PROJECT BACKGROUND FILE NUMBER: E08 -011, SEPA Planned Action APPLICANT: The Boeing Company REQUEST: Approval for designation of a Planned Action for site work on a 4.6 -acre area of a larger, 9.8 acre site, known as the Boeing Isaacson parcel. Proposed work includes demolition of asphalt and concrete, excavation and disposal of a mound of soil, installation of stormwater collection and treatment systems, and repaving. LOCATION: 8811 East Marginal Way South PROJECT DESCRIPTION: The project proposal is to remove an asphalt -paved mound of soil. Proposed construction activities associated with the underlying Public Works Type C Grading permit will include demolition of portions of the existing asphalt and concrete pavement, excavation of soil for off -site disposal, grading, installation of a stormwater collection and treatment system, and repaving the disturbed area. Soil to be removed was previously determined to contain hazardous levels of arsenic, which was stabilized in 1991 to prevent leaching of arsenic. Soil samples and analysis in January 2008 determined that the soil now contains arsenic at a level less than 5 milligrams per liter, an amount which is no longer characterized as hazardous and allows disposal of the soil as solid waste. The decision is final with no administrative appeal. I. BACKGROUND/PROPOSAL Tukwila's Manufacturing and Industrial Center (MIC) is one of the Puget Sound region's major industrial centers. Industrial development over most of the sub -area was evaluated in multi -site environmental review. In 1992, a programmatic environmental impact statement (EIS) was prepared for the Duwamish Corridor master plan, a proposal to redevelop Boeing properties in the MIC over a 10 year period. In 1998, sub -area plan/EIS updates extended the previous analysis of the corridor's Boeing properties (about 650 acres) to the entire MIC sub- area (about 1,370 acres). As part of this Planned Action review for the current proposal, the impacts of the current proposal are compared to 1998 Integrated GMA Implementation Plan and Final Environmental Impact Statement to ensure that all impacts have been mitigated. One Planned Action determination has been issued previously for the site, on September 11, 2000, for construction of a 212,000 square foot building with 150 parking stalls and other site improvements including landscaping. The site is currently vacant. Please refer to file number E2000 -018 for more information on the previously- issued SEPA Planned Action. The current proposal is to grade an approximately 4 rt 6 acre area consisting of a mound of soil that has been paved over with asphalt and concrete, to reduce the mound effect thereby bringing the site to a more consistent grade. Existing asphalt and concrete will be demolished as part of the underlying Public Works permit, and the area will be repaved with asphalt after the soil is excavated and disposed of off -site and a stormwater collection and treatment system is installed. The work area for this project is zoned Manufacturing Industrial Center/Heavy (MIC/H). Though the western portion of this parcel is located within the 200 - foot regulated buffer of the Duwamish River, no portion of the work will be located within the 200 -foot buffer. Materials to be excavated include soil previously determined through the toxicity characteristic leaching procedure (TCLP) to contain elevated levels of arsenic, in concentrations in excess of 5 milligrams per liter (mg/L). According to a Technical Memorandum from 2001 by staff in the Environmental Resources Management division of the Boeing Company, the soil did not exhibit any other hazardous waste characteristics and did not contain any listed waste. The contaminated soil was treated in 1991 using a stabilization process to reduce the leachability of the arsenic. In January 2008, Landau Associates conducted sampling and analysis of the treated soil and confirmed that TCLP concentrations of arsenic were below 5mg/L. At this concentration, the stabilized soil is no longer designated as hazardous waste and can be disposed of as solid waste. No change in the volume or peak flows of stormwater is anticipated with this project. Installation of two new Vortech's stormwater collection/treatment systems and new piping where there are grades exceeding 0.5 percent is proposed with this project, as part of the underlying Public Works permit. Installation of these new facilities is being done to meet requirements for water quality treatment for the project area. II. DECISION CRITERIA This proposal was identified as a potential Planned Action because of its location within the subarea subject to the Tukwila Manufacturing /Industrial Center Integrated GMA Implementation Plan and Environmental Impact Statement. The determination of whether a project fits the Planned Action criteria is divided into two phases. Each phase is described below, including a response that explains how the current proposal meets the criteria. 1) In the first phase, a determination is made whether the project satisfies all of the following characteristics (contained in TMC 21.04.152 Planned Actions Identified): 1. The action is a `permitted use" located within the MIC /L (TMC 18.36.020) and MIC /H (TMC 18.38.020) zones and/or is an accessory use (TMC 18.36.030 and 18.38.030 respectively). 2. The action is: a. not an "essential public facility" as defined in RCW 36.70.200 and TMC 18.06.270, b. not a conditional or unclassified use, in the respective MIC /L or MIC /H zones, c. not a development, any portion of which includes shoreline modifications waterward of the ordinary high water mark, d. not a development associated with 16th Avenue Bridge construction activities. Response: The proposal for this site is to conduct grading and excavation, removing a mound of soil capped with asphalt and concrete pavement and installing water quality facilities. The 4.6 -acre area disturbed with this permit will be repaved with asphalt once the soil mound is removed and the water quality facilities are installed. The site is currently vacant, and there is no other use anticipated for the site at this time. The site's status /use as a vacant lot is a permitted use within the JR Page 3 of 5 09/122008 1254 PM H:\Planned Action SEPA\Boeing- Isaacson Mound Removal\E08 -011_Boeing Mound Removal_SR.doc MIC /H zoning district, and is not an essential public facility or a development associated with 16th Ave Bridge construction activities. The project does not involve work waterward of or within the 200 -foot buffer from the ordinary high water mark of the Duwamish River. 2) Once the project has met the initial test to qualify as a planned action, it must then show the following: A. Will all of the impacts of the proposal be mitigated by the time the project is complete? Please document all mitigation measures, using attachments if necessary. Response: Based on the answers provided in the Endangered Species Act (ESA) Screening Checklist, the project does not constitute a "take" under ESA. The following provides clarification for items answered "yes" in the ESA Screening Checklist. Compliance with existing codes will mitigate any impacts related to grading, stormwater, and hazardous substances. (1) Grading and clearing —The project includes demolition of existing asphalt and concrete, excavation of soil, and installation of stormwater quality infrastructure. The site currently has no vegetation; there is no clearing or disturbance of vegetation involved with the proposed construction activities. The applicant has prepared a Technical Information Report that outlines measures that will be taken to prevent erosion during construction activities, as well as a Stormwater Pollution Prevention Plan (SWPPP). Additionally, the applicant is in the process of applying for a Construction Stormwater General Permit from the Washington State Department of Ecology. As stated in the SWPPP, the applicant will follow best management practices to prevent erosion and sedimentation, and to identify, reduce, eliminate or prevent stormwater contamination and water pollution from construction activity. (2) Processing or handling, storage, or treatment of hazardous substances — Applicant shall be responsible for obtaining any applicable permits from the Puget Sound Clean Air Agency for impacts related to emissions into the air. Soil on the project site was previously treated for high concentrations of arsenic. Sampling and analysis of the soil in January 2008 by Landau Associates indicates that arsenic levels in the soil are now below 5 milligrams per liter, a level at which the soil may be disposed of as solid waste. The applicant shall properly store, sample, and dispose of excavated material according to state and federal laws. New impervious surfaces will replace areas of the site which were previously impervious, resulting in no net increase in the amount of impervious surface on the project site. (4) Generation of stormwater from the creation of impervious surfaces that will not be infiltrated on site— No change in the volume or peak flows of stormwater is anticipated with this project, and stormwater will be collected on site and treated through new water quality systems to be installed with this project, prior to being discharged to the Duwamish River from an outfall located on the Boeing Thompson property located to the south. Stormwater management shall comply with the 1998 King County Surface Water Design Manual. B. Is the proposal consistent with the applicable sections of the Tukwila Comprehensive Plan? TMC 21.04.154 requires that the Comprehensive Plan policies that are to be reviewed are those identified in the "Integrated GMA Implementation Plan and Environmental Impact Statement for the Tukwila Manufacturing/Industrial Center." Specifically, the proposed project meets the following policy: . Policy 11.1.2: Assist landowners in remediating site problems caused by contaminated soil. III. CONCLUSION The current proposal to demolish and excavate an asphalt and concrete - capped soil mound covering a 4.6 -acre area, install water quality improvements, and to repave the area with asphalt, is consistent with the criteria for approval as a Planned Action. There is currently no use planned for the site, other than a vacant lot, which is a permitted use in the MIC/H zone. Work proposed with the underlying permit satisfies all other criteria contained in TMC 21.04.152. Proposed actions associated with the proposal are consistent with Tukwila's Comprehensive Plan, and all impacts associated with the current proposal will be mitigated.
