Tukwila City Hall Council Chambers JOE DUFFIE; JOAN HERNANDEZ: ALLAN EKBERG, Council President; DENNIS ROBERTSON; STEVE MULLET; PAM CARTER; JIM HAGGERTON. JOHN MCFARLAND, City Administrator; LINDA COHEN, City Attorney; LUCY LAUTERBACH, Council Analyst; ROSS EARNST, Public Works Director; RON CAMERON, City Engineer; DOUG MICHEAU, Public Works Coordinator; STEVE LANCASTER, DCD Director; VERNON UMETSU, Associate Planner. Councilmember Mullet explained that the Transportation Committee had discussed the Bids that were opened on November 9, 1995 for intersection improvements at Andover Park East/Baker Blvd., and illumination improvements for the S -Line Bridge. The Committee recommended the contract be awarded to the lowest bidder -MT Electric, Inc. MOVED BY MULLET, SECONDED BY DUFFIE, TO AWARD THE CONTRACT TO MT ELECTRIC, INC. IN THE AMOUNT OF $171,428.85 FOR ANDOVER PARK WEST/BAKER BLVD. INTERSECTION IMPROVEMENTS, AND THE 61ST AVENUE SOUTH BRIDGE ILLUMINATION IMPROVEMENTS. MOTION CARRIED. Mayor Rants opened the public hearing at 8:13 p.m. City Attorney Cohen conducted the swearing in of all participants. Vernon Umetsu, DCD, briefed the Council that design changes require additional City Council approval. These changes include increased density from 28 to 31 units, a reduced building 2 envelope, with a modified design approach, and a modified Special Meeting November 13, 1995 Page 2 Public Hearing Sunshine Ridge (Cont' d) Applicant: Public hearing vlosed Res. #1331 to approve an application for the Sunshine Ridge PRD recreation deck design. He said all other project characteristics were generally unchanged. Staff took the liberty to draft a resolution to approve an application for the Sunshine Ridge Planned Residential Development and adopting Findings and Conclusions. He said after reviewing with the City Attorney, revisions were suggested in Section 1, Item Numbers 4 5; and in Section 2, Item Numbers 1 5. Lyle Kussman of Kussman Associates, Architects, Planners Consultants, P.O. Box 1705, Bothell, Washington, 98041, commented that he proposes a project with 28 condominiums and 59 parking spaces on a 1.07 acre lot. The units would be located in a street front building which varies from 2 to 3 stories and a rear building of 5 stories. Parking would be in a partially underground structure, whose roof would be a recreation deck. He said he agreed with the staff's presentation and had no further comments. However, he would entertain any questions the Council might have. An extensive discussion ensued with some of the Councilmembers' questions focusing on parking spaces; vehicle headlights shining onto the project; security, safety and protection of the children; and recreation space. Mayor Rants closed the public hearing at 9:00 p.m. MOVED BY DUFFIE, SECONDED BY MULLET, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. Mayor Rants read a resolution to approve an application for the Sunshine Ridge Planned Residential Development and adopting Findings and Conclusions. MOVED BY ROBERTSON, SECONDED BY EKBERG, TO ADOPT RESOLUTION #1331 TO APPROVE AN APPLICATION FOR THE SUNSHINE RIDGE PLANNED RESIDENTIAL DEVELOPMENT AND ADOPTING FINDINGS AND CONCLUSIONS.* Special Meeting Minutes November 13, 1995 Page 3 Res. #1331 Sunshine Ridge PRD (font' d) REPORTS MOVED BY EKBERG, SECONDED BY ROBERTSON, TO AMEND THE RESOLUTION AS FOLLOWS: SECTION 1, ITEM NUMBER 4, AMENDED TO READ: "THE DESIGN REVISIONS TO THE PROJECT DESIGN APPROVED IN RESOLUTION 1318 WERE REVIEWED BY THE CITY COUNCIL AND ARE INCORPORATED IN APPLICANT PLAN SHEETS DATED NOVEMBER 7. 1995 (ATTACHMENT M." SECTION 1, ITEM NUMBER 5, AMENDED TO READ: "FINDINGS AND CONCLUSIONS REGARDING THE CONSISTENCY OF THE PROPOSED DESIGN REVISIONS. WITH PLANNED RESIDENTIAL DEVELOPMENT REVIEW CRITERIA IN TMC 18.46.060. .070..080. .090. AND .112. HAVE BEEN PRESENTED AT THE PUBLIC HEARING HELD ON NOVEMBER 13. 1995." SECTION 2 AMENDED TO EXCLUDE ITEM #1. SECTION 2, ITEM #5, ADD THE WORD "COMPLETELY" PRIOR TO THE WORD "SCREENED." *MOTION CARRIED. *MOTION CARRIED AS AMENDED TO ADOPT RESOLUTION #1331. Councilmember Hernandez reported that she had attended the Southwest King County Chamber of Commerce meeting this past Friday. The program focused on bridging the gap from school to work. A student from Foster High School spoke and did an exceptional job. Councilmember Duffie reported that Tukwila Elementary School held an excellent celebration of Veteran's Day. City Administrator John McFarland, aka Colonel McFarland, was guest speaker. City Attorney Linda Cohen reported that a decision had been made on Baker Commodities from the Court of Appeals. The Court agreed with the City that it was a Non Conforming Use. The Court ruled that Baker will be able to obtain their Unclassified Use Permit for the new storage tanks. Cohen said there was one portion of the opinion where the Court referred to Council's action as arbitrary and capricious but then the rest of the decision went on to say that they really used the substantial evidence to our best interest, which means that it is not arbitrary and capricious. Therefore, someone from WCIA, under Bill Schoel's direction, will submit a motion to modify that portion of the judge's decision (The City will not have to pay attorney's fees for this.) The damages portion is all that is left and should be covered entirely by WCIA. McFarland, adding to Duffie's Veteran's Day comments, informed the Council that the Fourth Grade Class at Tukwila Elementary did a skit on what the Pledge of Allegiance means. It was so impressive that he invited them (on behalf of the Mayor and Council) to perform the same skit at a future Council meeting.
