A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, ACCEPTING THE DONATION OF CERTAIN REAL
PROPERTY TO THE CITY BY TIMMI I. MARSHALL AND AUTHORIZING
THE MAYOR TO ACCEPT THE DONATION ON BEHALF OF THE CITY.
WHEREAS, Timmi I. Marshall is the Trustee of two parcels of property as fully described
in Exhibit A attached hereto, located within Tukwila, Washington, and desires to donate these
parcels to the City of Tukwila; and
WHEREAS, an environmental assessment of these parcels has been conducted for these
parcels, the results of which revealed no known environmental pollutants; and
WHEREAS, the City's Department of Public Works has identified the properties as
beneficial to the expansion of publicly owned right of way; and
WHEREAS, the City Council has evaluated the benefits to the City of the acquisition of
these parcels and has determined that the acceptance of the donated parcels is in the best
interests of the City;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Council does hereby accept the donation from Timmi I. Marshall of
the parcels shown in Exhibit A.
Section 2. The City Council authorizes the Mayor to execute the appropriate documents
necessary to convey clear title for the parcels shown in Exhibit A to the City.

WHEREAS, "OWNER") is the legal owner of two parcels of real
property in the City of Tukwila bearing the tax identification numbers of 735960- 0870 -06 and
152304- 9053 -09; and,

of Tukwila ("CITY'7; and,
WIMREAS, the CITY desires to accept such parcels contingent on City Council
approval and satisfactory evidence that such parcels are in good condition; and,
WHEREAS, the CITY wishes to conduct a Level One environmental assessment of the
properties to include field visits and possible testing; and,
WHEREAS, both the CITY and OWNER wish to ensure that such testing and field visits
shall not result in claims, expenses, or damages against each other,
NOW, THEREFORE, in mutual consideration of the benefits derived hereto, the CITY
and OWNER do hereby agree as follows:
Section 1•
OWNER agrees to provide access to the CITY to conduct field review and testing on tax lots:
735964 0870 -06 and 152304-9053 -09 in order to conduct a level one environmenw audit and
related field testing on said parcels.
Section 2•
The CITY and OWNER agree to release and hold one another harmless from any action, claims,
liabilities, and damages of any kind whatsoever which may arise from the field testing or
reconnaissance work at the parcels identified in Section 1.
Section 3.
The CITY agrees to restore the properties to their existing condition prior to the conduct of any
testing or field review authorized in Section L; provided. the CITY shall not be required to
restore any vegetation removed during the reasonable pursuit of soils testing and field
investigation_

1 am very interested in donating these two pieces of land to the City of Tukwila. Both
are located on Pacific Hwy South. One is at South 133rd and the other is at South
130th.
My late husband had a billboard business through the `70's. Since then, many
billboards have been taken down and not replaced on my properties. This includes
the two pieces I own in Tukwila.
As they are too small for any development, I am interested in donating these to your
city. From what I have seen in pictures, a little gardening and a park sign would spruce
up the area.
Please let me know your decision at your earliest convenience.

Subject: Proposed Property Donation at
Pacific Highway South and 37 Ave S.
ISSUE:
Accept or refuse proposed donation of two parcels on Pacific Highway South from the
current property owner. (See attached Vicinity Map and Site Map)
BACKGROUND:
The owner of two parcels of property at the corner of Pacific Highway South and 37 Ave
S has offered to donate them to the City. The parcels are too small to develop and the
only adjacent property owner is not interested in acquiring them.
This issue was previously brought to Transportation Committee on January 16 and March
4, 1996. Transportation Committee recommended acceptance of both parcels at March 4
meeting.
Subsequently, GeoEngineers has provided a limited Environmental Site Assessment
report for each parcel. GeoEngineers conclusion, for each parcel, is that the risk of on -site
soil and ground water contamination of regulatory significance is low based on the results
of their study.
ALTERNATIVES:
Accept or refuse donation.
RECOMMENDATION:
Authorize Mayor to accept donation of both parcels. Ve
