LA `ti City oihTukwila . 1 6200 Sou center Boulevard Tukwila Washington 98188 1906 • Frank Todd, Mayor P TO: FROM: DATE: SUBJECT: MEMORANDUM City Council Public Works Committee Mark Caughey, Acting Planning Director 18 April 1980 'PLANNING COMMISSION REVIEW - PROPOSED SIDEWALK ORDINANCE At its work session last evening, the Planning Commission examined the proposed sidewalk ordinance and offered the following comments: 1) Section 1B- Consensus: Retain present wording The Commission notes that most R -1 development in town was provided with sidewalks at City expense; it is unfair to require builders of infilling sites to bear privately the cost of sidewalk installation. Section. 2A- Consensus: Change "20 %" Floor area threshold to a "dollar" • amount, i.e. $25,000. The Commission feels that this approach will eliminate argument which might result from application of different valuation methods. 3) Section 3A- Consensus: Direct staff'to develop design criteria for retro- fitting sidewalks on remodel sites. The proposed design standards will key sidewalk width to traffic demand and will insure minimal removal of existing landscape in retrofitting sidewalks. 4) Section 3B- Consensus: Delete section The Commission feels that placement of fire hydrants is subject to the Public Works Director's approval of the sidewalk plan set as provided in Section 1A. 5) Section 5- Consensus: Clarify intent of section Calculation of benefit is not really clear in this instance; also, some verbage to require L.I.D. participation should be included to insure com- pletion of vital sidewalk linkages. 6) Ordinance Title: Consensus: Eliminate curb and gutter from perview of this ordinance. Sidewalk Ord inance April 25, 1980 Comments on Enviornmental Questionnaire Review for the City of Tukwilas' Side Walk Ordinance. For the safety and liability of. the City, should the sidewalks be in- stalled, the fire hydrants, fire department connections, street lamp poles should be removed off the walking area. Another solution would be to put the sidewalk on a curving layout to by pass these items. This will help in keeping the people using the walks on the walks and out of the streets. It would also give wheel chairs full excess to the walks. Hubert H. AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO THE INSTALLATION, MAINTENANCE AND REPAIR OF SIDEWALKS, CURBS AND GUTTERS AND ADDING TO TUKWILA MUNICIPAL CODE TITLE 11 AND REPEALING ORDINANCE NO. 1025. COUNCIL ACTION MEETING TYPE TAU AGENDA ITEM ACTION e/w /7 WHEREAS, it is hereby deemed necessary in the interest of public safety and convenience to establish requirements for the construc- tion of sidewalks, curbs and gutters of industrial, commercial, and residential properties. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Sidewalks, curbs, and gutters for new construction. A. Whenever a building permit application is made for the construction of new multi - residential, commercial er industrial structures within the city, the person or business seeking such permit shall also make sidewalk plan submittal for approval by the Public Works Director. The plans shall include the necessary information for the construction of sidewalks, curbs and gutters on all sides of the property adjoining any street or other public right -of -way and shall extend the full distance of each parcel. A building permit shall not be issued until such time as a sidewalk construction plan is approved by the Public Works Director. B. Single family Residential shall be excluded from this ordinance except when built as a part of an overall development, plat, or subdivision. Section 2. Existing streets or arterials when sidewalk con- struction, curbs or gutters required. It is recognized that there exists in the City of Tukwila arterials and streets which, notwithstanding, that they may have already been widened, do not have sidewalks or associated sidewalk construction. In furtherance of the _intent of this ordinance and subject to the limitations and exceptions provided in other sections, it shall be a condition of the issuance of a building permit for the following construction activities that curbs, gutters and sidewalks conforming to stan- dards and guidelines prepared by the Department of Public Works shall be installed along the entire street frontage of the property prior to the issuance of a building permit. A. Substantial remodeling to buildings or structures adjacent to a business or arterial street and neither zoned nor actually used as a single family residence. For purposes of this chapter, "Sub- stantial remodeling" means construction which increases the floor area of an existing building or structure by at least 20% or any alteration or repairs including interior, plumbing, electrical and structural made within a 12 month period, which together exceeds 25% of the value of the previously existing building or structure. B. The maintenance and repair of unfit or unsafe sidewalks, curbs or gutters, as determined by the Public Works Director, shall be the responsiblity of the abutting property owner. • Section 3. Standards of Construction. A. All sidewalks required to be constructed under the provisions of this section shall be of portland cement concrete and sidewalks, curbs and gutters shall otherwise conform to . standard specifications and plans for municipal public works construction, commonly known as APWA Standards. All sidewalks required to be constructed pursuant to the provisions of this section shall be 6 feet in width for arterial streets provided that in C -1 and C -2 zones sidewalks shall be 8 feet in width. All other sidewalks shall be 5 feet in width. B. There shall be a. prohibition on installation of any fire hydrants within the borders of any sidewalks. Location shall be in a planter strip between the curb and sidewalk or immediately behind the sidewalk. Section 4. Delays, waivers or exceptions. A delay; waiver, or exception may be granted if the city council deems that such side- walk construction will be physically unfeasible. In the event any person desires to file a request for delay, waiver, or ex:. ception with the city council pursuant to this section, such request must be considered by the city council 30 days prior to the time that the building permit for the residential, commercial or industrial structure is issued. Section 5. Statement of policy cost participation. The city shall participate in the cost of sidewalk, curb and gutter construction only to the extent that the cost thereof exceeds the special benefits conferred to the properties within the local improvement district form for the purposes of constructing the sidewalk. Section 6. Severability. If any section, subsection, provision or clause of this ordinance or its application to any person or circumstance is held invalid by a court of competent jurisdiction, the remainder of this ordinance or the applications of the provisions to other persons and circumstances shall not be affected.
