We have reviewed the checklist and have the following comments: • Any contractor demolishing or constructing buildings or other structures, foundations, etc., is subject to the State regulatory requirements of designation and appropriate management of any hazardous wastes generated as a result of such work. • Hazardous wastes generated through the use, maintenance, or repair of any construction equipment, vehicles, earth working equipment, paving equipment, etc., are subject to the same regulatory requirements for appropriate management. • Proper steps to mitigate soil contamination and/or cleanup of contaminated soils are required. • Issues of hazardous waste designation, storage, management, and proper disposal should be addressed as a result of the work proposed in this checklist. A Hazardous Waste permit is not required of this project unless dangerous waste will be received, treated, stored for greater then ninety (90) days, or disposed on site. "Ecology suggests, but does not require, that a copy of this letter be attached to any building/demolition permit for this project." Corrective action at former Tosco Site No. 256237 has been conducted as an Independent Action pursuant to Washington Department of Ecology (Ecology) rules and regulations, and specifically, in accordance with the state Model Toxics Control Act. The site has been assigned the following identifiers by Ecology: Site ID Number 8502 Release ID Number 1459 The status of the site cleanup is listed in Ecology's LUST database as "cleanup started ". To our knowledge, Ecology has not assigned a Department project manager for this cleanup. The following is a brief summary of the site assessment and cleanup history: Underground storage tanks were replaced in 1989, at which time approximately 700 cu yds. of contaminated soil was excavated. Four monitor wells were later installed - these wells are monitored and sampled on an annual basis. In March 1996, soil contamination was documented in the vicinity of the pump islands during a site upgrade project. Reports documenting these site investigation and cleanup activities have been submitted to Ecology's Northwest Regional Office and should be available for review in their central files. The report documenting the most recent groundwater monitoring event is attached for your information. ® 76 1 CarWash Bear Ms. Minnie Dhaliwal, City of Tuk• October 9, 2001 Page 2 • Since acquiring the property from Unocal Corporation in 1997, Tosco, a wholly -owned subsidiary of Phillips Petroleum Company, has directed the corrective action at this site. Tosco intends to conduct additional assessment of soil conditions upon removal of the underground storage tank (UST) system. Based upon our current understanding of site conditions, the extent of contaminated soil appears limited, however, Tosco may conduct remedial excavation as practical to address contamination discovered during the UST system removal. The need for additional corrective action will be evaluated upon review of the UST decommissioning assessment results. Results of this assessment will be documented in a report prepared by Tosco's consultant and submitted to Ecology.
