TUKWILA CITY COUNCIL September 5, 1995 (Tuesday) Tukwila City Hall 7:00 p.m. Council Chambers REGULAR MEETING MINUTES CALL TO ORDER Mayor Rants called the Regular Meeting to order and led the audience in the Pledge of Allegiance. Approval of Minutes: 7/12/95 (Sp. Mtg.); 7/19/95 b. Approval of Vouchers: Nos.80676 through 80916 in the amount of $580,585.72. c. Authorize Mayor to accept triangle piece of limited access property in the 51st Ave. S. /S. 158th St. right -of -way turnback deed. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, TO APPROVE THE CONSENT AGENDA AS SUBMITTED. MOTION CARRIED. MOVED BY HERNANDEZ, SECONDED BY EKBERG, TO AWARD A CONTRACT TO GENERAL FIRE EQUIPMENT IN THE AMOUNT OF $126,359 FOR THE PURCHASE OF A REPLACEMENT RESCUE TRUCK (FIRE).* Chief Keefe explained that all bids received were over the budgeted amount. General Fire Equipment submitted the lowest of the bids. In order to reduce costs, the specifications were separated. The body will be purchased locally; the chassis will be built elsewhere at a reduced price and delivered to the lowest bidder. *MOTION CARRIED. Bridge Access (property purchase) MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Attorney Cohen read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, GRANTING TO WATER DISTRICT NO. 20, A MUNICIPAL CORPORATION AND PUBLIC UTILITY SELLING AND DISTRIBUTING WATER WITHIN KING COUNTY, THE RIGHT AND FRANCHISE TO USE AND OCCUPY THE STREETS, AVENUES, ROADS, ALLEYS, LANES AND OTHER PUBLIC PLACES AND WAYS OF THE CITY OF TUKWILA, WASHINGTON, FOR CONSTRUCTING, MAINTAINING, REPAIRING, RENEWING AND OPERATING A WATER DISTRIBUTION SYSTEM AND ACCESSORIES WITHIN AND THROUGH THE CITY OF TUKWILA, WASHINGTON; PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, TO ADOPT ORDINANCE NO.1751 AS READ.* MOVED BY CARTER, SECONDED BY ROBERTSON, TO AMEND ORDINANCE NO. 1751 BY REWORDING THE FOURTH WHEREAS CLAUSE TO READ AS FOLLOWS: WHEREAS, THE CITY OF TUKWILA WOULD LIKE TO PRESERVE PUBLIC -OWNED INFRASTRUCTURE WHICH COULD BE AFFECTED BY THE OPERATIONS OF THE FRANCHISE AND TO ENSURE THAT ANY WORK DONE IS IN ACCORDANCE WITH TUKWILA DEVELOPMENT STANDARDS; AND...MOTION CARRIED. *MOTION CARRIED AS AMENDED 7 -0. Public Works Director Ross Earnst explained that temporary use of the subject property is required for the construction access for the bridge foundation, excavation in the vicinity of the center pier, and piping the creek around the foundation during excavation. In addition, at the completion of construction, the property will provide access to Gilliam Creek for monitoring, maintenance of erosion and biofiltration. Bridge Access (property purchase) Council 8:45 p.m. not useful to him and rather than allow the City an easement, he will only sell it to the City. Councilmember Robertson commented that the property owner is selling the City a useless piece of property that can't be developed. The second piece of property along 51st Ave. S. would be used to construct a retaining wall on the roadway side of the right -of -way line. The property owner agreed to give this property to the City if the City purchased the Southcenter Blvd. parcel. MOVED BY DUFFIE, SECONDED BY ROBERTSON, TO AUTHORIZE THE MAYOR TO PURCHASE PROPERTY FOR ACCESS TO THE 51ST AVE. S. BRIDGE. MOTION CARRIED 7 -0. REPORTS Finance Director Alan Doerschel distributed the Capital Mayor Improvement Plan and Financial Planning Model to Council and gave a brief overview of both documents. Doerschel's comments focused on significant changes in the new documents. City Administrator John McFarland reported that the Ball apartments have been posted Dangerous Building -Do Not Occunv and are going through the abatement process. All tenants were evicted by the owners prior to the City posting the building. Councilmember Ekberg reported the Kent ACT theater is looking for a new home. He suggested the possible use of the Foster High School auditorium. Mayor Rants noted that the Rainier Symphony has requested the use of the auditorium also.
