FOR ENVIRONMENTAL CHECKLIST

I. SUMMARY OF PROPOSED ACTION
The proposal is to short plat an existing .56 acre property into three single family residential lots. An existing
single family residence will remain. Over 500 cubic yards of cut and fill are proposed or have been placed
resulting in the need for a SEPA Environmental Review.
II. GENERAL INFORMATION
Project Name: Banakes Short Plat
Applicant: Anna Nguyen, The Concept Group
Location: The site is located at 14213 33rd Ave South. It is bound on the north -east by 33rd
Ave South and the east by 34th Ave South. Single family residences and low -
density residential zoning surround the property on all sides except to the south
where the zoning is medium density residential and the property is bordered by
the Satelite II apartments. The tax parcel number is 5537200116.

III. REVIEW PROCESS
The proposed action is subject to State Environmental Policy Act (SEPA) review as the project
proposes a gross quantity of 615 cubic yards of cut and fill.
IV. BACKGROUND/PROPOSAL
The applicant is proposing to divide one 24,227 square foot lot with one single family residence
into three single family residential lots. The existing house will remain and the two new lots will
be served by a new shared driveway. The applicant placed 490 cubic yards of fill around June of
2008. The applicant intends to develop the two newly created vacant parcels which will result in
an estimated total of 615 cubic yards of cut and fill.
V. REVIEW OF THE ENVIRONMENTAL CHECKLIST
The following lists the elements contained within the Environmental Checklist submitted for the
proposed project. The numbers in the staff evaluation correspond to the numbers in the
Environmental Checklist. If staff concurs with the applicant's response, this is so stated. If the
response to a particular item in the checklist is found to be inadequate or clarification is needed,
there is additional staff comment and evaluation.

VI. COMMENTS:
On September 15, 2008, notice was posted on the site and mailed to property owners and
tenants within 500 feet of the property. Tenants in the adjacent apartment building were
mailed noticed on February 19, 2009. Written comments were received from concerned
neighbors on September 25th and October 24, 2008 and led to the City requiring the
applicant to perform a wetland determination.
VII. CONCLUSION
The proposal can be found to not have a probable significant adverse impact on the environment
and pursuant to WAC 197 -11 -340 a Determination of Nonsignificance (DNS) is issued for this
project. This DNS is based on impacts identified within the environmental checklist, attachments,
and the above Final Staff Evaluation for Environmental Checklist File No. E08 -012, and is
supported by plans, policies, and regulations formally adopted by the City of Tukwila for the
exercise of substantive authority under SEPA to approve, condition, or deny proposed actions.

Dear Mr. and Mrs. Johns,
In October of last year, you sent me a comment letter in response to notice you received from the
City regarding the above mentioned project. Your letter raised concerns regarding tree clearing and
wetland filling on the site and some questions regarding an existing fence.
In light of your comments and other information on the site, the City made a request to the applicant
to hire a wetland biologist and provide a wetland delineation and determination. The report,
completed in January of this year, concluded that the fill placed on the site was not placed over
wetland conditions on the property. A Technical Information Report was submitted with the
application that indicates that during heavy rainfalls, stormwater on the site flows in a northerly
direction towards a series of catch basins and underground pipes. The current City code does not
regulate tree removal from private property unless the property has sensitive areas which this site
does not.
You also asked if the applicant would be moving the existing fence, which is located on his
property, to your shared property line. Nothing in the application discusses the fence and the City
does not require relocation of the fence. Fences six feet or less do not require a permit to erect.
Aside from some very specific circumstances, an applicant is generally not limited as to where he
may locate his fence on his property.

To Whom It May Concern:
This letter is in regards to the Notice of Application project information (lease see
attached) we received in the mail. We live on Lot 6 at the end of S. 142" Place directly
behind the project.
Our first concern is the removal of trees and raising the elevation of the project lot(s) to
fill in a wetland will cause the majority of the rain on the project lot(s) to drain onto our
now even lower lot, which is saturated in the rainy season as it is. We are concerned that
what the developer has already done may cause flooding under our home and by building
three homes on the project lot(s) would acerbate the problem. We are unsure what, if
any, changes may take place regarding draining of rainwater in our yard and how that
may affect our property, as I am sure you could understand our concern.
Our second concern is an old wood fence that belongs to the original home on the
existing lot where the project will be built. Our neighbors have been in their house since
it was built in 1963, a year before ours home was built, and they stated that fence was
there before our home was built and belonged to the house on the project lot(s). The
fence is very old, not sturdy and needs to be replaced onto the recently surveyed property
line which is 7 of the project lot(s) feet to west of its current location. We would like to
find out if a new fence will be built to replace the old existing fence on the proper east
line of our lot?

I have been provided a Notice of Application for the above noted Short Plat and would
just like to comment that Lots 2 & 3 are definitely wet lands and have already had fill
hauled in.
My kids had to walk through that area while going to school and that's the first thing they
said was `that's wetland' and they would know by walking this area over several years
and during the Sept thru June period.
I hate to see the loss of wetland since that is vital to our environment but we keep losing
acres over development. And the ones that disregard the usage of land need to be
penalized.

The environmental checklist updated on January 15, 2009; reflects the revised
Technical Information Report dated January 2009. (1) Soil classification has been
determined through soil / sieve analysis, by LabCor Portland, Inc., dated June 22,
2008. (2) Land altering quantities have been revised from 65 c.y. cut / 10 c.y. fill to
65 c.y. cut / 550 c.y. fill. This reflects the land altering that occurred onsite last year,
without a permit. (3) Stormwater is not proposed to be infiltrated on -site, accept for

Dear Mr. Banekes:
As requested I conducted an evaluation of the property located at 14213 33rd Avenue South in the City of Tukwilla,
Washington. The property is identified as King County Parcel No. 5537200116. The purpose of this work was to
complete a site evaluation to make a determination if wetland conditions were present on the property prior to
recent grading activity on the property.
The scope of work included a site visit on November 18, 2008, at which time we completed our site observations.
In completing the field work for the property I excavated a series of eight shallow test holes to depths up to 4.5ft
using a post hole digger.
I also reviewed aerial photographs from 1936, 1998, 2000, 2002, and 2005, which are available from the King
County web site. The aerial photos were used to review historical conditions on the property. It is my
understanding that there was recent grading activity on the property. The City of Tukwilla has requested
additional information regarding possible wetland conditions on the property before the grading was completed.
General Site Conditions
The subject property is an irregularly shaped parcel of approximately 0.6 acre. It is located at 14213 33rd Avenue
South in the City of Tukwilla. The location is illustrated on the Vicinity Map (Figure 1). There is an existing
residence on the property with a gravel driveway providing access from 33rd Avenue South, near the northeast
property corner. Adjacent properties to the north and west are occupied by single family residences. There is an
apartment building with asphalt paving on the property to the south.
Vegetation on the property includes several large Douglas fir (Pseudotsuga menziesii) trees around the existing
residence. There is a line of trees including Douglas fir along the south property line between the apartment
parking area and the subject property. There has been recent grading activity on the southern section of the

property. Groundcover vegetation reflects the recent activity and is sparse across the property. Some lawn and
landscaping surrounds the existing residence.
There is no direct indication that there is wetland on nearby adjacent properties. There are standing Douglas fir
trees along the south property line and adjacent properties to the east are occupied by maintained lawn and
landscaping.
Historical Aerial Photograph Review
I reviewed aerial photographs which are available from the King County Web site. Photos taken in 1936, 1998,
2000, 2002, and 2005, are available for viewing at the web site. Photos from 1936, 2002, and 2005 are included
with this report as Figures 1 through 5. Photos taken in 1998 and 2002 are available but they are of lower quality
and it is difficult to see details on the subject property.
Examination of the 1936 photo shows the property and surrounding lands to be in agricultural use. The existing
house on the property is present. Roads surrounding the property had been constructed at the time of the 1936
photo. The photos do not show indications of wetland conditions on the property or in the immediate vicinity.
Conditions on the subject property appear similar in the 2002 and 2005 photos. There appears to be a mix of shrub
and herbaceous groundcover on the property and the house appears to have been added to. The apartment building
and asphalt parking had been constructed prior to the 1998 aerial photo. While the quality of the image is low,
conditions on the property appear similar to that shown on the 2002 photos. It is not possible to identify the
species composition of the vegetation across the property. There is no indication of wet surface conditions on the
property in the photos. There is some indication that there may have been some grading activity on the property
before the 1998 photo.
Soil Conditions
The King County Soil maps do not cover the Tukwilla area and therefore do not provide information regarding soil
conditions on the property prior to any recent grading activity.
I excavated a series of 8 shallow test holes on the property at locations indicated on the attached Site Map (Figure
5). In general, conditions encountered in the test holes are similar at each of the locations. At each of the
locations, there was a change in soil conditions at depths of 24" to about 36" below the surface. Surface soils were
generally brown sandy soils with inclusions of wood bits and other debris. Soils below this surface soil, and
extending to the depth explored were generally gray or dark gray and were more dense than the overlying soils.
The lower soils also included wood pieces and some debris indicating the presence of fill. The distinct change in
soil conditions indicate that there had been two grading events on the property.
Soils to the depth excavated were generally wet to moist. There was no free water or saturated soils present.
Observations of the near surface conditions, as observed in the test holes indicate that recent grading activity on
the property placed up to about 36" of soil on the property. Below the most recently placed fill soils, there is older

This letter is written in response to your comment letter dated October 14, 2008 for the above
referenced project. Please find enclosed with this letter the revised TIR and SEPA checklist
addressing your comments. Comments from the letter have been addressed below in bold.
Environmentalist Review Comments:
1. Hire a qualified wetland biologist with training and experience in wetland
determination and delineation to do the following:
Garet Munger, a wetland biologist with AldersNW, was hired to perform a field study
to determine the possible existence if wetlands on the property. His letter dated
January 12, 2009 and full report outlining his findings is enclosed with this re-
submittal package.
a. Evaluate the presence of wetland hydrology in at least four sample locations, in
accordance with the Washington State Wetlands Identification and Delineation
Manual— particularly Section F for Atypical Situations. It will be necessary to reach
the native soils beneath the fill material. The biologist should use the original site
topography information as a guide to determine the location of the sample plots.
A map should be presented showing the sampling locations.
A total of eight shallow test holes were excavated across the site. These holes
were excavated to depths of up to about 4.5 ft. These test holes indicated that
there had been recent filling to depths of about 3ft over older fills. A map
showing the loation of the test holes is included with the report. No map of the
original topography is available at this time.

b. Evaluate the presence of hydric soil conditions in the native soils below the fill in
the same sample locations. Although the applicant submitted results of a soil test
from LabCor Portland Inc. in the Draft Technical Report, aside from the fact that no
information is presented as to the location of the soil sample, this report does not
provide the information needed to make the determination of the presence or
absence of hydric soils.
The soils below the recently placed fills do not show hydric soil characteristics.
c. If hydric soil and hydrologic indicators are observed, an attempt should be made to
determine the approximate boundaries of the former wetland and the estimated
size of the former wetland.
Observations indicate that the recent filling did not cover wetland.
d. Obtain historic information about soil ponding, previous vegetation, and other
factors that would contribute to a determination of the presence or absence of
wetland.
Examination of the aerial photos available from the King County Web site do not
show definitive indication that there wetlands present before the recent grading
activity. The aerial photo from 1938 shows that the property and immediately
surrounding areas were in agricultural use.
SEPA Checklist /Draft Technical Report Comments:
2. The soil classification (SEPA Checklist Environmental Elements, Earth) does not appear
to be correct. Soils in this location have not been mapped by NRCS, as it is considered
to be an urban area. The same incorrect classification is presented in the Draft
Technical Report, page 1.
Both the SEPA checklist and the TIR have been revised to state, "The United States
Department of Agriculture Natural Resource Conservation Service (NRCS), did not
map soils information in the project vicinity because it is an urban area. A soil sieve
analysis was performed by LabCor Portland, Inc. The soil is categorized to be coarse
sand."
3. The Draft TIR, page 2, states in Section 2 that "during heavy rainfall events, stormwater
sheet flows in an easterly direction towards the drainage ditches on Military Road
South" and in Section 3 that "during heavy rainfall events, stormwater from the
property sheet flows in an northerly direction towards 34th Avenue South." The SEPA
checklist, Section2. Water, c. Water Runoff, (1) lists the latter.
Section 2 of the TIR has been revised to state, "During heavy rainfall events,
stormwater from the property sheet flows in a northerly direction toward 34th
Avenue South." The statement in Section 3 and the SEPA checklist are correct. No
revisions made to those two areas.

4. The SEPA Checklist, Earth (e) estimates 65 cy of cut, 10 cy of fill while the TESC Plan,
sheet EC1 of the TIR estimates 65 cy of cut and 550 cy of fill. The applicant has already
placed 490 cy of fill on the site without a permit.
The SEPA checklist has been revised to reflect the quantities stated on sheet EC1. Cut
and fill quantities were estimated based on existing topographic information from the
site survey.
5. Section 4, Infiltration Facility Design of the Draft TIR says that "soils are not conducive to
infiltrating stormwater from roofs." The SEPA checklist, Section 3 Water, b. Ground, (1)
states that "surface water will continue to infiltrate to native soils and /or sheet flow to
its natural location of discharge." This is an area that allows infiltration; a perk test will
be required with a building application.
The SEPA checklist, Section 3b has been revised to state, "Surface water will continue
sheet flow to its natural location of discharge along 34th Avenue South." Although
infiltration is allowed in this area, infiltration trenches will not be proposed for the
roof stormwater.

As requested I am completing an evaluation of the property located at 14213 33rd Avenue South in the City of
Tukwilla, Washington. The property is identified as King County Parcel No. 5537200116. The purpose of this
work was to complete a site evaluation to make a determination if wetland conditions were present on the property
prior to recent grading activity on the property.
The scope of work included a site visit on November 18, 2008, at which time we completed our site observations.
In completing the field work for the property I excavated a series of eight shallow test holes to depths up to 4.5ft
using a post hole digger.
I also reviewed aerial photographs from 1936, 1998, 2000, 2002, and 2005, which are available from the King
County web site. The aerial photos were used to review historical conditions on the property. It is my
understanding that there was recent grading activity on the property. The City of Tukwilla has requested additional
information regarding possible wetland conditions on the property before the grading was completed.
My observations of subsurface conditions as observed in the test holes indicate that recent grading activity on the
property placed up to about 36" of soil on the property with the greater depths of fill along the south side of the
property. Below the most recently placed fill soils, there is older fill material which extends to depths below the
depth of the test holes. This observation of an earlier level of fill is generally consistent with conditions observed
in the aerial photographs.

14. TRANSPORTATION

The site is bounded to the east by 33rd and 34th Avenue South. The
proposed properties will be accessed via a shared access
road /driveway connected to 33rd /34th Avenue South.
b. Is the site currently served by public transit? If not, what is the
approximate distance to the nearest transit stop?
There is no transit service in the immediate vicinity of the project.
However, King County Metro Transit service is provided along Military
Road South which is less than'/ of a mile from the project site.
c. How many parking spaces would the complete project have? How many
would the project eliminate?
A minimum of 2 parking spaces will be provided per housing unit. The
project will provide a net increase in parking spaces.
d. Will the proposal require any new roads or streets, or improvements to
existing roads or streets, not including driveways? If so, generally

The project includes the construction of a private access driveway that
will serve all three lots. Proposed frontage improvements will include a
paved shoulder to match the existing pavement on 33' d /34 Avenue So.

creating 19.14 new weekday daily trips and 20.2 new weekend daily
trips.

Dear Ms. Nguyen:
This letter is referencing a three -lot short plat and a SEPA determination for the property located
at 14213 33rd Avenue South. Two neighbors to the project sent letters to the City during the
SEPA comment period. Both letters (attached) raised concerns that, prior to placing fill at the
site, a wetland was on the property. Additionally, the city's drainage maintenance supervisor,
John Howat, has observed water 7 -10' deep on the property during heavy rains. In 1999, the city
put a drainage pipe into the property in 1999 to deal with the overflow and in an attempt to
control the flooding onto the neighboring property to the south. In light of this information, the
city requires additional information regarding the presence of a former wetland to process this
application.
Our urban environmentalist reviewed the application and requests the following:
1. Hire a qualified wetland biologist with training and experience in wetland determination and
delineation to do the following:
a. Evaluate the presence of wetland hydrology in at least four sample locations, in
accordance with the Washington State Wetlands Identification and Delineation
Manual, particularly Section F for Atypical Situations. It will be necessary to
reach the native soils beneath the fill material. The biologist should using the
original site topography information as a guide to determine the location of the
sample plots. A map should be presented showing the sampling locations.

b. Evaluate the presence of hydric soil conditions in the native soils below the fill in
the same sample locations. Although the applicant submitted results of a soil test
from LabCor Portland Inc. in the Draft Technical Report, aside from the fact that
no information is presented as to the location of the soil sample, this report does
not provide the information needed to make the determination of the presence or
absence of hydric soils.
c. If hydric soil and hydrologic indicators are observed, an attempt should be made to
determine the approximate boundaries of the former wetland and the estimated
size of the former wetland.
d. Obtain historic information about soil ponding, previous vegetation, and other
factors that would contribute to a determination of the presence or absence of
wetland.
The above information should be submitted to the City for evaluation.
Comments on SEPA Checklist/Draft Technical Report
Staff also noticed a number of inconsistencies and issues with the SEPA checklist and Draft
Technical Information Report (Draft TIR). Please address the following comments.
2. The soil classification (SEPA Checklist Environmental Elements, Earth) does not appear to
be correct. Soils in this location have not been mapped by NRCS, as it is considered to be
an urban area. The same incorrect classification is presented in the Draft Technical Report,
page .1.
3. The Draft TIR, page 2, states in Section 2 that "during heavy rainfall events, stormwater sheet
flows in an easterly direction towards the drainage ditches on Military Road South" and in
Section 3 that "during heavy rainfall events, stormwater from the property sheet flows in an
northerly direction towards 34th Avenue South." The SEPA checklist, Section2. Water, c.
Water Runoff, (1) lists the latter.
4. The SEPA Checklist, Earth (e) estimates 65 cy of cut, 10 cy of fill while the TESC Plan,
sheet ECI of the TIR estimates 65 cy of cut and 550 cy of fill. The applicant has already
placed 490 cy of fill on the site without a permit.
5. Section 4, Infiltration Facility Design of the Draft TIR says that "soils are not conducive to
infiltrating stormwater from roofs." The SEPA checklist, Section 3 Water, b. Ground, (1)
states that "surface water will continue to infiltrate to native soils and/or sheet flow to its
natural location of discharge." This is an area that allows infiltration; a perk test will be
required with a building application.

CONDITIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved
from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced
