THE GRANTOR, NICK F. HEINZ and FERN LORETTA HEINZ
for and in consideration of Two Hundred, Seventy and 187 Dollars ($270.00)
in hand paid, conveys and warrants to THE CITY OF TUKWILA, the
following described real estate, situated in the County of King,
State of Washington to the same extent and purpose as if the
"pper rights .,herein granted had been acquired by condemnation proceed-
ings under Eminent Domain Statutes of the State of Washington:

The South 5 feet of Lot 1 in Block 7 of Hillman's Seattle Garden
Tracts, as per plat recorded in Volume 11 of plats, page 24, records
of King County, Washington, EXCEPT the West 102 feet thereof; contain-
ing 450 square feet, more or less.
together with the right to make all necessary slopes for cuts and
fills upon the abutting property and on each side of said described
right of way, in conformity with standard plans and specifications
for highway purposes.
It is understood and agreed that the delivery of this Deed
is hereby tendered and that the terms and obligations hereof shall not
become binding upon the City of Tukwila, unless and until accepted and
approved herein in writing for the City of Tukwila by the Mayor.
