Marine building project. Please note the publication dates as they

I understand that your lender has required you to take the unusual
step of publishing Notice of Action on a relatively simple Declaration
of Non - Significance as a condition of project financing. While the
probability of challenge to the DNS arising from publication of this
notice is remote, any such action to enjoin, review or set -aside the
City's decisions may result in delayed issuance of your occupancy
certificate.

SUBJECT: Sperry Marine DNS
This morning I•received a verbal request from Western Pacific Properties
to publish a notice of action on the Sperry14arine Building Declaration
of Non - Significance. Our cooperation in this regard will help Western
. Pacific to satisfy their lender's conditions for obtaining permanent
financial backing for the project.
I have reviewed the SERA Checklist Disclosure Statement in comparison
with that submitted in support of the rezone application filed for this
property (EPIC- 146 -80) and find it to be adequate.
The building has been under construction for about two months and is
nearing completion. The proponents are aware of the risk involved with
publishing the Notice of Action i.e. the remote possibility that an
action by the public to enjoin the D.N.S. could delay issuance of any
occupancy certificate.

20' poles. The low reflective glass have been set 45 to the street to
