It appears that the majority of our facility is not disturbed by your improvements. However, facilities such as hydrants and valve boxes affected by changes in the grade will need to be adjusted in accordance with the districts' standards. Additionally, areas where the watermain will exceed 6' cover, the pipeline must be sleeved with a steal casing to avoid future excavations beyond our capabilities. Dike Improvements Project (85- DR03). On 6/28/91, following preparation by Tukwila's SEPA Official of a "draft" determination of non - significance for the project, the SEPA materials were submitted to Mr. Lank's office for comments with a request for reply by 7/10/91. During the morning hours of 7/10/91, I visited with Mr. Derek Poon of Mr. Lank's Division, and informed him of our urgency to obtain a SEPA determination in order to meet deadlines for processing the Shorelines Permit (L91SH084) for this same project. He stated that he would have a response for us by the close of business on 7/1/91. In the afternoon of 7/1/91, I spoke with Eric Stockdale, who had been assigned the responsibility of reviewing the SEPA materials and determining if there would be a need for comments on behalf of the County. Mr. Stockdale stated that he had reviewed the materials and that King County would not be providing comments on the checklist or the determination of non - significance. The proposed cutoff levee is the upstream tie to high ground for a levee improvement project which extends from 1-405 to the south past S. 180th St., along the west bank of the Green River. When completed, the levee will have two feet of freeboard above the Standard Project Flood (SPF). The Army Corps of Engineers is participating in the project in an amount of $1.6 million, however, if the project does not go to construction by September ist, the federal funding will be withdrawn. The cutoff levee was originally proposed in an area within the City Limits of Tukwila and had to be relocated due to the discovery of a small wetland in the originally proposed cutoff levee alignment. A Shorelines permit had been issued for the originally proposed cutoff levee as an element of the entire project scope. The new proposed location, however, is outside the City of Tukwila and requires King County Permits for Shorelines, Grading, and R.O.W. Use. The City of Tukwila Department of Community Development is serving as the lead agency on the SEPA determination as approved by King County Environmental Review Division (see Exhibit D -12 (d)). The cutoff levee is to be constructed in the existing foot print of an existing levee, a county roadway, and a private roadway. No construction will occur on the riverward side of the existing structures. There is no room riverward of the Frager Rd. (county road) section of the levee to provide additional shade- related vegetation.. Additional shade vegetation has been voluntarily provided in the scope of work for portions of the levee improvements within the City's limits to enhance the habitat value for anadromous fish species in the river. The Army Corps of Engineers conducted an environmental assessment for the remainder of the proposed improvements (in the City Limits), and the District Engineer issued a finding of no significant impact. CENPS- EN -PL -ER June 5, 1991 MEMORANDUM FOR: RECORD SUBJECT: Site Inspection of Proposed Cutoff Levee for Tukwila Levees to Determine the Presence of Wetlands Within the Levee Alignment 1. Subject site inspection was conducted June 4, 1991, by Ken Brunner, wildlife biologist for the Seattle District Corps of Engineers. Mr. Brunner has been trained in the identification of wetlands and is competent to conduct the subject inspection. 2. Project Description. Approximately 300 feet of existing levee would be tapered; 925 feet of Frager Road would be raised; and 750 feet of cutoff levee would be constructed along 196th Street. All of this work would be done within the existing footprint of the various existing features, and would not impinge on natural features. The lone exception to this may be along Frager Road, where the levee may need to extend a few feet beyond the existing footprint of the road. 3. Analysis. No wetlands were found along any of the three sections of proposed levee construction, neither on existing structures nor adjacent to the structures. The Green River flows riverward of the existing levee; the vegetation on the riverward side of the levee consists of a tall, unidentified grass (similar in appearance, but smaller than, reed canary grass); evergreen blackberry, and Scot's broom. Horsetail (Equisetum sp.) was also present in small patches. On the landward side of the levee was tilled farmland up to the toe of the levee, and up to the edge of Frager Road. Likewise, along the south edge of 196th is tilled farmland. Along the north edge 196th, and the west side of Frager Road, is a paved lot. No standing water, and no evidence of standing water was found anywhere in the vicinity of the proposed alignment. Soil pits were not dug, though the soil surface was inspected at random, and no saturated soils were found. The soils may or may not be considered hydric, but soils maps were not available at the time of inspection. Though evidence is sketchy, the undersigned feels that, based on the lack of wetland vegetation, that no wetlands exist in the vicinity of the proposed levee alignment. Kenneth R. The project has been closely coordinated with King County Surface Water Management Division and the Corps of Engineers and is funded to a large extent with Corps funds. If the construction of this project is delayed beyond the 1991 season, it is very likely that we will lose funding assistance. Therefore, we are seeking any means available to expedite the permitting processes associated with this project. As stated in my previous letter, the City must obtain a Shoreline Permit, Grading Permit, Right -of -Way Use Permit, and SEPA Determination, from the County, for those portions of the project which are outside the City. In an effort to meet our restrictive time line and begin construction this season, we respectfully request that you consider transferring responsibility for the SEPA process to the City of Tukwila Department of Community Development (DCD). This transfer is appropriate as DCD is very familiar with the project specifics and have conducted the SEPA review for the remainder of the proposed levee improvements. With your concurrence, our DCD will move forward with their review and determination for the section of levee improvements outside the City. To ensure that the County has input in the process, our SEPA Official plans to provide your agency with a copy of the checklist for review and comments prior to issuing a determination. The City will seek the remaining required permits listed above through applicable County agencies. My staff have met with Chris Tiffany and Anna Nelson of your staff to discuss this issue and they have indicated that they are not opposed to the option. If you concur, it is very likely that we can move forward on this regionally significant project. The Corps, the City and King County have all been working with other agencies and property owners for the past two years in expediting this project. The environmental process has been carried out for the original dike /levee scope of work with the Corps as lead agency (copy enclosed). The City has also prepared the Christensen Road Project which is part of the committment for the Corps 205 Project and is now about to be advertised for summer of 1991 construction. The City has also carried out a shoreline permitting process through your department for the Corps 205 /Christensen Road Projects. At this late time frame, the scope for the southerly end of the Jack Pace May 24, 1991 Page 2 project has been changed and now requires processing of permits and easement acquisitions through the county and private property owners. The permits which will be required from the county include the following: 1. Shoreline Permit 2. Right -of -Way Construction Permit 3. Grade and Fill Permit It is not anticipated the County's SAO process will be triggered by this work per recent discussions with County BAQLD officials. The raising of Frager Road and utilization for the additional function of flood protection by the City will require a flood easement from the property owners and a right -of -way construction permit from the County; the taper from Frager Road to the existing levee and the levee to the City boundaries will require a conversion of the existing King County easement via King County to the City (also allowing for the taper); finally, a new easement will be required from private property owner to the City for the new cross levee at South 196th Street from Frager Road to the west and the hill (approximately 750 LF). The City has been in touch with all private property owners and public agencies affected by this process and is working with the property owners and King County to get the permitting process accomplished now. The first order of business before the Shoreline Permit, Right -of -Way Construction Permit and the Grade and Fill Permit can be processed, is to obtain a SEPA determination. From my meeting with Anna Shell of BALD, who carries out the Shoreline permit for the County and Chris Tiffany of BALD who carries out the Grade and Fill permitting process, informed George Kessler of SSWM, Noel Gilbrough of the Corps of Engineers and myself (5/20/91) that King County is agreeable to other agencies providing lead agency status to carry out the environmental process, and also invited the City to carry out the environmental process to expedite the entire project. Today I'm writing a letter to BALD, which you will receive a copy of, which states the City of Tukwila will accept this suggestion and is proceeding ahead with this project accordingly. The City has also been in touch with the heads of various King County departments to expedite the permitting process including Lou Haff, County Engineer, George Wanamaker of the Roads Division, Jim Kramer of King County SSWM (SSWM has been working very closely with the City and the Corps throughout the development of the Corps 205 Project), Pearl McElheran, Manager for the Real Property Division and Greg Kipp, Manager at BALD. Copies of May 3, 1991 letters to County Managers reflecting our coordination efforts are enclosed in this submittal. w • Jack Pace May 24, 1991 Page 3 The scope of this project is to raise approximately 925 feet of Frager Road, an average of 2 feet; providing the taper from the raised Frager Road along the existing dike /levee for approximately 300 feet to meet existing dike elevation of 35.2; and, finally raising the existing private roadway approximately 4 - 7 feet from Frager Road to meet the existing hillside Elevation 35.2 - all of which is to provide 2 feet of freeboard above the standard project flood elevation (final elevation 35.2 - NGVD). All this work will be accomplished within the parameters of the existing roadways and Frager Road roadway right -of -way and in such a manner as to not affect nor impact any other uses. The final product will be a conversion of existing roadways, both public and private, and tie into the existing Green River levee in such a manner as to provide the necessary SPF diking which provides necessary flood protection to the City's infrastructure. It was prepared in response to a letter from King County dated 2 June 1987 which requested Federal assistance in providing flood protection to the city of Tukwila from flooding from the Green River. In the course of the study the city of Tukwila took over the sponsorship of the proposed project as it lies wholly within the city limits of Tukwila. The results of the preliminary planning indicated that only one alternative, raising an existing levee and either tieing into a private land owner's levee improvement or adding a short cutoff levee to provide standard project flood (SPF) protection, met the requirements of economic, engineering, and environmental feasibility while responding to the flood damage reduction criteria. The costs and benefits for this alternative were compared to the "no- action" alternative. Due to the significant amount of development within the flood plain, flood proofing and setback levees were not considered as viable alternatives. The environmental impacts of the proposed action are typical of any small construction project. These include short-term increases in noise, dust, and debris and vehicular traffic disruption. There will also be temporary loss of recreational and Levee top vegetation, and the cutoff levee will cover up to 12 acre of wetland. If the Federal project ties_into a private levee, impacts associated with the cutoff levee will not occur. Various measures will be taken to assure that more severe impacts do not occur: • Avoid construction or equipment operation in the Green River. ' • Avoid construction, material placement, or negative disruption of riverward levee slopes. • Minimize construction disruption of recreational activity on the strip park portion of the levee. • Use existing sources of clean quarry materials for levee improvements. • Take extreme precaution to avoid petroleum product spols during construction. • • Area restoration.' The planning for this project complies with all applicable laws, regulations, and agency consultations, including the Endangered Species Act, Fish and Wildlife Coordination Act, and National Environmental Policy Act. Based on the analysis described above and provided in more detail in the environmental assessment, it has been determined that the project will not result in significant adverse environmental impacts. The proposed project is not a major action and, therefore, does not require preparation of an environmental impact statement. Project Background. Location. Description. Cverview. and Need. a. Authority. This study is conducted under authority of Section 205 of the 1948 Flood Control Act, as amended. In the course of the study the city of Tukwila took over the sponsorship of the proposed project as it lies wholely within the city limits of Tukwila. b. btudy Area. The study area is along the left bank of the Green River in southwestern King County, Washington State. The Green River drains an area of 438 square miles (see figure 1) as it flows west and north from the Cascade Mountains 60 miles to the historic mouth of the Black River, forming the Duwamish River. The Duwamish River empties into Elliott Bay in Puget Sound in Seattle 11 miles downstream. c. Needs. Howard A. Hanson Dam at river mile (R.M.) 64.5 and a system of levees provides flood control to the lower Green River Basin. King County and the cities of Auburn, Kent, Renton, and Tukwila have recently competed a comprehensive study of the Green River levee system. That study identified riverbank areas between the cities of Auburn and Tukwila that do not have sufficient height to contain design flows and still provide adequate levels of freeboard. One of the most significant reaches of deficient levee identified in these studies was also identified by a Corps of Engineers 1984 study of the Green River. This area is on the left bank of the river, extending along Christensen Road in Tukwila southerly to approximately South 196th Street on Frager Road (see figure 2). The 1984 Corps of Engineers study also proposed improvements to this 3.5 mile reach which the local governments agreed to sponsor. The Corps of Engineers later determined that the project could not be implemented based on a concern that the levee improvement would not provide complete flood protection to the benefitted area and would be dependent on the performance of other locally constructed and maintained levees. Mapping indicated that this levee reach (see figure 2) would be complete unto itself with the addition of a small cutoff levee at its upstream end. Developments during plans and specifications have allowed the option of tieing into a private levee being planned by the Seattle District, Corps of Engineers. Such a tie in would forego the need to construct the cutoff levee. The private (Sepale) levee is undergoing a separate planning and permit review at the present time. *This revision complements and supplements the draft EA coordinated in July 1989. Revisions, changes, and additions are resultant from comments received on the draft EA and project options added during preparation of plans and specifications. The•Federal Emergency Management Association (FEMA) has conducted a flood ' plain management study for the past several years that included the Tukwila area. This study has concluded that'a significant portion of the study area lies within the 100 -year flood plain and is in the process of revising their maps to indicate this. The city has completed interim repairs to the levees to ensure that the city stays out of the 100 -year flood plain as designated by FEMA. The city coordinated this action with FEMA and the Corps of Engineers. 2. Alternatives. a. General. The results of the preliminary planning indicated that only one alternative, the SPF levee, met the requirements of economic, engineering, and environmental feasibility while responding to the planning criteria. The costs and benefits for this alternative were compared to the "no- action" alternative. Due to the significant amount of development within the flood plain, flood proofing and set back levees were not considered as viable alternatives. b. The No- Action Alternative.. No action by the Corps of Engineers would be taken for flood damage reduction through either structural or nonstructural means. The no- action alternative would result in the continuation of average annual flood damages in the study area estimated to be *387,500. c. The SPF Levee Alternative - The Recommended Plan. The recommended plan would be a modification to the existing 100 -year protection levee to increase its height so that it would protect the study area against an SPF flood. This would entail modifications to 3.5 miles of existing levee from R.M. 12.7 to R.M. 16.2. 3. The Proposed Project. a. General. The downstream end of the project begins at the Highway 405 Bridge across the Green River. The project parallels the river incorporating 500 feet of high ground from Highway 405 south along Christensen Road. From here the levee begins, requiring 780 feet of Christensen Road to be raised approximately 2 feet. The levee then leaves Christensen Road and begins to follow the Green River trail systems along the river for approximately 11,550 feet. The first 2,080 feet of the trail system lies above the SPF level and ties to high ground. From here the project then requires a levee improvement for the next 6,540 feet of the park. The next 2,930 feet of the trail system which is located on top of an existing levee would be raised from 180th Street Bridge over the Green River to the southern end of the trail along the vest bank. Both of these levee segments would average approximately 18 inches in height. The project would then raise 5,270 feet of an existing levee adjacent to the Segale development from 180th Street to the southern city limit of Tukwila. This levee segment would average approximately a 1 foot increase in height. Feasibility studies indicated here the project would leave the river requiring a cutoff levee approximately 535 feet long to tie the project to high ground at the west side of the flood plain. An option identified during preparation of plans and specifications would consist of tying the upstream 4 • • end of the improved levee into a levee to protect a proposed developement by a local landowner that would consist of approximately 200 acres and would run from the upstream end of the proposed Section 205 project to 204th Street. This development would be constructed with a Corps approved SPF levee and include a 9 -acre retention pond. This proposal is being planned by the landowner in accordance with applicable laws and regulations and may be completed in time to meet the Federal project. b. Relocations. The alignment of the levee requires the relocation of approximately 780 feet of Christensen Road (includes transitional slopes to match the existing grade of Christensen Road), 4,700 feet of a 6- foot -wide running path with a crushed brick surface and 2,930 feet of a 10- foot -✓wide asphalt path. The relocation of Christensen Road is necessary to maintain vehicle access to existing businesses. The design of the Christensen Road relocation has been previously designed for the city of Tukwila. The trail, parking area, and approximately 100 feet of the road design are not considered part of the relocation required for this project. The existing running path and bike path will be relocated where necessary on top of the new levee sections. The width of the two paths and the surface materials used will be the same in order to maintain the current use of the paths and to provide esthetic continuity throughout the park. c. Landscape Restoration. Landscape restoration of the proposed project includes topsoiling and sodding or seeding embankments and disturbed surfaces, relocating or replacing existing park trees, and restoration of recreation trails and replacement or relocation of existing site furnishings. The main objective of the landscape restoration is to maintain a safe and esthetically pleasing project in light of the regional value and high public use of the Green River trail system and to replace habitat value. Restoration of new or disturbed surfaces (including contractor staging and access areas) shall include topsoiling (2 -inch depth) and grass seeding or sodding. Sodding shall be performed in all disturbed areas of the Christensen Greenbelt Park which had previously been maintained lawn as well as other surfaces adjacent to trails or recreation site features where quick establishment is required due to high public use. Seeding shall be performed on all other surfaces to be grassed (primarily large embankment slopes and low maintenance areas). Trees requiring removal and considered cost effective to be relocated shall be removed and placed on the landward side of the levee, if possible. The loss of existing park trees determined not cost effective to relocate shall be replaced with a 4 -inch diameter tree of similar species (based_ on availability and appropriateness) in a new location. At present, only a single large tree will be required to be destroyed. Wherever possible, no fill material shall be placed within the drip line of existing trees to be retained as this will cause irreparable damage to tree roots and eventual death of the tree. 5 • • Recreation features (consisting primarily of picnic tables, benches, bollards, and signs) throughout the park and trail system that are impacted by the flood control project shall be relocated. Maintaining as much barrier —free access as possible to the trail systems shall be considered throughout project design and construction. Grade transitions between existing and proposed slopes shall be smooth (especially to trails or paths) to provide a safe and esthetically pleasing project. Transitions between levee types shall be given special attention during design to avoid abrupt grade changes and sharp tail turns. Trail surfaces shall be placed flush with the finished grade for ease of mowing and public safety. 4. Affected Environment. The Green River Valley is about 2 miles wide and contains rich agricultural bottomland. The lower part of the valley from Auburn to Tukwila is currently undergoing rapid transformation from agricultural to light industry, large shopping centers, and residential development. Within the project area, the Green River is a slow, meandering stream with an unconsolidated bottom. It is confined to a deep channel about 100 to 200 feet in width. The river banks are predominantly part of an extensive earth embankment levee system with smaller areas of high natural banks. A few bends in the river may be armored with riprap. Representative vegetation growing along the banks of the river consist of esquisetum, juncus, reed canarygrass, blackberry spp., and a few cottonwood trees. In summer months aquatic vegetation and filamentous algae grow along shorelines and shallows. AQUATIC RESOURCES Fish habitat within the project area has been severely altered. Commercial development, clearing and filling of land, increased volumes and rates of stormwater runoff, building construction, and diking and piping within the floodplain /riparian corridor have had major impacts on water quality and fish habitat. Key anadromous fish species found in the system include steelhead trout, searun cutthroat trout, fall chinook, coho, and chum salmon. In addition, there are a variety of resident fish. The portion of the Green River that flows through the project area is used by anadromous fish primarily for transportation and rearing. Fall chinook, coho, and chum are the principle salmon species utilizing this section of the river. The Washington Department of Fisheries (WDF) reported a 1986 estimated total escapement of 15,574 fall chinook, 18,982 coho; and 6,188 chum for the Green - Duwamish River. The Green River has been one of Washington State's top 20 summer steelhead rivers in recent years. Summer and winter steelhead smolts have been planted in the Green River watershed. Winter —run smolt releases in 1987 totaled 140,000 (WDW released 114,000 and treaty tribes 25,900). These fish may remain in the Green River for 2 -3 years before migrating to the ocean.. They 6 return to spawn usually after 2 -3 years. Total run size for the winter -run steelhead for 1987 -1988 was estimated at 10,023. The sport catch for Green - Duwamish River steelhead was estimated at 720 for 1987 summer -run and 2,301 for 1987 -1988 winter run. TERRESTRIAL RESOURCES Alteration and destruction of wildlife habitat has occurred and continues to occur in the lower Green River Valley. Significant losses of riparian habitat and seasonally flooded wetlands adjacent to the river have increased because of accelerated development within the floodplain, and the flood control projects that have been implemented to protect those developments. Species of wildlife that occur or have occurred in the past are probably those that typically use riparian and wetland areas. Mammal species would include beaver, muskrat, mink, river otter, striped skunk, long - tailed weasel and numerous small mammals. Waterfowl, wading birds, and passerine birds probably inhabit the area year - around or transitionally during migration. Mallards, common mergansers, and great blue herons were observed in or near the project site during an onsite visit. CULTURAL RESOURCES The alinement for the project was disturbed by construction of the existing levee and there is no potential for discovery of cultural resources. THREATENED AND ENDANGERED SPECIES In accordance with Section 7 of the Endangered Species Act of 1973, as amended, the Corps is required to assure that their actions have taken into consideration impacts to federally listed or proposed threatened or endangered species for all federally funded, constructed, permitted, or licensed projects. The Fish and Wildlife Service has determined in their letter of April 25, 1989, to the best of present knowledge, there are no listed or proposed threatened or endangered species occurring within the project area. Should a species become officially listed or proposed before completion of the project, the Corps would fulfill its continuing responsibilities as described in sections 7(a) and (c) of the Act. 5. Environmental Impacts and Ameliorative Measures. a. General. Impacts of the proposed action - the SPF levee - are typical of any small construction project. These include short -term increases in noise, dust, and debris and vehicular traffic disruption. There will be temporary loss of recreational and levee top vegetation. Up to approximately X acre of wetlands may be covered by the cutoff levee. 7 b. Fish Resources. • Impacts to fish populations and fish habitat are not expected because the project is located on the top of an existing levee system and no construction would be done'on the riverward side of the levee in the Green River. There may be opportunities to increase shading. • During the construction phase, potential siltation and turbidity could occur should bank excavation or the new materials for rebuilding the levee enter into the river. Futhermore, if petroleum products from construction equipment or construction activities entered the river, this could also potentially cause adverse impacts to fish and other aquatic organisms. c. Wildlife Resources. • Approximately 12,840 square feet (.29 acres) of floodplain habitat would be impacted from the construction of a new cutoff levee located at the upstream end of the project area. The vegetation in this area is primarily reed canarygrass and Himalayan blackberry. A small section of the impact area near Frager Road is dominated with cattail and sedge. The cutoff levee would border agricultural land to the south and commercial development on the north side. Wildlife use of this habitat is unknown. This habitat will be definitively characterized during plans and specifications and, if warranted, ameliorative measures or replacement will be included in the project. This impact will not occur if the option to meet private levee is undertaken. • Short term direct impacts to wildlife could potentially occur during the construction phase of the project. Displacement of wildlife from using the riparian habitat along the levee system would be localized to the area of construction activity. The actual effects to mammals and avian species would be unknown, but would be expected to be temporary since the degree and duration of construction activity at any one location should be small. • Because the major part of the project is located on top of an existing levee, disturbance of wildlife habitat will be minimal. However, the project could involve removal of one existing mature tree along the top of the levee. This would eliminate habitat for perching birds, primarily passerine species. As compensation for loss of these trees, the project included replacement of similar species and in a nearby location. A substantial amount of time will pass before the replacement trees are able to grow large enough to provide an equal amount of perching habitat. Replacement plans include planting of fast growing trees up and downstream of the railroad bridge just upstream of Strander Boulevard. 8 • The project would disturb existing vegetation on top of the levee and at construction equipment, access and staging areas. Project designs have incorporated restoration of new or disturbed surfaces by topsoiling and grass seeding or sodding. Impacts should be short—term if vegetation measures are directed towards restoring and replacing stable and diverse vegetation cover as soon as possible following project construction. Maintenance of revegetation measures is the responsibility of the local sponsor of the project. d. Mitigation to Ameliorate and Avoid Impacts. (1) Avoid construction or equipment operation in the Green River. (2) Avoid construction, material placement, or vegetative disruption of riverward levee slopes. However, other policies govern the long —term maintenance of levee systems which are separate and apart from levee construction authorities. These policies relate to maintenance of any levee for which Federal funds may be expended (Public Law 99 program). The existing levees being improved through the proposed project are subject to these policies —even if the project were not undertaken. While vegetation (brush, blackberry vines, etc.) located riverward of the new construction would not be removed as an integral part of this project it may be partially removed prior and subsequent to the project. Such partial removal will only be accomplished to the extent necessary to inspect and maintain the integrity of the existing levee and to preserve the design capacity. If the levee improvements we propose are implemented, there will continue to be vegetation control by the local sponsor as required in an operating agreement. (3) Minimize mud and dirt tracking from construction sites. (4) Minimize construction disruption of recreational activity on the strip park portion of the levee. (5) Use existing sources of clean quarry materials for levee improvements. (6) Take extreme precaution to avoid petroleum product spills during construction. On 1/23/89 we contacted Mr. Noel GS1I:r ough to discuss our concerns with this proposed project. The following comments encapsulize this conversation. The Tribe is very concerned With vegetation management on the entire Green River, and particularly with the lower Green /Duwamish. It s Intuitively obvious to even the most casual observer that there is a severe lec1; of shading vegetation along the lower Green, due mainly to flood control practices. This has resulted in critically high water temperatures for returning fall chinook salmon and a lack of shade for 'ding cover. The Green River has the largest chinook run in South get Sound. The total return to the river in fall of 1989 is projected m t 20,00C t= 30,000 chinook. On page 4 the Draft EA incorrectly states the 1985 estimated total run size of 692 fall chinook and 8.132 chum for the Greer.- Duwamish River.- The actual predicted total run size for 1985 fall ch:'r,:!- was.15,500 according to the joint VDT/Tribal Report (see attachment). We suspect the chum number is 8,132. The pr ;osed levee project area contains numerous large trees (up to 4' diameter) along the banks of the Green River. These trees provide the only shade for meny miles of the lower Green and are therefore very important to retain at all costs. The project proposal mentions that trees over 6" diameter are too costly to relocate and will be replaced with a 4" diameter tree of similar species. The Tribe does not feel. that replacing a 4 foot diameter shade tree with a 4 inch diameter ttree (which will not provide shade for the river for decades, if ever) is .Y acceptable. ;. We suggest revising the LA for this project to reflect protection of.all large trees, and if it Is absolutely impossible tol protect them, that they be replaced with ten or more 4 -6 inch diameter trees that will be located close enough to actually shade the green River. On 1/23/89, ?!r. Gilbrough noted that only one to three large trees would have to be • removed, and that a large bar at river mile 13 would be a good site for planting the much smaller replacement trees. While the Tribe would. -refer on -site replacement, this would appear to be an acceptable mpromise. Based on the Surface Water Management Division's review of these project - related materials, I have the following single comment to offer: Section 5.b. of the DEA should also reference the possible removal of mature cottonwoods from the top of the levees as a potential impact to fisheries resources. While Section 5.c. properly deals with these habitat impacts to passerine bird species, it is important to note the critical reliance of fish species on the shade provided by such large trees. This comment also applies to recommendation 5 on page 7 of Appendix C to the DPR. Both high temperatures and temperature- related concerns with low dissolved oxygen levels have been consistently noted as factors potentially limiting utilization of remaining fish habitat in the lower Green River. Studies performed both by Metro and through the Green River Basin Program have outlined this concern, and strongly recommend preservation of any relict stands of mature cotton- woods which may still remain. Depending upon specific levee siting decisions to be made by the COE, it may be possible for preservation of these trees to be incorporated Into the flood control project, pursuant to Section 7 -6(3) of the COE's March 31, 1978 Engineer Manual No. EM111O -2 -1913, entitled, 'Design and Construction of Levees.' It was prepared in response to a letter from King County dated 2 June 1987 which requested Federal assistance in providing flood protection to the city of Tukwila from flooding from the Green River. In the course of the study the city of Tukwila took over the sponsorship of the proposed project as it lies wholly within the city limits of Tukwila. The results of the preliminary planning indicated that only one alternative, raising an existing levee and either tieing into a private land owner's levee improvement or adding a short cutoff levee to provide standard project flood (SPF) protection, met the requirements of economic, engineering, and environmental feasibility while responding to the flood damage reduction criteria. The costs and benefits for this alternative were compared to the "no- action" alternative. Due to the significant amount of development within the flood plain, flood proofing and setback levees were not considered as viable alternatives. The environmental impacts of the proposed action are typical of any small construction project. These include short -term increases in noise, dust, and debris and vehicular traffic disruption. There will also be temporary loss of recreational and levee top vegetation, and the cutoff levee will cover up to 12 acre of wetland. If the Federal project ties into a private levee, impacts associated with the cutoff levee will not occur.
