WHEREAS, the City of Tukwila has initiated vacation of a portion of South 150th Street right -of -way lying easterly of Macadam Road to approximately 450 feet east of Macadam Road, and WHEREAS, by resolution dated June 17, 1991, the Council set July 15, 1991 as the date for a public hearing, and WHEREAS, a public hearing was held on said vacation petition before the City Council on July 15, 1991, and WHEREAS, notice of the pendency of the street vacation and hearing were given as prescribed by law, and WHEREAS, the abutting property owner has agreed to dedicate to the City the real property, described in Exhibit C hereto attached, to provide for improvements to South 150th Street, which property has a value equal to the value of the street being vacated, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. That certain public right -of -way located within the City of Tukwila, Washington, and more particularly described on Exhibit A, and shown on Exhibit B, both of which are attached hereto and hereby incorporated herein, is vacated. Section 2. That the street so vacated shall belong to the abutting owner, as provided in RCW 35.79.040. Section 3. That A.E. Scherler will dedicate that property described in Exhibit C, attached hereto and hereby incorporated herein, the full value of which equals the value of the vacated right -of -way, and no further compensation shall be required of either abutting property owner. Section 4. The City Public Works Director is hereby instructed to amend the City's official street map to be consistent with this ordinance. Section 5. If any section, sentence, clause or phrase of this ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 6. The City Clerk.is directed to record this ordinance and to provide a certified copy thereof to the King County Department of Records and Elections upon its effective date. Section 7. This ordinance shall be in force and effect five days after publication of the attached summary which is hereby approved; provided, however this ordinance shall not be published until the City Clerk has the deed to that real property described in Exhibit C hereto in hand and until the official street map amendments provided for in Section 4 hereof have been completed and further provided that this ordinance shall be null and void if said deed is not received or said street map amendments not completed within thirty days of the date of this ordinance. Chapter 11.60 STREET AND ALLEY VACATION PROCEDURE Sections: 11.60.010 11.60.020 11.60.030 11.60.040 11.60.050 11.60.060 11.60.070 11.60.080 Purpose. Definitions. Filing. Procedure. Approval -- Ordinance of vacation. Appraisal. Streets abutting water. Acquisition by public entity. 11.60.010 Purpose. The purpose of this chapter is to establish policies of the city for vacation of street and alley rights -of -way, and to facilitate efficient pro- cessing of street vacation application. (Ord. 1087 §1, 1978 11.60.020 Definitions. As used in this chapter, the following definitions shall apply: (1) Chapter 35.79 of the Revised Code of Washington includes the existing law of the state of Washington regard- ing street vacations or any amendments thereto. (2) "Street" means any street or alley or any part thereof within the city limits of the city. (Ord. 1087 §2, 1978). 11.60.030 Filing. All petitions or resolutions for street vacations shall be submitted on proper forms to the city clerk's office consistent with RCW 35.79.010. The city clerk shall review each petition to determine whether it has been signed by the requisite number of eligible property owners and, if complete, accept it for filing. The filing fee and an appraisal, if required, must be in- cluded prior to an acceptance for filing. (Ord. 1087 §3, 1978) . 157 r (Tukwila 12/15/78) ) • 110.040 -- 11.60.080 11.60.046 Procedure. After the petition or resolution has been filed, the city clerk shall: (1) Propose a resolution to the city council fixing a time when the matter will be heard; (2) Forward the petition or resolution to the Office of Community Development and the Department of Public Works for their review, comment, and SEPA review; (3) Forward all relevant information to the city council for their decision deliberations during their hearing; and (4) Provide notices of hearings as required by RCW 35- .79.020. (Ord. 1087 §4, 1978). 11.60.050 Approval -- Ordinance of vacation. If the city council approves the vacation of any city right -of -way, it shall, by ordinance, vacate the property pursuant to RCW 35- .79.030; provided, however, that such vacation of land shall not become effective until persons acquiring the land to be vacated have compensated the city in an amount equal to one - half the fair market value of the property pursuant to RCW 35.79.030 and determined as provided in Section 11.60.060 below. The city shall retain in the vacation ordinance any easement rights deemed necessary by the city. (Ord. 1571, §1, 1990: Ord. 1087 §5, 1978). 11.60.060 Appraisal. Appraisals from a member of the American Institute of Real Estate Appraisers shall be re- quired, or not required, pursuant to the following guide- lines: (1) If the total assessed value of the land requested to be vacated is less than ten thousand dollars, a pro- fessional appraisal shall not be required and the assessed value shall be used. In determination of this value, the applicant must demonstrate the value of the adjacent land as shown on the records of the county department or records and elections and the county assessor's office and compute this value on a per- square -foot basis. This value per square foot shall be multiplied by the square footage of the total land area in square feet requested to be vacated. (2) If the assessed value of the land requested to be vacated is in excess of ten thousand dollars, as computed above, an appraisal by a member of the American Institute of Real Estate Appraisers who is acceptable to the city shall be prepared at the applicant's expense prior to the acceptance and processing of the street vacation application by the city. (Ord. 1571 §2, 1990: Ord. 1087 §6, 1978). 11.60.070 Streets abutting water. Streets abutting a body of fresh or salt water shall not be vacated unless in compliance with RCW 35.79.030. (Ord. 1087 §7, 1978). 11.60.080 Acquisition by public entity. If all of the abutting property owners to the vacated street do not 157 -1 (Tukwila 11/90) 11.64.010 -- 11.64.020 desire to acquire title to the land as set forth in RCW 35.79.040, the city may make the vacated street available for acquisition by any other municipal or public corpor- ation or agency thereof, at no cost, if the municipal or public corporation or agency can demonstrate substantial public benefit will be gained by said transfer. The filing fee for street vacations is waived as to all such public corporations or agencies. (Ord. 1087 §8, 1978). Chapter 11.64 SIDEWALK CONSTRUCTION* Sections: 11.64.010 Administration. 11.64.020 Sidewalks required. 11.64.030 Standards of construction. 11.64.040 Delays and variances. 11.64.010 Administration. The public works director shall be responsible for administering this chapter unless construction of a standard sidewalk conflicts with the re- quirements of the Tukwila building code or zoning code, whereupon concurrence of the planning director shall be re- quired. (Ord. 1516 §3(Exh. C(part)), 1989). 11.64.020 Sidewalks required. (a) Sidewalks shall be required for any new multifamily residential, commercial or industrial structure; or upon substantial remodeling of an existing structure; or subdivision activity. (b) For purposes of this chapter, "substantial remodel- ing" means construction which increases the floor area of an existing building or structure by at least twenty percent or any alteration or repairs including interior, plumbing, elec- trical and structural made within a twelve -month period, which together exceeds twenty -five percent of the value of the previously existing building or structure; or total cumu- lative building improvements from the date of-the ordinance codified in this chapter increase building square footage by twenty -five thousand square feet or building value by two hundred fifty thousand dollars.
