NOTICE OF ACTION BY THE CITY OF TUKWILA
Pursuant to the provisions of chapter 43.21C RCW, notice is hereby given
that the City of Tukwila did on July 2, 1984 take the action
described below.
Any action to set aside, enjoin, review, other otherwise challenge such
action on the grounds of noncompliance with the provisions of chapter
43.21C RCW (State Environmental Policy Act) shall be commenced within 30
days or be barred.
The action taken by the City of Tukwila notice of which is hereby given,
was:
Adopt Resolution 920 approving annexation by election method to
the City of Tukwila
Said action pertained to property at:
Between Highway 518(N), 42nd Ave. W. (W), 164th St. (S) and 51st
Ave. (E)

Dear Councilmembers:
On April 2, 1984, a petition for annexation for a certain area
contiguous to the City of Tukwila was presented to the Tukwila
City Clerk's Office by the proponents of the annexation.
Thereafter, the petition was referred to the Office of the
Prosecuting Attorney pursuant to RCW .35A.14.020. Our office
received that petition on April 3, 1984. Under the election
method of annexation set forth in RCW 35A.14.020, the prosecuting
attorney is obliged, within 21 days after submission of the
petition, to certify or refuse to certify the petition for
annexation.
For the reasons hereinafter set forth we have determined to
certify the petition for annexation.
ANALYSIS
Pursuant to the requirements of RCW 35A.14.020, the prosecuting
attorney must make two different determinations before a petition
for annexation may be certified. First, RCW 35A.14.020 requires
that a petition for annexation be deemed sufficient "under the
rules set forth in RCW 35A.01.040 . . . ."
To the extent applicable we have determined that the petition
meets the statutory requirements of RCW 35A.01.040. The petition,
as presented to this office, includes a number of pages containing
an identical text. See RCW 35A.01.040(1). The group of pages is
clearly intended by the petitioners to be considered as one
petition. See RCW 35A.01.040(1). The text of the petition is a
concise statement calling for an election to be held to determine
whether certain property should be annexed to the City of Tukwila.
See RCW 35A.01.040(1)(a). An ,accurate legal description of the
property proposed to be annexed was attached to each page of text.
See RCW 35A.01.040(1)(c). The signature lines of the petition
were numbered and also contained a space for the date the signer

signed the petition as well as a space for the address of the
signer. See RCW 35A.01.040(1)(d).
The petition was typed on white paper. Each page of the petition
containing signature lines also contained the warning text set
forth in RCW 35A.01.040(2). See RCW 35A.01.040(e) and RCW
35A.01.040(2).
With a few exceptions which I am sure your city clerk will note,
the signers of the petition signed in ink, stated their addresses
and dated, their signatures. See RCW 35A.01.040(2). Thus, for
purposes of RCW 35A.01.040(1) -(3) the petition for annexation is
sufficient. Because the remaining sufficiency requisites set
forth in RCW 35A.01.040 are matters to be determined by the
Tukwila city clerk, we did not address them.
The text of the petition also clearly meets the "petition content"
requirements set forth in RCW 35A.14.020. The petition under
consideration calls for an election to vote upon annexation of
unincorporated territory which is contiguous to the City of
Tukwila, an optional municipal code city. See City of Tukwila
Ord. No. 1009. The petition describes the boundaries of the area
proposed to be annexed by legal description and diagram.
The petitioners also claim that they represent at least ten
precent of the votes cast in the last state general election in
the area which is proposed to be annexed. In the text 'of the
petition it 'is also claimed that there are at least three hundred
twenty -eight (328) registered voters in the territory proposed to
be .annexed. Whether any of the petitioner's representations
discussed in this paragraph are, in fact, true is a matter to be
determined by the Tukwila city clerk.
The second determination to be made by the prosecuting attorney's
office before certifying the petition is whether the City of
Tukwila is "legally authorized to take the actions specifically
requested in the petition" for annexation. RCW 35.13.025 and
35A.14.020.
As noted above, the City of Tukwila has chosen the optional
municipal code form of city government. City of Tukwila Ord. No.
1009. The legal authority for annexation by a code city is found
in RCW 35A.14.010.

Pursuant to RCW 35A.14.010 a code city has the power to annex
unincorporated territory in the county which lies contiguous to
the code city if such territory is not owned by the county for use
for agricultural fair purposes. The territory which is proposed
to be annexed to Tukwila is unincorporated property which the
county does not own and use for agricultural fair purposes. This
territory also lies contiguous to the eastern boundary of the City
of Tukwila. Therefore, in this context, the city has the
statutory authority to annex the territory described in the
petition. We did not address any other question regarding the
Annexation issue. Thus, we have not determined whether the
Tukwila city council may be impeded from certain actions because
of the restrictions contained in RCW 35A.14.230.
CONCLUSION
For the foregoing reasons, pursuant to RCW 35A.14.020, we certify.
the enclosed petition for annexation.

<1, the undersigned, g resenting ten percent of the votes, or more, cast in the last
eneral elect ion for the area in consideration for election herein, lyino contiguous
to 'the City of Tukwila, Washington of which there is estimated to be ,32Sx registered
voters, do hereby call for an election to be held to determine whether such area
should be annexed to the City of Tukwila pursuant to Section 35A.14.020 of the
Revised Code of Washington.
The territory proposed to be annexed is within King County, Washington, and is
.described as follows: SEE, attached legal description in "Exhibit A" and map in
"Exhibit B."
This group of pages is one of a number of identical groups of pages forming one peti-
tion seeking the annexation of the property described below to the City of Tukwila,
and may be filed with other groups of pages containing additional signatures.
The undersigned has read the above or attached text and prayer of the petition and
consents to the filing of other groups of pages hereto to be considered as a part of
this petition up through the working day upon which this petition is filed with the
King County Prosecuting Attorney.

of way margin of State Highway 518; thence Westerly along said South right of
way margin of State Highway 518 to the East right of way margin of 42nd Ave. S.;
thence South along said East right of way margin of 42nd Ave. S. to the South
right of way margin of S. 164th St.; thence East along said South right of way
margin of S. 164th St. to the Tukwila City Limits; thence Northerly along said
Tukwila City Limits to the South right of way margin of State Highway. 518 and
to the beginning.

A RESOLUTION OF INTENTION OF THE CITY OF
TUKWILA, WASHINGTON, EXPRESSING SUPPORT FOR
THE PROPOSED MC MICKEN HEIGHTS ELECTION
METHOD ANNEXATION.

WHEREAS, the City Council has been advised that the
owners of certain property within the McMicken Heights area,
more particularly described hereinafter, have filed a peti-
tion for annexation of said property to the City of Tukwila
pursuant to the election method, and
WHEREAS, the City Council feels it is appropriate to
express its support for the proposed annexation and its
intention to accept the annexation, now, therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON
HEREBY RESOLVES AS FOLLOWS:
The City Council hereby expresses its support for the
proposed annexation of the property located within the McMic-
ken Heights area generally bounded as follows:
Beginning at the intersection of the Tukwika City
limits and the south right -of -way margin of State
Highway 518; thence westerly along said south
right -of -way margin of State Highway 518 to the
east right -of -way margin of 42nd Ave South; thence
south along said east right -of -way margin of 42nd
Avenue South to the south right -of -way margin of
South 164th Street; thence east along said south
right -of -way margin of South 164th Street to the
Tukwila City limits; thence northerly along said
Tukwila City limits to the south right -of -way mar-
gin of State Highway 518 and to the beginning.
