Rants, Mayor M E M O R A N D U M TO: Jack Pace /Darren Wilson FROM: Phil Fraser DATE: January 29, 1992 SUBJECT: Review for Potential Violation of Land Altering Ordinance No. 1591 at 13330 32nd Avenue South Elizabeth Thomas, the applicant at 14439 58th Avenue South has come in at my request with information regarding her land altering activities at 13330 32nd Avenue South and she provided the attached map identifying approximately a forty to 15 foot width by 101 foot length area of the subject property, which has been cleared. Per my review on 1/27/92 I determined that only 2,000 to 3,000 square feet has been disturbed by the recent land altering activity, less than 50 cubic yards have been moved on site and no significant cuts or fills triggering the Land Altering Ordinance have occurred. Therefore, I informed Ms. Thomas that the Land Altering Ordinance is not triggered with respect to the City's grade and fill criteria However, I would refer this information to your office for sensitive area determination and issue a no fee Land Altering Permit for the purposes of coordinating application of the Sensitive Area Ordinance requirements if you find corrective measures are needed relative to the SAO. A short slope area (8 to 12 feet of elevation) exists along the eastern edge of the Malinak Property. The site was dominated by blackberries with only a few trees in this area. Most of the vegetation has been removed. During the review of this PRD /Shortplat and using SAO guidelines, the Planning Division decided that the slope area and a 20 -foot buffer would be preserved for stability reasons. A geotechnical study was waived because the slope is located along the site's east boundary and does not need to be altered for lot development. After talking with Phil Fraser - Public Works, I'm not sure if the clearing and grading was permitted. Because the slope and its buffer were disturbed, the SAO requires some kind of restoration, ZC Chapter 18.45.080. E.3.b.(page 15) . I recommend the buffer area be planted with native trees and shrubs as part of a :landscape requirement. J Property owners who wish to develop or remodel a home on a parcel mapped as a sensitive area must complete and submit an environmental checklist. Sensitive areas are lands which slope 15% or more, have a watercourse or wetland on them or are in a coal mine or seismic hazard area. Maps have been made of all of these areas by the City, with the best available information, and are available for your-review. Purpose of Checklist: The State Environmental Policy Act (SEPA), chapter 43.21C RCW, requires Tukwila to consider the environmental impacts of your proposal before making decisions. The purpose of this checklist is to provide information to help you and Tukwila identify impacts from your proposal and to reduce or avoid those impacts. Instruction for Applicants: A determination of nonsignificance must be made by the Director of Community Development before you may apply for a building or land altering permit. A fee of $225.00, a completed environmental checklist and a site plan, and any additional information that will help describe your proposal or its environmental effects, must be submitted to the Department of Community Development in order for the determination to be made.
