CALL TO ORDER ROLL CALL Councilmember absent OFFICIALS CITIZEN'S COMMENTS SPECIAL ISSUES Comprehensive Plan Comments by Land Use Attorney COMMITTEE OF THE WHOLE MEETING MINUTES Council Chambers Councilmember Dennis Robertson, Acting Council President, called the Committee of The Whole Meeting to order and led the audience in the Pledge of Allegiance. JOE DUFFIE, JOAN HERNANDEZ, DENNIS ROBERTSON, STEVE MULLET; PAM CARTER; JIM HAGGERTON. It was the consensus of the Council to excused Council President Allan Ekberg from tonight's meeting. JOHN MCFARLAND, City Administrator; LINDA COHEN,. City Attorney; LUCY LAUTERBACH, Council Analyst; STEVE LANCASTER, DCD Director; JACK PACE, Senior Planner; ANN SIEGENTHALER, Associate Planner. Peter Thompson, 13450 51st Avenue South, commented that he's concerned about the rezoning of the property located above the Metro Park Ride on Interurban as Single Family Residence. He said the property was annexed as Office and Multi- Residence Zoning. He says his property abuts the Park Ride and he's never going to use it for Single- Residence; and furthermore, no one will ever buy it for that use. It needs to be developed either as Office or as Medium Density Residential. Councilmember Robertson informed Mr. Thompson that there will be a public hearing on this issue next Monday night. He was encouraged to attend so that his concerns might be addressed at that time. DCD Director Steve Lancaster introduced Bob Johns, Contract Land Use Attorney, who then addressed the proposal regarding the amendment process for the Comprehensive Plan. He said after he had reviewed the draft proposal, he found it raised no legal issues of concern. The changes that were made by the Council are within the authority of the State's Growth Management Act. Lancaster stated that his staff had met with Allan Ekberg today to review previous Council decisions made on the Comprehensive Land Use Map for accuracy. Regs Hwy. 99 Task Force Presentation Discussion REPORTS ADJOURNMENT 10:00 p.m. Dave Livermore, 13212 31st Avenue South; and Dwight McClain, 13015 38th Avenue South, both are members of the Highway 99 Task Force, addressed the priorities that should direct the development strategy of this area: 1) Upgrade the safety and security of the Highway 99 community; 2) Ensure the stability of single family neighborhoods; and 3) Maintain a range of housing opportunities as well as the City's current balance between housing and commercial areas. There are several business owners on the Task Force, and they are extremely concerned about what their Non Conforming Use for business operations would mean in the future. Other concerns are declining property values as a result of rezoning. The Task Force feels that the Council has reached a balance in land uses along the Highway. Neighborhood Commercial areas with much more flexibility, however, is supported by all the members of the Task Force. Mayor Rants reported that the State is going to spend approximately $700 thousand dollars in new signalization /new channelization, etc. on the Safety Project on Hwy 99 for the 144th intersection. However, they have discovered that the right -of -way on the north side of 144th is not the same as the one on the south side. Therefore, they need to purchase 10 ft. of right -of -way from the owners of Kentucky Fried Chicken (KFC). The owners of KFC agreed to sell. In doing so, KFC would have to move their sign. The City has an inflexible Code that says if the sign is relocated on the property, it must then comply to the Tukwila Sign Code. It will no longer be subject to the "grandfather clause." This means several changes will have to be made to KFC's sign. After learning of this, KFC decided against selling the right -of -way to the State. The State's alternative then would be to condemn the property. The State is not interested in doing that for a project of this size The City Council has an option -they can (by majority rule) make a determination by resolution to forgo the established criteria for signs.
