Parks Commission: Patricia Cagampang, Position #3; expires 3/31/96 MOVED BY DUFFIE, SECONDED BY HERNANDEZ, TO CONFIRM THE APPOINTMENT OF PATRICIA CAGAMPANG TO POSITION #3 ON THE PARKS COMMISSION. Approval of Vouchers: Nos. 71717 through 72043 in the amount of $738,887.29 Assign $71,606 of 1993 Open Space Bond Interest Revenue to the Interurban Trail Project MOVED BY HERNANDEZ, SECONDED BY MULLET, TO APPROVE THE CONSENT AGENDA AS SUBMITTED. MOTION CARRIED MOVED BY HERNANDEZ, SECONDED BY DUFFIE, TO AWARD A CONTRACT FOR THE ANDOVER PARK WEST OVERLAY PROJECT TO LAKESIDE INDUSTRIES IN THE AMOUNT OF $265,730.30. MOTION CARRIED MOVED BY MULLET, SECONDED BY DERODAS, TO AWARD A CONTRACT FOR THE EAST MARGINAL WAY EMERGENCY SLOUGH REPAIR PROJECT TO C.D. CONSTRUCTION IN THE AMOUNT OF $57,478.00. MOTION CARRIED Councilmember Hernandez voiced concern that repairs to dikes are occurring frequently. She suggested the Council set aside a separate fund to deal with this type of repair. Ross Earnst explained that the Utilities Committee has asked to review the policies dealing with the use of surface water funds. In the past, surface water funds have been used for diking and emergency repairs along the river. It is recommended that the emergency Z4'1 Tukwila City Council Regular Meeting June 20, 1994 Page 3 Bid Awards (con't) PUBLIC HEARING Ord. #1706 Renewing a Moratorium on Specific Development along Hwy 99 slough repair just awarded be funded by the East Marginal Way construction funds because the dike repair will help to protect the roadway. Earnst stated that the City and the Flood Zone Control District are looking at how to fund some of the major repairs they anticipate will occur in the future. Earnst explained that the Corps of Engineers provides a grant for 75 percent funding for the protection of public property, and the project must be considered an emergency. However, since it takes the Corps about a year and a half to get to the work, the City has chosen to do a portion of the work right now. A grant request for the remainder of the work will be forthcoming in the future. Mayor Rants added that he had requested a joint meeting with the Green River Flood Control Zone, King County, and the Corps of Engineers to discuss this issue. Mayor Rants opened the public hearing at 7:59 p.m. and called for public comment. City Attorney Cohen read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO LAND USE AND ZONING IN THE C -2 ZONE ALONG HIGHWAY 99 FROM S. 137TH ST TO S. 154TH ST.; RENEWING A MORATORIUM ON ACCEPTANCE OF APPLICATIONS FOR, AND ISSUANCE OF, NEW BUSINESS LICENSES AND BUILDING PERMITS FOR CERTAIN USES. MOTION CARRIED Ms. Cohen read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING SECTION 2.04.230 OF THE TUKWILA MUNICIPAL CODE, SETTING CITY COUNCIL SALARIES AND COMPENSATION, AND REPEALING ORDINANCE 1102. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT ORDINANCE NO. 1707 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Cohen read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ESTABLISHING RESTRICTIONS ON THE DISCHARGE OF FIREWORKS WITHIN THE CORPORATE LIMITS OF THE CITY OF TUKWILA AND REPEALING ORDINANCE NO. 1666. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT ORDINANCE NO. 1708 BE ADOPTED AS READ.* Ms. Cohen explained that Ordinance No. 1666, passed in 1993, was still valid but the title contained a reference to 1993. For clarification purposes, the new ordinance was brought forward for consideration. *MOTION CARRIED. MOTION CARRIED Cohen read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING THE WASHINGTON MODEL TRAFFIC ORDINANCE (MTO) AS CONTAINED IN THE WASHINGTON ADMINISTRATIVE CODE, CHAPTER 308 -330 WAC, TO REGULATE TRAFFIC IN THE CITY OF TUKWILA AND REPEALING THAT PORTION OF ORDINANCE NO. 1370 CODIFIED AT TMC CHAPTER 9.12 MOVED BY DUFFIE, SECONDED BY MULLET, THAT ORDINANCE NO.1709 BE ADOPTED AS READ. City Attorney Cohen explained that the state chose to reclassify the Model Traffic Ordinance from the RCW to the WAC. The Tukwila ordinance under consideration has been brought forward as a housekeeping action. *MOTION CARRIED. Mayor Rants reported on the AWC conference in Spokane. He distributed printed materials on The Eight Habits of Truly Effective Municipal Leaders and copies of resolutions passed at the conference. Rants suggested that as part of Council's 1995 work plan, a review be done of the zoning code for single family residential and on fire flows to see if the City can promote the in -fill of residential properties. City administrator John McFarland briefed council on the activities at Southcenter of proponents /opponents of Initiative 608 which prohibits the granting of special considerations for homosexuals in the State of Washington.
