EASEMENT (Retaining Wall Encroachment)

THIS Wall Easement, made this day of /1 arc k 2006, between Mr. Lynn H.
Livengood hereinafter called the Grantee; and the CITY OF TUKWILA, a municipal corporation,
hereinafter called the Grantor; WITNESSETH:
That the Grantor, for and in consideration of the sum of One Dollar ($1.00) and other valuable
consideration, receipt of which is hereby acknowledged, hereby conveys and grants to the Grantee, its
successors and assigns, the right, privilege and authority to install, construct, erect, alter, repair, and
maintain building retaining wall encroaching into the South 144 Street right -of -way at a width not
exceeding 6 inches (with the exception of additional allowable width of new siding on wall on top of
retaining wall); ALSO the right, privilege and authority to the Grantee, its successors and assigns, to
install, construct, erect, alter, repair, energize, operate and maintain at the south face of the building on
top of said retaining wall, signing that also encroaches into the South 144 Street right -of -way at a
width not exceeding 8 inches. All such retaining walls and signs are to be located upon, under and
across the following described lands and premises situated in the County of King, State of
Washington, over that property more. particularly described on attached Exhibit titled "S 144th Street
Improvement, True Value Hardware Revised Plan, dated Feb 2006
Together with the right at all times to the Grantee, its successors and assigns, of ingress to and
egress from said lands across adjacent lands of the Grantor for the purpose of installing, constructing,
altering, repairing, and maintaining said retaining wall and signs, and the right at any time to remove
all or any part of said retaining wall and signs from said lands.
The Grantor, heirs, executors, administrators, successors and assigns, hereby covenant and
agree that no structure or fire hazards will be erected or permitted within the above described easement
area without prior written approval from the Grantee, its successors or assigns; that no digging will be
done or permitted within the easement area which will in any manner disturb the facilities or their
solidity or unearth any portion thereof; and that no blasting or discharge of any explosives will be
permitted within fifty (50) feet of said lines and appurtenances.

The rights, title, privileges and authority hereby granted shall continue and be in force until
such time as the Grantee, its successors, assigns shall permanently remove all said electric and system
from said lands or shall permanently abandon said system, at which time all such rights, title,
privileges and authority shall terminate.
Any deed of trust on said premises held by the Beneficiary above named is hereby
subordinated to the extent, but only to the extent necessary, to so subordinate the lien of said deed of
trust to the easement herein granted to the Grantee.
