In order to locate the utility line in the wetland buffer it will be necessary to obtain Special Permission from the Director to have the buffer reduced to 15 feet. The need to submit an application for the wetland reduction was noted at the lire- application meeting. To qualify for a wetland buffer reduction it must be demonstrated to the satisfaction of the Director that it will not result in direct or indirect, short term or long term adverse impacts to wetlands and that: 1. The buffer is vegetated and includes an enhancement plan as may be required to improve the buffer function and value; or 2. If there is no significant vegetation in the buffer, a buffer may be reduced only if an enhancement plan is provided. The plan must include using a variety of native vegetation that improves the functional attributes of the buffer and provides additional protection for the wetland or watercourse function and values. BNSF will construct a 60'X 60' building which will be used for wash facilities and as a diesel fueling station. During construction approximately 1,000 cubic yards of soil will be disturbed. The project will also require that a new water flow line be installed which will extend about a mile to a utility connection at S. 116th Street. This water line will require work within 25 feet of two wetlands. This is a Planned Action SEPA which removes the City's notice of application requirements. In order for the project to considered under a SEPA planned action the following criteria apply: 1. Is the proposal a permitted and/or accessory use located with the MIC /L or MIC/H zones? The property is currently zoned Manufacturing Industrial Center/Heavy (MIC/H). Railroad lines are a permitted use with the MIC/H zoning. In addition gas pumps and heavy equipment repair are permitted in the zone. 2. Will all impacts of the proposal be mitigated by the time the project is complete? Near the location of the wash facility and fuel pumps is a Type III wetland. A Type III wetland requires a 25 foot buffer and 15 foot setback from the buffer. The applicant has requested to have the setback reduced 10 feet. TMC 18.45 sets requirements for locating utilities within the wetland buffer: a. Essential utilities must be constructed to minimize or, where possible, avoid wetland disturbance. b. All construction must be designed to protect the wetland and its buffer against erosion, uncontrolled drainage, restriction of groundwater movement, slides, pollution, habitat disturbance, any loss of flood carrying and storage capacity, and excavation or fill detrimental to the environment. c. Upon completion of installation of essential utilities, wetlands must be restored to pre - project configuration, replanted as required and provided with maintenance care until newly planted vegetation is established. 3. Is the proposal consistent with the applicable sections of the Tukwila Comprehensive Plan? The existing hub serves as a major connection for interstate trade. The proposed development will allow the rail yard to operate more efficiently. The project is consistent with the following goals and policies of the City's Comprehensive Plan: Goal 11.1, Support for existing industrial activities in the Manufacturing/Industrial Center and development of new industrial activity in order to maximize the employment and economic benefits of the people of Tukwila and the region, while minimizing impacts on residential neighborhoods. As noted the proposed expansion will allow the existing rail yard to operate more efficiently. Section 11.1.5, Allow uses that are commonly associated with manufacturing and industry, including those directly supporting such activity. Rail transportation is very important to all manufacturing uses in the City and the region. By enhancing the yard's capabilities all uses in the MIC district will benefit. 4. The project is not one of the following: a. an essential public facility; b. a development related to the Regional Transit Authority light rail or commuter rail c. a decision about the 16th Avenue Bridge improvements or disposition which would normally require a SEPA threshold determination; or d. a development in which any portion includes shoreline modifications waterward of the ordinary high water mark. Recommendation The proposal meets all SEPA Planned Action requirements and thus is not required to go through the full SEPA review. The only environmental impact is the construction of the underground water line through the wetland buffer. This can be mitigated through the City's existing wetland regulations (TMC 18.45). 2 • City of Tukwila • Steven M. Apparently, the City maps identify a more extensive area of wetlands within the Utility right -of- way (ROW), a portion of which is shown on the south end of our submitted maps. This came up in my initial meeting with the City and it was my understanding that the City maps have not been "ground - truthed" in that area. However, I was able to walk the entire perimeter of the Utility ROW that runs from the Tukwila Yard to Interurban Ave / E. Marginal Way. As a result, I am very comfortable with the relative location of the extent of the emergent wetlands at the eastern end of the Utility ROW. At the location of my identified wetland boundary, there is a very defined topographic rise from that point to the road. There was no indication of any direct, or indirect, connection to the Duwamish River or any associated tributary drainage's. This was the basis for my conclusion of the isolated nature of the wetlands. I have attached some additional photographs I took of the area to better identify the limits of the wetlands. If the City feels it is necessary, I would be happy to walk them through the area, or if they wish, the Utility ROW that is easily accessed from the west end by the road, all the way to the BNSF railyard boundary. The intent of this evaluation was to identify the presence of jurisdictional wetlands or other natural environmental issues within the property that may impact, or be impacted by, the proposed activity and identify project impact limits to ensure compliance with federal, state, and municipal regulations. Reviewed the National Wetlands Inventory Map 7.5 Quad Map "Seattle South, Washington" 1987. No wetlands are identified within 300 feet of the proposed building area. 2. Reviewed the Natural Resource Conservation Service's "Soil Survey of King County Area, Washington" dated 1973, which doesn't actually cover the project area, but allows for interpolation of soils to expect within the project area. 3. Performed on -site evaluations (2/14/03; 3/26/03) of the property. The wetland evaluation was conducted following routine wetland determination guidelines and methods, to identify and delineate jurisdictional wetlands for purposes of Section 404 of the Clean Water Act, as identified in the 1987 Corps of Engineers Wetland Delineation Manual. Formal data plots were completed to identify the wetland boundaries in the vicinity of the proposed building. Soil probes were used to define the perimeter of the wetlands away from the immediate area of the proposed building. We performed project perimeter surveys of the existing conditions of the property and photodocumented the site. Our primary focus was to identify water or wetland features that may restrict the proposed building construction, and potential impacts that the construction of a building may have on the surrounding environment. Site Evaluation Details Overall site topography of the BNSF property is flat, except within the footprint of a portion of the proposed building. Based on my site specific soils evaluation, the rail yard falls within the "Ur Series" (Urban Land). This is described in the King County Soil Survey as "soil which has been modified by disturbance of the natural layers through the additions of fill material several feet thick to accommodate large industrial and housing installations." This soil series is a common occurrence in the Duwamish River / Green River Valley Area, with the fill ranging from 3 to over 12 feet thick and consisting of gravelly sandy loam to gravelly loam. Initial Site Evaluation for Environmental Impacts and Permit Triggers RE: Existing Railroad Intermodal Yard Improvement - Tukwila, WA 31 March 2003 Page 2 of 4 _u •n ��Fs — alIMUIWEIIIMI Surrounding soils appear to consist of Newberg silt loam, which is consistent with the site soil probe samples we observed on -site. In the location of the proposed building, there is also an area of rock outcrop. There is a perimeter wetland ditch along the west edge of the property. There are no discharge structures or pipes connecting this wetland to the rail yard or any waterway. By definition, this is an isolated wetland, which does not fall within federal agency jurisdiction. It does, however, fall under state and local jurisdiction. During the winter, the seasonal water trapped in this perimeter depressional wetland results in a connection to the adjacent emergent reed canarygrass wetland, within the utility right -of -way perpendicular to the rail yard. This canarygrass meadow wetland has no connection to any pipe or conveyance to any open waterway. It dissipates to infiltration seeps adjacent to the law enforcement practice shooting range. The entire area upon which the building and features are being proposed, is presently developed and used as storage, open maintenance lay -down area, and parking, and is either existing structural fill (over 30 years old), or rock outcrop. The entire area is served by an existing storm water system within the BNSF yard. Conclusion and Recommendations By following erosion, sediment, and storm water protection best management practices (BMP's), the development of the proposed maintenance building will have no impact to any existing water resources in the project area. All runoff from the proposed building and site improvements will grade to the existing rail yard storm water system. No additional runoff beyond the existing natural area of drainage will be directed to the adjacent wetland. The adjacent isolated wetland is non jurisdictional on the federal level; not "Waters of the U.S." There will be no fill or disturbance impacts to this wetland area. The activity proposed would not result in any removal of vegetation or grading or clearing in areas not already used for rail yard maintenance activities. The City of Tukwila Municipal Code (Code) 18.45.020, provides guidelines for the sensitive area designations, and restrictions related to these areas. Based on the description of Wetlands in Section C of the Code, the wetland adjacent to the yard is classified as: "Type 3 - Less than an acre in size and consists of two or fewer Initial Site Evaluation for Environmental Impacts and Permit Triggers RE: Existing Railroad Intermodal Yard Improvement - Tukwila, WA 31 March 2003 Page 3 of 4 _...n - VIII s -- - - 1 IN - - 1 W -• . wetland classes. " It's location between a highly active rail yard and the King County Sheriff Firearms Practice Range does not lend itself to any potential that the area would be used by listed threatened or endangered bird or animal species. There is no connection to any surface waters. Plant species present are dominated by non - native Himalayan Blackberry and Reed canarygrass, with an overstory of cottonwood and vine maple. The buffer setback, Code requirement for Type 3 wetlands is 25 feet. There is no proposed fill or disturbances of any existing wetlands or vegetation surrounding the wetlands. The building will be approximately 30 feet from the closest point of the wetland area. Municipal code requires that the building foundation edge be an additional 15 feet from the edge of the 25 -foot buffer. For safety of equipment exiting the building and not coming into danger near the existing tracks, this total of 40 feet cannot be achieved. However, given the fact that the existing, and continued, non - vegetated yard and vehicle / equipment storage areas already falls within this setback, it appears this setback from a buffer that does not exist and a wetland which will not be altered, is redundant. The BNSF is requesting this additional setback requirement be waived due to the fact the proposed activity is equivalent to an existing similar use and activity for several decades, predating most federal jurisdictions and all state and local jurisdictions. This report and attached maps are provided to the City of Tukwila to obtain a determination of jurisdiction, or concurrence that the proposed building is located outside of sensitive area regulatory restricted area. The SEPA "short form" includes a document titled "AFFIDAVIT OF OWNERSHIP AND HOLD HARMLESS, PERMISSION TO ENTER PROPERTY", Due to FRA regulations and BNSF requirements BNSF cannot submit the form listed above. Both the FRA regulations and BNSF's requirements are in place to protect any individual that may be onsite or near an active rail line. Additionally this yard is an intermodal yard which Is inherently dangerous to people unfamiliar with operations. The City of Tukwila personnel will be granted access to the site when desired but will have to coordinate with BNSF personnel and will need to be escorted by a BNSF personnel or an authorized representative of BNSF. An escort is mandatory as city personnel do not have the appropriate orientation and safety training. When access to the site is desired please contact Kevin Cash, BNSF, at (206)658 -1612. Upon arriving at the site always stop at the office to sign in and to meet your designated escort. While onsite you must keep your headlights on and wear the appropriate personal protective equipment (PPE).
