TUKWILA CITY COUNCIL
CALL TO ORDER Mayor Rants called the Special Meeting to order and led the
audience in the Pledge of Allegiance.

CITIZEN'S COMMENTS Roger Baker, 11662 42nd Avenue South, thanked the City, Parks
Department and all those involved in the dedication of the maze,
park, and the memorial to his grandmother that was
commemorated in a ceremony at the Duwamish Park this past
Saturday. His family is very please and honored that the City
recognized the contribution his family made as early pioneers in
this City.
BID AWARD Ross Earnst, Public Works, explained that Metro's contractor will
install waterline using materials provided by the City with the
sewer construction on 43rd Avenue South, South 122nd Street, and
44th Avenue South. The material list was advertised and bids
received. Earnst recommended the contract be awarded to Western
Utilities Supply in the amount of $30,983.46.

PUBLIC HEARING
Legislative: an ordinance
renewing a moratorium along
Hwy 99
Mayor Rants opened the public hearing at 7:10 p.m.
Rick Beeler, DCD, explained that the ordinance is to extend a
moratorium on specific developments along Highway 99 because
the current ordinance expires December 20, 1994.
Council President Mullet inquired as to how many more times will
this ordinance require extending.
Beeler responding that the development regulations are currently
being discussed. However, after the discussions have taken place,
it will be up to the Planning Commission to review. Beeler
anticipates this issue going before the Planning Commission
around the latter part of June 1995. He said this doesn't prohibit
the moratorium from being discussed sooner, though, as a separate
issue.
Dwight L. McClean, 13015 38th Avenue South, distributed copies
of a letter he had drafted to all those concerned. The letter, in
summary, stated that the emergency moratorium has created a state
of emergency along the Pacific Corridor. Tukwila has made it
possible for the rest of the state and nation to see it's dirty laundry
exposed on camera. Will the City continue to blindly support a
moratorium that maintains this status quo. Is the City really
concerned about the children who reside in this high crime
community. Please revise the moratorium and allow current
business to invest, upgrade, remodel, or tear down and replace
these structures which attract the maggots of society. (A copy of
the letter in its full contents is on file in the City Clerk's office.)
Win Fan Lin, dba/Econolodge, 13910 Pacific Hwy South,
commented that by not issuing building permits for the buildings
along Hwy 99, it only worsens the situation. The ordinance is self
defeating.
Anna Bernhard, 14241 59th Avenue South, urged the Council to
extend the moratorium because she believes if the moratorium is
lifted, the whole area will deteriorate.

Rants briefed the Council that the Tukwila Tomorrow Committee's
aim is to focus on urban revitalization along Hwy 99. A contract
has been drafted to have a consultant review this issue and a design
report will be analyzed by the Hwy 99 Task Force.

City Attorney Linda Cohen read an ordinance of the City Council
of the City of Tukwila, Washington, relating to land use and
zoning in the C -2 Zone along Highway 99 from South 137th to
South 154th Street; renewing a moratorium on acceptance of
applications for, and issuance of, new business licenses and
building permits for certain uses.
Councilmember Robertson clarified that though the Tukwila
Tomorrow Committee's report is an exemplary one; it is not the
official City position. The process goes as follows: The citizens'
group (Tukwila Tomorrow Committee) prepared a
recommendation that went to the Planning Commission. The
Planning Commission is holding public hearings and discussing
the issue. The Planning Commission will in turn prepare a
recommendation that will come to the Council. The Council will
then debate the issue, take more public input and finally establish a
City position on land use issues based on the Comp Plan, the new
Zoning Map and on some Zoning Code changes. Robertson said
the moratorium is something the Council believes is necessary to
ensure that we don't continue to see the kinds of developments on
Hwy 99 that have been occurring in the past; and that is believed to
have contributed to some of the problems we're currently
experiencing.

Councilmember Hernandez said it appears that the comments that
have been made tonight on this issue favor neighborhood
livability; there were only some disagreement about what was the

best method to preserve it. She said in her opinion the
continuation of the moratorium is the best way to do this because it
would allow for time to weigh a recommendation from the Task
Force. This should result in an upgrade of the businesses that are
there and any others that continue to relocate there. The
moratorium does have a waiver process for those who feel it is a
hardship.

Alan Doerschel, Finance, briefed the Council that estimated
property tax revenues for 1995 are due to County Assessor's by
December 14, 1994. The actual County worksheet will not be
available until later. Adjustments to this ordinance will be made at
that time. He said we have learned that the City will be impacted
in 1995 with the fall in property values. The decline in assessed
valuation from 1994 is $114 million. Although we received $41
million from the Oxbow annexation and $20 million in new
construction valuation, the decline in base valuation will not allow
the 6% increase in tax collections for 1995. This will result in a
reduction of $452,000 in the anticipated revenues reflected in the
Proposed 1995 Budget and a resulting decrease in the six -year
planning model. The model has already been adjusted to reflect
lowered property tax expectations for the years 1996 through 2000.

City Attorney Cohen read an ordinance of the City of Tukwila,
Washington, levying the General Taxes for the City of Tukwila in
King County for the fiscal year commencing January 1, 1995, on
all property, both real and personal, in said City which is subject to
taxation for the purpose of paying sufficient revenue to carry on
the several departments of said City for the ensuing year as
required by law.

Doerschel recommended that the estimated assessed valuation in
Section 1 of the ordinance be changed from $2,464,000.000 to
$2.472.897.974: the rate per 1.000 be 3.18000: and the amount
changed to $7.863.000 for the Regular Levv and 145.000 for
the Special Tax Levv (golf course bonds): for a total of
$8.008.000.

Lynn Devoir, Parks Department, reviewed the additional changes
that had been made to the contract since the last Council meeting
where the Council authorized the Mayor to negotiate the agreement
with Terry Elliott.

AMEND THE FOURTH PARAGRAPH ON PAGE 5 OF THE
AGREEMENT, UNDER EOUIPMENT- -The second sentence.
delete the words "notice to" and add the words "approval
of." Thus, the sentence should read: "No other leased eauinment
of furnishings shall be provided by the Concessionaire without
prior approval of the City." MOTION CARRIED.

City Attorney Cohen read a resolution of the City of Tukwila,
Washington, granting a wage adjustment to non represented
employees of the City, and amending the non represented
employees salary schedule contained in appendix "A" of
Resolution 1287.

City Attorney Cohen read an ordinance of the City of Tukwila,
Washington, amending section 2.08.010 of the Tukwila Municipal
Code to fix the compensation of the Mayor; repealing ordinance
1682; providing for severability; and setting an effective date.

Councilmember Robertson questioned the Mayor's benefits of
medical, dental and pension, which amount to about $1,667 per
year. Robertson thinks this figure is too low. The Administration
will check into the issue to see if this is an error.

Rick Beeler, DCD, explained that as part of Tukwila's
comprehensive plan preparation process, an environmental impact
statement is required prior to City Council action; and, non -urban
center alternatives are needed for Tukwila Tomorrow Committee
review of the Southcenter business district. The department
solicited consultant services to assist in preparing these documents.

required $83,968 fee has already been budgeted.
After a brief discussion, the Council agreed to authorize approval.
