MOTION CARRIED Tukwila City Council Regular Meeting August 1, 1994 Page 2 CONSENT AGENDA OLD BUSINESS PRD Ordinance Citizen Comment a. Approval of Minutes: 7/11/94 (Sp. Mtg.); 7/18/94 b. Approval of Vouchers: Nos.72512 through 72815 in the amount of $396,873.71 c. Authorize Mayor to sign agreement in the amount of $39,984 with Sargent Engineers for the 51st Ave. S. Bridge PS &E. MOVED BY DUFFIE, SECONDED BY ROBERTSON, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. John McFarland read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NUMBERS 1247, 1289 AND 1599, AS CODIFIED AT TUKWILA MUNICIPAL CODE CHAPTER 18.46, PERTAINING TO PLANNED RESIDENTIAL DEVELOPMENTS, PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. Council determined they needed additional time to review the ordinance. Councilmember Robertson listed several issues needing clarification. Steve Lawrence, 4461 S. 144th St., asked that Council take a close look at TMC 18.46.090, Relationship to Adjacent Areas. Lawrence stated that the terms in this section seemed to protect the public from certain developments that they were not comfortable with, but according to legal experts, were unenforceable in court. He suggested Council develop a statement explaining how the City will determine what is compatible and the process involved in this determination. Council's finding must be supportable in court. Councilmember Robertson suggested including some type of wording that would bring a threshold requirement into play such as "if the site contains sensitive areas and their buffers that exceed percent of the total site area (The actual percentage to be determined by staff.) Robertson also requested the phrase "dwellings that are constructed are harmonious to surrounding residential character and building environment" be added back into the ordinance. Denni Shefrin explained that the city attorney was Tukwila City Council Regular Meeting August 1, 1994 Page 3 Old Business (con't) PRD Ordinance Res. #1302 Transferring Water Utility Assets and Customers to the City very specific about striking that particular language due to its uncertainty and ambiguity. Robertson suggested that density transfer calculations be included for multi family and contains sensitive areas. Shefrin explained that the density transfer formula only pertains to single family development in single family zones. However, a bonus density of 20 percent applies specifically to multi family zones. This increase is based upon five performance standards set forth in the code. Mayor Rants suggested that a land use attorney be present at next week's COW to review the issues prior to the meeting. MOVED BY ROBERTSON, SECONDED BY DUFFIE, TO FORWARD THIS ISSUE TO THE NEXT C.O.W.AND /OR SPECIAL MEETING FOR ADOPTION IN ONE WEEK. MOTION CARRIED. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Administrator John McFarland read A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT FOR TRANSFER OF WATER SYSTEM FACILITIES AND CUSTOMERS FROM THE CITY OF SEATTLE TO THE CITY OF TUKWILA. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT RESOLUTION NO. 1302 BE APPROVED AS READ.* Mayor Rants explained the agreement would not be signed until Seattle has completed their work. Councilmember Robertson said the Utilities Committee agreed with the contract as proposed and that time was of the essence in that bond prices are on the rise. Because of the time constraints, Robertson asked that if any changes were made to the wording in the contract, the entire Council review it rather than sending it back to committee first. *MOTION CARRIED. PENNEY, TRAMMEL CROW (EQUITABLE) AND ROFFE PROPERTY OWNERS. MOTION CARRIED MOVED BY DUFFLE, SECONDED BY EKBERG, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED John McFarland read A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, FIXING THE TIME FOR A PUBLIC HEARING FOR VACATION OF A PORTION OF SOUTH 104TH STREET FROM EAST MARGINAL WAY SOUTH TO APPROXIMATELY 200 PEET EAST. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT RESOLUTION NO. 1303 BE APPROVED AS READ. MOTION CARRIED. MOVED BY HERNANDEZ, SECONDED BY DUFFLE, TO AUTHORIZE THE MAYOR TO ACCEPT RELEASE OF A SLEEVE EASEMENT ON S. 180TH STREET BRIDGE FROM OLYMPIC PIPELINE. MOTION CARRIED Mayor Rants announced he would be on vacation from August 4 to August 22. John McFarland reported the City has sent Firefighters Wes Butler, David Ray, David Ewing and one apparatus to the Lake Chelan area to assist with the forest fires in the area. As an informational item Councilmember Hernandez distributed copies of the Bellevue Parks and Community Services brochure listing the many types of volunteer activities available in Bellevue. Hernandez felt the concept would be of interest to the City.
