Per our September 1, 2000 letter to you, your Subdivision application has been deemed to be incomplete. If
we do not receive the items required in our June 7, 2000 letter on or before January 8, 2001, your
Subdivision application will expire and your associated SEPA application must be withdrawn. No additional
extensions will be granted to your Subdivision application.
As you have been advised, any public street providing access through the site must be 100% dedicated to
the City of Tukwila. Your current proposal for a cul -de -sac is not acceptable as it is dependent upon an
easement across land owned by Seattle City Light.
You have indicated that given this access problem, your engineer may submit an alternative proposal. If your
existing proposal is reconfigured to create 9 or fewer lots, you must re -apply as the proposal can no longer
be processed as a subdivision. Additionally, if your proposal for 10 or more lots contains significant revisions
or alterations you may have to re- apply.
At such time as an alternative proposal has been developed, please have your engineer contact me to

Please be advised that your written request to extend the expiration date of your Subdivision application from
September 7, 2000 to January 8, 2001 has been approved by Jack Pace, Planning Manager. As we have
advised you, your Subdivision application has been deemed to be incomplete. If we do not receive the items

I am surprised to find out that my application for subdivision
submitted on May 19, 2000 is expiring on September 7, 2000. I
would like to ask you for an extension for 120 more days so that I
would have more time to work on the right of way easement with
Seattle City Light. I understand that it is a very big challenge to
get the dedication of the right of way to the City of Tukwila. If my
negotiation with Seattle City Light is not very productive in the
days ahead, I may need to work with my engineer to re- configure
the lots so as to avoid the need of an access easement with Seattle
City Light.

We have received and reviewed your documentation for the above - referenced
applications, submitted to us on May 19, 2000. Your SEPA and Subdivision
Preliminary Plat applications have been consolidated. This means that both
applications are being processed together because they are related to the same
project. We have the following comments.
Your applications have been found to be incomplete. In order to continue
processing your applications there are additional items that must be submitted to
the Department of Community Development. These items are listed below. For
your reference, we are enclosing a copy of Tukwila's Title 17, Subdivisions &
Plats and Chapter 18.54 Tree Regulations.
Subdivision Preliminary Plat Application:
1. The survey of the preliminary plat shall include the following (per TMC
17.04.060):
a. A statement to be signed by the Public Works Director approving
the survey data, the layout of the streets, alleys and other rights -of-
way, design of bridges, sewage and water systems, drainage
systems and other structures.

b. A certificate bearing the printed names of all persons having an
interest in the subdivided land, signed by the persons and
acknowledged by them before a notary public, consenting to the
subdivision of the land and reciting a dedication by them of all land
shown on the plat to be dedicated for public uses, and a waiver by
them and their successors of all claims for damages' against any
governmental authority arising from the construction and
maintenance of public facilities and public property within the
subdivision.
c. Certification from the King County Treasurer that all taxes and
assessments for which the property may be liable have been duly
paid, satisfied or discharged as of the date of certification.
d. Certification of examination and approval by the County Assessor.
e. Recording Certificate for completion by the King County
Departments of Records and Elections.
f. City of Tukwila Finance Director Certificate that states there are no
delinquent special assessments, and that all special assessments
on any of the property that is dedicated as streets, alleys or for
other public use are paid in full at the date of certification.
g.
Certification by the Public Works Director that the subdivider has
complied with one of the following:
i) All improvements have been installed in accordance with the
requirements of this title and with the preliminary plat
approval, and that original and reproducible mylar or
electronic records in a format approved by Public Works and
meeting current Public Works drawing standards for road,
utility and drainage construction plans certified by the
designing engineer as being "as constructed" have been
submitted for city records.
ii) An agreement and bond or other financial security has been
executed in accordance with TMC 17.24.030 sufficient to
assure completion of required improvements and
construction plans.

h. Certificate of approval to be signed by the Mayor and City Clerk.
i. Sheet 2 of 2 contains the stamp of Enayat S. Aziz. However the
stamp shows an expired date of December 24, 1998. Please
revise with an updated stamp.
2. The site and development plans shall provide the following information per
TMC 17.14.020:
a.
Owners of adjacent land and the names of any adjacent
subdivisions.
b. Lot lines for neighboring properties shall be shown for 300 feet
from the site's property lines (including right -of- ways).
c. Location, dimension and purposed of existing and proposed
easements. Provide copies of the three recorded documents
referenced as Items 4, 5 and 6 on page 5 of the Fidelity National
Title Report, Order No. 0284583, dated April 27, 2000 (copy
attached).
d. Location of all sensitive areas and sensitive area buffers (slopes
20% or greater, wetlands or watercourses) on the site. If all or part
of the buffer of the wetland (which is located on the adjacent parcel
to the south) is located on the subject property, it must be shown
.on the site and development plans.
e. Expected location of new buildings, their driveways and finished
floor elevations. Given the configurations of the proposed lots, the
probable location of structures will be important.
3. Three copies of a landscape planting plan by a Washington State licensed
landscape architect. One set of all plans and analyses shall have an
original ASLA stamp and signature. The planting plan shall contain the
following:
a. One tree in the front yard of each lot to create a uniform
streetscape (per TMC 17.20.030(G)).

b. The planting plan shall include a retention /removal plan for
the preservation of significant trees and vegetation (caliper
over 4 inches) located within sensitive areas (slopes 20% or
greater, wetlands or watercourses) and sensitive area
buffers (per TMC 17.14.20(B)(k) and (o).
c. The planting plan shall include diameter, species name,
spacing and location of trees /vegetation to be retained or
used to replace vegetation cleared (per TMC 18.54.080(2).
d. Each existing significant tree removed shall be replaced with
new tree(s), based on the size of the existing tree as shown
in TMC 18.54.130(3)(b) attached.
PLEASE NOTE: A tree clearing permit will be required prior to the
issuance of any land altering permit and the clearing of any
vegetation in sensitive areas. The tree permit will be subject to the
conditions set forth in TMC Chapter 18.54 (attached).
SEPA Application:
4. Your SEPA application appears to be complete at this time. Due to the
consolidation of your applications, a Letter of Completeness for the SEPA
application will be issued after the deficiencies in the Subdivision
Preliminary Plat have been satisfied (see Items 1 through 3 above).
Should changes occur in the design of the subdivision preliminary plat
proposal, these changes will need to be reflected in your SEPA checklist.
Additional Comments:
Upon receipt and approval of Items 1 through 3 above, both applications will be
deemed "complete" and the City will commence technical review. However,
these applications will expire if we do not receive the requested items within 90
days of this letter's date '(September 7, 2000), unless an extension is granted
pursuant to Section 18.104.070(E) of the Tukwila Municipal Code.
As a courtesy, we are providing you with the following information. The items
listed below are not required at this time. However, during the technical review
phase, the following will be required:

5. A tree clearing permit will be required prior to the issuance of any land
altering permit and the clearing of any vegetation in sensitive areas. The
tree permit will be subject to the conditions set forth in TMC Chapter 18.54
(attached).
6. A wetland consultant will be required to assess the impacts of off -site road
improvements (along 47th Avenue South). Possible on -site wetland
impacts, if any, must also be identified and addressed.
7. The Public Works Department will require a peer review of the
geotechnical study you submitted on May 19, 2000.
8. Any public street providing access through the site must be 100%
dedicated to the City of Tukwila. The proposed cul -de -sac is not
acceptable as it is dependent upon an easement across land owned by
Seattle City Light.
9. Based on staff observations at the site, the survey appears to be
generated from aerial photos. If the survey is, in fact, based upon aerial
photos, an "on- the - ground" survey will be required, meeting all of the
criteria provided in Items 1 and 2 above.
