PROJECT BACKGROUND FILE NUMBER: E07 -017 Planned Action APPLICANT: The Boeing Company REQUEST: Approval for designation of a Planned Action for demolition of an existing building and subsequent construction on the site of 38 parking spaces. LOCATION: 7775 East Marginal Way South PROJECT DESCRIPTION: The proposal is to demolish a two -story, 21,648 square foot building, and replace it with 38 new parking stalls. The building proposed for demolition is referred to as 2 -45, located at 7775 East Marginal Way South on the Boeing Plant 2 site. The demolition project area is part of a much larger site, a portion of which is within the shoreline zone. However, the specific project area for this proposal is beyond 200 feet from the ordinary high water mark, and is therefore not located within the shoreline zone. DETERMINATION: Project is designated as a planned action. The decision is final with no administrative appeal. BACKGROUND/PROPOSAL Tukwila's Manufacturing and Industrial Center (MIC) is one of the Puget Sound region's major industrial centers. Industrial development over most of the sub -area was evaluated in multi -site environmental review. In 1992, a programmatic environmental impact statement (EIS) was prepared for the Duwamish Corridor master plan, a proposal to redevelop Boeing properties in the MIC over a 10 year period. In 1998, sub -area plan/EIS updates extended the previous analysis of the corridor's Boeing properties (about 650 acres) to the entire MIC sub- area (about 1,370 acres). As part of this Planned Action review for the current proposal, the impacts of the current proposal are compared to 1998 Integrated GMA Implementation Plan and Final Environmental Impact Statement to ensure that all impacts have been mitigated. The current proposal is to demolish a 21,648 building located at 7775 East Marginal Way South, and replace the building with 38 new parking spaces, as well as associated landscaping and pedestrian features. The subject site is developed as an aircraft manufacturing facility with a number of separate buildings. The building to be demolished is beyond 200 feet from the shoreline of the Duwamish River. The subject site is zoned Manufacturing Industrial Center/Heavy (MIC/H). Several Planned Action determinations have been issued previously for demolitions on the site. The following is a list of these projects and their associated file numbers: • Building 2 -64: a 5,100 square foot building on the subject site. Decision issued on September 12, 2006. Refer to file number D06 -016. • Building 2 -62: a 41,000 square foot building. Decision issued on October 2, 2003. Refer to file number E03 -024. • Buildings 2 -63 and 2 -65: Decision issued on October 8, 2001. Refer to file number E01 -025. • Building 2 -66: Decision issued on December 14, 2000. Refer to File number E2000- 030. • Buildings 2 -50, 2 -71, and 2 -72: Decision issued on March 8, 2000. Refer to File number E99 -0035. II. DECISION CRITERIA This proposal was identified as a potential Planned Action because of its location within the subarea subject to the Tukwila Manufacturing/Industrial Center Integrated GMA JR Page2of5 H:U'lanned Action SEPA\E07 -017_Boeing Building 2-05_Staff Report.doc 11/132007 9:00 AM Implementation Plan and Environmental Impact Statement. The determination of whether a project fits the Planned Action criteria is divided into two phases. Each phase is described below, including a response that explains how the current proposal meets the criteria. 1) In the first phase, a determination is made whether the project satisfies all of the following characteristics (contained in TMC 21.04.152 Planned Actions Identified): 1. The action is a `permitted use" located within the MIC /L (TMC 18.36.020) and MIC /H (TMC 18.38.020) zones and/or is an accessory use (TMC 18.36.030 and 18.38.030 respectively). 2. The action is: .a. not an "essential public facility" as defined in RCW 36.70.200 and TMC 18.06.270, b. not a conditional or unclassified use, in. the respective MIC /L or MIC /H zones, c. not a development, any portion of which includes shoreline - modifications waterward of the ordinary high water mark, d not a development associated with 16th Avenue Bridge construction activities. Response: The proposal for this site is for demolition of an existing structure and construction of 38 new parking spaces. Since the area on which the existing building is located . is a portion of a larger site, the parking as proposed is an accessory use within the MIC/H zoning district. Additionally, the project is consistent with items a -d under number 2 above. 2) Once the project has met the initial test to qualify as a planned action, it must then show the following: A. Will all of the impacts of the proposal be mitigated by the time the project is complete? Please document all mitigation measures, using attachments if necessary. Response: Based on the answers provided in the Endangered Species Act (ESA) Screening Checklist, the project does not constitute a "take" under ESA. The following provides clarification for items answered "yes" in the ESA Screening Checklist. Compliance with existing codes will mitigate any impacts related to grading, stormwater, and hazardous substances. JR . _ Page 3 of 5 H :\Planned Action SEPA\E07 -017_Boeing Building 2- 45_Staff Report.doc 11/13/2007 9:00 AM (1) Grading and clearing —The project includes grading and clearing associated with construction of the parking area. The only plant materials on the site that will be disturbed by this activity is landscaping, which will be replaced in -kind. (2) Processing or handling, storage, or treatment of hazardous substances — Applicant shall be responsible for obtaining any applicable permits from the Puget Sound Clean Air Agency for impacts related to emissions into the air. Soil on the project site is not known to be contaminated. To ensure that soil excavated from the site does not pose a hazard, the applicant shall properly store, sample, and disposed of excavated material according to state and federal laws. Other hazardous waste associated with the existing building, including leaded equipment, fluorescent light tubes and mercury switches /thermostats, broken lamps and mercury- contaminated sink traps shall be disposed of or managed per state and federal requirements. (3) Regular use of fertilizers, pesticides or herbicides —Use of fertilizers, pesticides or herbicides shall meet all state and federal requirements regarding runoff and contamination of soil. (4) Construction of new impervious surfaces — Construction of new impervious surfaces includes the use of new concrete pavement for parking surfaces and new concrete sidewalks along the southwest side of the project site. This new impervious surface replaces areas of the site which were previously impervious, resulting in no net increase in the amount of impervious surface on the project site. The . total amount of impervious surface as proposed will actually be reduced from the previous amount as a result of this project through the addition of approximately 1,300 square feet of new grass sod to replace areas that were previously impervious surface. (5) Generation of stormwater from the creation of impervious surfaces that will not be infiltrated on site — Stormwater management shall comply with the 1998 King County Surface Water Design Manual. B. Is the proposal consistent with the applicable sections of the Tukwila Comprehensive Plan? TMC 21.04.154 requires that the Comprehensive Plan policies that are to be reviewed are those identified in the "Integrated GMA Implementation Plan and JR Page 4 of 5 11/13/2007 9:00 AM H:\Planned Action SEPA\E07 -017_Boeing Building 2 -05_Staff Report.doc • Environmental Impact Statement for the Tukwila Manufacturing /Industrial Center." Specifically, the proposed project meets the following goals and policies: Goal 11.1: Support the existing industrial activities in the MIC and development of new industrial activity in order to maximize the employment and economic benefits to the people to Tukwila in the region, while minimizing impacts on residential neighborhoods. Policy 11.1.1: Support the efforts ofexisting industries to expand and new industrial businesses to develop in the Manufacturing /Industrial Center by providing them with economic data, information on available development sites, help in understanding and getting through the permit processes, and other appropriate assistance. Policy 11.1.5: Allow uses that are commonly associated with manufacturing and industry, including those directly supporting such activity, such as offices and laboratories, while prohibiting unrelated uses. III. CONCLUSION The current proposal to demolish the 2 -45 building and replace this area of the site with 38 new parking spaces is consistent with the criteria for approval as a Planned Action. The proposed use of the site as a parking area is an accessory use in the MIC/H zone, and satisfies all other criteria contained in TMC 21.04.152 regarding the proposed use of the site. Proposed actions associated with the proposal are consistent with Tukwila's Comprehensive Plan, and all impacts associated with the current proposal will be mitigated. This current subarea plan /EIS updates and extends the previous analysis of the corridor's Boeing properties (about 650 acres) to the entire MIC subarea (about 1,370 acres). It also builds on the information developed for the City's Comprehensive Plan and Comprehensive Plan EIS efforts of 1994. The Proposed Action applies the "planned action" option for SEPA review as the center of a permit streamlining program of early, comprehensive environmental review, and supporting capital and regulatory revisions. REQUIREMENTS: Planned actions are developments that satisfy all of the criteria in TMC 21.04.152 (Planned Actions Identified). A proposal must initially qualify as a planned action, then pass a second screen to ensure consistency with the Comprehensive Plan and mitigation of all significant negative environmental impacts. The initial qualification criteria are summarized below. 1. The action is a "permitted use" located within the MIC /L (TMC 18.36.020) and MIC /H (TMC 18.38.020) zones and /or is an accessory use (TMC 18.36.030 and 18.38.030 respectively). 2. The action is: a. not an "essential public facility" as defined in RCW 36.70.200 and TMC 18.06.270, b. not a conditional or unclassified use, in the respective MIC /L or MIC/H zones, c. not a development, any portion of which includes shoreline modifications waterward of the ordinary high water mark, d. not a development associated with 16th Avenue Bridge construction activities. PROCEDURES: A Planned Action application form may be submitted with the underlying development permit. At the time you submit your application you must have all of the items listed on the attached "Complete Application Checklist." You may request a waiver from items on the checklist that are not applicable to your project. Please discuss this waiver request with City staff either at a pre - application meeting or at the time of application submittal. Within 28 days of receiving your application, City staff will determine if it is complete based on the attached checklist. If not complete City staff will mail you a letter outlining what additional information is needed.
