This letter is in response to your questions regarding the 4.789 acres of land situated at
South 180th and Southcenter Parkway within the City of Tukwila. This land, commonly
referred to as the "South Parking Lot" is used as a parking lot by Pavilion Mall employees
and customers.
Per our agreement with the City of Tukwila, we are required to provide a total of seven
hundred and forty (740) parking stalls for Pavilion Mall usage. The main Pavilion Mall
parking lot provides only five hundred and eighteen (518) parking stalls. Hence, we are
dependent on the stalls located in the "South Parking Lot" to meet the City of Tukwila
parking requirements.
Pacific Northwest Group A leases the 4.789 acres of land from Herman Schoenbachler,
Ruth Schoenbachler and Robert W. Schoenbachler. The term of the lease is seventy years,
January 1, 1985 through December 31, 2054.

AGENDA ITEM Pavilion Outlet Center- Amended Agreement
I) INTRODUCTION
On February 9, 1982, the City Council held a public hearing for purposes
of assisting the SEPA responsible official in assessing and mitigating the
environmental implications of converting the former Doces' building to the
Pavilion Outlet Retail Shopping Center. As an outgrowth of that hearing,
the Benaroya Company, as developers of the Pavilion, executed and recorded
a property use and development agreement (Auditor's File 8203090492) which
contains a number of strategies for mitigating off - street parking and
maneuvering impacts. The agreement also provides that any amendment
thereto must be approved by the City Council.
II) APPLICANT.'.S REQUEST
The Benaroya Company is before you at this time seeking to amend Parking
Plan "A" on Page 2 of Exhibit 2 of the agreement (see attached) as follows:
1) Delete provisions 2 and 3 in their entirety
2) Modify provision 1 thus:
"A total of 740 parking spaces shall be required to serve the
Pavilion Outlet Center. Of that total., 518 spaces shall be
provided on the Pavilion site proper. At least 222 additional
spaces, but no more than 500 additional spaces shall be provided
at the southeast quadrant of 57th Avenue South and South 180th
Street by lease agreement in accordance with the terms of City of
Tukwila Conditional Use Permit 82 -20- CUP."
RATIONALE
. The zoning code allows commercial developments to provide some or all of their
minimum required parking off - premise if a conditional use permit for such purpose
is Granted by the Planning Commission. On November 18, 1982, the Planning Commission
approved a C.U.P. to the Benaroya Co. to operate a.500 -stall off - premise parking
area on the Schoenbachler property at the S/E corner of 57th Avenue and 180th St.
The site is currently leased to Benaroya Co. for a three -year period. As this 3-
year period is of course much less than that of the Pavilion's anticipated
economic life - cycle, conditions attached to the use permit provide for the imple-
mentation of Parking Plan "B" of the agreement '(a parking garage on the Pavilion
site) or other suitable arrangement for satisfying minimum parking requirements
when the lease expires.

Deleting provisions 2 and 3 of Parking Plan "A" will free -up 200 spaces at..
Parkway Plaza for use by new or expanded tenant activity in that center
separately from the Pavilion requirements and will eliminate the Pavilion
shuttle -bus system which has proven awkward and only marginally effective.
RECOMMENDATION
That the Planning staff and the City Attorney be directed to amend the property use
and development agreement under Auditor's File 8203090492 as described in
Section II of this report.

( "the City" herein) by the JACK A. BENAROYA COMPANY, a
Washington corporation ( "Benaroya" herein) and JACK A.
BENAROYA, individually:
WITNESSETH:
WHEREAS, Benaroya is the owner of certain real property
located in the City of Tukwila, County of King, State of
Washington, which is more particularly described in Exhibit 1
attached hereto and incorporated herein by reference ( "the
Property" herein) ; and
WHEREAS, pursuant to the Building Code and Zoning Code of
the City of Tukwila, Benaroya has applied for a building permit
to remodel an existing structure which is, located on a portion
of the Property; and
WHEREAS, to facilitate the granting of the building permit,
Benaroya is willing to provide and maintain a Parking Plan for
the benefit of the Property; and
WHEREAS, the City is willing to approve the bulding permit
subject to the Parking Plan and subject to the execution and
recording of an appropriate instrument with the City;

Now, Therefore, Benaroya hereby covenants, bargains and
'agrees on behalf of itself, its successors and assigns, that if
the building permit as applied for is granted, the Property
will be developed and used. in accordance with the following
terms and conditions:
1. Benaroya will develop the Property pursuant to the
plans which have been filed with, and will be approved by, the
City for remodeling the Doces building into the "Pavilion
Outlet Center" which plans are found in Tukwila File Nos. 2245,
EPIC - 178-82, subject to further revisions upon application by
Benaroya and approval by City, pursuant to the requirements of
Tukwila's Building Code and Zoning Code.
2. The Parking Plan (consisting of both Parking Plan "A"
and Parking Plan "B "), as attached hereto and marked Exhibit 2
and incorporated herein by reference as though fully set forth,
shall be instituted by Benaroya pursuant to the terms of said
Plan.
3. This Agreement shall be recorded in the records of the
King County Department of Records and Elections and filed in
the records of the City Clerk, and the covenants hereof shall
be deemed to attach to and run with the Property and shall be
binding upon Benaroya, its successors and assigns, and shall
apply to atter- acquired title to Benaroya to the Property.
4. This Agreement may be amended or modified by written
agreement between Benaroya and the City; provided any such

amended agreement shall be approved by the Tukwila City Council
by ordinance.
5. This Agreement is made for the benefit of the City and
property owners located within 300 feet of the Property and the
City may institute and prosecute any proceeding at law or in
equity to enforce this Agreement including injunctive relief.
Such judgment may include reasonable attorneys' fees for the
prevailing party.
6. Nothing in this Agreement shall prevent the City
Council from making such further amendments to the Building
Code and Zoning Code as it may deem necessary in the public
interest.
7. In the event any covenant, condition or restriction
hereinabaove contained or any portion of this Agreement is held
to be invalid or void, such invalidity or voidness shall in no
way affect any other covenant, condition, or restriction
hereinabove contained.

PARKING PLAN "A"
Commencing upon the opening of the Pavilion Outlet Center,
the Benaroya Company will implement the following elements,
also shown graphically on the Parkway Plaza Master Site Plan
and Outlet Center Parking Plan, Sheet AA1 (revised 2/15/82)
attached hereto:
1. A total of 1996 parking spaces on that
portion of the "Property" lying east of the
Southcenter Parkway will be allocated as indicated on
the Master Site Plan.
2. A shuttle bus seating at least 20 persons
will run continuously during regular business hours
from the main entry of the Pavilion Outlet Center to a
"Metro -type" shelter in the Parkway Plaza north
parking lot as shown on the Master Site Plan. The
area around the shelter will be clearly designated for
parking of Pavilion Outlet Center's customers' and
employees' cars. The bus route will be as indicated
by the arrows on the Master Site Plan to ensure
efficient delivery of customers and employees to the
Pavilion Outlet Center and to encourage use of the
existing excess parking in the Parkway Plaza north
lot.
3. Two hundred spaces (200) in the Parkway
Plaza north parking area, generally surrounding the
shuttle bus station as shown on the Master Site Plan,
will be designated for customers and employees of the
Pavilion Outlet Center.
4. The parking area immediately adjacent to the
Pavilion Outlet Center will be re- striped to provide
additional spaces and to provide for the parking of
compact cars, as graphically shown on the approved
final Parking Plan for the Pavilion Outlet Center as
shown on Sheet P1 (Dated 2/19/82).

5. Parking closest to the Pavilion Outlet
Center will be reserved for customers of the Center
with parking areas for tenants and employees
specifically designated at a less convenient
location.
In the event that the implementation of the
provisions of paragraphs 1 through 5 does not prevent
or alleviate traffic congestion and parking problems
on or near the Property, Benaroya may., at its
discretion implement the following supplemental
measures.
6. Provision of additional off- street parking
spaces on the Property on the west side of Southcenter
Parkway, including: a) an 85 -space lot in the area
commonly known as the North Canyon and shown on the
Master Site Plan; and b) approximately 500 surface
spaces within the developed parking area west of
Southcenter Parkway, in addition to the North Canyon;
and
7. Inclusion within the shuttle bus route, of
that portion of the property lying west of Southcenter
Parkway, or
8. Such other measures, approved by the City's
Planning Department, which provide additional parking
spaces serving the Pavilion outlet Center.

PARKING PLAN "B"
At such time as the City of Tukwila Planning Department
determines that a dangerous or undesirable parking situation
exists on the Property as a result of the use of the Pavilion
Outlet Center, or as a result of any other development of the
Property, Benaroya shall cause to be implemented Parking Plan
"B" containing the following element which replaces those
contained in Parking Plan "A ":
Construction of an attached parking structure on the
Pavilion Outlet site proper with sufficient parking
capacity to satisfy the Tukwila Planning Department
that the dangerous or undesirable parking situation
has been corrected, not to exceed 665 spaces for the
Pavilion Outlet Center as approved by the building
permit to be issued hereunder, together with any
additional parking spaces required by the Planning
Department to mitigate such dangerous or undesirable
conditions, and together with any additional parking
spaces required by any permits later issued for more
intensive uses on the Pavilion Outlet Center site
proper.
The decision of the City's Planning Department requiring
Benaroya to implement "Parking Plan "B "" shall be made in
writing and a copy of such determination shall be sent by the
City, by certified mail, to Benaroya. Benaroya shall implement
said Plan within 90 days of such notice.
Benaroya may appeal the decision of the Planning Department
requiring implementation of Parking Plan "B" by filing a
written notice of appeal with the City Clerk. Such appeal
shall be considered by the City Council within 30 days of the
filing of the notice of appeal. The City Council may affirm,
deny, or modify the determination of the Planning Department.
The decision of the City Council shall be final.

Council President Bohrer called the Tukwila City Council Committee
of the Whole Meeting to order at 7:05 p.m.
EDGAR D. BAUCH, LIONEL C. BOHRER (Council President), JOE H. DUFFIE,
MABEL J. HARRIS, GEORGE D. HILL, DORIS E. PHELPS, GARY L. VAN DUSEN.
Sharon Wylie, Administrative Assistant, reported that the personnel
report on the evaluations for the Fire Department is completed.
A meeting with the Public Works Department has been arranged to
develop the evaluations.
Councilman Bauch, Chairman of the Public Works Committee, stated
the Committee will meet Wednesday night at 4:45 p.m.
Councilman Harris reported Mayor Todd, Councilman Duffie, Bauch,
and Harris attended the legislative meeting in Olympia.
None.
Phil Fraser, Acting Director of Public Works, recommended the
acceptance of the bid of MacDonald Miller Company in the amount
of $5,969.60.
MOVED BY HARRIS, SECONDED BY PHELPS, THAT THE MECHANICAL SYSTEMS
MAINTENANCE CONTRACT BID AWARD BE ON THE AGENDA OF THE FEBRUARY 16,
1982 REGULAR COUNCIL MEETING. MOTION CARRIED.
Mark Caughey, Planning Department, said the public hearing is held
for purpose of finding -of -fact to assist in the completion of the
SEPA threshold determination for conversion of the former Doces
building to a multi- tenant retail structure.
Council President Bohrer opened the Public Hearing at 7:25 p.m.
Council President Bohrer said a letter from The Greater Tukwila
Chamber of Commerce dated February 9, 1982 in support of the project
would be made a part of the Minutes of the Meeting.
Cris Crumbaugh, audience, offered the support of the Segale Company
in the planned project.
There being no further comments offered by the public, Council
President Bohrer closed the Public Hearing at 7:28 p.m.
Mr. Caughey said there would be no change in the outside of the
building. Mr. Benoliel, Benaroya Company, showed outside and
inside views of the proposed project.

Council President Bohrer led the audience and City Council in
the Pledge of Allegiance and called the Tukwila City .Council
Committee of the Whole Meeting to order.

Mayor Van Dusen reported the visit from the Sister City, Ikawa,
was enjoyed by all. The City is receiving many gifts and would
like to publicly display them. He suggested the Council spend
$1,000 out of professional services to buy a display case to
be placed in the City Hall lobby.
MOVED BY DUFFIE, SECONDED BY HILL, THAT THE MAYOR BE GIVEN UP
TO ONE THOUSAND DOLLARS OUT OF CITY COUNCIL PROFESSIONAL SERVICES.
FUND FOR THE PURCHASE OF A DISPLAY CASE. MOTION CARRIED.
Councilman Phelps reported her attendance at the dedication of
the Kirkland City Hall. It has a 72 -hour jail facility with 5
cells. The architecture is similar to Tukwila City Hall.
Councilman Bauch reported there were three sandwich sign boards
in evidence at Sunwood. Brad Collins, Planning Director, said
he would take action to have them removed at dark.
Councilman Harris reported the task force will meet with other
members on the new health contract. She said there would be no
further monies from Tukwila until we know what we are getting
for our tax dollars.
Byron Sneva, Director of Public Works, reported that the notice
from the Federal and State Highway Department has been received
funding the study for the relocation of the T -Line Bridge.
Deputy City Attorney Woo reported the Allenbach case was argued
the previous week. The judge has promised a decision by
Christmas.

Mr. Joel Benoliel, representing Benaroya Company, said there is
adequate parking without using the surplus spaces in Parkway
Plaza North.
Councilman Phelps said she was concerned that some of the
customers at Pavilion Center were parking along the back of the
warehouses. It was her understanding there was to be no access
going east /west behind the building (Midland Drive). It is a
private access street.
Mr. Benoliel said there may have been parking there during the
opening four or five days of the Pavilion Center. It is easy to
park in front of the building now and there would be,no reason for
anyone to go behind the building to park.
Councilman Phelps asked that someone look at the documents to be
sure this is a private road and not an access road from Andover.
Council President Bohrer said the Council would like a report
from Administration on the subject of private use of the cul -de -sac.

of the proposed reorganization of the Public Works Department.
He stated he would like to advertise for the new position of
Building and Grounds Maintenance Section Manager so hiring can
be done prior to the first of the year. The proposed salary is
Grade 4, Step 1 ($2,253 /month).

Automobile Parking
As we agreed at our recent meeting, I am writing to review the history of
our various agreements regarding parking requirements in order to avoid any
possible confusion in the future.
On February 23, 1982, we executed a Property Use and Development Agreement
affecting all of the property under this company's ownership in Tukwila. On
that date, subject to that Agreement, the City issued a building permit
covering the remodel of the former Doces' Building.
The Agreement contains certain "parking plans" designed to alleviate congestion
and to provide adequate parking for our retail developments on the east side
of Southcenter Parkway. Parking Plan A incorporates a drawing entitled
"Parkway Plaza Master Site Plan and Outlet Center Parking Plan, Sheet AA -1
(revised.2 /15/82)." That drawing, found in the City's file EPIC - 178 -82, shows
actual parking layouts for the various buildings, and shows the available
parking spaces totalling 1,996. Parking Plan A is predicated upon those
1,996 spaces being available for use in connection with Parkway Plaza and
the Pavilion. Sheet AA -1, as finally approved by the City, shows the 1,996
spaces provided as follows:

Thus, after demolition of Abigail's and resulting additional parking stalls,
the excess of 88 stalls increased to an excess of 176 stalls reserved for
additional food service in the Pavilion.
Now, the City has issued a permit for construction of the Pavilion Cafe & Bar
in the Outlet Center, consisting of 12,446 square feet of restaurant gross
floor area. The existing code requires an additional 6 parking stalls for
each 1,000 square feet of gross floor area in a shopping mall of less than
200,000 square feet gross leaseable area. Thus, the new Pavilion restaurant
will require 75 parking stalls. As a result, as of the date of this letter,
the revised totals are:

SUBJECT: Pavilion Outlet Center- Auxilliary Parking Area
In response to our meeting of 21 June 1982, the following comments
represent the Planning Department's position on the issue of allowing a mid -
block crosswalk traversing S. 180th Street and adjoining the Pavilion
Outlet Center with the auxilliary parking lot.
If I may be permitted the latitude of interpreting Mr. Brown's favorable
position on this matter, it is that we, the City officials, must anticipate
people's . worst judgment and behaviour and therefore plan accordingly. In
the present instance, the preceding theory translates as follows:
1) Since pedestrians will choose to travel the shortest, unrestricted
path between their cars and the project entry, they will attempt
to cross S. 180th Street at about the mid -block point, regardless
of the illegality of jay - walking or the apparent danger of swiftly-
moving traffic.
2) Since it would be "negligent" of us to ignore this fact, therefore,
we must capitulate to the inevitable and at least try to make
a mid -block crossing -point somewhat safer by striping a cross -walk
at that locale.
Mr. Brown's observations about pedestrian behaviour are probably correct;
we do not, however, agree with the inevitability of his solution. Rather,
it is our task as responsible, professional city administrators to plan
"proactively ", not reactively, and to use our skills in that regard to
preserve safety of both the pedestrian and motorist.
As a proactive planning solution, therefore, we recommend the following:
1) Elimination of any proposed "mid- block" crosswalk.
2) Elimination of sidewalks adjoining the south side of S. 180th
Street.
3) Placement of a 6' high chain link fence at the northmost edge of
pavement in the auxilliar parking area. The fence should extend from

the curb return tangent point on the west to the driveway apron on
the east.
4) Between the aforementioned fence and the curb line on S. 180th,
dense plantings and large trees should be placed to discourage pedes-
trian activity.
We believe that implementation of these steps•will have the affect of
channelling pedestrians from the parking area to the intersection crosswalk
at 57th /180th, thus enhancing their safety and that of motorists traveling in
the area.

2/19/82 Public Works has reviewed and found this plan acceptable for
final plan application under the following conditions:
The most southerly 30 -foot access point on Southcenter Parkway,
per this redevelopment, will be considered temporary and may
be .subject to revision or elimination in the future at such
time as it is deemed a safety hazard or in order to facilitate
smoother traffic flow or relieve congestion in Southcenter Parkway
as determined by the City.
The reverse left to the left turn lane transition may not be
accepted by the City in the final plan review for Southcenter
Parkway and South 180th Street.

Dear Rudy:
Following up on our telephone conversation of this afternoon and.
earlier conversation with Mr. Bob Fehnel, I am enclosing copies
from the Manual On Traffic Uniform Control Devices pertaining to
street channelization. Particularly, note the treatment of
two -way, left -turn channelization as it melds into the left -turn
slot.
On the same sheet I have also copied a typical channelization plan
detailing on a larger scale the left -turn slot and other elements
associated with the intersection.
These are clean, tidy, non - restrictive, easy to install and easy
to maintain under all weather comditions. They have a lot to
offer in terms of operations, as well. Not the least of these is,
if traffic builds up for long periods of time, you can always
install more restrictive forms of channelization such as 'C'
curbs, islands etc. Further, this type of control serves the
public very well, for example, during off - peak conditions.

I have reviewed the proposed Property Use and Development
Agreement suggested by the Jack Benaroya Company. I have
the following comments:
1. The agreement should provide that in the event that
it is necessary to enforce the contract by taking legal action,
that the City shall recover its reasonable attorney's fees and
costs.
2. There is no firm-deadline 'for completion of various
requirements. This may not be a problem provided that all parties
act in good faith.
3. The agreement needs to more specifically provide for some
surety or other assurance that the Jack Benaroya Company or its
successors in interest in the property will perform the obligations
under the terms of the agreement. Such surety can be provided in
the form of a bond or cash deposit. An alternative might be that
in the event the Jack Benaroya Company fails to perform a certain
function such as providing a bus,•or constructing an on -site
parking structure,' that .upon reasonable notice, the City can
undertake the either purchase the equipment,: provide the services,
or take such other action is appropriate to perform those obliga-
tions. The City then has the right to seek to be reimbursed for
the providing of these services against the current property
owner.

PROPERTY USE AND DEVELOPMENT AGREEMENT
THIS INSTRUMENT, executed this day of ,
1982, in favor of the CITY OF TUKWILA, a municipal corporation
( "the City" herein) by the JACK A. BENAROYA COMPANY, a
Washington corporation ( "Benaroya" herein) and JACK A.
, BENAROYA, individually:
WITNESSETH:
WHEREAS, Benaroya is the owner of certain real property
located in the City of Tukwila, County of King, State of
Washington, which is more particularly described in Exhibit 1
attached hereto and incorporated herein by reference ( "the
Property" herein):; and
WHEREAS, pursuant to the Building Code and Zoning Code of
the City of Tukwila, Benaroya has applied for a building permit
to remodel an existing structure which is located on a portion
of the Property; and
WHEREAS, to facilitate the granting of the building permit,
Benaroya is willing to provide and maintain a Parking Plan for
the benefit of the Property; and
WHEREAS, the City is willing to approve the bulding permit
subject to the Parking Plan and subject to the execution and
recording of an appropriate instrument with the City;

Now, Therefore, Benaroya hereby covenants, bargains and
agrees on behalf of itself, its successors and assigns, that if
the building permit as applied for is granted, the Property
will be developed and used in accordance with the following
terms and conditions:
1. Benaroya will develop the Property pursuant to the
plans which have been filed with the City for remodeling the
Doces building into the "Pavilion Outlet Center" which plans
are found in Tukwila File No. dated December 15,
1981, subject to further revisions pursuant to the requirements
of Tukwila's Building Code and Zoning Code.
2. The Parking Plan (consisting of both Parking Plan "A"
and Parking Plan "B "), as attached hereto and marked Exhibit 2
and incorporated herein by reference as though fully set forth,
shall be instituted by Benaroya pursu &nt to the terms of said
Plan.
3. This Agreement shall be recorded in the records of the
King County Department of Records and Elections and filed in
the records of the City Clerk, and the covenants hereof shall
be deemed to attach to and run with the Property and shall be
binding upon Benaroya, its . successors and assigns, and shall
apply to after- acquired title to Benaroya to the Property.
4. This Agreement may be amended or modified by written
agreement between Benaroya and the City; provided any such

5. This Agreement is made for the benefit of the City and

City may institute and prosecute any proceeding at law or in
equity to enforce this Agreement including injunctive relief.

PARKING PLAN "A"
Commencing upon the opening of the Pavilion Outlet Center,
the Benaroya Company will implement the following elements,
also shown graphically on the Parkway Plaza Master Site Plan
and Outlet Center Parking Plan, Sheet AA1 (revised 2/15/82)
attached hereto:
1. A total of parking spaces on that
portion of the "Property" lying east of the
Southcenter Parkway will be allocated as indicated on
the Master Site Plan.
2. A shuttle bus seating at least 20 persons
will run continuously during regular business hours
from the main entry of the Pavilion Outlet Center to a
"Metro -type" shelter in the Parkway Plaza north
parking lot as shown on the Master Site Plan. The
area around the shelter will be clearly designated for
parking of Pavilion Outlet Center's customers' and
employees' cars. The bus route will be as indicated
by the arrows on the Master Site Plan to ensure
efficient delivery of customers and employees to the
Pavilion Outlet Center and to encourage use of the
existing excess parking in the Parkway Plaza north
lot.
3. Two hundred spaces (200) in the Parkway
Plaza north parking area, generally surrounding the
shuttle bus station as shown on the Master Site Plan,
will be designated for customers and employees of the
Pavilion Outlet Center.
4. The parking area immediately adjacent to the
Pavilion Outlet Center will be re- striped to provide
additional spaces and to provide for the parking of
compact cars, as graphically shown on the approved
final Site Plan for the Pavilion Outlet Center as
shown on Sheet Al (revised 2/ /82).
5. The two existing curb cuts closest to the
intersection of Southcenter Parkway and South 180th
Street on the south and west sides of the existing
Pavilion Outlet Center parking lot will be eliminated
and new curbing shall be installed.

6. Parking closest to the Pavilion Outlet
Center will be reserved for customers of the Center
with parking areas for tenants and employees
specifically designated at a less convenient
location.
In the event that the implementation of the
provisions of paragraphs 1 through 6 does not prevent
or alleviate traffic congestion and parking problems
on or near the Property, Benaroya may, at its
discretion implement the following supplemental
measures.
7. Provision of additional off - street parking
spaces on the Property on the west side of Southcenter
Parkway, including: a) an 85 -space lot in the area
commonly known as the North Canyon and shown on the
Master Site Plan; and b) approximately 500 surface
spaces within the developed parking area west of
Southcenter Parkway, in addition to the North Canyon;
and
8. Inclusion within the shuttle bus route, of
that portion of the property lying west of Southcenter
Parkway, or
9. Such other measures, approved by the City's
Planning Department, which provide additional parking
spaces serving the PavilionQutlet Center.

determines that a dangerous or undesirable parking situation
exists on the Property as a result of the use of the Pavilion
Outlet Center, or as a result of any other development of the

The decision of the City's Planning Department requiring
Benaroya to implement "Parking Plan "B "" shall be made in
writing and a copy of such determination shall be sent by the
City, by certified mail, to Benaroya. Benaroya shall implement
said Plan within 9.0 days of such notice.
Benaroya may appeal the decision of the Planning Department
requiring implementation of Parking Plan "B" by filing a
written notice of appeal with the City Clerk. Such appeal
shall be considered by the City Council within 30 days of the
filing of the notice of appeal. The City Council may affirm,
deny, or modify the determination of the Planning Department.
The decision of the City Council shall be final.

( "the City" herein) by the JACK A. BENAROYA COMPANY, a
Washington corporation ( "Benaroya" herein) and JACK A.
BENAROYA, individually:
WITNESSETH:
WHEREAS, Benaroya is the owner of certain .real property
located in the City of Tukwila, County of King, State of
Washington, which is more particularly described in Exhibit 1
attached hereto and incorporated herein by reference ( "the
.Property" herein); and
WHEREAS, pursuant to the Building Code and Zoning Code of
the City of Tukwila, Benaroya has applied for a building permit
to remodel an existing structure which is located on a portion
of the Property; and
WHEREAS, to facilitate the granting of the building permit,
Benaroya is willing to provide and maintain a'Parking Plan for
the benefit of the Property; and
WHEREAS, the City is willing to approve the bulding permit
subject to the Parking Plan and subject to the execution and
recording of an appropriate instrument with the City;

Now, Therefore, Benaroya hereby covenants, bargains and
agrees on behalf of itself, its successors and assigns, that if
the building permit as applied for is granted, the Property
will be developed and used in accordance with the following
terms and conditions:
1. Benaroya will develop the Property pursuant to the
plans which have been filed with the City for remodeling the
Doces building into the "Pavilion Outlet Center" which plans
are found in Tukwila File No. dated December 15,
1981, subject to further revisions pursuant to the requirements
of Tukwila's Building Code and Zoning Code.
2. The Parking Plan (consisting of both Parking Plan "A"
and Parking Plan "B "), as attached hereto and marked Exhibit 2
and incorporated .herein by reference a-s though fully set forth,
shall be instituted by Benaroya pursuant to the terms of said
Plan.
3. This Agreement shall be recorded in the records of the
King County Department of Records and Elections and filed in
the records of the City Clerk, and the covenants hereof shall
be deemed to attach to and run with the Property and shall be
binding upon Benaroya, its successors and assigns, and shall
apply to after - acquired title to Benaroya to the Property.
4. This Agreement may be amended or modified by written
agreement between Benaroya and the City; provided any such

"B" containing the following element which is in addition to
those contained in Parking Plan "A ":
-Construction of an attached. parking facility on the
Pavilion Outlet site proper with sufficient parking
capacity to satisy the Tukwila Planning Department
that the dangerous or undesirable parking situation
has been corrected, not to exceed 665 spaces for the
Pavilion Outlet Center in the configuration as
approved by the building permit to be issued
hereunder, together with those required by any permits
later issued for more intensive uses on the Pavilion
Outlet Center site proper.
The decision of the City's Planning Department requiring

MEMORANDUM
Attached is a very long letter describing assumptions and
conclusions of the analysis conducted per City of Tukwila
letter of January 27th.
1. Parkway Plaza operates at the lower end of ITE trip
generation for comparable "shopping centers ".
2. New traffic will amount to about 8 percent, contrasted
against the case when Doces was in full swing.
3. No access problems getting into the site from either
Southcenter Parkway or South 180th. Level of Service
will be "A ".
4. No problems leaving the site in the case of RIGHT turning
movements, on either arterial. Level of Service will be "A ".
5. Only problem will be for the LEFT turning movement during
the evening peak hour. Level of Service will be "D ", which
is acceptable for a previously built facility.
6. Suggest at least a 33' wide driveway at the South 180th
location. This exists on the design plan sheet and thus .
should be so constructed.
7. No degradation in air quality is anticipated.
8. In view of LEFT exiting movement (peak hour only), have
suggested a bus route that combines the Benaroya plan
with Tukwila DPW plan.
9. Data delimitation exists in our assumptions in that we
have had to make -do with limited material and total
absence of previous or historical experiences in the
literature. Hence, you may wish to review such items
as shuttle -bus capacity, headways and stop zones.
10. Regarding lane- stacking and other traffic operations on
city arterials: no problem in the area. Probably, the
impacts will be felt more distant to the site, e.g.
Strander Boulevard.
11. No changes are suggested to the city's channelization on
the arterials. They may want to adopt a less restrictive
design by reduced usage of "mushroom buttons ", etc., but
that is of no concern to the subject matter.

1982 in favor of the CITY OF TUKWILA, a
municipal corporation ("the City" herein) by the JACK A.
BENAROYA.COMPANY, a Washington corporation ( "Benaroya"
herein) :
W I T N E S S E T H:
WHEREAS, Benaroya is the owner of certain real
property located in the City of Tukwila, County of King,
State of Washington, which is more particularly described in
Exhibit 1 attached hereto and incorporated herein by reference
( "the Property" herein); and
WHEREAS, pursuant to the Building Code and Zoning
Code of the City of Tukwila, Benaroya has applied for a
building permit to remodel the Doces building into the "Pavilion
Outlet Center" which is located on the Property; and
WHEREAS, in connection with the building permit,
Benaroya is willing to provide a parking plan for the Property;
and
WHEREAS, the City is willing to approve the building
permit subject to the parking plan and subject to the execution
and recording of an appropriate instrument with the. City;
Now, Therefore, Benaroya hereby covenants, bargains
and agrees on behalf of itself, its successors and assigns,
that if the building permit as applied for is granted, the
Property will be developed and used in accordance with the
following terms and conditions:
1. Benaroya will develop the Property pursuant
to the plans which have been filed with the City for remodeling
the Doces building, which plans are dated the 15th day of
December, 1981, subject to further revisions pursuant
to the requirements of the City Building Code and Zoning
Code.
2. The parking plan as attached hereto and
marked Exhibit 2 will be instituted by Benaroya pursuant to
the terms of said Plan. Any modifications to said Plan
shall be agreed upon by the City Planning Director, and in
the event of any dispute, shall be resolved by the Tukwila
City Council.
3. .This Agreement shall be recorded in the
records of the Ring County Department of Records and Elections
and filed in the records of the City Clerk, and the covenants
hereof shall be deemed to attach to and run with the Property
and shall be binding upon Benaroya, its successors and
assigns, and shall apply to after - acquired title of Benaroya
to the Property.
4. This Agreement may be amended or modified by .
agreement between Benaroya and the City; provided any such

amended agreement shall be approved by the Tukwila City Council.
5. This Agreement is made for the benefit of the
City and the City may institute and prosecute any proceeding
at law or in equity to enforce this Agreement including
injunctive relief.
6. In the event any covenant, condition or
restriction hereinabove contained or any portion of this
Agreement is held to be invalid or void, such invalidity or
voidness shall in no way affect any other covenant, condition,
or restriction hereinabove contained.

PROPERTY USE AND DEVELOPMENT AGREEMENT
PARKING PLAN
PARKING PLAN "A"
Commencing upon the opening of the Pavilion Outlet
Center,. the Benaroya Company will implement Parking Plan "A"
containing the following elements, also shown graphically on
the Parkway Plaza Master Site Plan and Outlet Center Parking
Plan, Sheet AA1 (revised 1/18/82). attached hereto:
1. A total of 2,015 parking spaces on the "Property"
which will be allocated as indicated on the site plan.
2. A shuttle bus seating at least 20 persons
will run continuously during regular business hours
from the main entry of the Pavilion Outlet Center to a
"Metro- type" shelter in the Parkway Plaza north parking
lot as shown on the site plan. The shelter will be
clearly designated for parking of Pavilion customers'
cars. The bus route will be as indicated by the arrows
on the site plan to ensure efficient delivery of customers
to the Pavilion and to encourage use of the existing
excess parking in the Parkway Plaza north lot.
3. Two hundred spaces in the Parkway Plaza north
parking area, generally surrounding the shuttle bus
station as shown on the site plan, will be designated
for customers of the Pavilion Outlet Center.
4. The parking area immediately adjacent to the
Outlet Center will be re- striped to provide additional
spaces and to provide for the parking of compact cars.
5. The two existing curb cuts closest to the
intersection of.Southcenter Parkway and South 180th
Street on the south and west sides of the existing
Outlet Center parking lot will be closed.
6. Parking closest to the Outlet Center will be
reserved for customers of the Center with parking areas
for tenants and employees specifically designated at a
less convenient location.
PARKING PLAN "•B"
At such time as the City of Tukwila Planning Department
determines that an overflow parking situation exists as a
result of the use of the Pavilion. Outlet Center, and subject
to right of appeal by the Benaroya Company to the City Council
of Tukwila, the Benaroya Company shall cause to be implemented
Parking Plan "B" containing the following elements, which
are supplemental to those contained in Parking Plan "A".
1_. Provision of additional excess parking on the
west side of Southcenter Parkway, including: a) -an 85-
space lot in the area commonly known as the North -
Canyon and shown on the site plan; b) approximately 500
surface spaces within the developed parking area west
of Southcenter Parkway and under Benaroya Company
ownership; and /or -
2. Construction of an attached parking facility
on the Outlet Center site proper.
3. Inclusion within the shuttle bus route, of
those properties under Benaroya Company ownership lying
west of Southcenter Parkway.
It is understood that implementation of scheme 1
or 2 above would provide, in conjunction with existing
surface parking spaces, the required parking for the various
uses within Benaroya ownership at the ratios presently set
forth for such uses under the Tukwila Zoning Code as of the
date of the Pavilion Outlet Center building permit application,
irrespective of future amendments to the City's parking
requirements.

In accordance with the letter of January 27, 1982 forwarded
to the Benaroya Company over the signature of Mr. Brad Collins,
Director of Planning, we are responding to the several elements
under Traffic Analysis.
First, with respect to "estimation of traffic volume generated
by the project" and of additional value to the individual
responsible for determining impacts regarding air quality,
I am setting out a series of tables used in estimating traffic
volumes.
Concerning the entire site, we are assuming that the following
space is available. Note that we are not including the
warehouse section of the Jafco facility but concentrate our
assumptions entirely on that space devoted to retail sales.

In the above, AWDT refers to Average Weekday Traffic while
DHV refers to the Design Hour Volume which, for the subject
facility, is the evening peak hour.
With the completion of the Pavillion Outlet Center, one
might assume that the new facility would follow ITE Land
Use Code 826 which applies to shopping centers of size 500
k.s.f. to 999 k.s.f. Under these conditions the following
trip generation rates would be derived:

However, when comparing traffic generation two years ago
against the ITE standards, we find that the Parkway Plaza
site "tends" to the minimum rates defined by the. Institute
of Transportation Engineers (ITE). Therefore, since the
Parkway Plaza site appears to display characteristics some-
what less than the average, possibly due to its linear
configuration along with its peripheral location in terms
of the Tukwila environment, the expected trip generation
rates are:

In terms of new or "attracted" traffic, the "Outlet Center"
will increase traffic volumes over the previous demand by
some 8 percent.
When reviewing data used in this analysis, a single data
delimitation does exist: estimates of trip generation for
furniture stores. Because no trip generation data has
been published for facilities specializing in retail sales
of furniture, we have had to rely on previous data collected
during field studies relative to the Parkway Plaza Office
Building. Driveway demands for both the Levitz and R.B's
furniture facilities was segregated and trip generation rates
for these obtained. Estimates of gross square feet of building
size(s) were made from other plan sheets. For reference,
trip rates for these furniture stores is about 3.8 trips /k.s.f.
This was based on observations of 318 vehicles using both
the Levitz and R.B's Furniture store(s) lot(s) on a July day
in 1980. Saturday and Sunday trip rates will, naturally, be
much higher since these are their peak shopping days.
In addition, we have used previous driveway studies to determine
trip production for the entire Parkway Plaza complex, apart
from the former Doces sector. For the most part, Parkway
Plaza tends to the lower range in ITE published rates.
For analysis purposes, the basic assumption is that the new
"Outlet Center" will increase traffic demand by some 1,080
vehicle trips per day over current (1982) levels. In terms
of Parkway Plaza, the new facility will account for an extra
15.5 percent of total demand, over current (1982) operations.
It is important to recall,'hewever, that the air quality
and traffic analysis are contrasted against the "old"
configuration which, of course, included the Doces shop.
As noted earlier, the increase in demand is much smaller
amounting to approximately 8 percent.
Traffic volumes on Southcenter Parkway in the vicinity of
the project, south of the Jafco/Parkway Plaza Office Building,
were researched under the "old" or previous case. No substantial
change has taken place over the last few years when comparing
peak hour volumes at the intersection of South 180 and
Southcenter Parkway. For example, the approach volumes in
1979 were 1454 vph (Entranco Study, page 103) while the
1982 approach volumes are 1488 vph. This 'is an increase of
some 2.3 percent for the entire three year period. To all
intents and purposes, growth has been very limited.. Thus, for
air quality analysis, the following arterial demand is suggested.

Second, the City of Tukwila has requested a review and
discussion of "adequacy of the internal circulation pattern
and driveway entry location; ...including striping, lane -
stacking.capacity, curb -cuts, signing and turning movements."
Further, analysis of "the alternative shuttle -bus route pro-
posed by the Benaroya Company and the Public Works Department..."
have been requested.
The expected increase in traffic demand, "old" configuration
versus "new" configuration is about 7.9% from 10 :00 in the
morning until 8:00 in the evening. This is a relatively
small number so that little change in traffic operations is
anticipated. However, in order to assess lane- stacking
capacity as well as those elements relating to "curb- cuts"
we are using the analysis techniques of Transportation
Research Circular 212, Interim Materials on Highway Capacity,
Unsignalized Intersection. As in the case of other capacity
calculations, the output measure is Level of Service along
with a descriptor defining delay, at least to the extent
delay is anticipated.
Computations are included in the appendix of this letter report.
Regarding "striping" and "lane - stacking capacity ", the principal
observations relate to channelization on both Southcenter
Parkway and S. 180th.
Evening peak hour turning movements were taken on February 4,
1981 and described below.

From personal observation, some queuing takes place on
S. 180th, east leg, westbound. The extent of queuing was
a maximum of seven vehicles or to a point on S. 180th in
line with the portico of the Outlet Center. This lasted
for no more than 30 minutes. Accordingly, the proposed
driveway revision which would extend the shuttle -bus route
to the easternmost driveway serving the Outlet Center would
most certainly provide an operation free of queuing due to
the signal at S;. 180th and Southcenter Parkway.
The north leg of this intersection also experienced queuing
but to a lesser degree. Again, the concept of closing off
the southernmost driveway of the shopping center (closest to
S. 180th) is a viable option although, in my estimation, not
really necessary. Traffic performance could certainly be
improved if the channelization on both S. 180th and Southcenter
Parkway incorporated a design which did not use an island for
separating the left -turn lane from the 2 -way left -turn lane.
I see no particular reason for using any form of channeliza-
tion to demark the two types of movements when, fundamentally,
they are virtually the same. However, at the present time
the left -turn slot is sufficiently long to handle standing
left- turning vehicles so that they do not back out into the
thru lane. Nevertheless, should this happen, our recommendation
would be to remove such channelization so that left- turning
vehicles could queue within the 2 -way left -turn lane.
With respect to the two alternate transit routes for the
shuttle -bus, both the "Benaroya design" and the "DPW design"
have positive and negative aspects.
The "DPW design" which incorporate the northbound right -turn
entry at the Red Robin Restaurant, then swinging south thru
the shuttle -bus station, and past the main Jafco entrance,
and then to the signalized intersection appears to have
substantial benefits in terms of both passenger loading,
site service, and entry - opportunity onto Southcenter Parkway.
Further south on Southcenter Parkway, access can be gained
at either the driveway close to Abigail's Restaurant or, in
accordance with the "Benaroya design ", thru the signalized
intersection at S. 180th and thence east to the eastern
driveway by the Outlet Center. Note that this latter route
has a substantial benefit in that passenger loading can take
place under the portico.
From the portico, access to Southcenter Parkway can be
achieved via the proposed curb cut situated between the Bon
and Abigail's Restaurant. Naturally, this would require
modifications to the parking lot separating the two facilities.

Accordingly, I.would suggest a preferred route for the
shuttle -bus as shown in the attached. This is a combination
of_ both the "Benaroya design" and the "DPW design "..
Last, with respect to the "curb - cuts ", I believe that I have
noted above that there may be little necessity for modifying
these. However, since both the Department of Public Works
and the Benaroya Company appear to favor the relocation of
the S. 180th curb -cut to the east of the Outlet Center and,
in addition, the relocation of the Abigail's Restaurant curb -
cut further :.north to a point in line with the Bon /Abigail's
Restaurant route, and since adequate opportunities exist for
entering into the traffic . stream with little delay, the
proposal for relocating these is satisfactory.. Again, we
do not expect any substantial interference with thru traffic
nor with the capacity of the "stacking- lane ".
In conclusion, please understand that the traffic estimates
contained herein are based entirely on previous studies
performed in the area including those associated with the
major furniture stores (Levitz and RB Furnitute). In addi-
tion, based on historical materials we have also made
assumptions with respect to trip generation, particularly
with respect to the "trend" towards the low end of ITE trip
generation rates. Should the Outlet Center become a highly
popular facility, and I hope it does, there may be a slight
shift in demand. Accordingly, it is more than appropriate to
consider all of the above data in a "preliminary" frame of
reference, subject to revision on completion of the Outlet
Center.

Air Quality
To assess the potential air quality impact of the proposed
project, the traffic information prepared by Christopher
Brown was utilized in a computerized dispersion model, Caline 3.
Caline 3 predicts carbon monoxide (co) concentrations which
can result from roadways and is accepted by both the Environmental
Protection Agency and the Puget Sound Air Pollution Control
Agency. Traffic parameters used in the modeling analysis
are displayed on Figure 1.
With a wind direction of 355° (nearly paralleling Southcenter
Parkway), a very stable (F) atmosphere and. a 1 second per
meter wind speed, a maximum 8 hour average co concentration
of 8.0 parts per million (ppm) was predicted at the receptor
positioned southeast of the intersection. A maximum 8 hour
concentration of 7.6 ppm was predicted with a 95 wind
direction at the receptor positioned to the northwest of the
intersection. Both concentrations include a 2.0 ppm
background concentration to account for any co generated by
other co sources in the area.
Since the ambient standard for the 8 -hour average co _
concentration is 9.0 ppm, the modeling analysis indicates
that the proposed project will not cause ambient air quality
to exceed the standards, even under the unusually adverse
meteorological conditions specified in the modeling. Because
it is the most stringent,.PSAPCA uses the 8 -hour co standard
as a guideline in assessing potential air quality impacts
from roadway sources; since the 8 -hour co standard has not
been exceeded, it is unlikely that other pollutant standards
will be exceeded.

This is in response to your letter dated January 27, 1982.
Enclosed herewith please find an Addendum to the Environmental Checklist
form which amplifies the five responses mentioned in your letter.
We have discussed the requested detail concerning traffic impacts with
our outside traffic engineer. He will be examining the subject areas
raised in your letter and will be preparing a report which will be
submitted in time for your review and comment prior to the City Council
hearing on February 9, 1982.
Jerry Hillis has begun drafting a property use and development agreement
to incorporate the alternate and contingency parking plan, which will
be submitted to Larry Hard for his review as soon as possible. Hopefully,
this agreement can be recorded immediately following the City Council
hearing so that we will experience no additional delay in the processing
of the building permit.

to
Environmental Checklist Form
to
City of Tukwila
Jack A. Benaroya Company, the proponent, hereby supplements the
Environmental Checklist form submitted on January 13, 1982 for the Pavilion
Outlet Center (Dotes Remodel).
Item I.10:
There are contingency plans which have been formulated since the
date when the original Checklist was prepared. These include the possible
construction of an attached parking garage structure in the area adjacent
to the existing west warehouse loading doors and ramp. This could include
demolition of the existing free - standing restaurant building (Abigail's)
provided it becomes necessary and provided a satisfactory arrangement is
made with the existing tenant.
There are two means by which this contingency plan could be put into
effect. The City could require that the structure be built in order to
alleviate future parking shortages related directly to the operation of the
Pavilion Outlet Center. The City's right to require such construction is
to be spelled out in detail in a "Development Agreement" to be approved by
the City Attorney and to be placed of record so as to affect title to all
of the property shown in the parking plan on file with the City.
Alternatively, the proponent may elect of its own volition to proceed
with the contingency plans for construction of a structural parking facility
in order to accommodate uses in the Pavilion Outlet Center or to mitigate
impacts of the development which may not become evident until after the
Center begins retail operations.
In either event, any potential adverse impact of the proposal having
to do with parking or traffic congestion will be mitigated by these
contingency plans.
(See, also, explanation for Item II.13 in original Checklist at
page 9 thereof.)
Item I.11:
The City and the State have discussed plans to extend the South 188th
Street ramp to Interstate Highway 5 to the intersection of Southcenter
Parkway and South 180th Street. These plans are indefinite. The date,
exact location, funding, and exact nature of such a connection have not

been established. Thus, the hypothetical impacts of such a connection are
difficult or impractical to assess at this time. The City's traffic engineers,
Entranco, are currently engaged in a study which would include the potential
connection herein discussed.
Item II.2(a):
Air emissions and a resulting impact on ambient air quality is possible
as a result of increased automobile and truck traffic to the proposal,
especially during the construction phase. However, it is felt that the
proposal will not significantly adversely affect air quality since the
geographic area is already one devoted to vehicular traffic associated with
adjacent retail and other commercial and business uses. In other words,
since the activity anticipated in connection with the proposal does not
significantly differ from the current levels and types of traffic movements,
no significant adverse impact is anticipated. Emissions associated with
congestion and stalled traffic will be mitigated by implementation of
various of the alternate parking plans referred to in the original Checklist
form.
Item II.6:
It is probable that there will be some increase in general noise levels
at or near the proposal, particularly during the construction phase, arising
from use of ,construction vehicles and equipment. However, no significant
adverse impact is anticipated since the nature and extent of 'such noise will
not differ greatly from existing conditions associated with neighboring
commercial, industrial and business uses.
Item II.13(c):
Since the date when the original Checklist form was prepared, the
proponent has decided to pave the existing area east of the building in
order to create additional automobile parking adjacent to the building.
The existing rail spur will remain, but would not be in use since no rail
shipments would be made to the building under the current proposal. This
will provide the added benefits of (1) preventing potential hazards of conflict
between rail'and automobile uses and (2) establishing a useable traffic
lane on the east side of the building which will enhance traffic flow and
will ensure better access to that side of the building by emergency
vehicles.

On 26 January 1982, the various agencies of Tukwila's city government
completed their review of the subject environmental checklist. Based on
the inter- agency review process, additional information on certain topics
in the checklist will be needed prior to completing the required thres-
hold determination. In accordance with Section WAC 197 -10 -330 (la) of the
State Environmental Policy Act Guidelines, we hereby request that you
supply written information on the following topics:
1) Traffic Analysis: The Public Works, Police and Planning Depart-
ments have expressed concern about the transportation and circula-
tion impacts associated with development of the outlet center.
While this document need not approach the complexity and detail of a
formal traffic study, the following subject areas should be
examined by a professional engineer in sufficient detail to insure
adequate understanding of the safety and efficiency of traffic
movement in the project vicinity:
- Estimation of traffic volume generated by the project.
- Discussion of adequacy of the internal circulation pattern and
driveway entry locations; of special concern is the proposed
shuttle -bus travel route, including striping, lane- stacking
capacity, curb -cuts, signing and turning movements.
- Analysis of the alternative shuttle -bus routes proposed by the
Benaroya Canpany and the Public Works Department (see attached
sketch) .
- Analysis of the adequacy of stacking -lane space on adjoining
major thoroughfares as they afford turning space into the project.

As you are aware, this material must be received and reviewed prior to the
February 9, 1982 hearing before the City Council, in order to facilitate
environmental clearance as quickly as possible. We also anticipate that any
declaration of non- significance issued for the project would require recordation
of all necessary legal agreements to implement the shuttle -bus and contingency
parking plans, subject to the approval of the City Attorney and prior to the
release of building permits. We urge you to coordinate resolution of this
matter directly with Mr. Haul's office.

SUBJECT: EPIC - 178 -82 Doces Remodel Environmental Checklist
On 19 January 1982, the Benaroya Company's Environmental Checklist was
circulated to other interested departments according to our standard
internal review procedure, and we have received comments from the Police,
Fire, Recreation and Public Works Departments.
Here is a summary of the remarks returned from these agencies:
A) Fire. Department
- Provide properly identified fire access lanes surrounding the
outlet center building, Abigail's and the Home Store.
B) Police Department
- Traffic: Inadequate maneuvering space for two -way traffic cir-
culation on the south side of the building; recommend that
one -way west -bound only aisle be investigated.
Appears to be inadequate stacking capacity on Southcenter Parkway
for left turn into west entry.
- Lighting: Sufficient security lighting should be added to north .
and east sides of the building to provide safety for pedestrians
and vehicles.
Recreation
- Development of sideswalks on the Southcenter Parkway and So. 186th
Street frontages should be part of the project's required improve-
ments as these will be principal linkage routes to the Christensen
Trail and for pedestrian activity.

It appears that additional information may be needed to complete the

PAVILION OUTLET CENTER
PARKING PLAN
Commencing upon opening of the Pavilion Outlet Center. a shuttle bus
seating at least 20 persons will run continuously during regular business
hours from the main entry of the Pavilion Outlet Center to a "metro-type-
snelter to be located where indicated in the Parkway Plaza North parking
lot. The parking area and shelter will be clearly designated for parking
of Pavilion customers' cars. The bus route will be Is indicated on the
plan. insuring efficient delivery of customers to the Pavilion and
encouraging use of the existing excess parking in the Parkway Plaza North
lot. Further details of this plan and alternate parking plans which the
City may cause to be implemented in the future will be incorporated into
a Property Use and Development Agreement wnicn will be recorded after
approval by the City and the Owner.

Review Department comments: Traffic Flow: The current proposed:-traffic pat'ttrn
appears inadequate along the south side of the building parallel wind adjacent to
S. 180th St. The layout plan indicates the proponents will move an existing drive-
way approximatley 165 feet east to the east side of the building. This will create
a long and narrow traffic channel. The layout indicates a seperation of 20 feet
between parking stalls for fehicle flow. This is insufficient for two -way traffic
pattern. During peak traffic times, cars backing out of parking stalls will have
difficulty in entering the traffic flow. Vehicles would be backed up from the drive-
way, west to the west side of the building. Once a vehicle passes the west side
driveway, it would be unable to turn around. Trucks which would enter the area

would cause considerable more congestion due to their size and manueverability.
Fire Trucks would have difficulty in manuevering through the area. also. Closed
area through traffic lanes are 12 feet in width. The proposed traffic lane is
10 feet in width. One alternative would be to establish one -way westbound traffic
flow and reverse the angle of the proposed parking stalls on the south side.
Properly placed arrows and signs indicating one -way at the entrance and exit of the
traffic lane would notify drivers of the proper traffic flow. The access and egress
are questionable. The flow patternfrom Southcenter Parkway to the west entrance
is not sufficient to hold more than three cars. This would create a backup of
traffic in the inside southbound lane. A detailed traffic study should be conducted
to determine the traffic flow into this area.
Security Lighting: Security lighting on the north and east sides of the building
do not exist. There are two lights on buildings across the street to the north,
however these are inadequate and unreliable. The east side is totally without
lights of any kind. The building to the east creates a tunnel effect and during
times of darkness, is an extreme safety factor. Sufficient lighting should be
installed on both the north and east sides of the building to provide safety for
citizens and vehicles.
Personnel Entrances: Information regarding installation of personnel doors and
widnows along the north and east sides was not furnished. Such installation should
conform to existing city safety codes.

The existing retail and warehouse areas (including the existing retail
mezzanine) comprise approximately 190,000 square feet of gross floor
area. The proposal is to create a second floor throughout the building
and a central mall area connecting to the upper level with escalators.
The existing warehouse would also be devoted to retail tenant areas.
The gross floor area would be increased to approximately 260,000 square
feet by the completion of the second level, but the gross leaseable area
would remain at very close to the existing 190,000 square feet by virtue
of the common areas, mall and corridors.

The site for the proposal is at the intersection of South 180th Street
and Southcenter Parkway. The former Doces store, including the separate
restaurant building (Abigail's) occupies about 7.5 acres of land. However,
the proposal includes the common use of the proponent's adjacent ownership
to the north, Parkway Plaza. The proposal would tie together these
formerly separate ownerships, to create common interior driveways and
parking areas.

Explanation: The proponent anticipates the submission of a parking plan,
binding site plan, or other suitable means of assuring the City that
adequate existing parking areas will be available to and practically useful
to the proposed development. This may include the use of a shuttle bus to
transport retail customers from adjacent, under - utilized parking areas to
the new center. It may also include establishment of exclusive mandatory
parking areas for tenants and their employees to relieve potential
congestion in the customer areas.
In general, the proponent recognizes that the proposal will create
additional vehicular traffic to the site, but any adverse impacts will
be ameliorated through the adoption of measures mutually acceptable to
the City and the proponent.
