ADJOURNMENT Tukwila City Hall is ADA accessible. The Council appreciates hearing from citizens but may not be able to take immediate action on comments received until they are referred to a Committee or discussed under New Business. CITIZEN COMMENTS At each Council meeting, citizens are given the opportunity to address the Council on items that are not included on the agenda during CITIZEN COMMENTS. Please limit your comments to 5 minutes. SPECIAL MEETINGS /EXECUTIVE SESSIONS Special Meetings may be called at any time with proper public notice. Procedures followed are the same as those used in Regular Council meetings. Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel matters as prescribed by law. Executive Sessions are not open to the public. PUBLIC HEARINGS Public Hearings are required by law before the Council can take action on matters affecting the public interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the Tukwila Municipal Code states the following guidelines for Public Hearings: The proponent shall speak first and is allowed 15 minutes for a presentation. 2. The opponent is then allowed 15 minutes to make a presentation. 3. Each side is then allowed 5 minutes for rebuttal. 4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second time until everyone wishing to speak has spoken. 5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the question, but may not engage in further debate at that time. 6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss the issue among themselves, or defer the discussion to a future Council meeting, without further public testimony. Council action may only be taken during Regular or Special Meetings. COUNCIL MEETING SCHEDULE No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given. Regular Meetings - The Mayor, elected by the people to a four -year term, presides at all Regular Council Meetings held on the 1st and 3rd Mondays of each month at 7:00 p.m. and Special Meetings. Official Council action in the form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular or Special Council meetings. Committee of the Whole Meetings - Councilmembers are elected for a four -year term. The Council President is elected by the Councilmembers to preside at all Committee of the Whole meetings for a one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m. Issues discussed there are forwarded to Regular or Special Council meetings for official action. BACKGROUND The City of Tukwila has been sponsoring a family oriented 4th of July celebration for the last 14 years. This is one of the most successful City sponsored events in terms of public attendance and participation. This event will draw in excess of 5,000 people to the park to view and participate in the festivities scheduled by Parks and Recreation. DISCUSSION Parks and Recreation has retained the same fireworks company, Western Display Fireworks, Ltd., a company with 62 years of experience in public displays. We will use the same location as last year to avoid having to protect the sports turf fields in the northeast corner of the facility. This fireworks discharge location will be in the southwest corner of the facility on the natural grass fields. Additionally, the largest aerial shell will be 3"; this allows for a smaller safety perimeter. Western Display has also proposed several ground displays that the crowd will be able to see when looking south. FINANCIAL IMPACT This event is funded through the Parks and Recreation Department. RECOMMENDATION The Committee is being asked to forward this item to the June 20, 2016 Regular Meeting Consent Agenda. They have applied for the permit for a public fireworks display at the Starfire Sports Complex, 14800 Starfire Way. Western Display is a licensed Pyrotechnic Company with the State of Washington. The display will be held in conjunction with the City's planned event, on July 4, "Family Fun at the Fort", being organized by the Parks and Recreation Department. This will be a 20 to 30 minute show starting at approximately 2200 hours. The fireworks will be transported to the site in the AM of July 4 and will be under the required supervision until they are discharged. The mortar tubes and support equipment will be brought to the location on July 4. The application was reviewed for adherence to the requirements under WAC 212-17 and accepted industry standards; we find everything is within these guidelines. The display will be held again in the Southwest corner of the facility. We will however, have a small portion of the 6720 Fort Dent Way Office building within the South edge of the fallout zone. Crowd control can be a potential issue, as the crowd that assembles to watch the fireworks show has increased every year. Last year the traffic leaving the site was managed with the available Tukwila Police on site and available patrol units. To mitigate these issues, I believe the following measures should be done: • Stage two fire apparatus at the site: one apparatus on each side of the river in order to cover the 6720 Fort Dent Office building. Apparatus shall be out of service during the display and for 30 minutes following the display. Any breech of the safety perimeter shall suspend the display until the perimeter is cleared and re— established. 15. Upon completion of the display, the fallout area shall be checked for unexploded shells. Cleaning of debris, if not practical on the night of the event shall be at first light the next day. 16. Review of Facilities Plan Council Questions Matrix Staff is maintaining a list of Council questions and responses with regard to the facilities plan, and an updated version was provided for Committee review. The Committee was given additional details relating to service level impacts for the Fire Department, Police Department, Municipal Court, and Public Works, as well as historical LTGO debt capacity trends. Questions relating to these were recorded in the matrix. Committee members debated pros and cons of financing options for the proposed Public Safety bond and associated public outreach. Shall the City Council approve the adoption of the 2015 State Building Code in Tukwila? We will not be making extensive changes to the new 2015 State Building Codes. Permit fees will be reviewed later this fall. BACKGROUND The State Building Code Council was created to advise the legislature on building code issues and developed the building codes used in the state of Washington. In the course of development of the State Building Code the Council holds public hearings, considers proposed state amendments and finally adopts the international model codes and amendments. This occurs on a three-year cycle. The following 2015 editions of the model codes make up the referenced State Building Code: •International Building Code with statewide amendments •ICC/ANSI A117.1 -09, Accessible and Usable Buildings and Facilities, with statewide amendments •International Residential Code with statewide amendments •International Mechanical Code with statewide amendments •International Fuel Gas Code with statewide amendments (part of the IMC adoption) •2014 Liquefied Petroleum Gas Code (NFPA 58) -National Fuel Gas Code (NFPA 54) (for LIP Gas installation only) •Uniform Plumbing Code with statewide amendments -International Energy Conservation Code/Washington State Energy Code •International Existing Building Code with statewide amendments found in the IBC •International Swimming Pool and Spa code DISCUSSION Adoption of 2015 State Building Codes is necessary to enable legal enforcement of the new codes within the City. The building industry, contractors, designers, developers, etcetera, depend on statewide uniformity in the codes that impact their businesses. More importantly, the citizens of Tukwila deserve to know that the built environment that they live, work and play in are designed with the latest health, fire and life safety measures. With this adoption, there are currently a few minor housekeeping issues we are asking council to consider as follows: I. Work exempt from permit section 105.2 of the International Building Code and International Residential Code. 23 INFORMATIONAL MEMO Page 2 a. The Residential Code and the Building Code have different size exemptions for one -story detached accessory structures. The Building Code allowed 120 sq. ft. and the Residential Code allowed 200 square feet. For consistency, we are recommending alignment with both codes to reflect a maximum 120 sq. ft. The 120 sq. ft. figure has been the maximum size for many code cycles. b. The Residential Code and the Building Code, allows an exemption for fences not over 7 feet in height. We are recommending fences not over 6 feet in height. II. 16.04.250 Procedures applicable to all construction permits: E. Expiration of Permits. (revised) Previously the code stated, "The Building Official may grant one or more extensions..." It has been revised to state, "The Building Official may grant a maximum of two extensions for periods not more than 180 days each." Projects will still be required to request progressive inspections (every 180 days) or expire by limitation after two extensions. F. Expired Permit Final. (deleted) The verbiage within the current section has been revised to clarify the intent of reactivating a permit for final. An example of the intent of this section is for an owner who's contractor does not call for final inspection of a rooftop HVAC unit replacement. Providing a means for a final inspection allows us to address any safety issues. The new verbiage clarifies how and when a permit can be reactivated for final inspection and is as follows: [New] F. Reactivating Expired Permit for Final. Expired permits that have completed the inspection process and need only final inspection approval may be reactivated. Reactivation shall require a new permit application and fee per Expired Permit Final on the most current permit fee resolution. The Building Official may grant one thirty (30) day extension to an expired permit for the purpose of performing a final inspection and closing out the permit as long as not more than ninety (90) days has passed since the permit expired. Provided no changes have been made or will be made in the plans or scope of work, the thirty (30) day extension commences on the date of written approval. If work required under a final inspection is not completed within the thirty (30) day extension period, the permit shall expire. III. Notable code changes /clarifications: a. The 2015 Mechanical Code: This code includes multiple codes such as the adoption of and amendments to the following codes: - 2015 International Fuel Gas Code - 2015 National Fuel Gas Code (NFPA 54) - 2014 Liquefied Petroleum Gas Code (NFPA 58) b. International Building Code Existing Buildings Chapter 34: Previously the International Building Code provided us with guidance to control the alteration, repair, addition and change of occupancy of existing buildings and structures through Chapter 34 "Existing Buildings." The International Code Council (ICC) deleted Chapter 34 "Existing Buildings" and provided us with the International Existing Building Code with statewide amendments. c. International Residential Code Appendix G: Appendix G, "Swimming Pools, Spas and Hot Tubs," was previously included in the adoption of the International Residential Code. Appendix G has been replaced with the International Swimming Pool and Spa Code. d. Sanitary Drainage. Side sewer, private sewer main extensions beyond a point defined in the plumbing code as the building drain, and required grease interceptors all within the City's sewer districts shall be in accordance with the City of Tukwila Public Works Department's "Development Guidelines and Design and Construction Standards," in conjunction with the Uniform Plumbing Code requirements. Any person who commences work before obtaining the necessary permits shall be subject to an investigation fee. The investigation fee shall be equal to the established permit fee as set forth in the FnGSt GUrrent permit fee reselutioR in accordance with the permit fee schedule adopted by resolution of the City Council. This fee, which shall constitute an investigation fee, shall be imposed and collected in all cases, whether or not a permit is subsequently issued. D. Fee refunds. The Building Official may refund any permit fee paid by the original permit applicant that was erroneously paid or collected. The Building Official may also authorize the refund of not more than 80% of the permit fee when no work has been done under a permit issued in accordance with the code. Where a plan review fee has been collected, no refund will be authorized once it has been determined that the application is complete and the plan review process has commenced. Refund of any permit fee paid shall be requested by the original permit applicant in writing and not later than 180 days after the date of fee payment. E. Expiration of Permits. All building, mechanical, plumbing, fuel gas piping and electrical permits shall become invalid unless the work on the site authorized by such permit is commenced within 180 days after issuance or the work is suspended or abandoned for a period of 180 days after the time the work is commenced. Reactivation shall require a new permit application, and the fee shall be in accordance with the permit fee schedule adopted by resolution of the City Council. The Building Official may grant one 30-day extension to an expired permit for the purpose of performing a final inspection and closing out the permit as long as not more than 90 days have passed since the permit expired. Provided no changes have been made or will be made in the plans or scope of work, the 30-day extension commences on the date of written approval. If work required under a final inspection is not completed within the 30-day extension period, the permit shall expire. G. Residential remodel permits. All references to Board of Appeals is amended as follows: Any person, firm or corporation may register an appeal of a decision or determination of the Building Official provided that such appeal is made in writing within 14 calendar days after such person, firm or corporation shall have been notified of the Building Official's decision. Any person, firm or corporation shall be permitted to appeal a decision of the Building Official to the Tukwila Hearing Examiner when it is claimed that any one of the following conditions exists. 1. The true intent of the code or ordinance has been incorrectly interpreted. 2. The provisions of the code or ordinance do not fully apply. 3. The decision is unreasonable or arbitrary as it applies to alternatives or new materials. 4. Notice of Appeal procedures shall be in accordance with TMC Section 18.116.030. I. Violations. Whenever the authority having jurisdiction determines that there are violations of this code, a written notice shall be issued to confirm such findings. Any Notice of Violation issued pursuant to this code shall be served upon the owner, operator, occupant or other person responsible for the condition or violation, either by personal service or mail, or by delivering the same to and leaving it with some person of responsibility upon the premises. For unattended or abandoned locations, a copy of such Notice of Violation shall be posted on the premises in a conspicuous place, at or near the entrance to such premises, and the Notice of Violation shall be mailed by registered or certified mail, with return receipt requested, to the last known address of the owner, occupant or both. J. Penalties. Any person, firm or corporation who shall willfully violate or fails to comply with a Notice of Violation is liable for the monetary penalties prescribed in TMC Section 8.45.100.A.2. Section 4. Repealer. Ordinance No. 2449, as codified at TMC Section 16.04.020, is hereby repealed. Section 5. Repealer. Healthy Tukwila Staff updated the committee on current efforts to promote health in Tukwila as informed by strategic goals, PROS Plan goals, and budget priorities, and which can be categorized as: Fit City, Vibrant City, Green City and Connected City. In 2013, the City committed to the "I "CANN initiative, aimed at reducing obesity in King County. A Partnerships to Improve Community Health grant received in 2015 kicked off the "Healthy Tukwila" initiative. The Parks Department has many current partnerships aimed at achieving health and wellness goals. Staff plans to move forward with this work using existing budget and resources, and asked the committee for input. Additional or expanded initiatives requested by Council may require additional funding through the 2017 -2018 budget process. Councilmember Hougardy stated she likes the category framework and supports current work. Chair Quinn stated that Councilmembers can help populate the "4 pillars" approach with examples such as work done by the Tree Committee. Please let me know if you have any questions or need additional information about any of the following items. Intergovernmental Update • Waste Management Scholarship Program: Waste Management partnered with the City of Tukwila to provide 2o16 scholarships to Foster High School Students. They reviewed the applications the City received for the Tukwila City of Opportunity Scholarship and selected five students to receive $1,000 scholarships. Waste Management plans to continue collaborating with the City Scholarship program next year. • Council Chat at Foster High School: Teens for Tukwila sponsored a Council Chat at Foster High School on June 3. Over So teens participated in the event to discuss important topics including employment, education and safety. Mayor Ekberg, Council President Duffie, and Councilmembers Robertson, Seal, Hougardy, Quinn and Kruller, also attended. The teens discussed their ideas to address community priorities. II. Community Events • Residential Collection Event: The Tukwila Recycling Program offered a successful event for hard -to- recycle items at Foster High School on May 14. Items received included: 8.19 tons of metals, 15 porcelain toilets and sinks, 126 tires, 16 mattresses and box springs, 3.12 tons of reusable household goods and textiles, l9 propane tanks and 6 tons of bulky wood, 45 gallons of antifreeze, 23 auto /marine batteries, 275 gallons of motor oil /mixed petroleum products, 46 oil filters, and 294o household batteries. The Recycling Program also distributed 19 recycled - content compost bins and 3o recycled content rain barrels at a reduced cost to Tukwila residents. Community Clean -Up Event: The City partnered with Waste Management to offer Tukwila's first Curbside Collection Event on June 1o. The event was very successful. Staff will be meeting with Waste Management to receive a report on items collected and to discuss lessons learned for future events. III. Staff Updates Public Safety • Foster High School Class Discussion: On May 26 Tukwila Police Officers participated in a classroom discussion at Foster High School. A few days later officers responded to a call in a neighboring City, and were approached by an attendee from the classroom discussion. The officer was able to gather some great information from this student. • 17th Annual Mu'tamar Conference: On May 28 Sergeant Boyd and Officer Valdez spoke about the role of law enforcement in the United States and in the community at the 17th Annual Mu'tamar Conference for the East African Islamic Community held at Foster High School. • New Towing Program: Effective June 1 the Police Department moved from a single towing contractorto a rotational (multiple company) towing system. ABC Towing and Skyway Towing are the companies on our rotational tow truck list for all PD impounds and fleet towing needs. • Meeting with Foster High School Bike Club: Community Development staff met with the Foster High School Bike Club to discuss student interest in bicycle facility planning. After school reconvenes in the fall, the Bike Club plans to make a presentation to the City Council about their interest and support for bicycle infrastructure here in Tukwila. Project Updates • TIB Redevelopment— Motel Demolition: Fencing and hydroseeding is scheduled to be completed by June 17. The electrical service connection from Seattle City Light to the two newly erected lights should be up and running by the end of the month. • 53rd Ave S: The City has received responses from 1g of the 46 private property owners along the roadway as to the design option they prefer. A follow -up letter was sent to the owners who did not respond to solicit additional input. • Foster Library Building: The Tukwila School District has announced they have reached an agreement with the King County Library System to purchase the Foster Library building. • TUC Pedestrian /Bicycle Bridge: Bid Opening was held on May 24 with the low bidder, SB Structures, coming in below the engineer's estimate and within budget. The bid award is scheduled for the June loth Regular Council meeting. Selection of a construction management firm should be completed by June 17. • S 144th St Phase II: The bid opening on June 7 only had two bidders and both bids were significantly over the engineer's estimate. Analysis of the bids is underway. • Washington Place: Mayor Ekberg and Economic Development staff toured Washington Place, the 1g story hotel and apartment building that is under construction on Andover Park East.
