Additional Legal Description is on Page 1 of deed Assessor's Tax Parcel Number: none available public road QUITCLAIM DEED O� t0 IN THE MATTER OF SR 405, Green River Interchange; O O KNOW ALL MEN BY THESE PRESENTS, that the STATE OF WASHINGTON, for and in accordance with that Agreement of the parties entitled TB 1 -0073, dated the 26" day of C April, 1993, hereby conveys and quitclaims unto the CITY OF TUKWILA, a municipal 7-1 corporation in the State of Washington, all right, title, and interest under the jurisdiction of the O Department of Transportation, in and to the following described real property situated in King County, State of Washington: All those parts of Sections 23 and 24, Township 23 North, Range 4 East, W.M., shown hachured on Exhibit "A" attached hereto and made a part hereof. The specific details concerning all of which may be found on sheet 2 of that certain plan entitled SR 405, Green River Interchange, now of record and on file in the office of the Secretary of Transportation at Olympia, Washington, bearing date of approval December 18, 1992, revised to June 20, 1997. It is understood and agreed that the above referenced property is transferred for road /street purposes only, and no other use shall be made of said property without obtaining prior written approval of the grantor. It is also understood and agreed that the grantee, its successors or assigns, shall not revise either the right of way lines or the access control without prior written approval from the grantor, its successors or assigns. Revenues resulting from any vacation, sale, or rental of this property, or any portion thereof, shall: (1) if the property is disposed of to a governmental entity for public use, be placed in the grantee's road /street fund and used exclusively for road/street purposes; or (2) if the property is disposed of other than as provided in (1) above, be shared by the grantee and grantor, their successors or assigns in the same proportion as acquisition costs were shared, except that the grantee may deduct the documented directs costs of any such vacation, sale, or rental. Page 1 of 3 Pages TB 1 -0073 The grantee herein, its successor or assigns, shall not have the right of ingress and egress to, from, and between said SR 405, and the lands herein conveyed and will maintain the control of ingress and egress to, from and between the lands herein conveyed and the lands adjacent thereto, as indicated by the prohibition of access symbol appearing on said Exhibit "A nor shall the grantee herein, its successors or assigns, be entitled to compensation for any loss of light, view and air occasioned by the location, construction, maintenance or operation of said Highway. EXCEPT that said grantee, its successors or assigns, shall have reasonable ingress and egress, to, from, and between the lands herein conveyed and said Highway via grade intersections thereto and at those points and under those conditions allowed by access notes and approach schedule, all as shown or noted on said Exhibit "A The grantee also agrees to maintain and reconstruct the portions of the pedestrian and bicycle trial within the highway right of way as shown on said Exhibit "A Except for snow and O ice removal, maintenance and reconstruction of the separation structures shall be the CC responsibility of the grantor.
