building except for the twoparking islands which will contain a .small

Well digging for the purpose of monitoring the migration of dissolved petroleum constituents seems
within the scope of the original shoreline permit (L06 -073) . Digging and installing a groundwater
monitoring well, although not specifically mentioned in the shoreline permit, is being undertaken to
support and monitor soil remediation. It, therefore, should fall within the scope of the original shoreline
permit. No amendment to L06 -073 will be required at this time.

FYI. Who should be signing R.O.W access consent form on PW behalf.
My understanding is that there are some old monitoring wells in Christensen Rd, however
their removal was not part of Shell soils remediation work.
Question for Planning Dept: does well(s) drilling(s)s trigger an amendment to Shell's
existing Shoreline permit ?

On behalf of Equilon Enterprises LLC dba Shell Oil Products US (Shell), Conestoga- Rovers & Associates (CRA)
is seeking off -site permission to drill and install a groundwater monitoring well in City of Tukwila Right -of -Way.
Attached please find an aerial photograph showing the site, several existing wells and the approximate location of
the proposed well installation between the 501 Tukwila Parkway address and the Green River. Inferred
groundwater flow direction based on prior data is to the east toward the river. There is a concern regarding
dissolved phase petroleum constituents migrating toward the river, considered a sensitive receptor.
This well installation is important toward closure of the property under the State of Washington Department of
Ecology's Voluntary Cleanup Program (VCP) implemented under their Toxic Cleanup Program.
Attached is a short form access agreement reviewed and approved by Shell to conduct the proposed
downgradient well installation. As stated in the agreement, all applicable permits and fees will be paid by Shell to
the City of Tukwila according to Tukwila Municipal Code, Title 11, Right of Way, Chapter 11.08 Permits, Type C-
Disturbance of City Right -of -Way.
As we understand, the fee of a Type C permit is determined by the value of the construction. The value of
construction is $3,500. Please let me know by e-mail or mailed correspondence the fee /review costs and any
other supporting documentation that is required by the City of Tukwila for their review and approval pertaining to
this Type C permit. The project site is currently operating under Public Works Construction Permit # PW06 -135,
issued June 19, 2007.

Dear Mr. Lancaster:
Thank you for sending Seattle Public Utilities a copy of your DNS Addendum for this project.
This letter is to provide notice that Seattle Public Utilities operates a 60" inch concrete cylinder water
transmission pipeline within Andover Park East in the vicinity of this project. This pipeline supplies
water to South King County (Including Tukwila and the Airport).
I have enclosed a copy of our map book sheets showing the approximate location of the 60" inch
concrete cylinder pipeline. If there is to be operation of heavy equipment, excavation or construction
performed in the area of our pipe, Seattle • Public Utilities should be included in the pre- construction
process, plan review and the actual construction.
Information needed by SPU
• Three copies of scalable Plan, Section and Profile drawings that show the planned
improvements in proximity to our pipe. These plans will be reviewed for comment by SPU
Operations staff & engineers.
• The planned start and finish dates.
Information you may need
• Record plans of our facilities can be obtained from the City of Seattle Vault which is located at
the 47th floor of. the Seattle Municipal Tower, 700 5th Ave., Suite 4700, Seattle, 98124. The
phone number there is 206 - 684 -5132.
• Any work in close proximity to our pipeline (including locating by potholing) must be supervised
by SPU. Call SPU's Lake Youngs Headquarters at 206 - 684 -3933 at least 48 hours in advance.
• Pipe protection may be necessary if heavy equipment crosses the pipe. Typical temporary
bridging would be timbers and steel plate.

DETERMINATION OF NONSIGNIFICANCE (DNS) ADDENDUM
Description of Original Proposal:
The original proposal called for removal of asphalt paving, demolition of a service building
and four underground storage tanks (UST) at the site of a form Shell gas station. A paved portion
of the site, containing neither structures nor tanks, is located within 200 feet of the Green River.
Description of Addendum:
The addendum covers planned remedial activities to remove residual petroleum- impacted
soil that was encountered in July, 2006, during the removal of underground storage (described in
the initial SEPA review).
The remedial activities at the site will include excavation of up to 2,500 cubic yards (in-
place) of overburden soil that will be temporarily stockpiled on site. This overburden was clean
backfill used after UST removal. Approximately 450 cubic years of petroleum- impacted soil
will then be removed from the excavations for transport and sampling. The excavation will then
be backfilled from overburden soil stockpiled onsite. An additional 450 cubic yards of 1 '/4 "
gravel will also be used to backfill the excavations.

request. The original DNS was issued May 31, 2006. This addendum is adopted on
December 14, 2006

INTRODUCTION
The purpose of this narrative is to describe the work for which applicable permits are being sought. A
description of the site, project work activities and anticipated project schedule are presented.
Shell Oil Products, US previously operated a Shell Service Station 121333 at 501 Tukwila Parkway in
Tukwila, Washington. The station was closed and the four underground storage tanks (USTs) and
service station building were removed from the site in July 2006. Groundwater was not observed during
UST excavation activitities. This submittal presents details of planned remedial activities to remove
residual petroleum- impacted soil that was encountered in the UST excavations in July 2006.
The remedial activities at the site will include excavation of up to 2,500 cubic yards (in- place) of
overburden soil, which will be temporarily stockpiled on existing asphalt or on plastic sheeting on site.
This overburden was clean backfill used after UST removal. Approximately 450 cubic yards (in- place)
of petroleum - impacted soil then will be removed from the excavations, loaded into trucks and transported
to Waste Management Inc. rail transfer facility in Seattle, Washington. The soil then will be transported
by rail to Waste Management's disposal' facility in Arlington, Oregon. Soil samples will be obtained
from the limits of the excavations and from soil stockpiles and submitted for chemical analytical testing.
The excavations will be backfilled using overburden soil stockpiled on site. Approximately 450 cubic
yards of imported 1 V4 -inch gravel also will be used to backfill the excavations. A portion of the site is
located within 200 feet of the Green River.
SITE DESCRIPTION
The site is King County parcel ID # 0223000040. The site is accessed by Andover Park East or
Christensen Road. A vicinity map depicting the site location is included on the site plan drawing
accompanying this submittal (Sheet 1).
The project's work area is relatively flat and partially paved. The site is located in a commercial area of
Tukwila. Andover Park East is adjacent to the site on the west; Tukwila Parkway on the north;
Christensen Road, Christensen Greenbelt Park and the Green River to the east; and a commercial
building to the south.
PROJECT DESCRIPTION
REMEDIAL EXCAVATION ACTIVITIES
This section describes general construction methods for the remedial excavation activities. The work will
be sequenced in the following manner.
• The Contractor will maintain the existing temporary chain link fence at the site and install erosion
control (silt fence and /or straw bales) around the site perimeter and mobilize equipment to the site.
• A licensed driller will abandon monitoring wells MW -1, MW -2, MW -3, and MW -5 in accordance
with WAC 173 -160.
• Excavate overburden from one of the UST excavations and stockpile soil on site. The soil will be
placed on existing asphalt or plastic sheeting. Proposed excavation locations are shown on Sheet 1
of 3.
• Soil stockpiles will be covered daily using the method shown in Sheet 2 of 3.

• Excavate petroleum- impacted soil from one of the UST excavation's, Load soil directly into trucks and
transport off site to transfer facility in Seattle, Washington. The soil will then be transported by rail
to their Waste Management's facility in Arlington, Oregon. The contractor plans to enter the site
from Christensen Road and exit the site to Andover Park East to minimize traffic impacts,
maintaining a safe distance from the limits of the excavations. A haul route to and from Waste
Management's transfer facility in Seattle is shown on Sheet 3 of 3.
• Soil samples will be obtained from the soil stockpiles and the excavation limits for field screening
and chemical analytical testing. Soil sampling activities will be conducted in general accordance
with Ecology's "Guidance for Remediation of Petroleum Contaminated Soils."
• The remedial excavations will be partially backfilled using noncontaminated overburden stockpiled
on site, pending the results of the chemical analytical data.
• Imported 1 1/4-inch gravel from Stoneway Sand and Gravel of Renton, Washington will be used to
backfill and regard the remainder of the excavations. A haul route to and from Stoneway Sand and
Gravel is shown on Sheet 3 of 3.
Total material excavation volume generated at the site is estimated to be up to 2,950 cubic yards (in-
place). Approximately 2,500 cubic yards (in- place) of the excavated soil stockpiled on site will be
protected from erosion prior to its subsequent use as backfill. Approximately 450 cubic yards (in- place)
of excavated soil will be transported off site to an approved landfill. Approximately 450 cubic yards (in-
place) of imported 1 1/4-inch gravel will be used to backfill the remainder of the excavations.
TEMPORARY EROSION AND SEDIMENTATION CONTROLS
Temporary erosion and sedimentation control measures that meet or exceed the minimum wet season
requirements of King County will be implemented prior to grading or excavation. The following Best
Management Practices (BMPs) apply:
1. The boundaries of the property and access areas are currently established with temporary
fencing. The contractor will install erosion control (silt fencing and /or straw bales) prior to
construction. During construction, no disturbance beyond the marked limits will be permitted.
2. Catch basin liners that trap petroleum hydrocarbons and sediment will be in the catch basins on
and adjacent to the site.
3. Site preparation, excavations, and fill placement will be completed during drier weather to the
extent practical. Precipitation and runoff patterns will be monitored during construction. If
necessary, additional sediment barriers will be installed to help confine sediment transport and
runoff to the immediate work area. In the event that excavated soils are very wet, a filter /straw
containment area for the soil stockpile will be prepared using straw bales and plastic sheeting. If
too much soil accumulates on the roadway surfaces, the contractor will perform removal
operations more frequently or construct a contained wheel cleaning station on -site.
4. Erosion and sediment control measures will be inspected immediately after each rainfall and at
least daily. Any required repairs will be made immediately.

5. Backfilled soil will be adequately compacted.
6. Silt fencing will be disposed of in a proper manner
BMPS FOR PREVENTING AND CONTAINING PETROLEUM SPILLS
To prevent petroleum products or other material from contaminating soils and water bodies during
vehicle and equipment maintenance, the following BMPs will be implemented:
1. Construction equipment and vehicles will be properly maintained to prevent leaking of petroleum
products.
2. Drip pans and tarps or other containment systems will be used when performing field
maintenance on vehicles and equipment. Maintenance of equipment will be performed off site at
repair facilities and yards to the maximum extent feasible.
3. Any contaminated soils or material will be disposed of off site in proper receptacles or at an
approved disposal facility.
4. Vehicle and equipment fueling will be attended at all times by site personnel.
5. Spill cleanup materials will be stored on site and employees will be trained in spill control
procedures.
SCHEDULE
Work will begin in mid November 2006, as the necessary permits and approvals are obtained, and as the
work crew is available. Work is anticipated to be completed and the site restored within approximately
one month after starting.

parking lot, concrete slabs, fuel islands. In addition, a total of six underground storage tanks
(UST) will be removed, including four 10,000 gallon USTs, one 1,000 gallon UST, and one
550 gallon UST with related appurtenances. The site location is 501 Tukwila Parkway. A
portion of the property is located within the Shoreline Management Zone. The property is
to be sold. As of 5/30/06, a "For Lease – Retail" sign was posted at the site.

VI. Comment Letter:
One comment letter was received regarding the project. Seattle Public Utilities provided
notice that it operates a 60" concrete cylinder water transmission pipeline within Andover
Park East in the vicinity of the project. This is a main water transmission pipeline
providing water to south King County communities.
SPU needs to be included in preconstruction process, plan review and construction if
there is to be heavy equipment, excavation or construction in the vicinity of the pipe.
Staff Response: Require that SPU needs to be included in preconstruction process, plan
review and construction if there is to be heavy equipment, excavation or construction in the
vicinity of the pipe.
This requirement shall be included with the demolition permit, and other future construction
permits.
VII. Conclusion
Staff finds that the proposal does not have a probable significant adverse environmental
impact. Pursuant to WAC 197 -11 -340, staff recommends issuing a Determination of Non -
Significance for this project.

this project.
This letter is to provide notice that Seattle Public Utilities operates a 60" inch
concrete cylinder pipeline within Andover Park East in the vicinity of this project. This
pipeline is one of our main water transmission lines which supplies water
communities in South King County.
I have a enclosed copy of our map book sheets showing the approximate location of
the 60" inch concrete cylinder pipeline. If there is to be operation of heavy
equipment, excavation or construction performed in the area of our pipe, Seattle
Public Utilities should be included in the pre- construction process, plan review and
the actual construction.
Information needed by SPU
• Three copies of scalable Plan, Section and Profile drawings that show the
planned improvements in proximity to our pipe. These plans will be reviewed
for comment by SPU Operations staff & engineers.

Dear Ms. Grindle:
Tukwila staff has reviewed the materials that you provided for environmental/SEPA review,
and has found that you will need to address the following as part of the application for
demolition permit:
1) There are several ground water monitoring wells on private property and in the
right -of -way associated with the gas station. Some of them were installed in 1997
under Tukwila Permit No. MI97 -0129 and in 1996 under MI96 -0020 and some
were pre- existing. A permit from Washington State Department of Ecology
(http: / /www.ecy.wa.gov) shall be obtained to properly decommission these wells.
2) The legal description on submitted plan (no date, no sheet no.) is incorrect. There
is a 15 -foot wide sidewalk easement recorded under King County auditor's file
#9511300546 benefiting the City of Tukwila that is not mentioned. Two of the
auditor's file numbers ( #5500000 and 6138178) in the last paragraph of the legal
description are incorrect. The paragraph refers to attached, but not the documents
were attached.
These materials are not needed for the current SEPA review process, but shall be submitted
at your earliest convenience to complete the demolition permit materials. For specific
questions about the request, please contact Joanna Spencer, Senior Engineer, directly at 206-

1) There are several ground water monitoring wells on private property and in the right -of-
way associated with the gas station. Some of them were installed in 1997 under Tukwila
Permit No. MI97 -0129 and in 1996 under MI96 -0020 and some were pre- existing. A
permit from Washington State Department of Ecology (http: / /www.ecy.wa.gov) shall be
obtained to properly decommission these wells.
2) The legal description on submitted plan (no date, no sheet no.) is incorrect. There is a 15-
foot wide sidewalk easement recorded under King County auditor's file #9511300546
benefiting the City of Tukwila that is not mentioned. Two of the auditor's file numbers
( #5500000 and 6138178) in the last paragraph of the legal description are incorrect. The
paragraph refers to attached, but no the documents were attached.

This letter serves as our response to the "Notice of Incomplete Application" sent to Saybr Contractors,
Inc. on March 30, 2006. Per your request, the following describes the scope of work that will take place
within the 200 -foot shoreline zone of the subject property.
a. Description of activities that will be carried out within the shoreline area: Within the subject
property indicated by the City as being within the 200 -foot shoreline zone, our scope of work
includes demolishing and removing the asphalt paving that currently is part of the property's
parking lot. The square footage for the asphalt is approximately 7,260 square feet. The estimated
cost of the asphalt paving removal is approximately $1,800. The tanks, building, etc. are all
located outside of the 200 -foot shoreline zone (as shown on the attached map.)
b. Map /graphic showing the work area in relation to the shoreline area: A map detailing the
work area as related to the shoreline area is attached.
c. Discussion of whether activities undertaken in the shoreline area meet the Shoreline Permit
requirements per Tukwila Municipal Code Chapter 18.44: In light of the limited scope of
work that is to take place within the 200 -foot shoreline zone and per the City's Shoreline Code
(Chapter 18.44), Saybr Contractors, Inc. believes that this work does not require a Shoreline
Permit. Specifically, this work is less than $5,000 and requires only removal of existing asphalt —
no other additional improvements are being made for this portion of the property under this SEPA
application.

Your application for SEPA review for demolition of a former gas station located at 501 Tukwila
Parkway, Tukwila, Washington has been found to be incomplete. It appears that a portion of your
project site is located within the 200 foot shoreline zone, and therefore may require a Shoreline
Development permit per Tukwila Municipal Code Chapter 18.44. If required, the Shoreline Permit
would be needed in addition to other permits and approvals related to the demolition of the existing
building.
I have enclosed a copy of TMC Chapter 18.44, an application for a Shoreline Permit, and a map
showing your project's location in relation to the shoreline zone. SEPA review is intended to
include the range of activities and permits that a project requires. In order to have a complete SEPA
application, the following must be submitted to the permit center:
a. Complete description of the activities that will be carried out within the shoreline area,
including the expected value of that portion of the work, the amount of fill and grading
required in the shoreline area, and any other activities related to site demolition and cleanup;
b. Map /graphic showing the work area (including building to be demolished, tanks, asphalt
area etc.) as described in "a" above in relation to the shoreline area;
c. Discussion of whether activities undertaken in the shoreline area meet the requirements for a
Shoreline Permit per Tukwila Municipal Code Chapter 18.44.
Upon receipt of this item the City will re- review the SEPA application for completeness and will
mail you written notification of completeness or incompleteness within 14 days.

18.44.110 General Shoreline Regulations
All uses within the Shoreline 'Overlay District
must conform to'the'- followuig general' regulations:
1. The use is in conformance with the
regulations of the underlying zone district;
2. The use does not conflict with the goals
and policies of the shoreline;: master program or the
provisions of the Shoreline Act and shoreline regula-
tions;
3. No structures or accessory facilities shall
be located over the river unless such striictureprotects
or promotes the public interest;:
4 There ,shall be no disruption existing
trees;, or; vegetation within the river environment
unless necessary, for public safety or flood control, or if
allowed; as a part-of an: approved shoreline; substantial
development permit;
5. No .effluent shall be discharged into the

fication as established by the State for) the adjacent

6. All State and federal water quality, regula-
tions shall be strictly, complied with; . ,

storage facilities, and the effective setback area shall be
suitably landscaped. This shall not prohibit ingress and
egress points between an access road and the described
facilities;
3. Parking, loading, and storage facilities shall
be appropriately screened from the river with:
a. A solid evergreen screen of a
minimum six -foot height, or
b. Decorative fence six feet high. (Note:
Chain link fence shall be slatted and planted with ivy
or other trailing vine except where a safety hazard
may exist.), or
c. Large hardy shade or fruit trees such
as maple, alder, poplar, cottonwood, sycamore,
willow, oak, beech, walnut, ash, birch or other species
approved by the Director at a maximum of 30 feet on
center, or
d. Earth berms at a minimum of four feet
high, suitably planted with live groundcover or natural
grass;

18.45.010 Purpose
A. The purpose of TMC Chapter: - 18.45, is to protect
the environment, human . life and property, designate
and classify ecologically sensitive areas such as
regulated.: wetlands. ,and; watercourses. and ,geologically
hazardous areas and to protect, these areas and their
functions and values, while.,; also_ allowing for
reasonable use of public and private property. ;These
regulations are prepared to comply, with the Growth
Management. Act, RCW 36.70A,` to apply best available
science according to WAC 365 -195 -900, to, 925 . and to
protect critical areas as defined by WAC 365 -190 -080.
B. Standards..are hereby . established to meet the
following goals of protecting environmentally sensitive
areas:

natural functions and values of these areas. :.
2. Protect quantity and quality. of water

INFORMATION
State Shoreline requirements are implemented through the Tukwila Zoning Code, Shoreline Overlay I
(Tukwila Municipal Code (TMC) .18.44). Areas annexed to the City after the 1974 adoption ' of ,the Tukwila
Shoreline Master Plan are subject to the King County Shoreline Master Program. Generally, the areasstillk`subj''.ec
to King County's Shoreline regulations are located north of the 42nd Avenue South bridge.
REQUIREMENTS: All improvements over $5,000 and within 200 ft. of the Duwamish/Green
associated wetlands require a "Shoreline Development Permit" except the following:
• . Owner- occupied construction of a single family house
that does not exceed 35 feet in height and/or pier
construction when the pier construction costs are less
than $5,000 in salt water and $10,000 in fresh water;
• Normal maintenance and repair;
• Normal bulkheads common to single family
residences;
• Habitat improvements which are part of a watershed
plan;
• Hazardous waste remediation when approved by the
State;
• Emergency construction needed to protect property
from imminent danger;
PROCEDURES: Within 28 days of receiving your application, City Staff determines if it iscomplete
on the following "Complete Application Checklist. If not, you will be mailed a letter outlining what
information is needed.
A shoreline permit decision is made administratively by the Director of the Department _ of: ° Cor *mum
Development. If the project also involves other land use actions, such as design review, that iequireaa .publi;d
hearing, the applicant may request that the Shoreline Permit be heard along with the other permit(s) at the public
hearing. The City's decision will be sent for review by the Department of Ecology, which has 21 days to G
jurisdiction. No construction may occur during that time, although building permits may be reviewed.,
