilities Work Session should be sent to the Council Analyst as soon as possible, as the second Work Session will be forthcoming on Monday (April 11). Councilmembers can let the Council Analyst know if they want to meet with the Finance Director to get an overview of the financial model. Ms. Seal looks forward to the meeting on Monday and future discussions at the Finance and Safety Committee meetings. Councilmember Hougardy expressed appreciation to staff in the Communications Office for an excellent article regarding the Teens for Tukwila trip to Washington D.C. Ms. Hougardy offered corrections to her Council Report from last week. The correct name of the Managing Director of the Highline Forum is Lance Little, and the SeaTac Airport is known as a "regional" airport as opposed to a "King County" airport. Councilmember Quinn appreciates the forward thinking of Councilmember Robertson as Chair of the Transportation Committee regarding conversations about traffic. He expressed a desire to explore zone parking as an option for residential neighborhoods, and the importance of looking at the need for sidewalks. As the Council hears from the citizens, it is important to follow up and review options. Councilmember Kruller echoed the support for zone parking. Ms. Kruller reported that she attended the recent Tukwila School District Film Festival showing of "Paper Tigers," which focused on youth traumatized by difficult home situations. Later that same evening, she represented Tukwila in a networking dinner with House and Senate members regarding the State budget. Additionally, she expressed appreciation for the Sounders and the S2 team. The S2 team plays at Fort Dent, and she finds it fun and family friendly, with a strong community atmosphere. She said there is concern about the facility and the size of the fields being too small. As a member of the Community Trust, she knows that checks for capital improvements are being returned as upgrades are not being made. She asked that City Administration reach out and report back to the Council as to what Tukwila is doing to ensure Fort Dent is an appealing location for the Sounders /S2. Mayor Pro Tempore Duffie emphasized the good work of the Council Committee Chairs and the Committees. He also relayed how impressive Interurban Avenue has become with the re- construction effort. It is a pride - worthy thoroughfare. c. Staff Mike Villa, Acting City Administrator, referenced the City Administrator (CA) Report in the packet and offered to answer any questions. Councilmember Seal referenced the portion of the report regarding Katrina Dohn's comments at the March 21, 2016 Council meeting. Ms. Dohn provided her phone number to staff at the meeting and was of the opinion there would be follow -up by City staff. Ms. Seal asked that someone from City staff contact Ms. Dohn with a brief overview. Intergovernmental There was no report. MISCELLANEOUS Councilmember Quinn commended Mayor Pro Tempore Duffie for the manner in which he has worked with Council Committees and Committee Chairs this year. He also appreciated the collaboration in affording Councilmembers the opportunity to read the proclamations this evening.
