Based on information gathered during the site investigation, this Department will NOT approve the installation of the fence in the initial site locations for the following reasons, 1, The initial 7 foot high block fence posts installed at the South end of the lot, have clearly been constructed in the public right of way. The curb to curb street measurement is 28 feet. The South side street right of way for South 141st Street is 48 feet, (see attached map), The subject fence posts are 5 feet from the curb or approximately 19 feet from the center of the street, Therefor, the fence posts with out the benefit of a survey are clearly 4 to 5 feet on to the public right of way, The fence posts are also encroaching within a few inches of the public utility poles, All the installed posts along the South lot side must be immediately removed regardless of the permit application status. 2. Because there are no curbs on the adjoining West street, (33rd Road Place South) an estimated property line could not be accurately determined. It does appear the installed fence posts on the West side, may be on the applicant property as they are approximately 25 feet or greater from the street's paved center line, However, the posts at the South end of the West side also encroach within inches of the existing Fire Hydrant. These posts must be moved a minimum of 3 feet away from the Fire Hydrant as show on the submitted application site plan. 3, The applicant must remove all fence posts as required in items number 1 and 2 above. 4, Submit for a r,r fence permit application with the previously requested details and information from application MI02.078, (Mi02 -078 has expired), Should there be questions on the requirement, please feel free to contact the Building Division office at 206.431 -3670.
