Muth and Muth, husband and wife, (hereinafter II Muth1) (and B neai Northwest, Inc., a Washington Corporation (hereinafter it Bonsai Northwest ). This Agreement is predicated on the following circumstances: 1. WSDA is authorized under RCW 17.24 and RCW 15.58 to survey for, control and eradicate plant pests. 2. Muth is the o er of certain real property commonly known as 0 - v Washington. Mut operates a cotrmerc a nur©ery on the property known as Bonsai Northwest. 3. In August of 2001 the Citrus Longhorned Beetle (hereinafter SCUM') ) was introduced into the environment from a shipment of maple bonsai trees imported by Muth to the commercial nursery property identified above. 4. As a result, WSDA has commenced a comprehen©ive program to survey for, control and eradicate the CLIMB. Based on recommendations from the Science Advisory Panel convened by WSDA, 3DA intends to cut and remove host trees within 1 /8th of a mile of the site of the introduction. This includes eight host trees on Bonsai Northwest property. S. WSDA and Muth desire to enter into an agreement authorizing WSDA to enter onto the property for the purpose of cutting and removing the host trees at no cost to Muth, and releasing WSDA from any and all liability with respect to the cutting and removal of the trees. WSDA is authorized to enter onto the property described above at reasonable times during day- light hours between the date of this Agreement and June 17, 2002, and to remain thereon, or to leave and return as necessary, to cut and remove eight trees more particularly described on Exhibit gl A , attached hereto and incorporated herein by this reference. 2. WSDA shall give Muth twenty -four hours verbal notice of intent to enter onto the property for the purposes authorized herein. 3. The cutting and removal of the trees shall be completed at the sole cost and expense of WSDA and shall be performed in a professional and workman- like manner consistent with the standards of the tree removal industry. 4. For and in consideration of the covenants and agreements of WSDA set forth herein Muth, Muth's heirs, assigns, or other successors in interest, do hereby release and forever discharge the STATE OF WASHINGTON and the Department of Agriculture and its officers, agents, employees, contractors, agencies and departments from any and all existing and future claims, damages and causes of action of any nature whatsoever arising out of the cutting and removal of said trees and any related work to be performed by WSDA hereunder, except to the extent that said claim arises out of the negligence of WSDA, its officers, agents, employees, contractors in cutting and removing said trees. 5. The parties further represent, warrant and agree that: a. This is a final, conclusive and complete release of all unknown and unanticipated damages arising out of the work to be performed under this Agreement except as specifically set forth in paragraph 4, above.
