WHEREAS Gateway Building 10, LLC has constructed a transformer
building on certain property located at +9fff5 Gateway Drive, Tukwila,
Washington. 13015
WHEREAS at this address and in the location where Gateway Building
10, LLC has constructed said structure, exists a legal easement belonging to the
City of Tukwila which permits City access to utilities located underground;
WHEREAS Gateway Building 10, LLC recognizes that the City of Tukwila
possesses police powers granted to it by the Washington State Constitution,
Art, XI to regulate its rights of way and to generally provide for the public
health, safety, and welfare, and that the City of Tukwila likewise has the legal
authority to abate any obstructions or encroachments of it rights of ways or
utility easements under RCW 7.48;
WHEREAS Gateway Building 10, LLC recognizes that should the City of
Tukwila at any time desire access to the utility . easement at the location
described above, the City has the authority .to remove any obstructions or
encroachments on the easement and can charge the cost of such removal to the
responsible property owner; and,
WHEREAS Gateway Building 10, LLC recognizes that the City of Tukwila
also has the authority to file a lawsuit requiring removal of an • bstructions or
encroachments on this easement;

Gateway Building 10, LLC agrees to defend, indemnify and hold harmless
the City of Tukwila from any and all claims for damages brought by any party
regarding the Gateway Building 10, LLC structure, it operation, maintenance
and repair of the same, and shall defend, indemnify and hold harmless the City
from all liability for the City of Tukwila's actions taken, if any, to remove the
encroachment or obstruction over the City's utility easement, in the event the
City is required to do so to install, construct, repair or otherwise maintain
utilities within the City's easement area. This indemnification shall include
damages, costs, and attorney's fees.

Dear Mr. Shelton:
As conditions for approval of the design and location of the transformer building at 13075
Gateway Drive, within the existing utility easement, we agree to the following:

-- The design of the building will be modified to include a concrete "utilador ", below
the building, with capacity for at least (3) 15" round utility pipes, plus in addition to the
"utilador ", (3) 8" round steel conduits, also below the building.
-- Should future utility requirements exceed the capacities of the aforementioned
"utilador" and conduits, any additional cost for placement of these utilities due to the location
of the building will be borne by the property owner.
-- We shall indemnify the City of Tukwila for any damage incurred to the transformer
building as a result of installation of utilities either within the aforementioned "utilador" or
conduits, or adjacent to the transformer building, and within the existing utility easement,
-- Should the building ever cease to function as an enclosure for the transformer serving
the building at 13075 Gateway Drive, the property owner will be responsible for removal of
all elements of the building and restoration of the building site to its current condition.
The property owner also agrees to execute a Right of Use Agreement or some similar
document that includes the conditions herein and will be recorded with King County,
Washington.
It is our understanding that this is inclusive of all conditions for approval by the City of
Tukwila, Public Works Dept. Should you have further questions or concerns, please feel free

Minor Modification to L97 -0008 Design Review
Dear Mr. Beaumont:
This letter is in response to your request for changes to the site of the Gateway 10 Building. A
new, larger electrical transformer is required to accommodate the needs of the Electric Lightwave
tenant. You have proposed to enclose the new transformer within concrete block walls that will
be painted to match the building. The landscaping plan should also be, revised: to incorporate
evergreen plant material adjacent to the transformer structure.. Overall I find that the proposed
addition has been made in the least obtrusive manner possible by screening the transformer and
designing the walls to be compatible with the building.
The proposed revisions are within the scope of the Planning Commission approval. In context
with the scale of the development this modification will be considered a minor modification to
the design review approval and therefore approved administratively by this letter. A copy of this
letter and the revised site and building designs will be placed in the design review file, L97 -0008.
It is your responsibility to submit a building permit to cover these changes. If you have any

B. HVAC system work nearly complete. RTU -1 and AC -6 systems not running. They
were in the process of being tested, adjusted and balanced.
C. Provide P -trap at all A/C unit condensate drain connections,
D. HVAC system balancing work was in progress. Balancers on site and active. Verbal
report from the balancer is that ductwork was well constructed and tightly sealed,
minimizing leakage. They did not anticipate having problems getting the systems
adjusted and balanced to specified air quantities.
E. Fire protection system is substantially complete. Fire Department inspector was on
site having the system tested demonstrated.
F. Complete all "Final Closeout" items. See 15010, 3.08.

Dear Mr. Shelton:
As conditions for approval of the design and location of the transformer building at 13075
Gateway Drive, within the existing utility easement, we agree to the following:

-- The design of the building will be modified to include a concrete "utilador ", below
the building, with capacity for at least (3) 15" round utility pipes, plus in addition to the
"utilador ", (3) 8" round steel conduits, also below the building.
-- Should future utility requirements exceed the capacities of the aforementioned
"utilador" and conduits, any additional cost for placement of these utilities due to the location
of the building will be borne by the property owner.
-- We shall indemnify the City of Tukwila for any damage incurred to the transformer
building as a result of installation of utilities either within the aforementioned "utilador" or
conduits, or adjacent to the transformer building, and within the existing utility easement.
-- Should the building ever cease to function as an enclosure for the transformer serving
the building at 13075 Gateway Drive, the property owner will be responsible for removal of
all elements of the building and restoration of the building site to its current condition.
The property owner also agrees to execute a Right of Use Agreement or some similar
document that includes the conditions herein and will be recorded with King County,
Washington.
It is our understanding that this is inclusive of all conditions for approval by the City of
Tukwila, Public Works Dept, Should you have further questions or concerns, please feel free

This letter is to inform you of corrections that must be addressed before your application for
development permit can be approved. All correction requests from each department must be
addressed at the same time and reflected on your drawings. I have enclosed review comments
from the Public Works Department. At this time the Building Division, Fire Department and
Planning Division have no comments regarding your application for permit.
The City requires that four (4) complete sets of revised plans be resubmitted with the appropriate
revision block. If your review does not require revised plans but requires additional reports or
other documentation, please submit four (4) copies of each document.
In order to better expedite your resubmittal a Revision Sheet must accompany every resubmittal. I
have enclosed one for your convenience. Corrections /revisions must be made in person and will
not be accepted through the mail or by a messenger service.
