The City of Tukwila, Ordinance #1233 authorizes the Director of Public
Works to enter into an agreement which stays the construction of side-
walks subject to certain conditions.
Whereas the existing street does not•have an established finished grade
with associated storm drain and whereas certain underground utility'sys-
tems are not installed nor designed and whereas the width of said street
has not been established and whereas the existing right -of -way is not
sufficient; therefore, the sidewalk construction in connection with this
'building permit is not required at this time.
This letter agreement provides that at such time as the above conditions
have been eliminated as a condition for the staying of the sidewalk
construction, the propert owner at such time shall be given notice to
construct said sidewalk in accordance with plans and specifications
provided by the property owner and in compliance with the then, current
City standards. Said sidewalk shall be, constructed within ninety (90)
days of notice delivered'to the then property owner. The permits for
said construction shall be required.at that time.
This agreement shall be recorded at the property owner's expense upon
duly signing.
Your problem is not new, especially on•Interurban. A revised Sidewalk
Ordinance is now being formulated and I will inform you when it is before
the City Council for. input.:

(Refer to Plan Dated 5/17/83)
The Public Works Department has reviewed the attached drawing resubmittal and
approved this resubmittal per the following comments and per requirements set
for in a letter to yourself dated 4/1/83:
1. This plan is approved for storm drainage and curb cut /access /sidewalk
only. In the 4/1/83 letter you were requested to provide length, size,
type of material and location of proposed water meter and service for
the proposed office building; show the water main to which this water
service is to connect; the location of the existing main to which it
will tie to in the public right -of -way and any pertinent information
with regards to hydrants, fire loops, sprinkler systems for fire and
irrigation as required per your development. You are also requested
to provide the size, length, type of material and location for the
proposed sanitary side sewer including invert elevations at building
junction to the main and to show the sanitary side sewer main to which
this sanitary side sewer shall connect.
As the developer has not shown either his sanitary side sewer or his
water service and meter, the City takes no responsibility for the
ability of the future development to accomodate these types of services
in the future plan submittals.
2. Twenty -four hours prior to beginning your work, your contractor shall
apply for and obtain the following permits:
A. Curb Cut /Access /Sidewalk Permit - Permit fee: $25.00
B. Storm Drainage Permit - Permit fee: $25.00
3. Curb Cut /Access /Sidewalk Permit - All work shall be done in accord-
ance with the City's standard plans. Copies of these plans will be
made available by contacting Mark Reeves at 433 -1854. The elevation
of the sidewalk will be determined in the field with the assistance
of the City's inspector. A feathering -in of asphalt shall be pro-
vided at the ends of the sidewalk to allow for handicapped access.
Criteria for this amenity will be provided by the City's Inspector
Mark Reeves.
In addition to the sidewalk, a concrete apron into this private
development shall be provided per the City's standard plan.
4. Storm Drainage Permit - The storm drainage system shall be provided
in concrete pipe or metal (16 -gauge steel /steel with aluminum coating
and /or aluminum pipe). If steel pipe is provided, it shall be gal -
venized and be provided with Treatment 1 per Washington State Depart-
ment of Transporation requirements. Per FIRM Map all surface site
elevations shall be above 18 foot datum.
All pipe shall have 12 -inch minimum cover, at .5% minimum grade, pro-
vided in Class "B" bedding throughout. A materials review of inlets,
catch basins, control manholes and piping shall be conducted with
the City's Inspector Ray Doll (433 -1863) prior to approval of materials
and.installation.
Retention requirements shall be per King County Surface Water Management
Division at 344 -3874.
This plan shall be stamped by a professional engineer prior to issuance of permits'
described herein.

The plan review of the proposed foundation for a future building,
located at 6412 South 144th Street, Tukwila, indicates that the
following items need to be resolved before a building permit can .
be issued:
1. Parking stalls for the handicapped are required to be
12'6" wide and as close as possible to the primary,
public, building entrance and shall not slope more than
1 in 50. (Resuinittal of corrected drawing is not
required.)
Provide for protection of either the foundation "J" bolts,
or the mud sill whichever is applicable.
. The Planning Department and Public Works Department plan
review comments are attached in the original form for your.
'convenience.

Re: Foundation Permit -

Our office has completed its review of the proposed foundation permit and
finds that a number of matters must be resolved before we can authorize
its release:
A. Setbacks and Landscaping
The City Attorney has examined the content of the Developer's
Agreement recorded under Auditor's File 8108250512 and has
determined that the building for which a foundation permit
is sought must conform to all applicable setback, landscape
and parking requirements in effect at the present time. To
comply, the site plan must show a 25' front setback with a
15' wide landscaped area therein. (TMC 18.50.020 and 18.52.020)
. Amended Agreement
During our meeting on 31 March 1983, the possibility of shifting
the building's position northward on the site to attain the
required setback distance in the front yard was discussed.
This option is still available; however, the City Attorney advises
us that the aforementioned Developer's Agreement must be amended
to encroach upon the rear 72' of the lot which is now specified
for parking useage. The amendment process is largely a house-
keeping matter and can most probably be completed in a timely
manner.
Board of Architectural Review
TMC 18.60.060 (2) identifies the subject' property as situ -'
ated within the Interurban Special Review Area, and as such
is subject to B.A.R. review before building permits are
released. A complete B'.A.R. application is required,.
therefore, including building elevations and landscaping,
as provided in TMC 18.60.040. My staff will be pleased to
helf you in preparing your application to the Board for the
.next available agenda.
