PERMIT CONDITIONS:

2: No changes shall be made to the approved plans unless approved by the design professional in responsible charge and the
Building Official.
3: All mechanical work shall be inspected and approved under a separate permit issued by the City of Tukwila Permit Center
(206/431 - 3670).
4: All permits, inspection records, and approved plans shall be at the job site and available to the inspectors prior to
start of any construction. These documents shall be maintained and made available until final inspection approval is
granted.
5: All construction shall be done in conformance with the approved plans and the requirements of the International
Building Code or International Residential Code, International Mechanical Code, Washington State Energy Code.
6: There shall be no occupancy of a building until final inspection has been completed and approved by Tukwila building
inspector. No exception.

7: Remove all demolition rubble and looseilicellarteous material from lot or parcel of gr :, . properly cap the sanitary
sewer connections, and properly fill or othWse protect all basements, cellars, septic t ells, and other
excavations. Final inspection approval will be determined by the building inspector based on satisfactory completion of
this requirement.
8: All construction noise to be in compliance with Chapter 8.22 of the City of Tukwila Municipal Code. A copy can be
obtained at City Hall in the office of the City Clerk.
9: Ventilation is required for all new rooms and spaces of new or existing buildings and shall be in conformance with the
International Building Code and the Washington State Ventilation and Indoor Air Quality Code.
10: Water heaters shall be anchored or strapped to resist horizontal displacement due to earthquake motion. Strapping shall
be at points within the upper one -third and lower one -third of the water heater's vertical dimension. A minimum
distance of 4- inches shall be maintained above the controls with the strapping.
11: All plumbing and gas piping work shall be inspected and approved under a separate permit issued by the City of Tukwila
Building Department (206- 431 - 3670).
12: All electrical work shall be inspected and approved under a separate permit issued by the City of Tukwila Building
Department (206- 431 - 3670).
13: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of,
any violation of any of the provisions of the building code or of any other ordinances of the City of Tukwila. Permits
presuming to give authority to violate or cancel the provisions of the code or other ordinances of the City of Tukwila
shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the
Building Official from requiring the correction of errors in the construction documents and other data.

WHEREAS, the City of Tukwila has established the policy of preventing
any land use actions that would be detrimental with regard to present community
values and future goals and resources as demonstrated by the adoption of Reso-
lution No. 489 on August 4, 1975, until a new Comprehensive Land Use Plan could
be adopted by the City that conforms to current values and goals; and
WHEREAS, the zoning laws still in existence for the City of Tukwila
were adopted prior to the new City of Tukwila Comprehensive Land Use Plan and
will need to be revised to accomplish the goals and objectives of the Plan; and
WHEREAS, it is clear that the zoning map for the City of Tukwila no
longer reflects the Comprehensive Plan of the community, its legislative body,
and currently- recognized state of the art of planning; and
WHEREAS, Ordinance No. 1035, as amended by Ordinance Numbers 1053 and
1091, have established a termination date; and
WHEREAS, the adoption of a new zoning ordinance and map have not yet
been completed as contemplated by Ordinance No. 1035, as amended; and
WHEREAS, it is necessary to continue the procedures of Ordinance No.
1035, as amended, in order to promote the orderly development of the community.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Policy Statement. All segments of the City, including the
City Council, its advisory bodies and the administration, are directed to begin
the development of a new zoning ordinance and map using the new Comprehensive
Land Use policies, plans, and maps as a guide.
Section 2. Definition. As used herein, "Comprehensive Land Use Plan
Map" shall mean the maps of the new Comprehensive Land Use Plan document.
Section 3. Waiver Required. Until such time as the zoning ordinance
and map are brought into conformance with the new Comprehensive Land Use Plan
Map or until the termination of this ordinance, whichever shall occur first, the
following actions shall require a waiver and approval thereof by the City Council
prior to processing of the applicable land use permit by the City:
1. That the proposed action does represent a unique condition which
is insignificant in sacle.
2. That no other reasonable alternatives are available which would
not require a waiver.
3. That sufficient mitigating measures are provided if the request
for waiver involves building, grading, clearing, excavation or
filling in a geographical area generally identified by the Envir-
onmental Basemap as an area of high natural amenity or develop-
ment constraint.
4. That the request for waiver is consistent with the goals and
policies of the Comprehensive Land Use Policy Plan.
5. That the requirements of this ordinance impose a special hardship
to a site for which a waiver of the provisions would not necessi-
tate a major policy commitment prior to the adoption of the Zoning
Ordinance and Map.
Section 6. Termination Date. This ordinance and the policy herein
adopted shall remain in effect until the second regular council meeting of January,
1980, or until a new zoning ordinance and map is adopted, whichever comes sooner.
Section 7. Emergency Declared. The adoption of this ordinance is
declared to be an emergency and is necessary for the immediate preservation of
the public health, safety and /or welfare and shall take effect immediately upon
its passage.
Section 8. Severability Clause. If any portion of this ordinance is
deemed to be in violation of the constitution of this State or of the United
States of America or of any other law, rule or regulation, said finding shall
not render the remaining sections of this ordinance void.
Section 9. Ordinance Numbers 1035, 1053, and 1091 are hereby repealed.

18.12.010 Additional classifications. The R -1 district
is further subdivided into districts differing only in the
requirements of lot area per family as follows:

18.12.020 Use regulations -- Generally. In the R -1
district, no building or land shall be used and no building
shall be erected, altered, or enlarged, which is arranged,
intended or designed for other than one of the uses in this
chapter, except as otherwise provided in Chapters 18.64 and
18.66. (Ord. 251 §4- 1(part), 1957).
18.12.030 Use regulations without special restrictions.
Uses without special restrictions shall be as follows:
(1) One family dwellings;
(2) Publicly owned parks and recreational areas;
(3) Golf club houses, including courses, but not in-
cluding miniature golf courses and driving ranges;
(4) Agriculture;
(5) Greenhouses, nurseries and truck gardening, propo-
gating and cultivating only, of plants, upon approval of
the planning commission, after a public hearing; Provided no
retail or wholesale business shall be carried on upon the
premises so used; And provided further, that no obnoxious
fertilizer is stored upon the premises and no obnoxious soil
or fertilizer renovation is carried on upon the premises.

18.12.040 Conditional uses. (a) Uses subject to
specific conditions shall be as follows:
(1) Church plants (not permitted in converted resi-
dential buildings or structures in this district) and com-
munity center buildings;
(2) Public schools, elementary, secondary and high,
and private schools with curricula equivalent to public

elementary, secondary, or high schools, and institutions of
higher learning (accredited colleges and universities);
(3) Public libraries, police and fire stations;
(4) Public museums or art galleries;
(5) Water supply reservoirs, wells and filter beds.
(b) The uses in subsection (a) must be located in ac-
cordance with at least one of the following situations; Pro-
vided that under th= following subdivisions (1), (2) and
(3) there shall be side yards of at least three times the
amount required for such property under the height, yard
and area regulations of this district:
(1) On a corner lot immediately adjacent to or
across the street from a public park, public playground or
a parkway, which has a right -of -way width of at least one
hundred twenty feet; or
(2) On a parcel or tract of land entirely surrounded
by streets or streets and alleys; or
(3) On a lot immediately adjoining or immediately
opposite on the other side of a street from R -3 to M -1 dis-
tricts, inclusive; or
(4) On a lot approved by the planning commission
as being a location where such building will not materially
injure neighboring property for residential use. (Ord. 251
§4- 1(part) , 1957) .
18.12.050 Accessory uses. Accessory uses customarily
incident to the uses mentioned in Sections 18.12.030 and
18.12.040 and located on the same lot therewith, not involv-
ing the conduct of a business or industry shall be as fol-
lows:
(1) A private garage or servants' quarters, if located
not less than sixty feet from the front lot line, except in
the case of a terrace garage, and not less than four feet
from any rear and two feet from any side line and, in case
of corner lots, not less than fifteen feet from a side street
line. No garage shall be erected nearer than twenty feet to
a building on an adjoining lot occupied and used exclusively
as a private residence, unless permitted by written permis-
sion of the planning commission, or unless attached to the
main building. If serving two lots, the garage may be built
across the side or rear line and where an alley abuts a side
or rear lot line, such accessory building may be built on
the alley line. Furthermore, the servants' quarters shall
be occupied only by servants employed on the premises. When
built as an integral part of the main building, a private
garage or servants' quarters shall be subject to the regula-
tions affecting the main building.
A private garage or parking space, providing storage
for not more than one passenger motor vehicle for each two
thousand square feet of the lot area;

(3) A private stable, if located not less than sixty
feet from a front street line nor less than thirty feet from
a side or rear lot line. It shall provide capacity for not
more than one horse, mule or pony for each five thousand
square feet of lot area, but no more than a total of two of
the above mentioned animals shall be allowed.
(4) Temporary buildings such as real estate offices,
contractors' sheds and buildings of like character will be
permitted during construction of buildings or sale of prop-
erty, but not to exceed two years, upon approval of the plan-
ning commission.
(5) No billboard, signboard, advertising sign or win-
dow display, except as provided below, shall be permitted as
an accessory use in the district. The placing of an unillum-
inated "for sale," "for rent" or "for lease" sign, not more
than eight square feet in area, will be permitted as an ac-
cessory use, and churches and other institutions, as desig-
nated in Section 18.12.040, may display unilluminated bulle-
tin boards, not more than twenty -five square feet in size,
showing names, activities and services therein provided. The
bulletin boards may be lighted only if indirect lighting or
a shaded light is used (no neon'signs). During construction
of a building, one unilluminated sign advertising contractors
or architects of such building shall be permitted, provided
such sign shall not be more than sixteen square feet in area,
and shall be removed upon completion of a building.
(6) No store, trade, business, industry or practice of
a profession shall be permitted as an accessory use in this
district, except as follows:
(A) The office of a surgeon, physician, (including
osteopaths and chiropractors) or dentist, located in the
dwelling or apartment used as the private residence of such
surgeon, physician or dentist and attended only by members
of the immediate family, provided no window or other display
or sign is used to advertise such occupation, except one un-
illuminated name plate not to exceed eighty square inches,
carrying the name and occupation, may be allowed. No clinic
shall be allowed.

Description of Property:
• Located on 14470 58th Ave 5 Tukwila, WA 98168.
• A 47 year old one -story house and a detached garage with living space above.
The purpose of this report is to provide evidence /proof that the living space above the garage (mother -
in -law suite) was grandfathered in before the City of Tukwila passed a new law that prevents adding a
mother -in -law suite to a home.
Overview for the purpose of providing this report
• On August 7, 2012, I was approached by Carol Martin, Combo Building Inspector for the City of
Tukwila. Ms. Martin stated that I violated not having the proper building permits prior to
commencing work.
• I visited the City of Tukwila to share my floor plan on the proposed work to be done in the
garage below the mother -in -law suite. I spoke to Carol Lamb, Senior Planner for the City of
Tukwila, who informed me that in the City of Tukwila, mother -in -law suites are not permitted.
Therefore, the living space above the garage cannot be used as a mother -in -law suite. When I
purchased this home, the living space above the garage was marketed to me as a mother -in -law
suite. This was the first time I had heard of it being otherwise.
• Since I was under the impression that the living space already was a mother -in -law suite, I asked
Ms. Lamb if she could do more research since my property was built in 1981. Ms. Lamb referred
me to speak with Minnie Dhaliwal, Planning Supervisor for the City of Tukwila.
• Ms. Dhaliwal stated that I need to provide evidence /proof that the living space above the garage
was built as a living space when the house was built. Therefore, the living space would be
grandfathered in and usage as a mother -in -law suite will be permitted.

Proof /Evidence of mother -in -law suite erandfathered as living space
The following description of the proof /evidence can be viewed in the DVD labeled "Exhibit A."
Proof /evidence found in Mother -in -law suite:
• The windows are identical to the windows found inside the house.
• Counter tops and cabinets are custom made and the same type of wood that was used in the
house was also used in the mother -in -law suite.
• The doors, trims and closets are made of an older looking type of wood.
• Custom built -in shelves can be found in the 2 bedrooms which were very popular in the 1980s.
• One of the bedrooms in the mother -in -law suite lead to an attic. Inside the attic, you can find an
old furnace (not currently in use). The furnace has model /serial # that I obtained and called the
manufacturer, Lennox who informed me that the furnace was built in 1978. (More description
on the furnace including the model #, serial # can be found in Exhibit B).
• By viewing the size of the furnace, you can see that the furnace was installed in the attic before
the roof was installed because there is no other way to get that furnace inside that tiny attic.
Therefore, this is a significant evidence proving that the mother -in -law suite was built as a living
space at the time the house was built.
• Also, the furnace is connected to the bathroom vent, and it used to be connected to the
bedroom vents as well.
Permits:
• I visited the King County Health Department to obtain the plumbing permit for the mother -in-
law suite. I spoke to Debra Cannon, Administrative Support Supervisor who informed me that
they only keep records of permits for the past 6 years.
• I also visited the Washington State Department of Labor & Industries to see if there was any
permit filed /requested for electricity. They also informed me that they don't keep records for
more than 7 years.
• I contacted Olympia to see if they have any records stored but unfortunately they also informed
me that they don't have the space to keep records that old.
In conclusion, based on the evidence that I have provided in this report, the living space above the
garage should be permitted as a mother -in -law suite. I have also received the guidance of my attorney
who also agrees that there is plenty of evidence to show that the living space was built at the same time
the main house was built. Please give me a call if you have any questions.

AN ORDINANCE ESTABLISHING PROCEDURES
FOR REVIEW OF PROJECTS INCONSISTENT REPEALED BY
WITH THE NEW COMPREHENSIVE LAND US,E PLAN //07
WHEREAS, the City of Tukwila has established the policy of
preventing any land use actions that would be detrimental with regard to
present community values and future goals and resources as demonstrated
by the adoption of Resolution No. 489 on August 4, 1975, until a new
Comprehensive Land Use Plan could be adopted by the City that conforms to
current values and goals; and
WHEREAS, Resolution No. 489 will no longer be in effect after the
adoption of the New Comprehensive Land Use Plan; and
WHEREAS, the City is adopting a new Comprehensive Land Use Plan
simultaneous with the adoption of this ordinance; and
WHEREAS, the zoning laws still in existence for the City of Tukwila
were adopted prior to the new City of Tukwila Comprehensive Land Use Plan and
will need to be revised to accomplish the goals and objectives of the Plan; and
WHEREAS, it is clear that the zoning map for the City of Tukwila
no longer reflects the Comprehensive Plan of the community, its legislative
bodyacurrently- recognized state of the art of planning.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Policy Statement. All segments of the City, including
the City Council, its advisory bodies and the administration, are directed to
begin the development of a new zoning ordinance and map using the new Compre-
hensive Land Use policies, plans, and maps as a guide.
Section 2. Definition. As used herein, "Comprehensive Land Use
Plan Map" shall mean the maps of the new Comprehensive Land Use Plan document.
Section 3. Waiver Required. Until such time as the zoning ordinance
and map are brought into conformance with the new Comprehensive Land Use Plan
Map or until the termination of this ordinance, whichever shall occur first,

Section 7. Severability Clause. If any portion of this ordinance
is deemed to be in violation of the constitution of this State or of the
United States of America or of any other law, rule or regulation, said
finding shall not render the remaining sections of this ordinance void.

AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE #1035 DEALING
WITH PROCEDURES FOR APPLYING FOR A WAIVER TO THE COMPREHEN-
SIVE PLAN.
WHEREAS, Through Ordinance #1035 the City of Tukwila has established
a waiver process for proposed developemtns which are not consistant with the
City's new Comprehensive Plan, and;
WHEREAS, The City Council feels that the required submittals in Sec-
tion 4 of Ordinance #1035 are too restrictive.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 4 of Ordinance #1035 is amended in total to read
as follows:
"Section 4. Application Requirements. The City Administration shall
process a preliminary and final waiver application, when properly
applied for, through the City Council. These procedures shall be as
follows:
a. Preliminary Waiver Application. An applicant may make a pre-
liminary Waiver Application to the City for determination if
the project is basically consistant with the criteria in Sec-
tion 5 of Ordinance #1035. The City Administration is directed
not to process a preliminary waiver application nor place it on
the City Council Agenda until such time as the applicant has
submitted the following items:
(1) A site plan showing at a minimum the building location,
parking area configuration, access points, landscape areas,
and the amount of necessary grading involved.
(2) Renderings of the proposed structure showing the height,
width, and the materials used to finish the exterior of
the building.
(3) A complete waiver application form compelted filled in and
signed by the applicant.
The City Council will use the criteria in Section 5 of Ordinance #1035
to determine the merits of a waiver request and in their decision process
determining whether to approve or deny said preliminary waiver application.
Tentative approval of the City Council at the preliminary stage does not
commit the Council to approval of the Final Waiver Application if there

1. I have made application for a permit from the City of Tukwila, Washington.
2. I understand that state law requires that all building construction contractors be registered with the
State of Washington. The exceptions to this requirement are stated under Section 18.27.090 of the
Revised Code of Washington, a copy of which is printed on the reverse side of this Affidavit. I have
read or am familiar with RCW 18.27.090.
3. I understand that prior to issuance of a permit for work which is to be done by any contractor, the
City of Tukwila must verify either that the contractor is registered by the State of Washington, or that
one of the exemptions stated under RCW 18.27.090 applies.
4. In order to provide verification to the City of Tukwila of my compliance with this requirement, I
hereby attest that after reading the exemptions from the registration requirement of RCW 18.27.090,
I consider the work authorized under this permit to be exempt under number 13 , and will therefore
not be performed by a registered contractor.
5. I understand that the licensing provision of RCW 19.28.161 through 19.28.271 shall not apply to
persons making electrical installations on their own property or to regularly employed employees
working on the premises of their employer. The proposed electrical work is not for the construction
of a new building for rent, sale or lease.
I understand that I may be waiving certain rights that I might otherwise have under state law in any decision
to engage an unregistered contractor to perform construction work.

18.27.090 Exemptions. The regis. n provisions of this chapter do not apply to:
1. An authorized representative of the United States
government, the state of Washington, or any incorporated
city, town, county, township, irrigation district, reclamation
district, or other municipal or political corporation or
subdivision of this state;
2. Officers of a court when they are acting within the scope
of their office;
3. Public utilities operating under the regulations of the
utilities and transportation commission in construction,
maintenance, or development work incidental to their own
business;
4. Any construction, repair, or operation incidental to the
discovering or producing of petroleum or gas, or the
drilling, testing, abandoning, or other operation of any
petroleum or gas well or any surface or underground mine
or mineral deposit when performed by an owner or lessee;
5. The sale of any finished products, materials, or articles of
merchandise that are not fabricated into and do not become
a part of a structure under the common law of fixtures;
6. Any construction, alteration, improvement, or repair of
personal property performed by the registered or legal
owner, or by a mobile /manufactured home retail dealer or
manufacturer licensed under chapter 46.70 RCW who shall
warranty service and repairs under chapter 46.7o RCW;
7. Any construction, alteration, improvement, or repair
carried on within the limits and boundaries of any site or
reservation under the legal jurisdiction of the federal
government;
8. Any person who only furnished materials, supplies, or
equipment without fabricating them into, or consuming
them in the performance of, the work of the contractor;
9. Any work or operation on one undertaking or project by
one or more contracts, the aggregate contract price of
which for labor and materials and all other items is less
than five hundred dollars, such work or operations being
considered as of a casual, minor, or inconsequential nature.
The exemption prescribed in this subsection does not apply
in any instance wherein the work or construction is only a
part of a larger or major operation, whether undertaken by
the same or a different contractor, or in which a division of
the operation is made into contracts of amounts less than
five hundred dollars for the purpose of evasion of this
chapter or otherwise. The exemption prescribed in this
subsection does not apply to a person who advertises or
puts out any sign or card or other device which might
indicate to the public that he or she is a contractor, or that
he or she is qualified to engage in the business of
contractor;
10. Any construction or operation incidental to the
construction and repair of irrigation and drainage ditches
of regularly constituted irrigation districts or reclamation
districts; or to farming, dairying, agriculture, viticulture,
horticulture, or stock or poultry raising; or to clearing or
other work upon land in rural districts for fire prevention
purposes; except when any of the above work is performed

by a registered contractor;
11. An owner* who contracts for a project with a registered
contractor, except that this exemption shall not deprive the
owner of the protections of this chapter against registered
and unregistered contractors. The exemption prescribed in
this subsection does not apply to a person who performs
the activities of a contractor for the purpose of leasing or
selling improved property he or she has owned for less than
twelve months;
12.* Any person working on his or her own property,
whether occupied by him or her or not, and any person
working on his or her personal residence, whether owned
by him or her or not but this exemption shall not apply to
any person who performs the activities of a contractor on
his or her own property for the purpose of selling,
demolishing, or leasing the property;
13. An owner* who performs maintenance, repair, and
alteration work in or upon his or her own properties, or
who uses his or her own employees to do such work;
14. A licensed architect or civil or professional engineer
acting solely in his or her professional capacity, an
electrician certified under the laws of the state of
Washington, or a plumber certified under the laws of the
state of Washington or licensed by a political subdivision of
the state of Washington while operating within the
boundaries of such political subdivision. The exemption
provided in this subsection is applicable only when the
person certified is operating within the scope of his or her
certification;
15. Any person who engages in the activities herein
regulated as an employee of a registered contractor with
wages as his or her sole compensation or as an employee
with wages as his or her sole compensation;
16. Contractors on highway projects who have been
prequalified as required by RCW 47.28.070, with the
department of transportation to perform highway
construction, reconstruction, or maintenance work;
17. A mobile /manufactured home dealer or manufacturer
who subcontracts the installation, set -up, or repair work to
actively registered contractors. This exemption only applies
to the installation, set -up, or repair of the
mobile /manufactured homes that were manufactured or
sold by the mobile /manufactured home dealer or
manufacturer;
