The antennas will be mounted on a replaced Qwest utility pole located at 14403 51st Ave S. You are invited to comment on the project at a public hearing scheduled for July 24, 2003 at 7:00 p.m. before the Planning Commission. You have expressed concern about the proposed project; in particular you are concerned about health effects associated with the presence of wireless communication facility. The concerns expressed in your letter were conveyed to the applicant. Additionally, the applicant must comply with all federal standards for radio frequency emissions. The applicant for this project has submitted documentation showing that they meet all federal standards. I have enclosed a copy of that report for your review. Please be aware that Section 704 of 1996 Telecommunication Act preempts state and local governments from basing regulation of the placement, construction, and modification of personal wireless facilities directly or indirectly on the environmental effects of radio frequency emissions. Section 704 states that "No state or local government or instrumentality thereof may regulate the placement, construction or modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with Federal Communication Commission's regulations concerning such emissions." Based on the Telecommunication Act, city of Tukwila cannot regulate the installation of wireless antennae based on health effects of the proposed facility. The proposed facility has been designed to provide increased capacity/coverage of wireless voice and data service for the surrounding residential, commercial, & vehicular customers. This location will provide "seamless" coverage by allowing the radio frequency (RF) signal to "handoff' calls to the neighboring sites in this highly condensed terrain. Additionally, this location was selected because of its position relative to existing sites, providing favorable site geometry for federally mandated E911 location accuracy requirements. Good site geometry is needed to achieve accurate locations of mobile users thru triangulation with existing sites. T- Mobile is currently limited in PCS radio frequency spectrum as set forth by the FCC and licensed to T- Mobile. In order to meet increasing user demand with the same amount of radio resources requires that more wireless communication facilities be established, specifically in high traffic areas. The proximity of this proposed facility to Interstate 5, S. 144`h Street, & surrounding commercial/residential areas in the vicinity, directly results from this need. Other licensed PCS carriers have as much as 30 MHz of PCS radio frequency spectrum available thus reducing the number of sites needed to achieve comparable coverage & capacity. Providing capacity/coverage to this area is challenging due to many factors. The lack of existing towers, tall structures, and topography restrict alternatives available for all wireless service providers. No other suitable structures /towers that satisfy the coverage objectives are available within the area necessary for T- Mobile's network to seamlessly function. The proposed antenna tip heights shown on the attached plans are the minimum necessary to meet this coverage objective while creating a facility that blends with the physical surroundings and meets applicable zoning regulations. Please see the attached RF propagation maps that have been prepared showing the signal levels with and without the proposed facility. Existing site locations are represented on the subject maps. The varying signal levels are shown in the map key. These maps demonstrate that without the requested facility and height, T- Mobile customers will continue to have gaps in service and dropped calls. Wireless telecommunications providers are required to comply with the FCC "Rules & Regulations" CFR 47 §1.1310, Radiofrequency radiation exposure limits and CFR 47 §24.52, RF hazards. PREDICTED CONDITIONS AT GROUND LEVELS Site plans provided by T- Mobile indicate that all of the proposed T- Mobile antennas will be mounted atop a wooden replacement Qwest telephone pole at 14404 51st Ave S in Tukwila. The T- Mobile antennas will be centered at approximately the 32 -foot level on the 35 -foot replacement pole. The pole is shown without climbing appurtenances. Thus it is unlikely that anyone other than authorized RF workers could approach near enough to the proposed antennas to cause those persons' RF exposure to exceed FCC limits. It is expected that exposure conditions inside nearby buildings and near ground level due to the contributions from all transmitting antennas will be well below the FCC public exposure limits. FCC COMPLIANCE The Federal Communications Commission (FCC) has determined through calculations and technical analysis that cellular and broadband PCS facilities, such as those operated by T- Mobile, are highly unlikely to cause human RF exposures in excess of FCC guideline limits. The following calculations demonstrate that the proposed T- Mobile facility will not cause excessive exposure conditions near ground level in any areas. Hatfield & Dawson Consulting Engineers 2 The following equation is used to calculate RF power densities at specific far -field locations: S (mW /cm2)= 0.36 x ERP (watts) / (Distance in feet)2 This equation is derived from Equation 9 on page 21 of FCC OET Bulletin 65. It includes the effect of ground reflections. The FCC Public MPE limit for PCS base station frequencies its 1.0 mW /cm2. By manipulating the OET far -field RF power density equation, we can produce a new formula for determining the maximum distance from the proposed antennas where excessive exposure conditions may occur, and beyond which power densities would be too low to produce excessive exposures. The new formula requires solving the far -field equation for distance given the MPE limit of 1.0 mW /cm2 for PCS frequencies: Distance in feet = 1 0.36 x ERP (watts) According to T- Mobile RF engineers, the radiated power levels from the proposed T- Mobile facility will be Tess than 1730 watts. Using the above equation and inserting the worst -case maximum ERP of 1730 watts we find that the maximum distance within which excessive RF exposure conditions could exist is: Exclusion distance = .N10.36 x 1730 watts = 25 feet All of the proposed T- Mobile antennas will be mounted at 32 feet above ground level. It is apparent from the T- Mobile drawings that all publicly accessible areas near ground level, and habitable structures are farther than 25 feet from the proposed antennas. Thus it would not be possible for the proposed T- Mobile PCS facility to cause excessive RF exposure conditions in any area. Thus the proposed T- Mobile facility will be in compliance with the FCC's RF exposure rules. Hatfield & Dawson Consulting Engineers 3 INTERFERENCE The transmission equipment for the proposed T- Mobile PCS facility is certified by the FCC under the equipment authorization procedures set forth in Part 2 of the FCC rules. This assures that the proposed facility will operate only within the desired PCS frequency bands, and that spurious emissions are within FCC specifications. Thus the proposed T- Mobile PCS facility is unlikely to interfere with other adjacent or neighboring transmission or reception functions.
