Dear Mr. Sneva:
As you know, we have been meeting with Mr. Phil Frazer
of your staff and officers of the Sunwood Condominium Assoc-
iation to negotiate an easement across the Sunwood property,-6
so that the watermain in 152nd.Street can be extended easterly /) ?
from 57th Avenue to connect with the main in Sunwood Boulevard. t,
This extension is a missing element of the City's Comprehensive
Water Distribution Plan that has been required as a condition
of approval for the above - referenced project. We are willing
to perform the extension. In exchange for the necessary ease-
ment, we have offered to provide a fence and a 15 -foot landscape
screen along the boundary between our property and Sunwood.
We also, of course, have agreed to fully restore all disturbed
property to its pre- construction condition.
Attached is a copy of the counter -offer we received from
the Sunwood Condominium Association. Obviously, only the City
can deal with the first 3 conditions relating to Sunwood
Boulevard and its utilities. It is our understanding that the
City will not agree to these conditions, nor should it because
of the limited public benefit that would result in relation
to the long term costs that would be incurred. The last
condition is totally unacceptable to us as a 100 -foot wide
green belt along our north and east boundaries would make our
project infeasible.

We believe the City's Comprehensive Water Distribution
Plan should be implemented and we are willing to do our fair
share. We will not, however, be held hostage by Sunwood's
unreasonable demands. Because of our hillside location, it's
imperative that site improvements be completed before the
Fall rains begin. As it appears that an easement from Sunwood
cannot be obtained, we respectfully request that we be required
to extend the watermain only from 57th Avenue to our east
boundary and that we be allowed to give the City cash in an
amount sufficient to pay for completing the extension to
Sunwood Boulevard. The City could then condemn an easement and
finish the extension. This approach will enable the Comprehensive
Plan to be implemented properly rather than in a less suitable
manner via some compromise plan. If nothing else, it will take
away Sunwood's perceived leverage such that rational negotiations
might be possible. We will appreciate your favorable consideration
of our request. Please contact me at this office, if you need

AT CITY HALL AND ONCE AT THE SUNWOOD BOARD OF DIRECTORS
MEETING. YOU AND THE CITY HAVE ASKED FOR A FORMAL RESPONSE
TO YOUR REQUEST FOR AN EASEMENT ACROSS THE SUNWOOD
PROPERTY TO TIE THE WATER SYSTEM OF THE PROPOSED TUKWILA
HEIGHTS INTO THE WATER SYSTEM OF SUNWOOD. I HAVE STATED THAT
THESE MATTERS ARE NEGOTIABLE BUT HAVE NOT SEEN ANYONE
WILLING TO MAKE THE FIRST OFFER THEREFORE, ONCE AN
INDEPENDENT CONSULTANT HAS DEMONSTRATED THAT THERE WILL BE

Dear Mr. Frazer:
At 7:30 p.m. next Thursday I will be meeting with the Sunwood
Condominium Owners' Association Board of Directors to try and obtain an
easement such that the watermain in South 152nd Street can be extended
easterly from 57th Avenue to the watermain in Sunwood. I will discuss our
development plans and our desire to cooperate with the City in making the
extension according to its adopted Comprehensive Plan. To support our request
for the easement that is needed, it would be very helpful if you or your
staff could be in attendance to answer questions that may arise regarding
the Comprehensive Plan and the City's progress toward its implementation.
If we are successful in obtaining the easement, water service will be
provided to our project via the watermain extension as the City has required.
If an easement through Sunwood is denied, alternative options for serving •
the project will have to be prepared and implemented with the approval of
the City Public Works Director. I believe the City's assistance in this
matter will enhance our chances of being successful, which would certainly
be in the best interest of everyone considering the public and private
benefits that would occur. Please call if the City will not be represented
at the meeting. I appreciate the way all the staff has worked with us during
our project's planning phase.

The following comments and concerns were raised during the environmental
review of your project. They may not pertain to the environmental
determination, however, it was requested that they be forwarded to you as
they will need to be addressed during subsequent project reviews.
Fire Department (Doug Gibbs, 433 -1859)
1. Fire flow and water availability must meet minimum requirements of
I.S.O. Guide and Tukwila Fire Prevention Bureau.
2. All buildings must be sprinklered - Ordinary Hazard throughout per City
Ordinance #1141 (attached).
3. Fire hydrants must be installed per City Ordinance #729 (attached).
4. Fire lanes must be installed per City Ordinance #111O(attached).
5. Maximum grade is 15 %.
Parks and Recreation (Don Williams, 433 -1843)
1. I am concerned about areas commonly called "landscape areas" being
considered as "recreation space." A close review of TMC Section
18.52.060 (Zoning Code) should be done by the developer. Our review
will take a close look at whether or not the outdoor recreation space
is usable (not all landscaping and on steep slopes).
2. Tot lot and indoor recreation space are good features. Open flat
areas are also good, but they should meet the code requirements.

1. Access road into site...only one.
2. Access road into general area...there is only one access road servicing
the needs of the entire S. 152 Street apartment complex. This is the
highest density area in the City..should access on 152 St. be interrupted
emergency services to those residents to the far side of the interrupted
area would be cut off.
3. Does designated parking allow for visitors?
4. Rather than strive to achieve the minimum in lighting necessary to
provide a safe and secure environment the developer should be exploring
the use of directed lighting that will provide a high light factor
without the attendant light spill and glare.
5. Landscaping should be designed with the safety and security of residents
and visitors in mind.
6. Any questions on latest crime prevention through environmental design
techniques should be addressed to PatLowery.,433 -1822.

The objectives and the alternative means of reaching the
objectives for a proposal will be helpful in reviewing the
aforegoing items of the Environmental Checklist. This
information provides a general overall perspective of the
proposed action in the context of the environmental infor-
mation provided and the submitted plans, documents, suppor-
tive information, studies, etc.
1. What are the objective(s) of the proposal? The
objective is to develop rental housing for
middle- income persons who are employed in the
South King County /Tukwila area. Toward that end,
apartments will be developed in accordance with
the existing zoning restrictions. Available

will be used to increase the project's rental
desirability.

1. Earth
e. Excavation and grading will be required to reduce
slopes for the construction of driveways, parking
areas and building foundations. Suitable earth
material excavated from the northwestern /northeastern/
southeastern triangular portion of the site will
be structurally placed as fill under the supervision
of a professional geotechnical engineer in the
northwestern /southwestern /southeastern triangular
portion of the site. Approximately 20,000 YD will
be relocated. Unsuitable and excess material will
be exported off -site.
2. Air
a. On -site vehicular emissions will increase relative
to current levels. Fireplace smoke from the dwelling
units will increase current levels of particulate
matter. Dust levels may increase during the construction
period.
7. Environmental Health

2. Short -term elevated noise levels will occur during
the construction period. Long -term noise will occur
due to on -site vehicle traffic and human activity.
Implementation of the proposal should cause the local
LDN to increase by less than 3 dBA.
