Mullet, Mayor Department of Community Development Steve Lancaster, Director Mr. Chad Detwiller Rehabitat Northwest 5639 16th Ave South Seattle, WA 98106 RE: Notice of Incomplete Application 13330 32nd Ave S L05 -038 and E05 -007 Dear Mr. Detwiller: The City of Tukwila's Planning Department received your application for short plat approval June 15, 2005. On June 16, 2005 it was deemed to be incomplete because certain requirements of the application were not provided: Please provide the following: 1. One set of mailing labels for all property owners and tenants (residents and businesses) within 500 feet of the subject property. Note: Each until in multiple- family buildings - e.g. apartments, condos, trailer parks —must be included. 2. Print computer plat closure or demonstrated mathematical plat closure on all lots, streets, alleys and boundaries. Allowable error of closure shall not exceed one in 5,000 feet. 3. Four copies of the plat survey. A. The plat survey must include the name of the plat, graphic scale, space for the City of Tukwila file number and north arrow. It shall be drawn with black ink in record of suvey format and include the elements in TMC 17.04.060 A. The surveyor must stamp the survey. B. Legal description of all existing and proposed lots. C. The final plat documents must include all applicable certificates and approvals listed in the "Certificates of Approvals" section of this application (TMC 17.04.060). Existing and proposed lot lines shall be shown solid with new lines called out and lot lines to be removed shall be shown dashed. E. Lot and block numbers shall begin with the number one and be numbered consecutively without omission or duplication. F. Total lot or parcel sizes and average lot width of each proposed lot (min 50 feet for residential) Please also include the size of the private access road. G. Dash in required setback distances from all parcel lot lines. H. Fire access lane and turn- arounds per Fire Department standards. I. Location of all tracks to be dedicated to any public or private purpose shall be distinguished from lots intended for general development with notes stating their purpose and limitations. J. Location of existing and proposed public street rights of way and private access easements. K. Location, dimension and purpose of existing and proposed easements. Provide recorded documents which identify the nature and extent of existing easements. 4. Landscape Plan A. Landscape planting plan stamped and signed by a Washington State licensed landscape architect. Plan must include at least one tree in the front yard of each lot and meet Public Works standards (TMC 17.20.030 G). Plans must include the type, quantity, spacing, and location of all plantings Maximum sheet size24" by 36" B. Show all existing trees to be retained and any tree protection measures required (for example fencing and drip lines). You short plat and SEPA application has been deemed incomplete and City Staff will not begin to review the application until all required materials are submitted to the City. Planning staff did do a basic review of the materials and have found two major items that need to be addressed: 1. The property is zoned Low Density Residential (LDR). The minimum lot size in the LDR zone is 6,500 square feet. Lots two and three are both under 6,500 square feet. The City will not approve a short plat application that does not meet the minimum lot requirements. 2. The wetland report prepared by B -12 Wetland Consulting not meet City standards. In December of 2004 the City adopted a new Sensitive Area Ordinance. The new regulations require larger buffers than the City's previous ordinance. However, the wetland report references the City's old ordinance. For example, the buffer distance for a type II wetland under the new regulations is 80 feet. Yet the report notes that the buffer is 50 feet. Additionally, under section 3.0 "Observation" the report notes the various resources that were examined to determine the presence and location of a wetland on or near the property. The City maintains and extensive inventory of wetlands and streams within the City. The City's inventory (which was recently) updated would provide better information than many of the inventories that are referenced in the report. • Please note that the Department shall cancel an incomplete application if the applicant fails to submit the requested information within 90 -days following notification from the Department that the application is incomplete. The Department may extend up to 120 days if the applicant submits a written request for an extension prior to cancellation. The request must clearly demonstrate that the delay is due to circumstances beyond the applicant's control (such as the need for seasonal wetland data) or unusual circumstance not typically faced by other applicants, and that a good faith effort has been made to provide the requested materials (TMC 18.104.070). Once the above - mentioned information is provided, City staff can begin to review the application. File (L05 -038 and E05 -007) City of Tukwila Memorandum TO: Laurie Anderson, Finance FROM: Brandon Miles, Assistant Planner RE: Refund for E05 -007 DATE: April 21, 2006 A SEPA application was submitted for a short plat at 13330 32 "d Avenue South. However, when Planning staff reviewed the short plat application we found that the project was exempt from SEPA review and thus a formal SEPA application with checklist was not required. Planning requests that a refund check in the amount of $500 be issued to Rehabitat NW. A copy of the originally receipt has been attached.
