No. 20150428900001, King County Tax Parcel #: 152304 -9242 14 THIS EASEMENT is made this 1 �� day of F , 2016, between CITY OF TUKWILA, a Washington municipal corporation, hereinafter called the Grantor; and the CITY OF SEATTLE, a Washington municipal corporation, acting by and through its CITY LIGHT DEPARTMENT, hereinafter called the Grantee; AS FOLLOWS: That the Grantor, for and in consideration of the sum of One Dollar (1.00) and other valuable consideration, receipt and sufficiency of which is hereby acknowledged, hereby grants to the Grantee, its successors and assigns, the right, privilege and authority (an "Easement ") to install, construct, improve, remove, erect, alter, repair, energize, operate and maintain underground electric distribution facilities which are limited to: vaults, handholes, risers, ducts, conduits, cables, underground wires and other convenient appurtenances necessary to make said underground facilities an integrated electric system ( "Electric System ") upon, under, across and through the following described lands and premises ( "Property") situated in the County of King, State of Washington: PARCEL A OF CITY OF TUKWILA LOT CONSOLIDATION L13 -021 AS RECORDED UNDER RECORDING NUMBER 20150428900001, IN KING COUNTY, STATE OF WASHINGTON. Except as otherwise set forth herein, Grantee's rights shall be exercised upon that portion ( "Easement Area ") of the Property as depicted in Exhibit A attached hereto and as legally described as follows: THE SOUTHERN FORTY (40) FEET OF THE WESTERLY TEN (10) FEET OF THE ABOVE DESCRIBED REAL PROPERTY. Page 1 of 4 Together with the right at all times to the Grantee, its successors and assigns, of ingress to and egress from the Easement Area across and through the Property of the Grantor for the purposes set forth herein. Together with the right at all times to the Grantee, its successors and assigns, to cut and trim brush, trees or other plants standing or growing upon the Easement Area, which, in the opinion of Grantee, interfere with the maintenance or operation of Grantee's Electric System. Except for structures within the Easement Area as of the date of this Easement and except for grading, site work, construction and installation and maintenance of facilities as approved in City permits D14 -0999 and PW13 -0163, the Grantor, their heirs, executors, administrators, successors and assigns, hereby covenant and agree that no structure or fire hazards will be erected or permitted within the Easement Area; that no digging will be done or permitted within the Easement Area which will in any manner disturb the Electric System or its solidity or unearth any portion thereof; and that no blasting or discharge of any explosives will be permitted within fifty (50) feet of the Electric System. The City of Seattle is to be responsible, as provided by law, for any damage to the Grantor through its negligence in the construction, maintenance and operation of its Electric System. The City of Seattle shall restore the property to at least as good a condition than that which existed prior to any disturbance by the City of Seattle due to its actions to construct, improve, remove, erect, alter, repair, energize, operate and maintain underground electric distribution facilities within the Easement Area. The Grantor and Grantee acknowledge that the Electric System is not wholly contained within the Easement Area and that components of the Electric System extend into the public right -of -way for Tukwila International Boulevard. Grantor and Grantee hereby agree that any conflict between the Electric System and future public improvements within the right -of -way (consistent with the Franchise agreement in place between Tukwila and Seattle City Light) that necessitate relocation, adjustment, or other physical changes to the Electric System to resolve the conflict, will be resolved in partnership between Grantor and Grantee with all associated costs shared equally. Every reasonable effort will be made to design such future improvements within the right -of -way to avoid conflicts with the Electric System. The rights, title, privileges and authority hereby granted shall continue and be in force until such time as the Grantee, its successors and assigns shall permanently remove all of its Electric System from the Easement Area or shall permanently abandon the Easement Area, at which time all such rights, title, privileges and authority shall terminate without further action required from Grantor or Grantee.
