THE GRANTORS, WILLIAM R. HOPPER and PATRICIA A. HOPPER, his wife,

for and in consideration of payment of Five Hundred Eighty /Dollars
nJ ($585.00) and other good and valuable consideration.as hereinafter

stated, convey and warrant to THE CITY OF TUKWILA, as Grantee herein,
col the following described real estate, situated in the County of King,

fl State of Washington, to the same extent and purpose as if the rights
herein granted had been acquired by condemnation proceedings under
1 eminent domain statutes of the State of Washington:
The West 5 feet of the North 195 feet of the South 315
feet of Lot 3 of Interurban Addition to Seattle, as
per plat recorded in Volume 10 of Plats, page 55,
records of King County;
and such conveyance is made in partial consideration of and upon the
following terms and conditions:
1. A new driveway shall be constructed on Grantors'
property as shown on Exhibit "A" attached hereto
and thereby made a part hereof, which driveway
shall be 14 feet in width consisting of paving
10 feet in width and shoulders 2 feet in width.
O��GCo. 2. Said driveway shall be installed and completed
prior to commencement of construction by Grantee
within the area conveyed by this instrument, to
the end that there shall be continuous uninterrupted
vehicular access to and from Grantors' remaining
property during the period of street construction
by Grantee.
3. Said driveway shall be guaranteed by Grantee for
a period of one (1) year subsequent to completion
of the Grantee's construction project of which
construction on the property conveyed hereby
is a part, and acceptance of such project by the
Grantee.
4. The large maple tree east of the location of the
new driveway on the Grantors' property shall not
be disturbed or damaged by Grantee.
5. Fill will be placed by the Grantee abutting 62nd
Avenue South at a width of 20 feet where rockery
is indicated on Exhibit "A" Attached hereto.
6. The southwest corner of the Grantors' property as it
will exist as a result of the conveyance effected by
this instrument shall be marked by Grantee with a
permanent monument.
7. Drainage coming off the easterly bank on and abutting
Grantors' property shall be picked up by Grantee's.

8. The Grantee shall, at Grantors' direction, locate
temporary fencing during construction, and shall
relocate permanent fencing of at least like quality
of existing fencing following construction; and
further, Grantee, during the period of bonstruction,
shall provide security for livestock on Grantors'
premises. Go

9. Delivery of this instrument is hereby tendered, and d
O the terms and obligations hereof shall nqt become �y
binding upon the City of Tukwila, as Grantee, unless
and until accepted and approved herein in writing
for the Cit of Tukwila by its Mayor.
