It is my understanding that a 90 -day hold is requested as the result of negotiations with the current property owner and Burlington Northern Santa Fe (BNSF) to sell the property that is the subject of the above listed land use applications. You have expressed that placing a hold on issuance of a decision for pending land use applications would allow you the time you need to determine whether you would like to either continue to pursue the 9 -lot boundary line adjustment and associated environmental review, or to formally withdraw these applications. Washington state law requires that a decision-on a land use application by issued within the-time period established by local ordinance. The time period established by the City of Tukwila is 120 days from the date the applicant is notified that the application is complete. By making a request to place a 90 -day hold on the above mentioned applications, thus preventing the City of Tukwila from meeting the 120 day time requirement, you agree to release the City of Tukwila from liability for any damages related to your request. With this understanding, I will put a 90 -day hold on pending applications L07 -026 and E07 -007 as of the date of your letter of request (November 27, 2007). On September 27, 2007, City of Tukwila staff met with you and Jason Legat to discuss the possibility of a rezone of the property from Low Density Residential (LDR) to Manufacturing Industrial Center/Heavy (MIC/H). On October 30, 2007, City staff met with representatives from BNSF to discuss the potential rezone of the property as well. It was staff's opinion during both meetings that a rezone for the property in question is unlikely, given the site's location within an LDR zone and the significant change in use that would be permitted with a rezone of the property to MIC/H. Please provide a written response by November 28, 2007, stating whether you would like the Department of Community Development to either proceed with issuing a decision on applications pending for 12522 51S` Place South, or whether you would like to withdraw your applications. Our proposal includes the use of a BLA, to create 9 building -ready SFR lots, per city code. Our proposal also includes the demo and removal of all existing structures and the installation of electricity, phone, and cable TV to each ' building lot. 11. Location of the proposal. Give sufficient information for a person to understand the precise location of your proposed project, including a street address, if any, the tax lot number, and section, township, and range. If a proposal would occur over a range of area, provide the range or boundaries of the site(s). Provide a legal description, site plan, vicinity map, and topographic map, if reasonably available. While you should submit any plans required by the agency, you are not required to duplicate maps or detailed plans submitted with any permit applications related to this checklist. All of the above will be included in the BLA application package. 12. Does the proposal lie within an area designated on the City's Comprehensive Land Use Policy Plan Map as environmentally sensitive? No. Please respond to all questions. Use separate sheets as necessary. Applicant Responses: B. ENVIRONMENTAL ELEMENTS 1. Earth a. General description of the site (circle one mountainous, other: rolling, hilly, steep slopes, b. What is the steepest slope on the site (approximate percent slope)? Approximately 10 %. c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, muck)? If you know the classification of agricultural soils, specify them and note any prime farmland. Silty clay loam d. The grading that will occur for the BLA is trench excavation and backfill for the utility service stubbouts and minor gravel fill for lot access. The total excavation and fill quantity is estimated at approximatlely 100 cubic yards. Future filling and grading required for the 9 single family residences will include minor grading for building locations (approximately 10 cubic yards per house), excavation for building foundations, and a minimal amount of fill brought in for driveways. The fill will likely be crushed rock from a certified pit and it is estimated that approximately 10 to 20 cubic yards of crushed rock will be used for each house. Less than 10% of the site will be impervious after the BLA and utility stubbouts and it is estimated after completion of the 9 single family residences that less than 50% of each lot will be impervious. The impervious surfaces for each lot will include roofs, driveways, walkways, and patios. h. Proposed measures to reduce or control erosion, or other impacts to the earth, if any: BMP's of future clearing and grading activities may include stabilization of disturbed soils and installation construction entrances, silt fencing, and any other means required by weather conditions. 2. If any, generally describe and give approximate quantities if known. Emissions may include those associated with typical land grading activity.
