MINUTES REGULAR MEETING CALL TO ORDER /PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:04 p.m. and led the audience in the Pledge of Allegiance. CITY OFFICIALS Jim Haggerton, Mayor; Steve Lancaster, City Administrator; Shelley Kerslake, City Attorney; Bob Giberson, Public Works Director; Shawn Hunstock, Finance Director; Peggy McCarthy, Deputy Finance Director; Mike Villa, Interim Police Chief; Don Tomaso, Fire Marshal; Melissa Hart, Deputy City Clerk. ROLL CALL Melissa Hart, Deputy City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Joan Hernandez, Allan Ekberg, Council President, Dennis Robertson, Verna Seal, Kathy Hougardy, and De'Sean Quinn. AMEND AGENDA MOVED BY EKBERG, SECONDED BY HOUGARDY TO AMEND THE AGENDA TO ADD A PROCLAMATION FOR PEACE OFFICERS' MEMORIAL DAY AS THE FIRST ITEM UNDER PROCLAMATIONS /APPOINTMENTS AS ITEM #3 -A. MOTION CARRIED 7 -0. SPECIAL PRESENTATIONS Mayor Haggerton announced on April 18, 2011, the Tukwila City Council adopted Resolution No. 1738 establishing the date for an election on the question of the formation of a Tukwila Pool Metropolitan Park District. Pro and Con Committees are being formed at this time. The committees will submit statements in favor of and in opposition to the ballot measure, as well as the rebuttal statement, for the local voters' pamphlet. The committees are responsible for following all guidelines and submitting information to King County Elections. Anyone interested in being on either of the committees should contact the City Clerk's Office no later than 4:00 p.m. on May 18, 2011. a. The Future of Agriculture in King County Bob Tidball, King County Agriculture Commissioner, introduced King County Agriculture Commissioner Ben Kodama, and explained that there are approximately 43,000 acres of zoned agriculture land in King County. The agriculture areas within King County are located in Sammamish, Snoqualmie, Lower Green (between the cities of Kent and Auburn), Upper Green and Enumclaw. These areas are called Agriculture Production Districts (APDs). Mr. Tidball stated that has a small farm in the Lower Green APD. Mr. Tidball utilized a PowerPoint presentation on the following. Value of King County Agriculture: Ranked 13 in the State for agriculture production The number of farms has decreased. Local farmers today grow major crops that are sold in local grocery stores, livestock, specialty products, flowers, Asian vegetables, berries and grass -fed animals. Local farmers grow crops for consumption and also create local jobs. Neighborhood revitalization: Farmers Markets generate $15 -$25 million in annual sales; they attract people and create a sense of community. Agricultural farms provide environmental benefits by reducing climate impact from our food system. Tukwila City Council Regular Meeting Minutes May 16, 2011 Page 2 of 6 Lower Green APD consists of 1,403 acres and is home to a large vegetable grower that supplies local supermarkets and a large dairy operation that still provides home delivery Shared floodplain management: The preserved farmland needs to be protected and the current stormwater practices are inadequate. Irrigation for crops: The Agricultural Commission was recently briefed on the possible use of reclaimed water. King County agriculture production districts need continued support services from local cities including: Support for permitting and development issues Monitoring farmlands for growth impacts Marketing support Water supply and flood protection Advocacy for farm friendly land use policies and development regulations Public education on agriculture and the environment Cost sharing to meet the environmental regulations Access to affordable land Mr. Tidball stated the King County Agriculture Commission needs assistance from local jurisdictions. He urged the Council to be part of the local roundtable meetings, participate in a local farm tour, continue support of county -wide planning policies that help agriculture grow and thrive, and promote environmental enhancements that benefit the local farms as well as fish. He also asked for any volunteer groups that are interested in helping the Commission with projects to remove invasive plants from the creeks, culverts and drainage ditches. Councilmember Robertson stated he is the City's Water Resource Inventory Area 9 (WRIA9) representative, and he will report on this information at the next meeting. Mayor Haggerton explained Tukwila is also involved with the Suburban Cities Association, King County Flood Control Zone District, U.S. Army Corps of Engineers and the Federal Emergency Management Agency (FEMA) relating to levee certification. He conveyed that as part of the Tukwila South development agreement, the project will include a 7 -acre fish habitat for salmon. The Councilmembers asked questions regarding various parts of the presentation and thanked Mr. Tidball for the information that was presented. b. Financial Status Report on 4th Quarter 2010. Shawn Hunstock, Finance Director, and Peggy McCarthy, Deputy Finance Director, provided an overview of the 2010 4 th Quarter Financial Report. Ms. McCarthy utilized a PowerPoint presentation to provide statistics and information regarding the financial status of the City for the quarter ending on December 31, 2010. City -wide unreserved fund balances increased $7.4 million in 2010 from $41.7 million at December 31, 2009 to $49.1 million at December 31, 2010. The governmental funds contributed $4.9 million to the increase, the internal service funds contributed $1.5 million, and the enterprise funds contributed $1 million to the increase. Property tax revenue collected in 2010 exceeded budget by $107,942 or 0.83% and totaled almost $1 million more than collected in 2009. Several other revenue line items exceeded budget at December 31, 2010, including admissions tax and utility taxes. Revenues associated with plan check and other fees also increased in 2010. The General Fund experienced a $1.7 million decline in fund balance in 2010 primarily due to a decline in sales tax revenue. However, the past 5 consecutive months have seen an increase in sales tax collections compared to the same period from 2009. The City was also able to control expenditures, staying within or below budget partially by departmental reductions and not filling staffing vacancies. Tukwila City Council Regular Meeting Minutes May 16, 2011 Page 3 of 6 Councilmember Robertson asked clarifying questions regarding the differences between the adjusted fund balance and the actual balance and also requested that departmental budget lines "49 Miscellaneous" dollar amounts be reduced, and that the line item include detailed information about those expenses. He also suggested the Council review the Golf Course 411 Fund, page 32 of the agenda packet, either at the committee level or at a future Committee of the Whole meeting. In his view, the Council and Administration should conduct a thorough review of the current operations of the Golf Course in order to address the issues and brainstorm possible solutions for the areas of concern. Mr. Hunstock explained that staff is currently working on establishing a Request for Proposals document to seek candidates to create a business plan relating to revenues and expenses for the Golf Course and to address whether the City should continue operating the Golf Course. Councilmember Robertson indicated that a review of the Golf Course operations at the Council level would still be appropriate, and Councilmember Hougardy, as Chair of the Finance and Safety Committee, concurred. Mayor Haggerton asked Council President Ekberg to poll the Councilmembers to determine the best method to address Councilmember Robertson's questions and concerns to ensure there is Council consensus to pursue the referenced issues. The Councilmembers thanked Ms. McCarthy and Mr. Hunstock for the update on the City's financial status. PROCLAMATIONS /APPOINTMENTS a. A proclamation recognizing Peace Officers' Memorial Day per agenda amendment on Page 1. Mayor Haggerton read a proclamation designating May 17, 2011 as Peace Officers' Memorial Day and presented the proclamation to Mike Villa, Interim Police Chief. He announced the Peace Officers' Memorial ceremony will be held May 17, 2011 at the City Hall flag pole. Chief Villa thanked Mayor Haggerton, City Administration and the City Council for acknowledging the officers of the Tukwila Police Department. b. A proclamation recognizing National Public Works Week. Mayor Haggerton read a proclamation recognizing May 15 through May 21, 2011 as National Public Works Week, inviting all citizens to acquaint themselves with the challenges confronted in the provision of public works services in the community. Mayor Haggerton presented the proclamation to Bob Giberson, Public Works Director. c. Appointments to Boards and Commissions. Civil Service Commission Confirm the appointment of Ronald Johnston to Position #2 on the Civil Service Commission with a term expiring 12/31/2011. MOVED BY SEAL, SECONDED BY HOUGARDY TO CONFIRM THE APPOINTMENT OF RONALD JOHNSTON TO POSITION #2 ON THE CIVIL SERVICE COMMISSION, WITH A TERM EXPIRING 12/31/2011. MOTION CARRIED 7 -0. The Councilmembers thanked Mr. Johnston for his willingness to serve the community. MOVED BY HERNANDEZ, SECONDED BY QUINN TO CONFIRM THE REAPPOINTMENT OF SHARON KIDD TO POSITION #5 ON THE HUMAN SERVICES ADVISORY BOARD, WITH A TERM EXPIRING 4/30/2014. MOTION CARRIED 7 -0. Sharon Kidd expressed her appreciation for the difficult work that is done by the City Council. The Councilmembers thanked Ms. Kidd for her continued service to the community. Confirm the reappointment of Linda Weedman to Position #6 on the Human Services Advisory Board with a term expiring 4/30/2014. MOVED BY HOUGARDY, SECONDED BY DUFFIE TO CONFIRM THE REAPPOINTMENT OF LINDA WEEDMAN TO POSITION #6 ON THE HUMAN SERVICES ADVISORY BOARD, WITH A TERM EXPIRING 4/30/2014. MOTION CARRIED 7 -0. The Councilmembers thanked Ms. Weedman for her continued service to the community. CITIZEN COMMENTS Jared Strand, 10224 Beacon Avenue South, asked the Council to consider amending Tukwila Municipal Code Section 7.08 relating to chickens on properties within the City that are less than 10,000 square feet. Tukwila's code relating to chickens has not been updated since 1956. Mr. Strand referenced several other cities that have recently revised their codes to allow chickens, to exclude roosters, in the urban areas of the cities. His family members are urban farmers, and they would like to continue this practice with chickens. Councilmember Seal requested this item be forwarded to the Community Affairs and Parks Committee to review the 55- year -old regulation. Joanne McManus, 5610 South 133` Street, explained there are several wild rabbits throughout her neighborhood. She feels this has become a problem because individuals free the rabbits when they start growing up after Easter. CONSENT AGENDA a. Approval of Minutes: 5/02/11 (Regular) b. Approval of Vouchers: #357370 357463 and #110400 110501 in the amount of $3,460,752.24. c. Accept as complete the Andover Park West Emergency Sewer and Water Line Repair project (Contract #11 -033) with SCI Infrastructure LLC and authorize release of retainage, subject to the standard claim and lien release procedures (final cost of project, including retainage is $363,700.53). MOVED BY DUFFIE, SECONDED BY HERNANDEZ THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED. MOTION CARRIED 7 -0. UNFINISHED BUSINESS a. Authorize the Mayor to sign an application for Community Development Block Grant (CDBG) funds for the 2012 Minor Home Repair Program to serve the cities of Tukwila, SeaTac, Des Moines, Covington, and Pacific in the amount of $125,000.00. MOVED BY SEAL, SECONDED BY EKBERG TO AUTHORIZE THE MAYOR TO SIGN AN APPLICATION FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS FOR THE 2012 MINOR HOME REPAIR PROGRAM TO SERVE THE CITIES OF TUKWILA, SEATAC, DES MOINES, COVINGTON, AND PACIFIC IN THE AMOUNT OF $125,000.00. Authorize the Mayor to provide written assurance that the lease for the Way Back Inn will be for a 10 -year term contingent on receipt of a grant from the Boeing Employees Community Fund and authorizing the Mayor to sign the 10 -year lease contingent on receipt of the grant. MOVED BY SEAL, SECONDED BY DUFFIE TO AUTHORIZE THE MAYOR TO PROVIDE WRITTEN ASSURANCE THAT THE LEASE FOR THE WAY BACK INN WILL BE FOR A 10 -YEAR TERM CONTINGENT ON RECEIPT OF A GRANT FROM THE BOEING EMPLOYEES COMMUNITY FUND AND AUTHORIZING THE MAYOR TO SIGN THE 10 -YEAR LEASE CONTINGENT ON RECEIPT OF THE GRANT. MOTION CARRIED 7 -0. c. A resolution opposing federal preemption of local land use authority related to railroads and urging the United States Congress to clarify its intent regarding local authority. MOVED BY SEAL, SECONDED BY DUFFIE THAT THE PROPOSED RESOLUTION BE READ IN ITS ENTIRETY. MOTION CARRIED 7 -0. Melissa Hart, Deputy City Clerk, read the proposed resolution in its entirety. Pam Linder, 11918 Interurban Place South, thanked the Mayor, City Administration and Council on behalf of the residents of the Allentown, Duwamish and Foster Point neighborhoods for their assistance with this issue. Mayor Haggerton announced that today he received a response to his May 4, 2011 letter from Burlington Northern Santa Fe Railway. He explained that a copy of the letter was distributed to the Council. MOVED BY SEAL, SECONDED BY HERNANDEZ THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. MOTION CARRIED 7 -0 TO ADOPT RESOLUTION NUMBER 1741. REPORTS a. Mayor Mayor Haggerton attended the May 10, 2011 retirement celebration for Tukwila Police Officer Gerry Myklebust. On May 11, 2011 he attended the Suburban Cities Association Public Issues Committee (PIC) meeting. The PIC discussed the King County Metro Strategic Plan and the King County Flood Control Advisory Committee recommendation relating to the accreditation and certification of levees. He attended the May 12, 2011 Cascade Land Conservancy Awards breakfast meeting, which included a slideshow presentation including the St. Thomas public garden, and later that day he participated in the Audit Entrance Conference. On May 13, 2011 he participated in the Southwest King County Chamber of Commerce Annual Mayors' Panel Luncheon. This event included the Mayors from Tukwila, Burien and SeaTac. On May 14, 2011 he attended the Backyard Wildlife Festival and on May 16, 2011 the Southcenter Rotary Club lunch meeting where Congressman Adam Smith was the guest speaker. b. City Council Councilmember Duffie attended the Backyard Wildlife Festival on May 14, 2011. Councilmember Hernandez attended the retirement celebration for Officer Gerry Myklebust on May 10, 2011. On May 11, 2011 she participated in the Shoreline Master Program Council work session. She also attended the May 13, 2011 Southwest King County Chamber of Commerce Annual Mayors' Panel Luncheon. Council President Ekberg attended the Backyard Wildlife Festival on May 14, 2011. Councilmember Robertson attended the most recent Water Resource Inventory Area 9 (WRIA9) meeting. Councilmember Hougardy attended the May 13, 2011 Southwest King County Chamber of Commerce Annual Mayors' Panel Luncheon, and the Backyard Wildlife Festival on May 14, 2011. Staff Steve Lancaster, City Administrator, updated the Council on the code enforcement issue relating to the boat that had partially sunk in the Duwamish River. The vessel has been removed from the Duwamish River, and 90% of the costs associated with the removal of the vessel have been reimbursed to the City by the state. d. City Attorney There was no report. e. Intergovernmental The Council Analyst is not required to attend Regular Meetings. MISCELLANEOUS Council President Ekberg explained he was recently contacted by the Tukwila School Board President about the 2011 Joint City Council Tukwila School Board meeting. He explained the City Council will be the host, and he will be working with the Council Analyst on the scheduling for the meeting.
