Minutes of the Tukwila Planning Ccr:rnission meeting of September 23, 1982.
Acting Chairperson Avery convened the meeting of the Planning Commission
at 8:10 p.m. in the City Council Chambers. Other Commissioners in attendance
were Mr. Arvidson, Mr. Sowinski and Mr. Knudson. Planning Commission
position number one (1) is vacant due to the recent resignation of Mr. Larry
Gill. Mr. Brad Collins, Planning Director and Ms. Caroline'Berry, Assistant
Planner were present on behalf of the staff.
APPROVAL OF MINUTES
MOVED BY MR. KNUDSON, WITH MR. SCWINSKI'S SECOND, TO APPROVE THE MINUTES OF
AUGUST 26, 1982 AS PUBLISHED. MOTION CARRIED.
CITY COUNCIL ACTIONS
Mr. Collins informed the Commission of recent City. Council actions:
- Amended Sign Code was adopted by the Council on September 20, 1982 and
will be effective September 27, 1982 (actually September 30, 1982).
- Cooperative parking facility at Center Place approved by the Planning
Commission August 26, 1982 was appealed by Mayor Van Dusen based on
its potential impacts to City policy. City Council reviewed and
affirmed the Commission's decision to approve the cooperative parking
facility.
- Code amendment of PRD in Single Family districts subject to the condi-
tions recommended by •the Planning Commission was considered by the
Council on September 13, 1982.. The code amendment was sent. back to
staff for further information on bufferings of PRD to surrounding
properties. Code amendment is scheduled for Council consideration
September 27, 1982.
- Council decision of the Western Pacific Properties annexation was
postpone3.until Planning Commission's recommendation of zoning for the
proposed annexation area.

A. Application 82 -18-CA Paint Manufacturing in M-1 Districts Daniel
Boone requesting approval of an amendment of Chapter 18.40 of the
Tukwila Municipal Code to allow paint manufacturing in the M-1,
Light Industry districts. •

Ms. Berry presented the staff report regarding the code amendment to allow
paint manufacturing in M-1, Light Industry districts. Acting Chairperson
Avery opened the public hearing at 8:30 p.m.
COMMENTS —Mr. Charles Gordon, Attorney representing Daniel Boone Paints,
Inc., 945 88th NE Place, Bellevue, WA 98004
- Introduced officers of Daniel Boone Paints, Inc.
- Distributed exhibits to be entered into the record, including letters
from surrounding businesses supporting Daniel Boone Paints, Inc.
operating in Tukwila and City environmental and building records.
- Stated this business is not a nuisance activity.
- Have made site improvements at the request of Fire and Building Officials.
- Request a rapid decision as present lease expires this year.
- Several options are acceptable to Daniel Boone Paints, including
designation as a conditional.use in the M-1 district or as a legally
non - conforming use.
COMMENTS —Mr. Bill Boone, President of Daniel Boone Paints, 1401 Dexter N.,
Seattle, WA
- May 1980 became aware that the Highway Safety Products Building was
for sale, Highway Safety Products was having financially difficult
times.
- Daniel Boone Paints put earnest money on property prior to government
auction and at the auction purchased all the equipment in the building.
- June 1981 Bankruptcy Court directed sale of property to Daniel Boone
Paints. Sale was completed in same month.
- June 1981 made building improvements advised by Building and Fire
Departments in order to obtain an occupancy permit.
Present lease in Seattle expires this year, hence requests prorpt
decision on this matter.
- Never have used cadmuim oxide or other similiar toxic materials in their
.manufacturing process; equipnent'in building vacuums pigments from.
air prior to entering the atsmosphere; clean record with the City of
Seattle under constant monitoring.
- Wishes to continue using the building for what it was designed.
- Employ nine (9) persons, most of whom reside in the south end of Seattle,
in this area.
-. Neighbors have indicated a favorable reaction to Daniel Boone Paints
relocation in Tukwila.

- Andy's Tukwila Station is in close proximity to the area.
- Approve of Daniel Boone Paints locating in Tukwila.
COMMENTS—Ms. Helen Nelsen, property owner, 15643 West Valley-Road, Tukwila, WA
- Closest resident in the area.
- All the businesses in the area are one of a kind in this small area,
known as Tukwila Downs.
- Building has been used for heavy equipment under the Torgersons
and paint manufacturing under Farwest and Highway Safety Products.
- Not aware of any employees filing suit for unhealthy operation or
pollution.
- Area is zoned M -1 and operation is established; newly adopted land use
plan delegates this business as M-2.
- Every effort should be made to grant their petition.
COMMENTS--Mr. Charles Gordon, Attorney for Daniel Boone Paints, 945 88th N.E.,
Bellevue, WA
- Facility was purchased as a paint operations facility, as an allowable
use in the City. Self evident by Highway Safety Products as far back
as 19.72 and Far.West Manufacturing before that.
- Daniel Boone Paint's intent is to continue precise same paint processing
activities with'certain exceptions. For example, the City's request for
Daniel Boone Paints to install a sprinkler system and remove sane structures,
which were done in good faith and at substantial expense of Daniel Boone
Paints in order to became a good neighbor in the community.
Use of structure has never. ceased, sale was delayed through bankruptcy
and economic times. Intends to use the facility as used in the past
and is operating in good faith. .Requests in the very least to be able
to.continue the business as in the past.
- Doesn't believe there is any showing that this business will have any
adverse impact on the environment. SEPA findings in 1977 for substantial
construction on this site and at Far West with negative declaration of •
any significant adverse environmental impact.
- Point is not how, but can they operate this business at this location.
Prefer a code amendment, but'in the very least would like to be designated
as a non - conforming use.
Having heard all persons who desired to address the Commission, Acting
Chairperson Avery closed the public hearing at 9:55 p.m.

Mr. Collins informed the Planning Commission of additional alternatives to
the code amendment that they may consider ,including 1) adding paint
manufacturing to M-1 as a conditional us.e,2) designating paint manufacturing
as an unclassified use, and 3) designating Daniel Boone Paints as a
legally non - conforming use. The Planning Department prefers the third
alternative of administratively designating it as a legally nonconforming
use. Mr. Arvidson clarified that the designation is for this occupany
only. Mr. Collins indicated as long as this building was occupied any
business could continue paint manufacturing as non - conforming since the
period of cessation between businesses,has been 24 months or less.
MOVED BY MR. ARVIDSON, WITH MR. KNUDSON'S SECOND, THE PLANNING COMMISSION
RECOMMEND 10. THE CITY COUNCIL "DO NOT PASS" ON APPLICATION 82 -17 -CA AND THAT
NO CHANGE BE MADE TO TMC 18.40.020 OR TIC 18.42.020(2). MOTION CARRIED
WITH THE UNDERSTANDING THAT DANIEL BOONE PAINTS COULD QUALIFY FORA BUSINESS
LICENSE AS A LEGALLY NON - CONFORMING USE.
PLANNING CISSION ACTIONS
A. Application 82 -6 -A, Western Pacific.Properties requesting approval of
Tukwila zoning classification for various properties proposed to be
annexed to the City. Said properties are generally located on 48th
Avenue South between South 135th and South 134th Street.
Ns. Berry presented the supplemental staff report concerning zoning for the
proposed annexation area.
Mr. Bill Turner, resident, 13435 48th Ave. South, Tukwila, WA., not that
he is a.resident in the proposed annexation area. He has a petition signed
by 37 persons who do not desire the zoning of the proposed annexation area to
be changed. Not that 40th Ave. S. is really 20 feet rather than 40 feet as
Shown on the staff report. Mr. Collins clarified that the 40 feet represents
the right-of-way not necessarily the street. Many of the people would agree
to R-2 for the area.
Mr. Richard Barene, property caner, 13423 48th Ave. S., Seattle, WA.,
would like to go on record in favor of that the whole area be annexed to
Tukwila as CM or M-1. .Owns approximately 25% of proposed annexation area
in question:.
Mr: Matt Little, Western Pacific Properties Representative for the original
three parties who proposed the annexation, 13975 Interurban Ave., Tukwila, WA
views either staff exhibit "A" or "B" as acceptable methods of zoning, however,
prefers "B" in that it designates the entire proposed annexation area as CM.
The setbacks between single family and light industry classifications are
greater in exhibit "B." The street appears to be a natural be ndaxy.. Noted,
Mayor Van Dusen and Councilperson Phelps waived the surveyor fees in order
to include the additional area in the proposed annexation.
Mr. Collins clarified that staff is only recommending exhibit "B" not "A."
,Exhibit. "A" is included for purposes of illustration of setbacks, as they
compare to Exhibit "B."
