REFUNDS FOR SAO- RELATED DEVELOPMENT PERMITS
October 22, 1991
The City Council recently amended the Sensitive Areas Ordinance
(No. 1599) with Ordinance No. 1608, which took effect on
October 14, 1991.
This new ordinance exempts certain Single - Family permit applications
from SEPA review, eliminating the requirement for a SEPA Environmental
Checklist and $225 fee. The new ordinance also authorizes refunds of
Checklist fees received under the original Ordinance No. 1599.
Consequently, DCD is requesting a refund of the $225 Environmental
Checklist fee on behalf of the following applicants:

The Department of Community Development (DCD) has completed our review
of your environmental checklist for the above project. A Declaration
of Non - Significance has been issued (copy attached).
Now that the environmental determination has been issued, we can
complete review of your Building Permit Application. The last step
remaining is final review by the Building Division. Please note that,
to comply with the Sensitive Areas Ordinance (SAO), you will have to
meet the following requirements before your Building Permit can be
approved:
As the owner of the property, you will be required to sign and
record with King County Department of Records:
1) a statement (sample attached) waiving any claims
resulting from soil movement arising out of issuance of
the permit; and
2
a covenant (sample attached) running with the land
which identifies risks and any restrictions associated
with your project relative to slopes and coal mine
hazards.

Under the SAO, most properties affected by slopes and coal mines would
require a topographic survey and geotechnical report. DCD has waived
these requirements for your project. However, the claims statement
and covenant noted above cannot be waived. You will need to submit
these materials in order to obtain your Building Permit.

Dear Mr. Kendall:
We have completed our review of your environmental checklist for the
above project. A Declaration of Non - Significance has been issued

several conditions of Building Permit approval, as follows:

show two -foot contours and stamped by a professional
land surveyor. CAN WE SUBSTITUTE SITE INSPECTION FOR
THIS? ALL WE NEED TO KNOW IS WHERE SLOPE IS RELATIVE
TO ADDITION.
For the class of slope on your property, a geotechnical
report, prepared by a professional geotechnical
engineer, is required. This report should address how
the addition will affect (or not affect) slope
stability, or include recommendations for ensuring
stability.
3. Your property is also classified as a Coal Mine Hazard
area on the City's Sensitive Areas maps. Therefore,
the geotechnical report should include an evaluation. of
/) n potential land subsidence /shifting, identification of
any mine entrances or workings, and any other factors
deemed necessary by the Building Division for approval
of the addition's construction relative to the site's .

SUBJECT: Sensitive Area Designation and Ordinance Requirements' for
Roy Kendall residential remodel permit - 13941 56th Place
South.
This permit application is subject to the Sensitive Areas Ordinance
because the property includes mapped Areas of Potential Geologic
Instability (Class 2 slope) and Potential Coal Mine Hazard.
Because these areas are mapped on the subject property, a SEPA
checklist is required. Even though the Class 2 slope does not
appear to be affected by the proposed remodel addition, the site is
within 200 feet of a Class 3 sensitive slope. Currently, thet
Ordinance does not allow the geotechnical study requirement to be
waived by the DCD Director if within 200 feet of Class 3 or 4
sensitive slopes. Based on this interpretation, it does not seem
appropriate to waive a geotechnical study for the Potential Coal
Mine Hazard if a study is required for the Class 2 slope.

Environmental Checklist
When a Checklist is Required:
Property owners who wish to develop or remodel a home on a parcel mapped as a
sensitive area must complete and submit an environmental checklist.
Sensitive areas are lands which slope 15% or more, have a watercourse or wetland on
them or are in a coal mine or seismic hazard area.
Maps have been made of all of these areas by the City, with the best available
information, and are available for your review.
Purpose of Checklist:
The State Environmental Policy Act (SEPA), chapter 43.21C RCW, requires Tukwila to
consider the environmental impacts of your proposal before making decisions. The
purpose of this checklist is to provide information to help you and Tukwila identify
impacts from your proposal and to reduce or avoid those impacts.
Instruction for Applicants:
A determination of nonsignificance must be made by the Director of Community
Development before you may apply for a building or land altering permit. A fee of
$225.00, a completed environmental checklist and a site plan, and any additional
information that will help describe your proposal or its environmental effects, must
be submitted to the Department of Community Development in order for the
determination to be made.
This environmental checklist asks you to describe some basic information about your
proposal. Answer each question briefly, accurately, with the most precise information
known, or give the best description you can to the best of your knowledge.
In most cases, you should be able to answer the questions from your own observations
or project plans, without the need to hire experts. If you really do not know the answer,
