If we do not receive all of the required items listed in that letter on or before April 16, 2002, that SEPA application will expire. Per TMC 18.104.070(E), the Department of Community Development may extend this April 16, 2002 cancellation date up to 120 additional days (i.e., no later than October 16, 2002) if the applicant submits a written request for an extension prior to this cancellation. However, the applicant's request must clearly demonstrate that the delay is due to circumstances beyond the applicant's control (such as the need for seasonal wetland data) or unusual circumstances not typically faced by other applicants, and that a good faith effort has been made to provide the requested materials. Please be advised that we cannot return Items 3 and 4 (as listed on your February 6, 2002 letter in that submittal) as they were never provided. . We hope the following comments will clarify the status of the above - referenced permits and what steps need to be taken: in order to proceed. This information has previously been discussed in meetings and phone conversations with Sabir Khan, Mohammad Saleem and their various representatives over the past six months. Background Information Applications for both the land altering permit (MI01 -147) and the retaining wall permit (MI01 -148) were submitted in August, 2001 and were deemed to be incomplete. Under both of those applications, the scope of work covered three adjacent lots. For your reference, we have enclosed a copy of the Tax Assessor's Map for SE 15 -23-4 to illustrate their location. However, since the submittal of their applications, the applicants have indicated that one member of the Khan family owns the northernmost lot while the two southernmost lots are owned by a different member of the Khan family. Unfortunately, the applicants and their representatives have failed to provide adequate documentation demonstrating that the three Tots in question are each separate, legal lots. Additionally, they have failed to produce clear ownership information. The following is a partial list of some of the items we have previously requested in our technical review letters: 7- S EPA ( L.o\-s Q§ACC-\ Written documentation from the King County Assessors Office clearly demonstrating that Tax Parcel 322920 -0010 is now a valid parcel number and that is has been formally segregated from Tax Parcel 322920 -0005. 15'2 9( c A current Title Report for Tax Parcel -3-229-20-09057 � • A current Title Report for Tax Parcel 322920 - 0010.. • -A completed, signed and notarized "Affidavit of Ownership and Hold Harmless Permission to Enter Property" for Tax Parcel 322920 -0005 (form enclosed) • A completed, signed and notarized "Affidavit of Ownership and Hold Harmless Permission to Enter Property" for Tax Parcel 322920 -0010 (form enclosed). ts23o1-i-giL\ 9 Revisions to Existing Applications In order to process the northernmost lot under one application process and the two southernmost lots under a separate application process it will be necessary to submit revisions to the existing applications and to submit additional applications. The scope of the land altering application (MI01 -147) and the retaining wall application (MI01 -148) must be reduced to cover only the two southernmost lots. Additionally, a new land altering application and a new retaining wall application must be submitted for the northernmost lot. Please see Items 3 and 4 below for additional information. Due to the quantity of cut and fill associated with the development of the two southemmost Tots, a SEPA Determination is required. A SEPA application covering these two lots was submitted on January 2, 2002 and was deemed incomplete on January 16, 2002. Please see Items 1 and 2 below for additional information. Tor -Jan Ronhovde • February 19, 2002 Page 3 Owner Representatives or Coordinators As you know, we have recommended that each of the owners designate a representative or coordinator to handle the various permit applications. Once each representative or coordinator has been chosen, the Khans should supply them with all correspondence received from the City in connection with the permits referenced above. If representatives or coordinators are designated, please provide a letter from each of the owners indicating which applications they wish the coordinator to process on their behalf. Also provide contact information (full name, address, phone number, fax number) for the applicant and the applicant's coordinator when submitting revisions to any of the five permit applications referenced above. These revisions are to clearly indicate the parcel number and lot number of the property for which the application is being submitted. The use of incomplete addresses (such as 138XX Macadam Road South) on application documentation is not acceptable Additionally, if Mohammad Saleem is no longer a contact person, his name is to be removed from all submitted documentation. SEPA Comments 1. As described above, an application for a SEPA Determination under 'File E02 -001 was submitted on January 2, 2002 and deemed to be incomplete on January 16, 2002. As submitted, the scope of the SEPA application is limited to Tax Parcel 152304 -9149 (the southernmost lot) and a portion of Tax Parcel 322920 -0005 (known as Lot 1). 0010) However, the documentation you submitted on February 14, 2002 pertains to the northernmost lot of Tax Parcel 322920 -0005- (known as Lot 2). You have indicated that the required cut and fill for that property will be Tess than 500 cubic yards, and as such, will not require a SEPA application. Therefore, the materials you supplied on February 14th are being returned. 2. If the applicant under the existing SEPA application wishes to respond to the January 16, 2002 comment letter, he must submit the required documentation under Items 2, 3, 4 and 5 at one time to my attention. This must be done prior to April 16, 2002 or the SEPA application will expire. Please have the applicant or his representative carefully review the Tor -Jan Ronhovde • February 19, 2002 Page 4 • January 16, 2002 letter and then contact me to discuss the requirements stated in that letter before submitting. Segregation or Change in Scope of Existing Permits 3. Application MI01 -147 was deemed to be incomplete on August 23, 2001. If the applicant wishes to reduce the scope of MI01 -147 and submit an additional land altering application, he must contact the Public Works Department. The permit technician in that department (Laurie Werle at 206 -433 -7184) can provide information regarding revisions and submittal requirements. 4. Application MI01 -148 was deemed to be incomplete on August 21, 2001. If the applicant wishes to reduce the scope of MI01 -148 and submit an additional application for retaining walls, he must contact the Permit Center. The permit technicians in that department (Stefania Spencer at 206 -433 -7165 and Kathy Stetson at 206 -431 -3684) can provide information regarding revisions and submittal requirements. 5. Application D01 -345 was deemed to be incomplete on January .11, 2002. The cut and fill calculations provided on February. 14,. 2002 should accompany any submittals or revisions to D01 -345. Please contact the Permit Center regarding revision and submittal requirements for that permit. 6. Application D01 -179 was deemed to be incomplete on June 11, 2001. Please contact the Permit Center regarding revision and submittal requirements for that permit. Please review my comments carefully and discuss this information with the Khans. To date, you have already applied for the following permits: D01 -179 (residential building permit for the southernmost lot). Your SEPA application has been found to be incomplete. In order to continue processing your application there are additional items that must be submitted to the Department of Community Development. These items are listed below. As stated above, you applied for a residential building permit under D01 -345 on October 19th. In that permit you indicate that the total amount of cut and fill for that site will be 350 cubic yards. The Public Works Department has reviewed your documentation and finds that the cut and fill amount is only for the driveway on that site. The calculation does not cover other proposed grading work on that site. The D01 -345 building site is adjacent to the properties referenced in your SEPA application. If the total amount of cut and fill under D01 -345 meets or exceeds 500 cubic yards, you will be required to apply for a SEPA determination. Both your land altering permit application (MI01 -147) and retaining wall application (MI01 -148) cover your three adjacent building sites. If a SEPA application is also required for the D01 -345 site, you should revise the scope of your current SEPA application to incorporate that building site. The Title Report must clearly establish the status of the subject property as legal lots of record, clearly establish current ownership of all lots and identify all known easements and encumbrances. Copies of all recorded documents listed in the Title Report are to be attached. PLEASE NOTE: The "Limited Liability Guarantee" dated March 5, 2001 and provided to us on January 2nd does not satisfy these requirements. A completed, signed and notarized "Affidavit of Ownership and Hold Harmless Permission to Enter Property" is to be provided for all owners of all lots comprising the subject property (one copy, attached). The mailing address, business phone and fax number for each owner is to be included. Three copies of all supporting studies with original signatures and license stamp as needed. Even though the Company has no duty to defend or prosecute as set forth in Paragraph 3 above: (a) The Company shall have the right, at its sole option and cost, to institute and prosecute any action or proceeding, interpose a defense, as limited in (b), or to do any other act which in its opinion may be necessary or desirable to establish the title to the estate or interest as stated herein, or to establish the lien rights of the Assured, or to prevent or reduce loss or damage to the Assured. The Company may take any appropriate action under the terms of this Guarantee, whether or not it shall be liable hereunder, and shall not thereby concede liability or waive any provision of this Guarantee. If the Company shall exercise its rights under this paragraph, it shall do so diligently. (b) If the Company elects to exercise its options as stated in Paragraph 4(a) the Company shall have the right to select counsel of its choice (subject to the right of such Assured to object for reasonable cause) to represent the Assured and shall not be liable for and will not pay the fees of any other counsel, nor will the Company pay any fees, costs or expenses incurred by an Assured in the defense of those causes of action which allege matters not covered by this Guarantee. (c) Whenever the Company shall have brought an action or interposed a defense as permitted by the provisions of this Guarantee, the Company may pursue any litigation to final determination by a court of competent jurisdiction and expressly reserves the right, in its sole discretion, to appeal from an adverse judgment or order. (d) In all cases where this Guarantee permits the Company to prosecute or provide for the defense of any action or proceeding, an Assured shall secure to the Company the right to so prosecute or provide for the defense of any action or proceeding, and.all appeals therein, and permit the Company to use, at its option, the name of such Assured for this purpose. Whenever requested by the Company, an Assured, at the Company's expense, shall give the Company all reasonable aid in any action or proceeding, securing evidence, CLTA Guarantee Conditions and Stipulations Form 2015 -1 (Rev. 12- 15 -95) obtaining witnesses, prosecuting or defending the action or lawful act which in the opinion of the Company may be necessary or desirable to establish the title to the estate or interest as stated herein, or to establish the lien rights of the Assured. If the Company is prejudiced by the failure of the Assured to furnish the required cooperation, the Company's obligations to the Assured under the Guarantee shall terminate. 5. Proof of Loss or Damage. In addition to and after the notices required under Section 2 of these Conditions and Stipulations have been provided to the Company, a proof of loss or damage signed and sworn to by the Assured shall be furnished to the Company within ninety (90) days after the Assured shall ascertain the facts giving rise to the loss or damage. The proof of loss or damage shall describe the matters covered by this Guarantee which constitutethe basis of loss or damage and shall state, to the extent possible, the basis of calculating the amount of the loss or damage. If the Company is prejudiced by the failure of the Assured to provide the required proof of loss or damage, the Company's obligation to such assured under the Guarantee shall terminate. In addition, the Assured may reasonably be required to submit to examination under oath by any authorized representative of the Company and shall produce for examination, inspection and copying, at such reasonable times and places as may be designated by any authorized representative of the Company, all records, books, ledgers, checks, correspondence and memoranda, whether bearing a date before or after Date of Guarantee, which reasonably pertain to the loss or damage. Further, if requested by any authorized representative of the Company, the Assured shall grant its permission, in writing, for any authorized representative of the Company to examine, inspect and copy all records, books, ledgers, checks, correspondence and memoranda in the custody or control of a third party, which reasonably pertain to the loss or damage. All information designated as confidential by the Assured provided to the Company pursuant to this Section shall not be disclosed to others unless, in the reasonable judgment of the Company, it is necessary in the administration of the claim. Failure of the Assured to submit for examination under oath, produce other reasonably requested information or grant permission to secure reasonably necessary information from third parties as required in the above paragraph, unless prohibited by law or governmental regulation, shall terminate any liability of the Company under this Guarantee to the Assured for that claim. 6. Options to Pay or Otherwise Settle Claims: Termination of Liability. In case of a claim under this Guarantee, the Company shall have the following additional options: (a) To Pay or Tender Payment of the Amount of Liability or to Purchase the Indebtedness. The Company shall have the option to pay or settle or compromise for or in the name of the Assured any claim which could result in loss to the Assured within the coverage of this Guarantee, or to pay the full amount of this Guarantee or if this Guarantee is issued for the benefit of a holder of a mortgage or a lienholder, the Company shall have the option to purchase the indebtedness secured by said mortgage or said lien for the amount owing thereon, together with any costs, reasonable attorneys' fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of purchase. Such purchase, payment or tender of payment of the full amount of the Guarantee shall terminate all liability of the Company hereunder. In the event after notice of claim has been given to the Company by the Assured the Company offers to purchase said indebtedness, the owner of such indebtedness shall transfer and assign said indebtedness, together with any collateral security, to the Company upon payment of the purchase price. Upon the exercise by the Company of the option provided for in Paragraph (a) the Company's obligation to the Assured under this Guarantee for the claimed loss or damage, other than to make the payment required in that paragraph, shall terminate, including any obligation to continue the defense or prosecution of any litigation for which the Company has exercised its options under Paragraph 4, and the Guarantee shall be surrendered to the Company for cancellation. (b) To Pay or Otherwise Settle With Parties Other Than the Assured or With the Assured Claimant. To pay or otherwise settle with other parties for or in the name of an Assured claimant any claim assured against under this Guarantee, together with any costs, attorneys' fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of payment and which the Company is obligated to pay. Upon the exercise by the Company of the option provided for in Paragraph (b) the Company's obligation to the Assured under this Guarantee for the claimed loss or damage, other than to make the payment required in that paragraph, shall terminate, including any obligation to continue the defense or prosecution of any litigation for which the Company has exercised its options under Paragraph 4. 7. Determination and Extent of Liability. This Guarantee is a contract of Indemnity against actual monetary loss or damage sustained or incurred by the Assured claimant who has suffered loss or damage by reason of reliance upon the assurances set forth in this Guarantee and only to the extent herein described, and subject to the Exclusions From Coverage of This Guarantee. PROJECT UNDERSTANDING The project involves development of three residential properties situated on three separate building lots west of and adjacent to Macadam Road and southwest of S 138th Street in Tukwila, Washington. The proposed development will consist of site grading, and construction of driveways, iciailuug ,�aiis, and three residential houses. The site is located entirely within Class 2 and Class 3 Sensitive Areas as classified and mapped by the City of Tukwila. SITE RECONNAISSANCE We visited the site on November 1, 2001, and our observations are in general agreement with those provided by LSI ADAPT in their geotechnical engineering report and supplements. However, the report states the maximum slope inclination on the site to be 2H: 1V (horizontal to vertical). We noted that the existing slope in the northwestern part of Lot No. 2 possibly exceeded this listed maximum inclination. Our observations were confirmed by the topographic information on the site plans which indicates an inclination as high as 4H:3V. PROJECT PLANS AND GEOTECHNICAL REPORTS We conceptually reviewed the geotechnical engineering report and its two supplements prepared by LSI ADAPT, and the project site plans prepared by the developer. The report contains descriptions of the project site, proposed development, and geotechnical investigation conducted. It also provides conclusions and recommendations pertaining to the site preparation, foundation design and construction, temporary and permanent drainage, below -grade backflll walls, and structural fill. The geotechnical supplements 1 and 2 address the on -site storm water infiltration and retaining wall design, respectively. The site plans show the proposed locations of the residential structures, driveways, and retaining walls, as well as the proposed site grading, erosion control, and tree removal plans, and the proposed retaining wall profiles. Upon the review, we are in general agreement with the project document findings, conclusions and recommendations; however, we found the following deficiencies: • As mentioned in the Site Reconnaissance section, the geotechnical report fails to ?.,:knowleig° the existing slopes exceeding 2H:1V as noted during our site visit and confirmed by the topographic survey data. Furthermore, page 6 of the report erroneously equates the inclination of 2H:1V with the 25 percent grade change, whereas that inclination corresponds to a grade change of 50 %. The survey information indicates the maximum slope gradient reaching 4H:3V, or 75 %. • The geotechnical report recommends all permanent cut slopes be not steeper than 2H:1V. However, the site grading plan shows the toe of the steep slope in the northwestern part of Lot No. 2 being altered to an inclination as high as 1 H:1 V (100 %) because of close proximity of the proposed house location. In our opinion, such alteration of the sensitive area slope could potentially compromise stability of the slope and trigger slope failure. Furthermore, this is in violation of the Tukwila Municipal Code (Ordinance 1758 §1(part), 1995). Consequently, the proposed location of the house or the house dimensions should be adjusted to meet the Code requirement. Alternatively, the geotechnical report should demonstrate that the currently proposed setback could be exempt from the code requirement. • As noted by the Tukwila Public Works, the proposed location of the driveway parallel to Macadam Rd S and the Segmental Retaining Wall supporting it has to be adjusted to meet the setback from property line requirement. • The on site soils are predominantly fine - grained with high fines content. These soils are highly moisture - sensitive. The report fails to address earthwork in wet weather conditions. We are of the opinion that wet weather earthwork should be avoided on this site when possible. Specific recommendations pertaining to drainage, erosion control, and materials handling should be provided for times when work in wet weather cannot be avoided. CONCLUSIONS AND RECOMMENDATIONS Based on our assessment, we conclude that the lots are suitable for the planned development and slope stability on the subject and adjacent lots will not be detrimentally influenced by the development, provided the project documents satisfactorily address the above - listed deficiencies and that recommendations given in the revised geotechnical report are followed. SITE AND PROJECT DESCRIPTION The subject site is located at 13821 Macadam Road in Tukwila, Washington. The site consists of three vacant building lots measuring approximately 50 by 100 feet, identified as Lots No. 1 & 2 within Block 1 and Lot No. 149 on the west side of Macadam Road. The proposed house construction has been changed from a 2 -level basement design to slab -on -grade first floor with an access driveway supported by a Segmental Retaining Wall (SRW) situated on the lower slope along Macadam Road. The conclusions and recommendations contained in this letter are based on our understanding of the currently proposed layout of the project site, as derived from layout drawings, written information, and verbal information supplied to us. Consequently, if any changes are made in the currently proposed project, we may need to modify our conclusions and recommendations contained herein to reflect those changes. We recommend that ADAPT be retained to review final construction drawings and perform field observations during construction, in order to address any deviations that may become evident during the final design and construction phases of this project. EXPLORATORY METHODS In order to assess the soil conditions in previously unexplored areas on the lower slope, we performed a hand - excavated test hole at the location of the critical (highest) portion of the proposed wall. Our test hole was advanced and logged by an ADAPT geotechnical engineer using a hand auger and/or a shovel. Our representative also collected a representative soil sample which was stored in a watertight container and later transported to the laboratory for further visual examination and testing. After the test hole was completed,' we backfiilled it with excavated soils and tamped the surface. A test hole log (HB-1) describing the subsurface conditions encountered is attached to this letter. Practical excavation refusal was encountered at a depth of about 10.5 feet below ground surface (bgs) due to the presence of coarse gravel. SUBSURFACE CONDITIONS Based on our previous borings, the site soils generally consist of interlayered medium stiff to stiff sandy silt, clayey silt and loose to medium dense silty sands, above a stiff to a basal soil unit consisting of very stiff clayey silt / silt with clay. Our hand- excavated boring on the lower slope generally confirmed the previously mapped stratigraphy. Locally perched groundwater was observed atop the clayey silt and silt with clay soil units in our borings within the upper slope portions of the site. The enclosed Generalized Geologic Cross Section A A' illustrates the subsurface conditions at the site. LABORATORY TESTING PROCEDURES As a part of our geotechnical evaluation, we performed a series of Atterberg Limit tests, Materials Finer than U.S. No. 200 Sieve tests (200 Wash), and Moisture Content determinations. The results of these laboratory tests are presented on the enclosed laboratory test reports and were used to evaluate soil parameters for engineering evaluation and were used to develop soil classifications shown on the exploration logs. An Atterberg limits test indicates the moisture contents of a cohesive soil at the limits of plastic and liquid behavior, which is used to classify and index cohesive soils (ASTM:D - 4318). A general grain size analysis (ASTM:D -422) indicate the range of soil particle diameters included in a particular sample, while a 200 wash (ASTM:C -117) indicates how much fines (silt and clay) that is AIA International Development ADAPT Project No. WA01 -6267-0 August 16, 2001 Page 2 LSI ADAPT, Inc. contained in a sample. Moisture content determinations were made in general accordance with ASTM:D -2216. The results of these laboratory tests are presented on the enclosed laboratory test reports. ENGINEERING ANALYSES We performed internal and external stability calculations of the proposed SRW walls (greater than 4 feet high) using the AB Walls 2000 (Allan Block Wall) design software. For the lower SRW wall along the proposed driveway, we performed global stability analyses using the Slope/W computer program An iterative approach was used to provide the reinforcing grid spacing and grid length, while maintaining adequate static and seismic safety factors with respect to both internal and external global stability. A general discussion and the results of the analyses performed are provided in the sections below. Global Slope Stability Considerations In order to evaluate the global stability of the proposed SRW wall along the lower slope area, we used Slope/W to perform slope stability analyses along the most critical (highest wall section) point of the wall, corresponding to Cross Section A -A'. The results of the stability are expressed as a factor of safety, which is computed as the ratio of the forces resisting slope failure to the gravitational forces tending to cause a slope failure. Based on our field and laboratory analyses, the behavior of the fine - grained site soils are borderline between non plastic (sandy silt, silt) and cohesive (clayey silt, silt with clay). For the purpose of slope stability analysis, non plastic soils are generally modelled using effective stress analysis (friction angle), while cohesive soils are normally modelled using undrained shear strength (cohesion). Given the interlayered and borderline characteristic of the fine - grained site soils, we have analyzed for both conditions. For the static case, our analyses indicate a safety factor of 13 or greater against potential, deep - seated slope failure of the proposed lower slope wall. A pseudo-static analysis was performed to evaluate a potential seismic loading case, assuming an average horizontal ground acceleration of 0.15 g, which is about half of the anticipated peak horizontal ground acceleration and in accordance with generally accepted local practice. The factor of safety against slope failure due to the surcharge loading under seismic conditions is on the order of 1.1 or greater. These safety factors are generally considered to provide an adequate safety margin against slope instability by the geotechnical engineering community. Representative printouts from our Slope/W computer analyses are enclosed with this report, including the assumed soil profile and estimated critical failure circles for the minimum (critical) safety factor in the static and seismic cases, respectively. SRW Wall Design The internal and external reinforced wall stability was evaluated using the Allan Block design software for both the static and seismic case. Representative SRW sections of varying wall heights were evaluated with appropriate backslope angles and traffic surcharge loadings applicable to each section. It should be noted that the traffic loading was modelled using 250 pounds per square foot (psf) pressure, which is generally accepted for general roadway traffic. Although the proposed driveway vehicle loading is expected to be relatively light, we have used the general traffic loading criteria to allow for the AIA International Development ADAPT Project No. WA01 -6267-0 August 16, 2001 Page 3 LSI ADAPT, Inc. occasional heavy vehicle loading associated with construction traffic and delivery trucks. We used a 3 degree wall face batter in our analysis, to be on the conservative side. This would allow a less steep wall face without additional engineering review, should this be desired for cosmetic reasons. It should be noted that longer geogrid layers are .required on the uppermost block rows to resist the anticipated seismic lateral loading. In the seismic case, we have discounted the traffic surcharge loading, to avoid duplication of low - probability risk factors (generally assumed not to occur at the same time). Printouts of the AB wall design, including plan, elevation and section views, are enclosed with this letter. Backup calculation sheets are included with the AB Wall printouts. CONCLUSIONS AND RECOMMENDATIONS The proposed SRW walls are considered feasible, provided that the design elements and recommendations provided in this letter are incorporated into the final design and construction. The information provided in this supplementary letter should only be used in conjunction with our Geotechnical Engineering Report for the subject site. The conclusions and recommendations provided in this letter are based, in part, on our limited review of available geotechnical documents for the project site, and our interpretations and assumptions regarding subsurface conditions; therefore, if any changes to the existing site conditions are observed at a later time, ADAPT should be contacted to review those changes and modify our geotechnical evaluation, if needed. We understand that the City of Tukwila requires on -site infiltration of storm water if favorable site soil infiltration conditions exist at the site. The borings advanced as a part of our geotechnical study revealed the site soil conditions to generally consist of surficial, medium stiff sandy silts and silty fine sands overlying stiff to very stiff silt and clayey silt. Based on the observed soil conditions and generally accepted infiltration characteristics of fine- grained soils (sandy silts, clayey silts, etc), it is our opinion that the site surface and subsurface conditions are not favorable for the use of on -site infiltration systems, primarily for the following reasons: • Based on the soil classification performed as a part of our geotechnical report, the fine - grained site soils would be classified as Hydrologic Soil Type C or D (Silt Loam or Clay Loam, based on the USDA Soil Texture Class). These soil types are typically associated with infiltration rates of 60 min/inch, or Less.
