Garbage is defined as the animal or vegetable waste resulting from the handling, preparation, cooking and consumption of food. Rubbish is defined as combustible and noncombustible waste materials, except garbage; the term shall include the residue from the burning of wood, coal, coke and other combustible materials, paper, rags, cartons, boxes, wood excelsior, rubber, leather tree branches yard trimmings, tin cans, metals, mineral matter, glass crockery and dust and other similar materials. Piled next to the back of the structure are various boxes, bins, bags and other household furniture and products that must be stored inside a structure. Corrective Action: Store all boxes, bins, bags and household furniture and objects inside a structure. compliance Date: 2/18/2015 Violation # 2 BUILDING PERMITS REQUIRED Code Reference: IBC 105.1 Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convertor replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. Junk vehicle also includes individual parts of vehicles no longer attached to one another. There are vehicles parts being stored in the back of the property. KC records show the square footage of property is 18,360. The property shall not exceed 18 chickens. Remove all but 18 chickens from the property. 2/18/2015 Violation # 5 Code Reference: Corrective Action: Compliance Date::, ROOSTERS PROHIBITED TMC 7.08.050 The keeping of roosters within the City limits is prohibited. At least two roosters were heard at the property. Remove all roosters from the property. /IS /2015 Violation # 6 Code Reference: Corrective Action: SENSITIVE AREAS VIOLATIONS TMC 18.45.195 The following actions shall be considered violations of this chapter: 1. To use, construct or demolish any structure, or to conduct clearing, earth - moving, construction or other development not authorized under a Special Permission, Reasonable Use or other permit where such permit is required by this chapter; 2. Any work that is not conducted in accordance with the plans, conditions or other requirements in a permit approved pursuant to this chapter, provided the terms or conditions are stated in the permit or the approved plans; 3. To remove or deface any sign, notice, complaint or order required by or posted in accordance with this chapter; 4. To misrepresent any material fact in any application, plans or other information submitted to obtain any sensitive area use, buffer reduction or development authorization; 5. To fail to comply with the requirements of this chapter. TMC 18.45.070 Sensitive Area Permitted Uses and TMC 18.45.090 Wetland Uses, Alteration and Mitigation. *Vehicles were parking in the back yard with in the sensitive area. *A fence was put up in the sensitive area. *Chickens were allowed to roam in the sensitive area. * Rubbish which included wood and tree branches has been stacked in the sensitive area. *Trees in the sensitive area and entire property had been limbed up. *Trees that had fallen had been removed from sensitive area. *Filling in the wetland buffer is prohibited. There was wood, branches, and leaves dumped in the stream to alter the water flow. * Working in sensitive area without a permit. The buffer area had been removed of all vegetation Remove and Discontinue parking or storing Vehicles in the sensitive area (back yard). Remove the fence that was put up in the sensitive area. Discontinue allowing chickens to roam in the sensitive area. • Remove and Discontinue stacking wood, tree branches any rubbish in the sensitive area. Discontinue all limbing up or pruning of Trees on the property. All trees that fall down within the sensitive area (back yard) are required to be left where they fall. NO MORE TREES ARE ALLOWED TO BE CUT DOWN ON THE PROPERTY. Discontinue dumping or working in the sensitive area without a permit. Complies once Do— a 271:172717 FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO $500 PER DAY PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PER TMC 8.45.100(2). Appeal Provisions A person may, within ten days of receipt of this notice, file with the City Clerk a written notice of appeal containing the following: 1..A heading with the words: "Before the Hearing Officer of the City of Tukwila" 2. A caption reading: "Appeal of " giving the names of all appellants participating in the appeal. 3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the notice and order. 4. A brief statement of the specific order or action protested, together with any material facts claimed to support the contentions of the appellant(s). 5. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order should be reversed, modified, or otherwise set aside. 6. The signature of all persons named as appellants and their official mailing addresses. 7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters stated in the appeal. 8. The appeal fee for violations in the LDR zone is $100.00. All other zones $200.00. Fees must accompany the written notice of appeals. Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional administrative hearings.
