Benefited Property. The Parking Easement is for the benefit of all and every portion of other real property owned by Grantor adjacent to the Property and commonly known as the Riverton Terrace Apartments located at 14440 and 14410 41st Avenue South, Tukwila, Washington 98168 and legally described on the attached Exhibit B "Benefited Property 2. Purpose and Scobe of Parkin Easement. The Parking Easement is for the following purposes: eighteen (18) contiguous permanent full size (i.e., not compact) parking spaces "Parking Spaces located on the Property for the exclusive use of the Benefited Property together with nonexclusive rights of ingress and egress over the Property to provide pedestrian and vehicular access to the Parking Spaces to and from the Benefited Property and any public rights of way, and for ancillary purposes including, but not limited to parking signage. 3. Location of Parking Spaces. Pedestrian Access and Sianave. The Parking Spaces shall be located together on the Property in an area in close proximity to the Benefited Property. The Parking Spaces are presently located approximately as shown on the sketch attached as Exhibit C. The CM owner of the Property may relocate the Parking Spaces on the Property upon C", reasonable written notice to the owner of the Benefited Property so long as o use of the Parking Spaces for the benefit of the Benefited Property is not materially impaired by the relocation. Pedestrian access over the Property to the Parking Spaces shall be located and configured in such a manner as to be reasonably suitable for use by elderly people. Signage shall be installed in the vicinity of the Parking Spaces indicating that the Parking Spaces are for the exclusive use of the tenants and invitees of the Benefited Property. 4. Maintenance of Parkine Easement Area. The Parking Spaces and all other portions of the Property subject to this Parking Easement shall be maintained at the sole expense of the owner of the Property and at no expense to the Benefited Property or the owners and tenants of the Benefited Property. The Parking Spaces and all other portions of the Property subject to this Parking Easement shall be maintained in a condition at least as good as its existing condition and in a condition reasonably adequate for use of the Parking Spaces for parking purposes. The owner of the Benefited Property STATUTORY WARRANTY DEED TO TUKWILA PAGE 3 shall maintain related parking signage and may repair, modify and replace such signage. 5. Reservation of Easement. Grantor is the owner of the Benefited Property and is reserving this Parking Easement for the benefit of the Benefited Property in connection with and because of Grantor's conveyance of the Property to Grantee. 6. Covenant Running with Land. This Parking Easement and all the covenants and agreements herein shall run with the land and be binding on and inure to the benefit of all future owners of the Property and the Benefited Property.
