Public Works staff along with Building and Planning staff have
reviewed the fill on your property. I have been requested by the
Building Official to review this property in terms of drainage.
It is noted that this fill was placed prior to permit issuance.
There are still some unanswered questions which I would like to
bring closure on through our review. Therefore, I request the
following information be provided in the next week so I can
continue with my review:
1. A copy of the legal survey that was carried out, which is
the basis of the staking found in the field.
2. Identify on plan the permanent storm drainage facilities
including:
A. Original drainage pattern, including 2' interval
topography.
B. Permanent storm drainage facilities (including ditches).
C. Original and final points of discharge to downstream
properties.
From my field review, I question whether the storm drain pattern
has been changed as a result of the fill activities. The property
now slopes to the southeast. Is additional drainage along the
south and easterly borders of the property necessary? Is the drain
plan submittal taking the drainage back to its original point of
exiting your property?
Please note the attached letter of January 30, 1990 from Lawrence
J. Warren representing the Larry Popejoy property. From my field
observations, it was not obvious that your fill extends beyond
your own property limits, as claimed in this letter. If you can
shed any light on this matter I would appreciate your doing so in
your response.

Mitigation Determination of Nonsignificance
SEPA Conditions:
1. Based upon the Environmental Checklist, dated December 12,
1989, prepared by Charles Lang the applicant will do the
following:
A. Per p.7 of the SEPA Checklist- "water runoff " - provide a
drainage plan to include the original drainage pattern
within and into additional properties. Provide a new
drainage plan taking flow to the original point of
discharge to the lower properties.
Purpose: Mitigate impacts of the changes in the drainage

Re: Larry Popejoy Property
Dear Mr. Beeler:

By letter dated October 9, 1989, I wrote to you concerning
problems of fill on the Larry Popejoy property caused by an
illegal fill of his adjacent neighbor, Mr. Lang. To this date the
illegal fill still remains on the Popejoy property. That fill is
now causing problems with surface water runoff. It appears that
Mr. Lang has not satisfied the city of Tukwila's demands as
outlined in a letter to me dated October 25, 1989, from Leigh Ann
Tift, Assistant City Attorney.
As part of my October 9, 1989 letter I requested, pursuant to the
public records laws of the state of Washington, a copy of all
documents relating to the fill. I received two documents; a
permit to install /repair sewage disposal system and a copy of a
letLer from the city of Tukwila to Mr. Charles Lang dated August
2, 1989, and signed by Duane Griffin. I now specifically request
copies of the survey that was performed on the Lang property, as
Mr. Popejoy believes that the fill intrudes onto his property to a
greater extent than that acknowledged by Mr. Lang or the city of
Tukwila.
Mr. Popejoy has not agreed to have fill placed on his property.
He believes the fill is damaging as it creates a looming effect on
the uphill property, accentuates the slope, greatly limits the
usable land between the toe of the slope and the edge of the hill,
and is leading to substantial problems with surface water
drainage. The city of Tukwila should not issue a fill permit to
Mr. Lang as long as these problems remain. It is not an
appropriate function of city government to permit one property

owner to damage another property owner in the course of requiring
the first property owner to correct an illegal fill. The old
adage remains, two wrongs do not make a right. Mr. Lang was wrong
in putting in the fill in the first instance, and the city of
Tukwila should not compound that wrong by permitting the activity
after the fact.
