Mitigating Actions
for
EPIC- 30 -89: Hampton Inn Hotel
1. All provisions of the Public Works Department letter dated
December 15, 1989 (Attachment B) shall be satisfied.
2. The hotel structure shall be exactly located by a licensed
surveyor due to the very precise site construction required
to implement the approved design on the north, south, and
east of the structure. Precise construction is complicated
by the curvi- linear eastern property line which makes
accurate building location difficult.
The surveyor shall guarantee building location in a letter
to be received by the Building division prior to calling for
a foundation inspection.
This letter shall contain the following:
a. An unconditional statement that the building is located
as shown on the approved building plans and
b. An original stamp with signature.

Dear Sir:
The Public Works Department has reviewed your Plan Sheet No.'s
C -1 through C -4 and Plan Sheet No. M -1.0, and approves these
plans per the following conditions and comments:
The Erosion Control Plan (per Centrac letter of 12/12/89 and
conditions of this letter) is approved. These temporary
erosion controls are part of a Grade and Fill Permit which is
approved and administrated through the Building Official, (Ref.
Duane Griffin, 433 - 1854). Note: Conditions under Item # 9 of
this letter to apply to use of the public storm system at
Nelsen Place.
Relocation of the power pole and reimbursement for
such relocation to Puget Power shall be accomplished prior
to sign -off and allowance of access for this development.
Prior to obtaining the Grade and Fill Permit through the
Building Department, the Development shall show proof of
payment to Puget Power for this pole relocation.
This plan review is conditioned per the Poon Developer's
Agreement on file at the City Clerk's Office.
The approvals of the Building Official and Planning Director
shall be provided for issuance for the following permits. Call
Becky Davis, Permit Coordinator at 433 -1851 to have the
following permits prepared:
1. Flood Control Zone Permit (Permit Fee = $50.00)
The grade and fill portion and the site plan for

this development shall be covered by this permit.
2. Hauling Permit (Permit Fee = $25.00)
If hauling is required, a $2,000 bond, certificate of
insurance (minimum $1,000,000 for bodily injury /property
damage) and routing map shall be provided with the
application for the permit.
3. Public Roadway Improvements /Underground Street Lights/
Curb Cut /Access /Sidewalk Permit (Refer to May 8, 1989)
letter to Robert Poon and Permit No. CCAS - 142 -89
Development of curb /gutter /sidewalk /accesses and South
156th Street improvements shall be completed and
approved, per the conditions of prior public development
improvements approvals, (Ref. May 8, 1989 letter enclosed)
before access will be allowed for this development.
Included in these approvals will be authorization of
WSDOT in the City to allow access onto West Valley Highway
via South 156th Street as outlined in the May 8, 1989
letter.
4. Sanitary Side Sewer Permit (Regular Connection Charge
Plus $20.00 Inspection Fee for Hotel Structure)
Special connection charge for sanitary side sewers waived
by original construction and contributions to LID #19 and
past participation for development of sanitary sewer mains.
5. Water Meter Permit (A 4" Water Meter Deposit /Regular
Connection Charge Fee = $2,400)
The special connection charges for watermains is waived
by the development of the public water line in West
Valley Highway to the development. It is understood
that until this watermain is completed and signed off
with requests for acceptance through the City Council,
that this development is still unserved. (Reference May 8,
1989 letter, Item # 3).
6. Fire Loops /Fire Hydrants (Permit Fee = $25.00 - 8"
Fire Line into Property)
A stand -by charge for the 8" line from the property line
adjacent to West Valley Highway will be placed in the
development's water /sewer /Metro bill in the future.
The Public Works Department reviews and approves this
permit, the fire line from the wet tap of the proposed
public main to the fire vault and /or building structure,
whichever occurs first. The fire lines from the vault
and beyond including the sprinkler system are reviewed
and approved through the Tukwila Fire Marshall's Office.
Appropriate flow analysis to meet needs of Fire Department
requirements shall be provided to the Fire Marshall (call
Nick Olivas at 433 - 1859).
It is understood that until the waterline extension
built under the South 156th Street project is completed
that water is unavailable to the site. All fire lines
shall be constructed per the City's Public Works Water
Construction Development Standards. (Reference May 8, 1989
letter, Item # 3).
7. Landscape Irrigation Permit (Permit Fee = $25.00)
Four sets of landscape irrigation plans for required
landscaping along with one copy of the approved Planning
Department's landscaping plan shall be submitted to Public
Works via the Permit Coordinator for review and approval
prior to beginning any landscape irrigation work.
8. Landscape Irrigation (2" Diameter) Deduct Meter Permit
(Permit Fee = - 0 -)
This permit shall be applied for and obtained prior to
the installation of the deduct meter.
Call Dave Grage at 433 -1863 to assure the appropriate meter
type is provided.
9. Storm Drainage Permit (Permit Fee = $25.00)
Temporary grade /fill and interim storm system and pump
facilities to South 156th, is conditioned upon Centrac's
letter (from Don Carr, dated December 12, 1989) which
can accommodate the gravity flow as constructed. This
system shall not operate until it is verified that the
City has reinstituted the storm connection to the existing
system to the east. Requested is a written notification
to my attention, 30 calendar days prior to use, or the
Nelsen Place storm system by your Development for
temporary, interim or permanent drainage contribution
-from your Development.
Also, interim drainage seeping onto Puget Power right -of-
ways is conditioned on approvals and conditions of approval
by Puget Power as memorialized in Don Carr's letter.
As stated in prior approvals for the public infrastructure
improvements for storm drainage, streets, signalization,
curbs and gutters, sidewalks, etc., all work for public
infrastructures shall be completed and the candidates for
proposed public facilities provided in a letter of request
for turnover to the City by the Developer prior to
allowing occupancy of said structure. (For storm drainage,
Reference: May 8, 1989 letter, Item # 2).
The Tukwila City Council is the sole and final authority
for turnover of any proposed public water,sidewalk, storm
drainage, street facilities under the City's jurisdiction.
WSDOT is the authority for acceptance of the signalization
work turn -over at South 156th Street. The turnover
documents requested from the Developer immediately after
construction and final signoff of the improvements
as turnover are as follows:
a) Letter of request for turnover from the Developer.
b) "As- built" plans for the proposed public facility.
c) List of materials /cost (in City Format).
d) Bill of Sale.
e) Easement /right -of -ways for proposed public utilities,
sidewalks and roadway improvements (per City Attorney's
format, call John Colgrove at 624 - 1040).
f) Signed -off permits, including WSDOT sign -off and
acceptance letter for resignalization at South 156th
and West Valley Highway and allowing for opening of
South 156th Street.

Dear Mr. Fraser:
This is in response to your request regarding our plans to accommodate the stormwater from the
porposed Hampton Inn. As we discussed at our December 1, 1989 meeting with city staff, Puget
Power staff and CENTRAC staff, the newly constructed storm drain on Nelson Place will not be
usable until future sections are completed. A temporary connection was constructed to tie in with
the existing storm drain along Nelson Place. However, the existing line is plugged at S. 158th
Street and, thus, water ponds at the intersection. The roadway is failing as a result of this water
damage.
Ross Earnst committed to unplugging the line and draining the water into lines to the east provided
that Puget Power would grant an easement. This is badly needed to protect the infrastructure of the
road. Puget Power agreed to grant the easement and would send the City the appropriate permit.
According to Wayne Bressler of Puget Power, this easement should be complete and available this
week. With Nelson Place line unplugged the Hampton Inn storm water could be pumped into the
Nelson Place line.
It is our understanding that this work will proceed immediately, therefore, we will install our pump
to allow site water to be pumped into the city system. This is consistent with past agreements and
the construction of the storm drain as a condition of the development. It will be some time before
the pump is installed so we anticipate no conflict with the City completing the work prior to us
needing the connection.
Thank you for the excellent cooperation in not only correcting the maintenance problem but in
helping us to progress with our project.

TITLE AND NEARBY PROPERTY REVIEW
We contracted with Transamerica Title Insurance .Services of Bellevue,
Washington to perform a title history .of the site property. The result of
their history review is attached to this. report as Appendix A. The
purpose of a title history review is to provide an extended list of
property ownership names for use in reviewing lists of potentially
contaminated sites'and to identify industries, which may have occupied the
site.
The names listed in the title. history review are personal names of •
individuals and do not reflect any particular industry., The property was
mos.t recently occupied by residences. and . the. title • history- does not,
suggest any deviation from that land_use..,�;
We reviewed the Environmental Protection Agency's' CERCI:IS list for
any references to this property. or surrounding properties. The. CERCLIS
list is a summary listing of sites where the EPA has identified sites that
may- require remedial activities. No references to the property were found
on the.CERCLIS list.
We 'performed a brief "windshield tour" of nearby properties to..
identify land uses that could indicate the.potential for contamination of
the ..subject- site During • that tour..we identified .'the" following
conditions that could impact your property:
1: An abandoned service station 'is located adjacent- to the
southwest portion of the property... The underground storage
tanks appear to have been removed from the .property..
:.2: A landscaping service is located, adjacent to the southeast
portion of the property: It appears as if this company has at
least one underground fuel storage tank.
3. A major interstate highway adjoins the property.. Major highways
can be the source of transportation related hazardous materials
spills.
4. Additional businesses which appear to.routinely handle fuel and
solvents are located within one block of the property.

This information was.used to select the analytical testing protocol .
for analysis of ground water samples.
GROUND WATER SAMPLING
We installed two shallow ground water monitor wells on the southern
side of the property. These wells were installed during, the exploration
phase of the geotechnical study. The purpose of the monitor wells was
solely to provide access to the shallow aquifer for ground water sampling:.

.water samples .were. analyzed for constituents ;indicative of fuel
solvent. contamination. Specific. analyses' performed on each, ground water*
sample include a:modified.EPA method...601 /602 analysis (halogenated_ and
non - halogenated volatile- organics) and by EPA method '418.1 (Total
Recoverable Fuel Hydrocarbons).
Ground water samples were analyzed..by Farr, Friedman.& Bruya, Inca
The results of'ground water testing are included as Appendix B. No,
detectable volatile organic.compounds' were found. Analytical detection
limits were selected to be significantly lower than the clean -up goals
currently being enforced by regulatory agencies with - jurisdiction in this
area. Low concentrations of total petroleum hydrocarbons were detected.
These-levels (2.1 and 2.2 parts per million) are well below the current
regulatory• cleanup goal'of 15 ppm total petroleum hydrocarbons in ground
water.

SOIL SAMPLING AND ANALYSIS
We reviewed the logs of the geotechnical test borings and backhoe
test pits for evidence of soil'contamination. One representative soil
sample from the "contractor staging :area" was selected for further
analysis of petroleum hydrocarbons.. The "contractor staging area ". is
located in the vicinity of Borings 1 and 3, and Test Pit 1, shown on the
Site Plan, Figure 1. Several small,areas of surficial oil contamination
were noted in this area. These areas are most likely attributable to oil
leaking from vehicles. The soil sample, tested was from Boring 3 at a
depth of 3 feet.' The soils sample was analyzed using EPA Method 418.1
(Total• Recoverable.Fuel Hydrocarbons): • No detectable Concentrations:of
fuel.hydrocarbons (less than 5 ppm) were noted in this sample.
CONCLUSIONS
The results of this -study did not indicate the ,presence of
'significant subsurface fuel or solvent contamination. This study did not
'find records of known or suspected contamination on. the subject site-or'
adjacent properties. Based upon- our_findings,'it s:.our opinion that
little'or no potential liability.exists at this site relative to existing
soil or..ground water contamination.
We recommend that the-two monitor wells installed for this study be
sealed and abandoned in .accordance with state law within one year of the
date of'this report.. We will be able to provide you with assistance
this matter.
LIMITATIONS
'We'-have prepared this report for; use by EPCO, Incorporated. This
report. can be made available to other interested parties. The
information contained herein may not:be applicable to other sites.
Our interpretations. are based on data from a number of sources
including existing information, ground water monitor well installations,
and explorations performed as part of a geotechnical evaluation of the
site. Parameters selected' for chemical analysis were based upon obser-
vations of nearby property use and do not represent a broad'scan of all

possible contaminants. It is possible that other contaminants exist on
the site or that areas with undetected contamination exist in areas of the
site that were not explored.
Within the limitations scope, schedule and budget, our services
have been executed in accordance with generally accepted practices in this
area at the time the report was prepared. No other conditions, express or .
implied, should be understood.

The Public Works Department has reviewed and approved the site plan
submittals for the subject development as referenced in the "RE"
section of this letter per the following comments and conditions:
Prior to beginning any portion of the work the developer shall
accomplish the following:
A. Obtain authorization of the Building Official and the Planning
Director of the City of Tukwila to carry out this work.
B. Post a performance bond with the City for 100% of the proposed
public improvements to be provided by this development and
WSDOT (which is paid for by the developer via the City).
It is noted that per the City Attorney's review of the
Nendel's Developer agreement your property's has no obligation to
the water assessments for use of the Nendel's watermain extension.

Street lighting shall be provided in such a manner to be
eligible for turnover to the City as part of the turnovers at
the completion of the project.
The turnover documents for street work in South 156th Street
will be provided to the Public Works Department immediately
after completion of the approved work. Turnover documents are
outlined at the end of this letter.
Finally, barricades closing off South 156th Street ,shall
remain in place, until this project has been accepted by the
City Council and the Public Works Director has so determined
that the street is complete and available for its intended
use. The developer is responsible for the placement and
maintenance of these barricades until the City authorizes
their removal, which may be at a later time than the
acceptance of the work.

DEVELOPER'S AGREEMENT
THIS AGREEMENT is made and entered into this aria day of

, 1989, between the CITY OF TUKWILA, a Washington
municipal corporation (hereinafter referred to as "the City ")
and ROBERT POON of Kingston Realty and Investment, Inc., 530
West Valley Road, Alhambra, California 91803, as nominee for a
business entity to be subsequently formed (hereinafter referred
to as "the Owner ").
WITNESSETH
WHEREAS, the Owner is the owner of certain real property
located generally at the intersection of I -405 Exit 1 and West
Valley Highway, and
• WHEREAS, the Owner has applied for approval of a building
permit for the development of a hotel complex to be located on
the property, and
WHEREAS, the parties hereto have previously entered into a
Developer's Agreement dated April 23, 1987, and an extension
thereof on March 6, 1988, both of which have expired by their
terms, and
WHEREAS, the development of said property will create
traffic impacts which will necessitate the construction of a
new street between Nelson Place and West Valley Highway,

certain sidewalk improvements, a fourth and east leg of a
traffic signal at the intersection of Exit 1 I -405 Eastbound
off ramp and West Valley Highway, and a seventh lane on West
Valley Highway, and
WHEREAS, the development will also necessitate the
extension of a city water line which will benefit properties
other than those of Owner which may tap into or connect to said
water line, and
WHEREAS, the development will be in the vicinity of a
comprehensive surface water management system known as the
Nelson Place /Longacres Drive Basin Drainage Study prepared for
the City by Kramer, Chin and Mayo dated December, 1986 (the
"KCM Study "),
NOW, THEREFORE, IN CONSIDERATION OF the mutual benefits and
conditions hereinafter contained, the parties hereto agree as
follows:
1. Responsibilities of Owner.
A. New Street. Owner shall design, engineer and
construct, at Owner's sole cost and expense, a new street,
including curbs, gutter and storm drainage, meeting City
standards for commercial streets from a point on West Valley
Highway at Exit 1 to a point on Nelson Place located
approximately 600 feet north of Longacres Way. The actual
points of intersection between the new street and West Valley

Highway and Nelson Place shall be approved by the Public Works
apartment of the City.
B. Signalization. The City and Owner understand that the
Washington State Department of Transportation is currently
• designing improvements to I -405 and West Valley Highway and as
part of such design, and the improvements to be constructed
thereafter, WSDOT will design and construct a fourth leg for
the traffic signal located at the intersection of West Valley
Highway and the new street to be constructed under paragraph A
above. Owner agrees to assume all responsibility for the
design, engineering, and construction costs of such
signalization.
C. Seventh Lane. The City and Owner understand that a
seventh lane will be added to West Valley Highway by Owner in
cooperation with WSDOT as part of its improvements in the area
in order to facilitate ingress and egress to and from the new
street to be constructed pursuant to paragraph A above. Owner
agrees to assume all responsibility for design, engineering,
and construction costs related to such seventh lane. Both
parties understand that the seventh lane will be constructed
from a location to be determined by WSDOT somewhere between
South 158th and the new street and continuing to the I -405
overpass.

D. Sidewalks. Owner shall design, engineer, and
construct, at Owner's sole cost and expense, sidewalks meeting
City standards at the following locations:
(1) Along the northerly edge of the new street to be
constructed pursuant to paragraph A above; and
(2) Along the west property line of the Owner's
property adjacent to West Valley Highway and running from
the new street northerly to the I -405 overpass.
E. Water Line Extension. Owner shall design, engineer,
and construct at Owner's sole cost and expense, a twelve -inch
diameter water main line from a tap located on the Nendel's
Hotel property which will run across West Valley Highway to the
east boundary, thence northerly

the hotel site. If the Embassy
Suites development has extended the water line from Nendel's to
its development, Owner need only extend such line to Owner's
development to the point described above. Said water line
shall be constructed to City standards and the location and
design of the water line shall meet City approval.
F. Nelson Place Improvements. Owner agrees to provide,
at Owner's sole cost and expense, all design and engineering
services necessary for the improvement of Nelson Place to City
standards.
G. Dedication of Improvements and Right of
Way - Maintenance Bond. Upon completion of the new street and

sidewalks, the water line.extension, and the storm sewer line
described in A.I., below, and approval of the same by the City,
the Owner shall dedicate, assign, and convey to the City, free
from any lien or encumbrance, the improvements to be made
public, the real property upon which such improvements are to
be located having already been dedicated to and accepted by the
City. Also, at such time, Owner shall furnish to the City a
bond or other suitable security in an amount approved by the
Public Works Department of the City and in a form approved by
the City Attorney, guaranteeing the new street, sidewalks, the
water line extension and the storm drain line, if any, against
defects in workmanship and materials for a period of one (1)
year from the date of approval and acceptance of the same by
the City.
H. Future Storm Drainage LID. Owner acknowledges that
Owner's development will have a cumulative impact on the storm
drainage facilities in the area of Owner's property and that
Owner's property would be specially benefitted by improvements
to such facilities. Owner agrees to participate in any local
improvement district or utility local improvement district
which is formed for the purpose of storm drainage improvements
as described in the KCM study of December, 1986 and the KCM
Preliminary Design Report of June 28, 1988, and hereby waives
the right to protest the formation of any such LID or ULID,
provided that Owner retains the right to contest the method of

calculating assessments in such LID or ULID and the amount
thereof to be levied against Owner's property.
I. Storm Drainage System and Interim Design
Requirements. Per design criteria of the Longacres /Nelson
• Place Storm Drain Preliminary Design Report by Kramer, Chin &
Mayo, the Owner, at its sole cost and expense, will construct,
in lieu of permament on -site detention facility, as a condition
of receiving its final certificate of occupancy, a piped storm
drainage system generally easterly along the new S. 156th
Street then southerly along Nelson Place to hook up to that
portion of Phase I as constructed or to be constructed by
Embassy Suites and /or by public contract. Thereafter, the
drainage will be in an open ditch and will extend to the north
after passing under the BNSF Burlington Northern tracks. If at the
time of development of impervious surfaces at S. 156th and /or
the building site the portion of the system beyond the
intersection of Nelson Place and S. 158th Street has not been
completed, Owner will construct to City standards temporary
detention facilities including flow restrictions in upstream
manholes, temporary detention facilities in S. 156th Street, if
required, until it is opened to traffic and detention systems
on property, which will surcharge upstream drainage system, S.
156th Street, and Developer's property as necessary in order to
reduce flows to undeveloped rate of discharge. These interim
detention facilities shall be maintained, in place, by the

development until such time as the downstream drainage system
to the 24 inch diameter Longacres culvert has been
constructed.
2. Responsibilities of City.
A. Nelson Place Improvements. In consideration of
Owner's agreement to assume the design and engineering costs of
bringing Nelson Place up to City standards, the City agrees
that Owner shall have no responsibility with respect to the
construction costs of such improvements. Nothing herein shall
be construed, however, to relieve Owner of any responsibility
for additional improvements to Nelson Place which may be
constructed in the future.
B. City will use its best efforts to obtain the necessary
easements and construct the downstream storm drainage system in
a timely manner.
C. Benefited Area and Assessments`- Facilities. The
water line extension and the storm drain line to be constructed
by Owner, will directly benefit certain property not owned by
the Owner which cannot be legally described until the extent of
the improvements has been determined, by enabling and
facilitating development thereof. Pursuant to Chapter 35.91
RCW, the Owner agrees to develop a latecomers agreement, to be
approved by the City, to reimburse Owner for its costs on a pro
rata basis by assessing any owner of real estate located in the
benefited area who does not contribute to the original cost of
the facilities to be constructed by the Owner under this

Agreement and who subsequently taps into and /or uses said
facilities. The agreement is to be developed when the extent
and cost of the facilities are known. The pro rata share for
any one parcel of real estate contained within the benefited
area shall be computed by the Owner subject to approval by the
City Engineer. The pro rata share for each parcel shall be
shown on exhibits to be attached to the agreement. The City
agrees to pay Owner all said sums collected within sixty (60)
days ,after receipt thereof, less costs of administering the
Agreement, until the total of said payments equals the cost of
constructing the facility less Owner's pro rata share, or when
fifteen (15) years from the date of the Agreement have elapsed,
whichever shall occur first.

5. Binding Effect. This Agreement shall be binding upon
the parties, their respective heirs, legal representatives,
assignees, transferees and successors.
6. Recording. This Agreement shall be recorded with the
King County Auditor as required by Chapter 35.91 RCW and the
cost of said recording shall be paid by the Owner.
7. Attorney's Fees. In the event that either party shall
commence litigation against the other in order to enforce any
term or condition of this Agreement, the prevailing party in
such litigation shall be entitled to recover its costs,
including reasonable attorney's fees.
8. Entire Agreement. This Agreement contains the entire
understanding between the parties hereto, and no other
agreements, oral or otherwise, regarding the subject matter of
this Agreement shall be deemed to exist or to bind any of the
parties hereto or to have any other force or effect.
