SUBJECT: Discussion on Solutions for Litter Control
ISSUE
At the May 9, 2016 Committee of the Whole meeting, a representative from the Tukwila
International Boulevard Action Committee submitted a proposal to the Mayor and City Council
regarding revising business license requirements to include trash collection and disposal on the
exterior of the premises as well as the adjacent public sidewalk.
DISCUSSION
This is an opportunity for the Committee to discuss the proposal and provide direction on
desired next steps.
Current Law in Tukwila
Tukwila Municipal Code Chapter 6.12 was established in 1964 under the "Tukwila Refuse
Ordinance." TMC Section 6.12.040, Adequate Receptacles Required, prohibits owners or
occupants of private property to accumulate or allow the accumulation of litter other than in
approved receptacles. TMC Title 5, Business Licenses and Regulations, does not currently
address garbage or litter requirements beyond this.
Litter/Trash Laws in other Cities
Below are examples of litter-related laws in other cities, specifically with regard to private
property and/or public sidewalks or alleys.
Bothell
8.44.160 Merchants' duty to keep sidewalks free of litter.
No person owning or occupying a place of business shall sweep into or deposit in any gutter,
street, or other public place the accumulation of litter from any building or lot or from any public
or private sidewalk or driveway. Persons owning or occupying places of business within the city
shall keep the sidewalk in front of their business premises free of litter. (Ord. 697 § 10, 1973).
8.44.170 Owner to maintain premises free of litter.
The owner or person in control of any private residence or other private property shall at all
times maintain the premises free of litter. (Ord. 697 § 11, 1973).

6.86.040 Placement of litter receptacles.
(a) Litter receptacles shall be placed in all parks, trailer parks in respect to the service of
transient habitation, gasoline service St@tiOnS, tavern parking |OtS' shopping centers, grocery
Store parking |OtS. and in other Sinni|er public p|3CeS of quantity appropriate to the O8Hd for
such receptadee, all as specified by and in accordance with state regulations.

receptacles are required by this S8CdOn shall procure and place and maintain such litter

and it shall be unlawful for any such person to fail to so procuna, place and maintain litter

To revise the requirements for obtaining a Business License, in the City
of Tukwila, to include the collection and disposal of any trash, litter, or
garbage on the exterior of the business premises including the public
sidewalk adjacent to the business.
The adoption of this requirement should include penalties for the violation of it
