This is to confirm our phone conversation yesterday regarding
re- vegetation of the above site.
My letter of May 7, 1992 extended the deadline for re- vegetation of
the site to May 30, 1992. This extension was granted to allow you
to comply with your SEPA requirements for the project.
As I mentioned yesterday, the City of Tukwila has declared a water
emergency, and has placed restrictions on water use. Until the
water restrictions are lifted, we are asking property owners to
defer new plantings. Given this, you may delay the re-seeding .of
your site until next year, or until May 30, 1993.
Please let me know if you have any questions regarding this.

This is in response to your letter of April 14, 1992 regarding the
approved SEPA conditions for the above project.
I qpderstand that you spoke recently with Rick Beeler, Tukwila's
SEPrA Official. I also understand that, at that time, you agreed
that development of your site may not occur for a few years.
However, the site is currently experiencing erosion and gullying.
This delay in development and the site's erosion potential were the
factors which led to the stipulation of re- vegetation as a SEPA
condition. There has been no change in these factors which would
make re- vegetation unnecessary. Given this, the original SEPA
conditions must be satisfied.
As stated in my letter of April 8, 1992, the deadline for
re- vegetation of the site was April 30, 1992. To give you an
opportunity to comply with your SEPA requirements, this deadline
has been extended to May 30, 1992.
Please let me know if you have any questions regarding this matter

I am in receipt of your April 8, 1992, letter concerning the Segale - Strander Fill. - This letter is written
to advise you that pursuant to the Land Altering Permit which was issued for this project, "seeding of
site is not practical and will interfere with the integrity of the pre -load, and therefore is not a
requirement with this pre -load activity ".
As indicated in the Environmental Checklist submitted as part of our application for this project (the
" Strander Property Fill "), it is our intention to develop the site to accommodate a future building
compatible with the zoning. Inasmuch as the precise configuration of this future building has not been
finalized, we believe it is not prudent to seed the site only to remove the resulting vegetation in the
future.
Further, as we read the Mitigated Determination of Non - Significance, the requirement to seed the site
was intended to mitigate erosion and loss of vegetation. Erosion has not been a problem -- it has been
controlled by various other means, and what little vegetation existed on site prior to the pre -load will
be more than replaced with whatever landscaping is put in place in connection with the ultimate
development of the property.
In keeping with the Land Altering Permit, we will not be seeding the site before April 30, 1992.

THRESHOLD
DETERMINATION: This is a Mitigated Declaration
of Non - Significance
ENVIRONMENTAL REVIEW RECORD
The environmental review of this proposal consisted of an analysis
based on the Environmental Checklist prepared by M.A. Segale, Inc.
for the City of Tukwila (April 2, 1991).
DESCRIPTION OF THE PROPOSAL
The applicant proposes to fill a currently vacant site with
approximately 35,000 cubic yards of pit -run material. The material
would be graded and compacted over a period of approximately one to
nine months.
The owner has requested a Grade and Fill Permit in order to bring
the site up to the approximate grade of surrounding streets. No
buildings or other improvements are associated with this request,
and no approvals for such improvements are implied by this
environmental determination.

CHECKLIST ITEMS
A. EARTH
The site is mostly flat, with slopes of less than three
percent. Approximately 35,000 cubic yards of pit run
material would be brought to the site. Initially the fill
material would be approximately twelve feet high (35.5').
After re- distribution over the site and settling, the
fill's ultimate elevation would match existing street
grades (23.5').
There is a potential for erosion throughout the lifetime of
the project. Measures implemented to mitigate this
potential for erosion and sedimentation include trenches
•along the perimeter of the top of the fill,' with drainage
pipe installed to carry excess water to the base of the
fill. In addition, a four -foot high filter fabric fence
would be installed between the fill area and the
destination catch basin.
Seeding of the stabilized fill area would help reduce
erosion potential. However, due to the fact that the fill
material will be graded and distributed over the site at
frequent, indefinite intervals, seeding of the fill is not
practical during the settlement period (see Condition #2).
B. WATER
There are no permanent surface water bodies on site.
Across the street (Andover Park West) from the site is an
approximately 18 -acre pond. Storm runoff and runoff from
watering operations would be directed to an existing catch
basin at the northwest corner of the site. This catch
basin system runs in a direction opposite the pond.
Although site runoff would be filtered through filter
fabric fencing to reduce sedimentation, additional off -site
siltation could occur during significant rainfall. This
could be reduced through monitoring of the sedimentation
control system during significant storms (see Condition
#1).
As no buildings or paved surfaces are associated with this
construction, the project would not result in impervious
surfaces.

C. AIR
Short term impacts to air quality include dust generation
and emissions from equipment during filling and grading
operations. Implementation of dust control measures during
construction, such as watering exposed soil surfaces and
equipment traffic areas, would mitigate short term air
quality impacts. For these reasons, no significant long
term impacts to air quality are expected.
D. PLANTS
Currently, grass and herbaceous plants cover most of the
proposed site. Landscaping or re- seeding would help
mitigate the loss of this vegetation cover (see Condition
#2). However, no re- vegetation is proposed.
E. VISUAL QUALITY
Currently, the site is vacant. Upon completion of the
project, there would be little change in the visual quality
of the area.
F. NOISE
The site is surrounded by commercial businesses. Operation
of construction equipment would result in a short term
increase in noise levels near these adjacent uses.
Limiting construction activities to week days as provided
under TMC 8.22.160 would partially reduce short term noise
impacts.
G. TRAFFIC
Heavy equipment traffic along major arterials in the
Central Business District would be temporarily increased
during construction. However, potential impacts of hauling
operations would be mitigated through the required Annual
Hauling Permit process.
As the project consists of grade and fill operations only,
it would not add vehicle trips nor significantly change
existing circulation. As a result, no traffic impacts are
expected.

H. UTILITIES
The proposed fill could result in residual settling of the
ground around an existing pipeline on site. Potential
disturbance of this pipeline due to settling could be
mitigated through a plan for regular, frequent monitoring
of elevation changes (See Condition #3).
CONCLUSIONS AND RECOMMENDATIONS
Issuance of a Mitigated Determination of Non - Significance is
appropriate since the environmental review indicates no probability
of significant adverse environmental impacts from the proposal.
MITIGATED CONDITIONS OF APPROVAL
EARTH
1. Throughout the life of the project, the applicant
shall monitor potential off -site siltation during
significant rainfall, and take any measures deemed
appropriate by the Public Works Department to
control off -site siltation.
2. All disturbed areas shall be re- seeded after a
maximum time period of one year.
UTILITIES
3. When fill material is placed within 100' of the
curb line, the applicant shall monitor the ground
around the existing pipeline for changes in
elevation. This monitoring shall be done on a
weekly basis. The applicant shall immediately
notify the Public Works Department of any changes
in elevation.

D. This permit is being issued in advance of a building permit
and review for the benefit of the applicant. This approval
is for placement only and carries no guarantees as to the
suitability or location for use of this fill as a building
preload.

ENVIRONMENTAL CHECKLIST
Purpose of Checklist:
The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental
agencies to consider the environmental impacts of a proposal before making decisions. An
environmental impact statement (EIS) must be prepared for all proposals with probable
