QUITCLAIM DEED AND EASEMENT AGREEMENT
The Grantor, THE CITY OF SEATTLE, a municipal corporation, for and in considera-
tion of the benefits to its remaining lands abutting on either side, and of the cov-
enants of the City of Tukwila hereinafter set forth, conveys and quitclaims to the
CITY OF TUKWILA, a municipal corporation, for public road and street purposes over
the real estate described in "A" below, and an easement for the right, privilege and
authority to allow and permit, and to construct, alter, repair, operate and maintain
underground electric, telephone, water, sewer, gas and other utility transmission and
c7 distribution facilities, consisting of vaults, manholes, ducts, pipes, mains, conduits,
C7l cables, wires and other necessary or convenient appurtenances to be located beneath
the following described real estate in "B all of which real estate is situated in

the northeast quarter of Section 26, Township 23 North, Range
4 East, W.M., in King County, Washington, described as follows:
Beginning at the southwest corner of said subdivision; thence
North 0 0 26'30" West along the west line of said subdivision
333.20 feet to the true point of beginning; thence South 89 30"
East parallel to the south line of said subdivision 9.58 feet to
the center line of a drainage ditch; thence along said center
line North 48 East 97.16 feet; thence North 40

feet to the true point of beginning, EXCEPT the north 30 feet
thereof.
ALSO, the east 30 feet of the southwest quarter of the north-
east quarter (SW u of NE k) of Section 26, Township 23 North,
Range 4 East, W.M., EXCEPT the north 30 feet thereof.
"B The east fifteen feet of the west forty -five feet of that por-
tion of the southeast quarter of the northeast quarter of Sec-
tion 26, Township 23 North, Range 4 East, W.M., in King County,
Washington, described as follows:
Beginning at the southwest corner of said subdivision; thence
North 0 0 26'30" West along the west line of said subdivision
333.20 feet to the true point of beginning; thence South 89
East parallel to the south line of said subdivision 9.58 feet to

feet to the true point of beginning, EXCEPT the north 30 feet thereof.
ALSO, the west ten feet of the east forty feet of the south-
west quarter of the northeast quarter (SW of NE 4) of Sec-
tion 26, Township 23 North, Range 4 East, W.M., EXCEPT the
north 30 feet thereof.
The Grantor, its heirs, successors and assigns retain the right of egress and
ingress to the above street area at street level across all such utility easement
area from the remaining lands of Grantor abutting on each side.
a These grants are subject to construction of an improved street and related
permanent underground storm sewer and water facilities on the above area by the City
�D of Tukwila. If such street improvement and utility facilities are not completed and
CD final acceptance of such work made by Tukwila on or before December 31, 1975, the
CD easements, right, privilege, authority herein, and the conveyances and grants herein
CD made shall automatically cease, terminate and become null and void and all,rights and
title of the Grantor to the above described real estate shall become unencumbered of

Such grants and conveyances are subject to those certain easements as follows:
That certain easement executed October 25, 1961 for sewer and water
lines granted to the City of Tukwila by the City of Seattle pursuant
to Seattle Ordinance 90540, approved September 12, 1961, and Tukwila
Resolution 146.
That certain easement executed July 26, 1968, for underground tele-
phone system granted to Pacific Northwest Bell Telephone Company
pursuant to Seattle Ordinance 96893 and recorded under King County
Auditor's File Number 6397207 in Volume 5134 of Deeds, Page 494.
That certain easement executed August 6, 1970 for an underground
pipeline granted to Olympic Pipeline Company pursuant to Seattle
Ordinance No 99125 and recorded under King County Auditor's File
No. 6683975 in Volume 441 of Deeds, Page 552•
The grants and conveyances contained herein are subject to the unconditional
rezoning by the City of Tukwila of all the City of Seattle property in the SW i
of the NE 4 and that portion of said property lying within the SE u of the NE,
all in Section 26, Township 23 North, Range 4 East, W.M., in King County,
Washington, from RA (Residential Agricultural) to CM (Industrial Park).
In the event the above areas be abandoned or vacated by Grantee, its succes-
sors or assigns, the grants and conveyances herein shall terminate and revert to
Grantor, its successors or assigns.
IN WITNESS WHEREOF, the City has caused this instrument to be executed by its
Mayor and City Comptroller pursuant to Ordinance 102800 and the Grantee
has executed the same this 14th day of December 19 73

This agreement accepted subject to the foregoing covenants under
